Defying Supreme Court again

In junking of the seven impeachment complaints against Gloria Arroyo, her allies in Congress have once again defied the Supreme Court by clearly misinterpreting the Court’s ruling in Francisco vs. House of Representatives, the Counsel for the Defense of Liberties (CODAL) said.

Codal’s statement:

HOUSE MAJORITY DEFIES SUPREME COURT DECISION IN FRANCISCO VS. HOUSE OF REPRESENTATIVES

Pres. Gloria Arroyo and her allies in Congress have once again defied the Supreme Court by clearly misinterpreting the Court’s ruling in Francisco vs. House of Representatives when they defined initiation of an impeachment proceedings to mean the “filing, referral and receipt by the Justice Committee” of an impeachment complaint.

The Supreme Court declared in Francisco that an impeachment “proceeding is initiated or begins when a verified complaint is filed and referred to the Justice Committee for action”. Nowhere in the said decision did the Supreme Court require that for an impeachment proceeding to be initiated, the Justice Committee must receive it. CODAL finds Rep. Edcel Lagman’s strange interpretation distressing considering that he is a member of the legal profession and is supposed to be equipped with the knowledge to interpret clear decisions of the Court.

CODAL also finds absurd the theatrical interpretation by a Rep. Douglas Cagas of the term ‘referral’ to include ‘receipt’ using the Readers Digest as reference. Webster and other dictionaries defines refer as ‘to direct to a person or place’, and referral as ‘an act or instance of referring’. The act of referring does not require acceptance by the object of referral. To follow the logic of the majority, no person can be charged with firing a gun unless he hits his target. CODAL finds it regrettable that the impeachment proceedings is held hostage by the senatorial ambitions or other political plans by members of the House.

If the majority followed the Supreme Court definition, the Lozano Complaint is deemed initiated when it was referred by the Speaker to the Justice Committee on July 25, 2005 during the SONA last year. In that case, the one year period would have ended on July 25, 2006 and the valid complaint would be the 7th Complaint filed by members of Bayan on July 26, something possibly unacceptable to some members of the Majority. A Supreme Court decision, however, cannot be twisted on the basis of bias or ideological differences.

Problems with the Majority Interpretation : Danger to Impeachment Complaints

Firstly, the interpretation is a clear departure, again, from the Supreme Court ruling in Francisco. It must noted that the Majority patently violated this ruling last year, when it insisted that the impeachment complaint was initiated by the mere ‘filing’ of the Lozano complaint on June 27 rather than the ‘referral’ on July 25.
Secondly, this new House definition will allow the staff and other members of the Justice Committee to hold an impeachment complaint hostage by the mere act of delaying or withholding ‘receipt’ of the same. It practically invalidates intent of the Constitution and the rules of the House which requires the Speaker to ‘refer’ an impeachment complaint within 10 session days. The justice committee may not ‘receive’ an impeachment complaint within that 10 day period thereby making the Speaker vulnerable to violation of the rules as a result of the act of Committee personnel.

Thirdly, this definition will sow confusion in the House in regard to bills or resolutions filed. Normally, bills are deemed ‘referred’ on the date when these are referred to a particular committee in the First Reading. With the definition, a bill is only deemed referred once the sponsor manages to have it received by the relevant Committee, a complete departure from the tradition of Congress since it was created in during the Commonwealth period.

Pres. Arroyo’s has set a pattern of persistent defiance of judicial decisions not favorable to government such as prohibiting executive officials from appearing in Senate inquiries despite the Court’s decision invalidating EO 464. Her allies in the House have once again followed suit by distorting another Court decision. CODAL condemns the blatant disrespect and defiance shown by members of the Executive and Legislative branch to Supreme Court decisions and the erosion of the check and balance mechanisms under the Constitution in order to preempt serious investigation on crimes and other impeachable offenses. These acts only prove that the Impeachment Complaint is not only sufficient in form but also sufficient in substance particularly on the charge that Pres. Arroyo used ‘dictatorial powers’ to stay in power.

  3. In a democracy, we the people, are the true masters of these “clowns” este politicians. Our true sentiments is what they should express and represent. They accuse us however of trivializing the impeachment, we are not the ones acting in a zarzuela but the dumb actors in congress. While we take this matter seriously, the majority bloc continues to waylay the process through prejudicial questions and technicalities which are applicable only when it suits them. How convenient isn’t it?

    we should not waste anymore time and effort debating on why just one impeachment complaint was allowed. afterall, it has been anticipated that technicalities will be employed by the pro-GMA congressmen. that is why eight complaints were filed in the first place, isn’t it? it is actually a victory for the opposition to have covered all bases, so to speak. nakaisa ang mga nag-file ng mga complaint.

    it is sufficient enough that one, which is 100% similar in substance and form with the other seven complaints, has been admitted. so what if the other signatories of the other complaints can no longer attach their honorable signatures on this admitted complaint? as long as they rally behind this lone surviving complaint then there should be no problem.

    unless, they are just after the credit of being signatories. are they going to lose interest in the proceedings if their respective complaint will not be admitted. hindi naman siguro. if so, then they have ulterior motives outside that of seeking the truth thru impeachment.

    so, i say, just rally behind the opposition congressmen under the aegis of the lone surviving complaint. united we stand, divided we fall…into the kangkongan.

    And you are right. It’s victory, however it is small for the anti-Arroyo forces, that this one was able to squeak through the formidable wall that Arroyo’s minions in the House of Representatives have put up.

    We will not make it easy for them to step on us. Anong malay mo, baka matipalo yun.

    Even just to keep the issue of the illegitimacy of Gloria Arroyo’s presidency alive, the impeachment complaint is a step in the right direction.

    It’s part of the process of saving our democracy.

  12. What we have decided to do over here is write also to the Opposition Congressmen even just to give them the moral support to go on with what they think is right.

    It will be proof indeed of how corrupted majority of the Philippine Congressmen have become under the leadership of a crook like Joe de Venecia, who may yet to witness another tragedy in his family to give him a lesson that he does not seem to learn.

    And as the old adage says, “Kapal puno ang bigasan, kinakalos.” The time of reckoning may soon be near. Who knows?

The pro-gloria TONGressmen thought they could get away with it, hehehehehehehehehehe……. ulit. But wait, now that the eight complaint was declared as sufficient in substance, we must now focus on the declaration of the justice committee to accept it also as sufficient in form, that way the impeachment could be tackled and that evidence be shown to them. The problem right now, is when ermitaNYO says that the eight impeach complaint together with mike the defender will be killed in 6 or 8 days, tsk, tsk, tsk……. we should not be fooled by these TONGressmen, anyway, comes may of 2007, we must crucify these TONGressmen upside down and burn them in public. MANMANAN…….

If so, how come they do not seem to know that there are procedures to be followed in making a go of an impeachment and not merely some statement being issued by some bobos in Malacanang and Congress that it can be done in 8 days.

    Ano ba ang Supreme Court kay tiyanak? Mas powerful pa ang bruha sa pinakamataas na Hukuman. Siyempre kung pasaway ang gaga, ganoon din ang mga gago niyang mga tauhan. Para sa akin, palitan ang lahat na justices sa SC mula kay Panganiban na cabalen ni tiyanak. Ewan ko ba…basta wala akong tiwala sa mga kababayan ni tiyanak.

    Dapat ituloy na ni Mayor Binay yung plano niya na ilabas ang mga pangalan ng mga kankongressmen (representa-thieves) na magbabasura sa 2nd impeachment complaint. At mas maganda kung ilabas na niya yung mga nagbasura nuong last year impeachment. Willing akong magdistribute ng mga leaflets!

    On the other hand, ang isang dapat na binabatikos ng media at taumbayan sa Philippines ay iyong mga militar. Nakakapagtaka naman na nabigyan ng sobrang power ang mga ungas na mga sundalong kanin na iyan.

    I’m proud to say that I belong to a group in Japan that is trying to preserve what we have enjoyed for the past 61 years in Japan—freedom from these military people who can be more liabilities than assets to the country. This Japan has proved for the past 61 years living in peace because of a pacifist Constitution that hawks like Koizumi is trying hard to change even by deception as when they plan to impose a new law regarding the Yasukuni Shrine, which is a religious shrine dedicated to those who died in the World War II supposedly depending Japan but engaged in aggression in other countries similar to the activities of the USA today.

    What we see today, and my Japanese friends in the peace movements I am in, see is a military rule already being imposed on the Filipinos with a civilian puppet trying hard to act her role because she thinks that she is having the upper hand as the generals dance to what she thinks is her music not theirs. Kung baga sa lokohan ay naglolokohan, and the people laugh with them without realizing that they are being duped and had! 😡

    I feel sorry for Filipinos really that despite their numbers, they are unable to do things the way citizens of a democracy should be able to—create a government OF, FOR and BY the people. Frankly, I never really understood that when I lived in the Philippines, nor even when my family migrated to USA, where there was intense discrimination still in the 60’s.

    I actually understood what it was to be really free when I came to Japan, especially when I started to practice and enjoy my civil rights and liberties as a citizen of Japan, where the rule of the game is not whether one is a first class or what-class citizen. It is whether or not you want to be a good one, take it or leave it.

    This is one reason why we can vote here based on platforms, not even based on personalities, for who cares about these personalities? In the Philippines, regrettably, despite such boastings that the people’s power has removed a dictator, we still see the same problems Filipinos had long before Marcos had even tried to be a dictator to do what he wanted done for his people sans the crooks who surrounded him, cajoled him to give them the right to steal funds in his name and put them in banks overseas confident that in time they would be able to get them for their own personal use as what we see now happening to those monies recovered in some foreign banks under Marcos’ name that amazingly Imelda does not strongly oppose except for those jewelries she claims to be her own. Otherwise, how could they have known of those deposits in foreign banks if they did not deposit them themselves under the name of Marcos, who was too ill to really be able to track down the “kabulastugan” being done in his name!

    Even then, for example, we have been hearing of the anomalies regarding the overbilling of the construction of the highway from Aparri in Cagayan to General Santos in Mindanao. Why were those anomalies forgotten after EDSA 1, may I ask?

    Frankly, what the likes of Max Soliven should be doing is write about these anomalies and expose them without favor and fear, not tolerate them even when they see a building being erected to camouflage the rampant stealing being done right under everyone’s noses.

    I agree, Myrna. The journalists you mentioned have credibility problems. But, there are some Born Again journalists like Randy David who used to be anti-Erap and pro-GMA. Herman Tiu Laurel was not pro-Erap in the beginning. Like Ellen, Herman was pro-Cory. It was only later that he sided with Erap and continues to fight for Erap until now. Dick Pascual has also changed his position. Alex Magno is a goner. How can he be credible and fair as a journalist when he’s working for Gloria?

    The essence of a democratic form of government is its three equal branches; executive, legislative and the judiciary. Supposed to be, because of its nature, equal and due respect should be accorded to each other. Meaning, there will be no interference in their exclusive areas of responsibility and jurisdiction. The executive department will be the sole in-charge of governing; the legislative in the formulation and enactment of laws; and the judiciary for the interpretation and application of laws. That’s how democracy works. And in our country today, if we base on these assumptions, we can not say that we are living and being governed by a democratic government. It’s dictatorship without a name.

    Analysis of this present stolen government, we can not say that these functions of the three branches are working as it should be. T he executive department headed by Mrs. Pidal doesn’t give an iota of respect to the two branches. Time and again she interfered in the enactment of laws and in the administration of justice. Equality is never in her vocabulary and continued her dominating ways against her co-equals. She considered herself as above them all, thus, the continued defiance of the Supreme Court’s decisions. She dictated and bribed all her tsonggos in Tonggress to give in to her whims and caprices. Her unwavering belief is all of them, the justices, senators, tonggressmen are all genetically design to follow all her wishes and be their queen. What a country we have and what an evil she is.
    A question sometimes stir my consciousness; If the palace pretender continue to defy decisions of the courts, is there any provision of law that will force her to respect and submit herself to the court jurisdiction? In cases of ordinary persons, I know there is, but for the palace pretender, I don’t. Maybe that’s why she considered herself above everybody else and above the law. Only in Philippine style of democracy.

    re dictatorship..nw at my age n wat i’ve seen around me thru the years…i dont deny that i saw more concrete things happened in marcos’time (whter it was evil or good)…it was marcos’ wit that put the Philippines on the map but it was imeldific’s taste of the good life and vanity that was dragging their “empire” down..as i remmber, when curfew was jst a few minutes away, people learned to have the sense of planning, people unwittingly became disciplined not only to themselves but to the society…but mayb i was still naive or ignorant to the truth going on around during that time(those invited for questioning and victims of unjust killings) but there was almost no crime in the ordinary neighborhood we grew up while it was known for goons and kanto boys. i remmber my mom always quarelling with a goon for extortion but after 3 days of 1081, this guy suddenly became quiet as a mouse and looked for work…i also remmber this policeman manning the intersection which is a few meters frm our store, he was like a father-figure to all the kids in the block and the thing i remmber best is he is the most mestiso, clean and regale looking policeman i have ever seen(their uniforms were colored khaki if am not mistaken)…i could go on with the other adminstrations that i went thru while growing up in and around Tondo,Manila…and we cannot deny that we did come a long way from there…BUT!…a big BUT…the majority of the projects materializing right now had already been in the pipeline way back, although we knw the designs had long been revised several times…even the northrail and southrail project, we did design competitions for every station intergating the landrail and the skytrains, with the tickets patterned frm those of HK MRT..
    with this attitude, sadly, kitang-kita na walang originality ang gaga na ito at ang kanyang pamamalakad.my foreign boss before told me that the bruha is better as she’s an economist while erap is a goon-looking drunk so why was i complaining bec of the impakta?…i told him patron, this is asia most of all the Phil…anything can happen and only in the Phil that the dead can suddenly live again…and now when we exhange emails, he would ask me how come i had a sense of what was to come?….well :-

  43. Alam mo, Soliel, noong araw mahilig din ako ng ramen. Class pa ang kinakain ko, at maraming gulay pero dahil sa kulang pa rin ng sustansiya, nagkasakit ako. Malnourished ang labas. Nagkasakit ako ng simple colds lang na nauwi sa complication gawa nang ang tapang ng gamot na ibinigay. But it was a blessing in disguise. May side effect iyong gamot na ininom namin at nagdemanda ang mga katulad kong lumala ang sakit dahil sa gamot. Nanalo. I got 15M yen and a monthly stipend until I die ng 177,000 yen. Hinabol pa ako ng Ministry of Health noong last year ng pagpa-file na claim. Sabi ng kaibigan ko sa Pilipinas when I told her of the good news, Japan kasi at honest ang mga nakaupo. Sa Pilipinas daw iyan baka ninakaw na ni Pandak!!! 😡

    Kaya ano ang pinagmamalaki ni Pandak na dinidistribute niyang ramen? Kahit nga cup ramen na may mga rekado na walang masyadong nutritional value. Nakita ko nga ang isang pamilya ng mahirap na nabigyan ng ramen ng mga TV crew na hapon na ginamit sila sa isang documentary. Tuwang-tuwa silang ginawang ulam ang ramen. Dito ang ramen, parang kanin at hindi ulam kung kainin.

    Kaya iyong photo-ops ni Pandak, dito iyan pagtatawanan ng mga hapon at baka batuhin pa siya ng bulok na kamatis na may kasamang malaking bato kung opisyal siya dito!!! 😡

    alam m ba Yuko..dito, kahit mga gamot na expired, ginagamit kung pwed ilusot ng DOH…lalo na sa mga barangay clinics, minsan sasabihin pa ng mga mangmang na mayroon daw allowance ng ilang buwan aside frm the stated expiration date. hahaha!!!ganun na talaga katanga ang tingin ng mga pinoy sa kapwa pinoy…sample to tell u, wen my son’s school bus encountered an accident way back, the kids wer brought to ospital ng Maynila cz it was jst on the other side of the street where the accident happened..to make the story short, they have limited needle et al for stitching, their xray machine is out of order for almost 4 months(daw), the xray room was flooded, cotton and sterile dressings were being tipid to ensure magkakasya for the 5 kids and the poor driver who luckily, his hand was nt crushed. but he was crying in pain for an hour cz they had to buy more morphine..we wer asking for a CT scan bt they said its also under maintenance…then and there we decided to change venue. what happened to the 2.5 stitch became 5 stitches!!! buti at di natetano ang anak ko 🙁

    Bakit hindi diktador ang tawag kay Marcos eh talagang diktador naman? Ang salitang diktador ay hindi masama kung iisipin. Dikta lang ng dikta. Kung tama naman ang dinidikta anong problema? May demokrasya nga pero sa papel lang. May demokrasya nga pero hindi makareklamo ang mga tao.

    Sa tutoo lang, ang mga propeta…mga puno ng simbahan ay mga diktador din. Hindi ba nila dinidikta ang kanilang mga turo? Hindi ba nila pinipilit na sila lang ang tama at may karapatan magbasa ng Biblia? Hindi ba inaangkin na sila lang ang maliligtas at mga anak ng Diyos? Iyan ang mga tunay na diktador.
