Cotabato City – The independent forensic team led by Peruvian forensic anthropologist Dr. Jose Pablo Baraybar said yesterday it is “now almost sure that there is a 58th body” that is yet unaccounted for after his team’s discovery of a partial upper left denture with a metal clasp at the crime scene that did not fit any of the remains already recovered.

The recent discovery of the large cache of firearms, ammunition and other military armaments at a vacant lot near the Mansion of the Ampatuans in Maguindanao as reported by ABS-CBN and GMA News confirms our claim that, during all this time, the arms and ammunition of warlords and other rogue groups which have wreck havoc in our country are being supplied and sourced from the arsenals and factories of the AFP and the DND.

This corrupt and condemnable practice has not only led to the sacrifice of countless lives of soldiers, law enforcement officials and innocent civilians but has been fueling the endless war in Mindanao and other volatile areas. This was also one of the root causes which impelled us to demonstrate and speak out against the current administration at Oakwood way back in 2003; at Manila Pen two years ago; and whenever we get the chance to be heard.

Mrs. Gloria Macapagal-Arroyo, as Commander-In-Chief, and his anointed former DND Secretary Gilbert “Gibo” Teodoro, must be made accountable for all the deaths caused by these guns.

As this developed, Baraybar and his team were set to fly back to Manila yesterday on the advice of their private security consultants who reported that the group was being cased by armed men.

Dr. Baraybar said the dentures belonged to slain Midland Review staff Reynaldo “Bebot” Momay, of Tacurong City Sultan Kudarat, according to his dental records.

“However, the dentures did not fit the set of human remains earlier identified as belonging to Momay,” said the forensic anthropologist, adding that the same body is being claimed as well by the families of Victor Nuñez and a certain Tiamzon, both of UNTV based in General Santos City.

The discovery of the dentures brings to 58 the number of people who perished in the Nov. 23 carnage. Ealier, authorities reported that a total of 57 human remains have been recovered from the site and of these, only three have remained unidentified.

However, Dr. Baraybar’s team found that of the three remains, two have a full set of teeth while the third has full upper and lower dentures. “This clearly means we have another body still missing.”

Baraybar’s team began evidence-gathering at the massacre site in Barangay Salman, Ampatuan town Sunday. The dentures were recovered Wednesday in a grassy area near one of the vehicles – a Songgyang van – in the convoy that was waylaid by some 100 armed men linked to the powerful Ampatuan clan.

The Peruvian forensic expert said Momay’s dentures are held in place by a metal clasp and could not be easily dislodged unless extracted by an indirect force. “That is the best guess we can have at this moment.”

Dr. Baraybar and his British counterpart Christopher Cobb-Smith, a weapons expert and experienced field investigator, lead a team of forensic investigators and lawyers from the Center for International Law (CenterLaw) deputized by the Commission on Human Rights (CHR) to conduct an independent parallel investigation on the Ampatuan massacre. He also directed the Office on Missing Persons and Forensics of the UN Interim Administration Mission in Kosovo.

Baraybar and Cobb-Smith are joined in the team by Centerlaw lawyers Harry Roque, Joel Butuyan, Romel Bagares and Gilbert Andres.

The group’s recovery efforts had been hampered by the lack of heavy equipment. “We need a backhoe to empty out the previously excavated mass graves to sift through the debris to ascertain whether an untouched part of the grave may still hold some human remains,” said Dr. Baraybar. “It has to be carefully done – we have some experience doing this in the Balkans in our work for the United Nations International Criminal Tribunal for the Former Yugoslavia.”

The legal team’s chief counsel, Harry Roque, said he was able to arrange for a backhoe and a truck for the use of the forensic investigation to be fielded to the crime scene by Saturday morning.

“We’re moving our base of operations from Cotabato City to Koronadal City, where the security risks are not as high,” said Roque.

Big arms cache near Ampatuan mansions unearthed

The military on Thursday unearthed a large cache of arms and ammunition, enough to supply a brigade-size unit of the military near the mansions of the Ampatuans in Shariff Aguak, capital town of Maguindanao.

In an interview, Col. Leo Cresente Ferrer, Philippine Army’s 601st Infantry Brigade acting commander, said they found different types of high-powered firearms and ammunition buried in the ground in a vacant lot in Poblacion 3 in Shariff Aguak.

He said the lot is near the mansions of the Ampatuans, who are being investigated for their role in the Ampatuan massacre last November 23.

As of 8:30 p.m., Ferrer said they have discovered 141 boxes of ammunition for high-powered firearms such as M60 machine gun, M16 automatic rifles as well as caliber .45 bullets.

The Army commander said the ammunition found can supply the requirements of a brigade-size unit. An Army brigade consists of at least 1,500 men or at least 2 battalions plus several companies.

He said they also found the following:

* two 81mm mortars;
* a 60mm mortar;
* two 90mm and one 57mm recoilless rifles commonly known as bazookas;
* 4 M60 machine guns;
* caliber .50 Barrett sniper rifle;
* 200 other high-powered guns;
* 1 Ultimax light machine gun;
* 1 Bushmaster 5.56mm carbine;
* 2 Browning Automatic rifles (BARs);
* 1 FAL automatic rifle;
* 1 AK-47;
* 1 Heckler & Koch HK 11 light support machine gun;
* one 5.56mm M4 carbine;
* 9mm and caliber .45 pistols.

Gun replacement parts were also found.

More ammos expected

Ferrer estimated that the military hardware they have so far found has been placed in an area the size of a basketball court. He said the armaments found so far are worth around P1.4 million.

He said they expect to recover more guns and ammunition since the digging is still ongoing.

The digging may take 2 days since the soldiers are only using their hands.

Ferrer said they initially used a bulldozer but decided to stop using it since it might trigger an explosion in case they hit a bomb, artillery or mortar round buried in the ground.

Ferrer said a concerned citizen reported the arms cache to the Army on November 25, 2 days after the massacre which killed at least 57 people in Ampatuan town. The concerned citizen claimed to have seen a backhoe digging in the vacant lot after the killings.

“We have information from a concerned citizen, this was given to the Army and the police, that there was something buried on the night of Nov. 25,” he said.

He said they immediately sent a unit with bomb-sniffing dogs to confirm the report.

From gov’t arsenal

Ferrer said the ammunition boxes found bore markings of Armscor, meaning it came from the Government Arsenal in Bataan. He said some of the boxes even indicate the date of manufacture, June 2009.

Armscor supplies ammunition to the military, police, and also civilians, but only upon authorization of the government.

He said military and police uniforms were also found at the excavation site.

Ferrer, however, declined to connect the Ampatuans to the buried arms cache.

He said it would be up to the police to file a case based on the evidence found by investigators.

He said he could not confirm if the firearms were used in the Ampatuan massacre.

“I don’t know. We have the mortars and I don’t believe the mortars were used. May mga bala rin dito, different calibers, puwedeng nagamit noon o ibinaon para sa ganoon magamit pa ng mga goons ng mga private armies,” said Ferrer.

However, he said everyone knows who has the capacity and influence to buy such a large amount of firearms and ammunition.

“We will find out. Wala pa kaming personality. Pero obvious naman eh,” said Ferrer.

Ferrer also expressed his thanks to the civilian who tipped them off. He said the informant is helping achieve peace in Maguindanao.

A breakthrough

Director Felizardo Serapio Jr., directorate for Integrated Police Office-Western Mindanao, hailed the arms and ammunition find.

“This is a breakthrough sa investigation side. Naka-breakthrough na tayo dun sa shells ano… This has been one of the clamor na bakit nakikita natin old firearms. Here, we can see bago, mga brand new… we have not only assault rifles but we have offensive weapons like the Barrett,” said Serapio.

The military earlier recovered firearms from the two Special Civilian Active Auxiliary (SCAA) companies of Maguindanao which are alleged to have been used by the Ampatuans as part of their private army.

However, the recovery of the firearms was criticized since only old firearms such as World War II-vintage M1 Garand rifles were turned over.

The military said the arms and ammunition from the excavation site would be turned over to police, who are expected to test the firearms and see if they were used in the Ampatuan massacre.

“We will know that after the investigation. We will find out…That will be one of the objectives of our investigation. Most probably, may koneksyon sa mga nangyayari,” said Serapio.

Hold accountable

Meanwhile, Lt. Col. Romeo Brawner, Armed Forces of the Philippines (AFP) public information chief, said that whoever was responsible for the buried arms cache found would be held accountable.

He said that the AFP and the Department of National Defense (DND) will immediately launch an investigation.

He confirmed that the ammunitions found were from the Government Arsenal.

Brawner said only soldiers and police should be using supplies from the Government Arsenal located in Limay town in Bataan province, which is where ammunition is manufactured.

    Several times since the beginning of the Fourth Commission, we have witnessed human rights emergencies, atrocities and crises which have called our nation’s institutions to attention and action. Several times, the public had been restive, clamoring for redress and for justice. But never before since the beginning of the Fourth Commission had we encountered such an atrocious affront to civility, decency, humanity and human rights as the mass killings this week in Maguindanao. It is incredible, inconceivable and therefore incomprehensible that a crime of this magnitude can be carried out by human beings against other human beings, against the unarmed, against those who had no conviction to die, against women and men who had every intention of returning to their families and children. It was not war between warlords but mass murder of innocents.

    It was not an outburst of uncontrollable anger – it was premeditated. Where the perpetrators’ conviction to carry out the killings had materialized, it developed into frenzied baseness, not only to rob the victims of their lives, but their honor and dignity as well. It was rape, it was mutilation, it was execution, it was the most vicious form of murder perpetrated by the most grotesque version of human beings.

    The public outrage over the crime committed is not only understandable – it is essential. Our people’s freedom to speak out against and be enraged by affronts to our laws and human rights lays the predicate for calling out the government to take decisive action and deliver justice. Even where the outrage is directed at the government-at-large and not just the perpetrators, and where the clamor takes on stinging and even hostile character, we, in government, must welcome the criticism. The people’s ability to speak and speak openly is the basis of our faith in our freedom, rights and democracy, the very things we must now re-assert amidst this dreadful backdrop of the murders in Maguindanao.

    Now that the people have done their part, it is our turn to do ours. It is the government’s turn to vindicate our people’s faith in our institutions, in our Constitution and laws.

    There is no one government institution that can fully address the Maguindanao Massacre. In order to ensure a complete and expeditious resolution of the case and impartial levy of justice against all those who must be held accountable, various institutions must work harmoniously towards the same ends of justice. The DOJ, PNP, NBI and the CHR must work collaboratively, now more than ever, to ensure that our governmental response to the massacre lives up to the most scrutinizing expectations of the public-at-large.

    The collaboration between the Executive Department and the CHR will partake of a sharing of expertise at the center of parallel investigations covering the criminal, administrative and human rights aspects of the Mindanao Massacre. It is not an abrogation of each institution’s individual mandates, and certainly, the CHR will conduct its investigation independently, as it has always done in the past.

    Moreover, the collaboration must extend beyond the investigation of the murders to the extremely tense and volatile situation prevailing in Maguindanao. While the perpetrators are on the run save for one suspect, there are furtive forces that remain and continue to assert a culture of intimidation and impunity throughout Maguindanao. Just as the national government has mobilized its vast resources to address the killings, there are insidious counter-forces mobilizing as well to thwart justice yet again. The collaboration between the Executive Department and the CHR must address the very serious human rights situation that affects all bystanders to the Maguindanao Massacre.

    Even with Executive collaboration, the CHR will still assuredly exercise one of its most important mandates, and that is to oversee and thus ensure that governmental efforts meet the standards of utmost integrity and devotion to obtaining justice for the victims and their families. As much as the massacre is a human rights catastrophe, less-than-ardent effort to investigate, prosecute and deliver a just resolution is itself a grave violation of human rights. Even with collaborative efforts with the Executive Department, the CHR remains firmly independent in its oversight function in relation to the government.

    The avowed purpose in collaboration is to enhance each agency’s effectiveness, just as the CHR’s purpose of oversight function over the government on human rights obligations has always been to enhance the government’s functions, which must always be attuned and compliant with human rights.

    There are many who are working very hard to ensure that no effort will be spared to bring the criminals behind the Maguindanao Massacre to justice. We ask the public to preserve their faith in the rule of law, to extend faith to our government and its institutions, but to remain vigilant and vocal, especially where justice remains unserved.

    Yousee what’s wrong with this country? The majority of the people are kept in the dark. No voters awareness program have reached the provinces nor even in Manila. No resource management done by the Commission to recruit a better leader. The commission is dependent upon what the big boss is saying but it is comon knowledge that the COMSION is supposed to act independently for the benefit of the people… what have they done? they allow Manny Pacquaio, encouraged him to run for congressman and yet his fight with mayweather is scheduled in may 1. It allows a convicted plundered Jpseph Estrada to file candidacy. It allows candidate to offer the people to seel their votes that is not in GOOD faith. Furthermore, the commission does not understand that recruiting honest local representatives based on good moral character is as important as electing a president. Worst, it allows private entities to donate big chunks of money to a political candidates as to influence policymaking such as road construction close to its businesses and many more….

    This country is too sick and I am embarrassed by how the many levels of government treat their people like servants.

    There will be a lot of back negotiations here. The ampatuans are arroyos’ private army as well. Di ba sila ang nagpanalo sa kanya noong 2004 at nagbigay ng 12-0 sa senatorial candidates noong 2007. Sila rin ang nagpanalo kay Zubiri?

    All the prolonged interrogations are primarily done to negotiate with this hoodlum clan. Para soft landing nga naman ang dating.

    I suspect that they are the operators of the abductions in the South as well.

    Boobuwit can not have an iron hand on this clan kasi kakanta sila sa mga pinaggagawa ni boobuwit sa turf nila. Kaya parang larong chess yan. Isang pawn isang opisyal hanggang ma-mate yung queen. I am so waiting for that day!

    The ampatuans are not the only cultivated clan. Marami pa ang mga clusters na yan. Wala lang talagang magawa si boouwit kasi in cahoots siya sa kanila sa election fraud. Kaya tameme yung bansot kasi kapag ginalaw niya sila, she will be brought down as well. This is something she can not afford to do right now. This is why she can not even condemn the perpetrators of the massacre. Her ten year tenure grew these clans. Erap was able to take over the camps of these terror groups. Si pandak ang ipinalit, families of criminals. Let us see what kind of strategy she will have. Ingat lang siya dahil traidor ang mga yan. Once she is no longer protected by the armed forces of the Philippines ( who are now acting like her bodyguards) madali lang siyang iligpit ng mga ampatuans sampu ng mga clan na pinalaki niya para protektahan ang pandaraya niya.

    Tingnan niyo, Imelda is running too. wala talaga ang pinas… the majority are not well aware. This country has not created a majority of middle class who are highly educated that are capable of understanding the complexity. Many of our people are not aware of what true democracy is all about.. The function of a leader is to initiate and act to educate majority including appointing the right person to implement the plan of action. When did comelec and the other departments in charge of educating the poor majority propose, publicize and make aware o people’s voting rights. The vote buying is simply undermining democracy.

    Whatever the previous administrations have accomplished is not enough. JOBS! JOBS! JOBS! Not jobs in Abu Dhabi for OFW’s, not sailor-jobs in Africa nor accounting jobs in Singapore or teacher-jobs in Hongkong, Pilipinas needs jobs in Pilipinas.

    Triple the number of micro-loans; hire 50% more teachers for the schools; hire more police personnel for Mindanao, Makati, Mindoro. Politician-candidates always say they will fight corruption because it is easy to get UP-students and barbershop-kibitzers agitated when you say “fight corruption!!!”. Politicians do not say “…create new jobs” because then everyone listens, and when folks are listening, they can see through lies.

    If my recollection is right, Teodoro one time as Defense Minister mentioned that the Milirary was short of Ammunition and now we can figure why…and there are many Private Armies in the country, other the Ampatuans…

    Sa kaganapang ito, naaalala ko yung naging kasa natin dito sa blog na ito. Isang Muslim na taga Patikul Sulo o Tawi Tawi ata yun?

    As long as there’s no concrete plans to improve our Judiciary, as long as pork barrel is not re-allocated from Congress to local governments, and as long as the thieves and corrupt remains unfunished it will be very hard to live with it knowing. OK na ngayon matibay kami and will fight this till kingdom come!!!

    Correct , Tongue. That’s one of the issues they raised as they called for the resignation of Angelo Reyes and Gloria Arroyo. I remember Trillanes on July 27, 2003 saying, “Ang bala na ginagamit sa pagbaril sa amin ay galing sa AFP.”

    Some military officials are acting as gun-runners and in business with the Ampatuans. How can they explain the cache that bore the markings of the ammunition supplier of the government? It’s not everybody or anybody can do business with the supplier unless you are close to the powers that be. It’s not that hard to guess by now that the arms cache found its way from the hands of the military to the Ampatuans. Who else has the authority and power to do such?

    It’s no wonder that often times soldiers complain that they are running short of ammos. Now we know that it’s because they are being traded for cash by corrupt officers.

    No amount of denying from the military will clear the air of corruption within their ranks. The evidences are right their before their eyes.

    I read somewhere that Governor Ampatuan was belittling the car of one official and asked him what he was doing with his IRA. That means Ampatuan is using IRA for whatever pleases him with impunity. Ano ba ang ginagawa ng COA, uso ba ang audit sa Ampatuan country o nauna ng massacre ang mga ito?
