Martial law para itikom ang bibig ng mga Ampatuan

Ito kaya ang tunay na dahilan bakit nagdeklara ng martial law si Gloria Arroyo sa Maguindanao:

Sabi ni North Cotabato Vice-governor Manny Piñol nabalitaan niyang tinatakot ng mga Ampatuan si Gloria Arroyo na kakanta tungkol sa dayaan noong 2004 eleksyun kung ilalaglag siya.

“Ang sabi ng ibang mga miyembro ng Ampatuan clan, kung bibitawan sila ni Pangulong Arroyo, sasabihin din nila ang lahat.”sabi ni Piñol..

Narinig rin namin yun. May umuugong na balita na bina-blackmail ng mga Ampatuan si Arroyo. Hawak pa rin daw nila ang orihinal na dokumento noong 2004 eleksyun. Siguro mga election returns o certificate of canvass.

Maala-ala natin na pinagpalitan ng mga miyembro ng military ang mga numero sa COC na siya namang ginamit sa canvassing na ginawa ng Kongreso. Maala-ala pa rin natin siguro ang “Noted. Noted” nina Sen. Francis Pangilinan at dating Rep. Raul Gonzales, na ngayon at presidential legal counsel, nagg gustong pabuksan ng oposisyon ang mga ballot boxes dahil sabi nila pinalitan ang mga numero sa COC.

Marami ang nakapuna na mabagal kumilos ang Malacañang sa pag-aresto kina Ampatuan. Alalay na alalay sila. Kaya lang ang pag-kondena ay hindi lamang dito sa bansa kungdi buong mundo.

Sabi ng iba mukhang nakuha na ng Malacañang ang mga “election paraphernalia” na hawak ng mga Amaptuan. Kaya pwede nang ilaglag.

May mga nagsasabi naman na hindi pa yata nakuha, kaya kailangan nila magdeklara ng martial law para makuha yun.

Ang galing talaga nitong si Arroyo. Master siya sa “turning adversity into opportunity”. Yung paggamit ng krisis bilang oportunidad.

Ang problema lang kay Arroyo, ang oportunidad ay hindi para sa bayan o sa nakakarami. Palaging oportunidad para maisulong niya ang kanyang personal na interes at manatili siya sa kapangyarihan upang marotektahan siya sa maraming kasalanan na ginawa niya sa taumbayan.

Nagdeklara siya ng martial law sa Maguindanao ng Biyernes ng gabi sa Maguindanao kung saan nagkaroon ng masaker ng 58 na tao noong Nobiembre 23 dahil sa pulitika sa pagitan ng pamilyang Ampatuan at Mangudadatu.

Dalawa lang ang maaring basehan ng deklarasyon ng martial law ayon sa ating Constitution: “rebellion” at “invasion.” Ang “rebellion” ay pag-aklas laban sa pamahalaan at ang “invasion” ay pagsalakay ng bansa ng mga dayuhan.

Ang kaso nina Ampatuan na siyang mga suspek sa masaker ay “murder”. Sabi Rep.Didagen Dilanggalen, hindi rebellion ang kasalanan ng mga Ampatuan dahil, tauhan sila ng pamahalaan. “Kaalyado sila ng presidente,” sabi pa niya,

Talagang matalik at maasahang kaibigan ni Gloria Arroyo ang mga Ampatuan. Maala-ala natin na noong 2004 na eleksyun , bokya si Fernando Poe, Jr. sa Maguindanao samantalang ang mga boto ni Gloria Arroyo ay sumubra pa sa numero ng registered voters.

Ito pa ang nakakabahala: kung makalusot si Arroyo sa pagdeklara sa Maguindanao ng martial law na walang basehan, para matakpan ang pandaraya noong 2004 na eleksyun, ano ang makapag-pigil sa kanya sa pagdeklara ng martial law sa buong bansa para maprotektahan ang sarili sa iba pa niyang kasalanan?

    Mabuti na lang, responsable ang mga miyembro ng Congress. The Filipino people through their representatives in Congress can declare a stop to Maguindanao martial law. The constitution even says 24-hours for Congress to convene.

    from 1987 Constitution Section 18 :

    ….The Congress, voting jointly, by a vote of at least a majority of all its Members in regular or special session, may revoke such proclamation or suspension, which revocation shall not be set aside by the President. Upon the initiative of the President, the Congress may, in the same manner, extend such proclamation or suspension for a period to be determined by the Congress, if the invasion or rebellion shall persist and public safety requires it.

    The Congress, if not in session, shall, within twenty-four hours following such proclamation or suspension, convene in accordance with its rules without need of a call.

    The illegality of the arrest, however, will not invalidate the criminal charge. The Ampatuans cannot gain immunity from suit. The arrest being illegal, however, any evidence obtained as a fruit of the arrest is inadmissible, under the doctrine of fruit of the poisonous tree.

    Ang dami ng sinabi’t puna kay the goyang mula pa noong 2001. Sobrang batikos na ang ipinaulan at itong huli ay ang pagdedeklara niya ng martial law sa Maguindanao subalit kahit anong panawagan upang siya ay mag-resign, wala rin, dedma ang lolang buruka.

    Dalawa lang naman ang hakbang na dapat gawin upang masigurong mawawala kaagad sa Malakanyang ang kanyang kamahalang mangkukulam: i-asasineyt o kaladkarin palabas ng palasyo.

    Sana, merong maybayag na taga PSG upang isagawa ang alinman dito.

    I agree with Martial Law not only to seek Justice but for the purpose that it opens a big debate and legal arguments against the current administration.

    If Martial Law is used to secure the documents during the election, it’s a good time for many to question the justification of the Martial Law declaration. That’s what democracy is all about.

    The Ampatuan massacre has been condemned world-wide as the worst loss of life of media professionals in one day in the history of journalism. The Philippines is now the most dangerous place for journalist. The Massacre is the worst incident of political violence in the nation’s history. ( no political actor have been implicated of killing this many,there were allegations but this one is different- It is mass murder in cold blood against the innocent people.

    Killing people without a threat can be interpreted as rebellious especially if one’ss duty is to protect and promote peace. The Ampatuans has not only committed murder but against the rules of the government. The government is not Gloria… the government is US. Therefore if one disobey his/her duty, one becomes a rebel. yes or no?

    The hiding of the ammunitions that can supply a batallion can be interpreted that a plan may be is on the making but not yet concrete. If he goes down, you all go down ( rebellious state of mind )

    Killing the Ampatuans will not prevent 1 or 3 documents to get out of hand. It’s probably hidden or given to the MILF, or secured by someone? or buried or faxed way before the martial law.. who knows? The Ampatuans have lawyers too and have many loyal supporters. Killing them will not prevent the 2004 election documents from leaking.

    So you guys think that’s the reason of Martial Law? then God bless the filipinos….

    Sa mga nabasa ko at narinig after November 23, 2009, si ARMM Governor Zaldy Ampatuan na lang ang may natitira pang sensibilidad sa mga Ampatuans. Siya ang maaring kinakausap ng Malacanang. Sa pag declare ng Martial Law, dalawa ang posibleng dahilan:

    1. Lumalaban ng legal ang mga Ampatuans at sa mga kasong nasa korte, under oath, nila ihahayag na ang pangigipit sa kanila ay may kinalalaman sa 2004 at 2007 elections. Iba nga naman kung press release lang o sa interview nila sasabihin ang tungkol sa election. Kaya nag deklara ng Martial law para pigilan ang mga legal moves at para makuha pa sa Ampatuans ang delikadong dokumento tungkol sa election.

    2. This is a deal between Malacanang vs. Ampatuans. Kung may martial law, the Commander in Chief ang may control ng lahat sa Maguindanao at kayang itago ang mga dapat itago na mag didiin pa sa mga Ampatuans.     one must look at this event in an open mind. Remove Gloria in your thoughts and assume her of her crime. assume that she is guilty of neglecting her people. analyze that the decision she made was a collective decision maybe from he national security committee. what if some higher authority that we borrowed money from advice her to do it ? has it occured to anyone that her decision reflects the country as a whole? where are your governors and your congressman? they probably are also hiding their guns.. who knows. Let them speak and let them represent you.

    Rally in your own province and against your own representative. Tell them what you want and let them represent you… If you want to stop Martial law because in your own understanding is not a good decision then speak to your representative. It’s time to assess the skills of your own mayors and your own governors and congressman. Have they delivered what you want at local level? If the crime happens in your city, then the mayor of that city is liable. He has a duty too. When one is kidnapped in your city, then your mayor and your local officers are as liable as the one on top.

    Demand accountability now from bottom to top and top to bottom. What we have been doing in the past is demanding accountability directly from the top ignoring the little corruptions that has been going on at bagangay level, mayor’s offices, local police forces and provincial offices.

    You need a live witness to authenticate/identify the documents in court. Without authentication (somebody saying, yes that is what we faked), the documents are a mere scrap of paper – no different from your everyday kleenex.

    nah.. the signatures of the voters or the voters can be used as the witnesses. authentication witness is a weak defense. the voters themselves are the best witnesses.

    Certificates of canvass have no voters’ signatures. They are the totals tallied by the board of canvassers.

    This is not a mere defense. This is a rule of evidence. A document needs to be identified by a human witness in court.

I will not be surprised if, in the next several days, more and more areas not just in Mindanao but in the entire Philippines as well will be placed, first, under a state of emergency, and, later, under martial law or some other emergency rule, invoking the same gruesome murder.Indeed, the Maguindanao massacre could even escalate as an international problem involving other Muslim nations and their supporters, unless the Arroyo government manage to solve this problem real soon, which, unfortunately, it is not perceived to achieve.

I lived in Lanao del Sur half of my life papano mabobokya si Fernando kilalang kilala yan ng ating kapatid na mga Muslim kaya kung nanonood sila ng pelikula niya sumisigaw pa ng takbo takbo Fernando kaya its unbelievable talaga parang kasama sila that’s how they adored him.     Proclamation 1959: Proclaiming a State of Martial Law and suspending the privilege of the writ of habeas corpus in the province of Maguindanao except for certain areas.

    Whereas, Proclamation No. 1946 was issued on 24 November 2009 declaring a state of emergency in the provinces of Maguindanao, Sultan Kudarat and the City of Cotabato for the purpose of preventing and suppressing lawless violence in the aforesaid areas.

    Whereas, Sec. 18 Art. VII of the Constitution provides that “in case of invasion or rebellion, when public safety requires it, the President may, for a period not exceeding 60 days, suspend the privilege of the writ of habeas corpus or place the Philippines or any part thereof under martial law.”

    Whereas, Republic Act 6986 provides that “the crime of rebellion or insurrection is committed by rising publicly and taking arms against the government for the purpose of depriving the Chief Executive or the Legislature, wholly or partially, of any of their powers or prerogatives.”

    Whereas, heavily armed groups in the province of Maguindanao have established positions to resist government troops thereby depriving the Executive of its powers and prerogatives to enforce the laws of the land to maintain public order and safety.

    Whereas, the condition of peace and order in the province of Maguindanao has deteriorated to the extent that local judicial system and other government mechanisms in the province are not functioning; thus, endangering public safety.

    Whereas, the implementing operational guidelines of the GRP-MILF agreement on the General Cessation of Hostilities dated 14 Nov. 1997 provides that the following is considered a prohibited hostile act: “establishment of checkpoints except those necessary for the GRP’s enforcement and maintenance of peace and order and for the defense and security of the MILF in their identified areas as jointly determined by GRP and MILF.”

    Now, therefore I, Gloria Macapagal-Arroyo, President of the Republic of the Philippines, by virtue of the powers vested in me by the Constitution and by law, do hereby proclaim as follows:

    Sec. 1: There is hereby declared a state of martial law in the province of Maguindanao except for the identified areas of the Moro Islamic Liberation Front as referred to in the implementing operational guidelines of the GRP-MILF agreement on the General Cessation of Hostilities.

    Sec. 2: The privilege of the writ of habeas corpus shall likewise be suspended in the aforesaid area for the duration of the state of martial law.

    Done in the City of Manila this 4th day of December in the Year of Our Lord, Two Thousand and Nine.

    it remains a weak defense because the original document can also be tampered especially when a big brown bags have been provided. To get to the bottom.. only Mang Juan and Pedro can tell… As I said, GMA can always deny and she has always been.

    Knowing the Ampatuans superiority, Mang Juan and Pedro could have been bought too… therefore, the guilty is not only the ampatuans or Gloria but also the Mang Juan and Pedro for selling their votes…

    yup sampung taon na ang mga solid cases against GMA… what are we going to do about it? you know she has assets? To build a strong case, we have to use historical facts not just one year or one term event. alam mo na. lawyers can be bought too… it’s up to us people…

    municipal and other government offices have been shut down by local officials, allegedly allied with the Ampatuans, which is an “overt act showing they are following some other forces” other than the government.

    Ngunit, kung dudulog sa Congress, makukuha rin ang validity, at maaari pang pahabain ang mga araw ng batas militar.

    Takot si Gloria sa MILF. What the heck is MILF identified areas? Anong klaseng martial law iyan? Siguro chop-chop martial law.

    Obssesed with desire to keep power revved up by “chismis”, the Ampatuans harbored deep hatred and extreme fear of losing power. And to ensure that no election shall occur, the killings should be done with extreme brutality to justify “martial law,” a condition when no election can be held in the province. And if there would be martial law, the Ampatuans stay in power under the hold-over principle.

    I am just wondering how the government will prove “impending rebellion” and make it a legitimate reason for the declaration because the present constitution only allows “invasion and [actual] rebellion.” The qualifier impending was removed by the 1987 framers because this was the very reason Marcos used in declaring Martial Law. The framers didn’t want a repeat of a ML declaration due an impending rebellion.

    Sr Ampatuan has escaped from arrest?

    Reporting from Davao City, ABS-CBN’s Jeff Canoy said he talked with Ampatuan Sr.’s lawyer, who said authorities cannot arrest his client since the writ of habeas corpus is not suspended in Davao City.

    He said President Arroyo’s Proclamation 1959 declaring martial law covers only Maguindanao province.

    As of posting, Ampatuan Sr. was in the Davao Doctors’ Hospital in Davao City for medical tests. No findings have yet been released.

    That rebellion is imminent, according to the DOJ Sec, is already difficult to prove. Proving that the Ampatuans are at the helm of this ‘rebellion’ would even be doubly difficult. They get charged with rebellion, they will eventually get acquitted; the mass murder being an element of the rebellion charge can no longer be pursued as pursuing murder charges will already constitute double jeopardy.

    murder as an accesory or elements of rebellion will get the penalty of Reclusion perpetua as defined by Philippine Law, guilty parties suffer lifetime barring from holding political office. this may apply to the sr and other ampatuans.

    Andal junior will probably face first degree murder. the penalty remains the same. Reclusion perpetua.

    There are 15 heinous crimes in the Philippines including murder, rebellion, rape and plunder. The penalty are all the same depending to the severity of the offense or how our Justice court interpret the crime. With brown bags, the crime can be reduced and can be pardoned with money. Estrada, Jalosjos and Ampatuans. ( great actors in our country) and yet estrada is still allowed to run.

    the people of the Philippines should put pressure to Congress that there should be no pardon for the crimes of rebellion with murder and rape unless new evidence warrants an appeal. But this is Philippines, money can speak.

    Our Judicial systems penalty and reward are too weak especially if the convicted person has the money. Poor Mang Juan and Pedro who cannot pay for his right to appeal, will rot in jail. The interpretation of the penalty must not be prejudiced.
