Pagwawaldas ng assets ng taumbayan

Nakakatawa itong si Ricardo Abcede, commissioner ng Presidential Commission on Good Government , na ngayon ay nagtatago dahil katulad ni dating Agriculture Undersecretary Jocelyn “Jocjoc” Bolante, takot siyang humarap sa Senado.

Ini-imbistigahan ng Senate Committee on Government Corporations and Public Enterprises na pinamumunuan ni Sen. Richard Gordon ang napabalitang pagwawaldas ng mga assets ng Philippine Communication Satellite Corporation.

Malaki kasi sa mga shares ng Philcomsat ay sequestered dahil ang suspetsa ay pag-aari raw ni dating Pangulong Marcos. Kaya ilan sa mga director doon ay nominee ng Malacañang katulad ng pinsan ni Mike Arroyo na si Benito “Bomboy”Araneta.

Itong si Araneta ay unang umupo sa Philcomsat noong panahon ni Joseph Estrada. Siyempre nanatili siya doon ng umupo na sa Malacañang ang kanyang pinsan.

Kasama si Arroyo sa biyahe ni Arroyo sa Europe. Kinukuhaan namin ng kumpirmasyon ang balita na humiwalay ang mag-pinsan na Mike at Bomboy sa presidential party at kasama ng isang opisyal ng Development Bank of the Philippines ay nagpunta na sa Munich, Germany. Misteryosong biyahe, di ba?

Uuwi kaya si Araneta kasama ni Arroyo at haharap sa Senado? O susundin niya ang ginawa ni Bolante iiwas at magliwaliw na sa ibang bansa?

Balik tayo kay Abcede. Siya ang PCGG commissioner for asset management o tigapag-alaga ng mga ari-arian ng PCGG na matuturng natin na pag-aari ng taumbayan kasi yan nabawi kina Marcos dahil ginamit nila ang pera ng taumbayan sa pagkamal nyan.

Itong si Abcede ang isa sa beneficiary ng pagwawaldas ng assets ng Philcomsat. May dalawang faction kasi sa board ng Philcomsat. Ang isang grupo ay nagbigay ng kotseng Toyota Camry na nagkakahalagang P1.6 milyon kay Abcede. Siyempre pera ng Philcomsat.

Sa papeles na winagayway ni Gordon, makita na ang pangalan ni Abcede ang nakalagay na recipient. Ngunit naala-ala nila yatang bawal kaya linagay sa pangalan ng Philcomsat ngunit doon pina-deliver sa bahay ni Abcede. At si Abcede ang gumagamit ng kotse.

Garapal talagang itong mga bata ni Arroyo.

Sa regulasyon ng PCGG, ang government nominee sa isang sequestered corporation ay tatanggap ng hindi susubra sa P10,000 sa isang buwan o P120,000 sa isang taon. Ang pagtanggap ni Abcede ng kotse mula sa Philcomsat ay maituturing na paglabag ng ganoong regulasyon.

Nagtatago ngayon si Abcede . Sabi niya hintayin raw ang desisyon ng Supreme Court sa sinampa na kaso ng Sendo tungkol sa Executive Order no. 1 na siyang pinanindigan ng PCGG opisyal na sila raw ay hindi sakop ng batas sa pag-iimbistiga.

Nagtatago rin ang ibang commissioner at ibang director ng Philcomsat. Anong klaseng opisina ito?

    The first time I head of this PCGG, I thought and saw who was leading it, I could not help raising an eyebrow especially when they started sequestering properties that actually did not even belong to the Marcoses but to the Filipino people. One of them properties in fact was the Philippine House in SFO that the crooks (I understand Aquino’s sister was even part of the scam the way she now supports the scammers in the palace by the murky river.) There was also the house in New York that was bought during the Marcos regime to display Philippine products, and just because the contracts bore the signature of the late president, the properties were sequestered and sold without a national referendum.

    Then came the time to sell the properties acquired through reparations that they also pretended to be parts of the Marcos loots until my group, composed of scholars and journalists in Japan, andI exposed them for fraud. Then, we got the usual excuses until some members of the media in Japan and the Philippine took up our story and the attempt to sell the properties became an issue worth debating on at the Senate.

    Senator Enrile took up our cause and fight he did for it, while we try to discourage the Japanese wannabe bidders to buy even just one of the 5 properties located in prime areas in Japan for sale. Then the corrupt government even under Cory changed tactics by saying that it was for CARP, but who would believe them. “Manigas kayo!,” so we insisted especially when we found out about the 15% customary commission to the middleman in the sale that is also still the rule of the game in real estates dealing in Japan plus the other pakipkip.

    We owe a lot to Senator Enrile in fact for introducing the motion to make those properties Philippine patrimonies and have the Supreme Court declare them to be so in order that no one can easily sell them without passing through a national referendum and the people of the Philippines properly consulted.

    What was nauseating was the attempt to hoodwink the Filipinos who did not know much about Japan nor about their own country’s history enough to care for those properties granted in exchange for the lives sacrificed in the last world war (my uncles’ included), etc.

    The Japanese bidders out of respect for the wishes and will of the Filipino people that we represented backed out. Only two stayed, but by some miracle, one of them failed to submit the required check and was disqualified. The bidding was stopped and declared null and void. None of the 2,500 dollars paid by the 35 bidders were returned to the wannabe bidders (laking kuwarta din iyon).

    But the government was desperate to make money to pay those who helped topple Marcos of course, and tried another bidding. None bidded because we were past to connive the Japanese media, too, in exposing the deal on the property enough to frighten bidders.

    That is the reason now I guess why they do the bidding in the Philippines, and having foreigners with Japanese dummy to do the buying that when proven can be ground for disqualification.

    This is the reason why I think the PCGG is a useless agency that should be scrapped and those highly paid appointees terminated. Ang dami pang lagayan diyan I am sure.

    I should mention that I had a cousin in fact who benefitted from these sequesterings of properties that did not even belong to the Marcoses. I thought it was injustice, but God apparently would not allow evil to prevail. My cousin found his life more complicated and miserable living in that property that could be more aptly describe as stolen than sequestered.

    Talk of crime not being able to pay! But Ellen, wala na bang katapusan ang graft and corruption sa Pilipinas. Maliit pa ako rampant na iyan, hanggang ngayon ba hindi na natapos iyan at lalo pang lumalo dahil kay Ale Boba and her countless pigs?! Dugong aso na mga tikbalang pa!

    Next to Angara and Santiago, this Enrile is the most dangerous man in the Senate. His fans can praise him to high heaven, but I will not. His famous slogan “Problema mo, sagot ko” is actually “Problema ng Malacanang, sagot ko”. A trapo, an opportunist, a balimbing…that’s all about this guy. He doesn’t come clean…not the way he projects himself to be.

    I have witnessed so many hearings, inquiries and followed most of them from ‘aid to legislation’ to uncovering the “mystery” that normal police and criminal investigations can not dig out or to satisfy the Public demand for Answers. Ninety Nine Percent of the Time it never involves Elected Politicians, but Judges, Coroners, or Any Person considered knowledgeable to conduct such complex and very demanding tasks.

    The one example I can site is one that happened locally. City of Toronto IT equipment lease contract double to 86 millions from 43 without the Council approval. Came madame Justice Bellamy to conduct an ‘aid to legislation’ or more of uncovering the dirt, and it was unbelievable how a millionaire City Budget Commissioner (one of the council member) can be tempted by a 25 grand grease money by a smooth (brother of a Hockey Star, a hairdresser turned Salesman) sales who nothing about computers. The city spent 20 million on the inquest, but it was well-worth it and the Lady Judge kept her cool with all the lies and bravado in her court. But in her report he cited the Budget Commissioner that his testimonies was worthy of Pinocchio., and recommended laws that may prevent such abuse from happening again.

    I think that’s how a hearing should be conducted if everyone really wants to reform the system. Instead of Senator Gordon and all the Rest throwing insults and shouting match as if they are doing the World Wrestling Federation dramas.

Unfortunately, Vic, there should not have been _these shoutings at the Senate gallery if the overstaying occupants at the palace by the murky river are themselves preventing the smooth investigation of these cases and stopping the Senate from asking the prosecutor or the police themselves to start an investigation.

    The reason is because they are involved in the anomalies and/or are using these people now under investigation on promise definitely that they would be protected from prosecution and reason why they are hard on having the Senate abolished!—reason why you and the rest of the bloggers here should prevent them from doing that even by making sure they do not succeed in changing the Constitution under this bogus regime.

    I am told by a friend in Manila that former DoLE Secretary Pat Sto. Tomas was put in as chairman of DBP because she is very good at helping camouflage the escapades and shady deals of the Pidals, pimping blindly in fact for the Pidals when she was at DoLE. She should be the one to be investigated as well regarding the OWWA funds used for the health card scam.

    Am not really worried about this so-called mysterious trip of Fg and Co. to Munich. I know for sure that as soon as the business counterparts here smell something fishy, they won’t be tolerated. I should know. There might be corruptions here too, but those incidents ussually didn’t exist that long before they were exposed and never solved unpunished. I’m curious what’s the mystery behind those secret trips. Wanna bet guys?

    PCGG is a waste of tax payers money! If we are to define “White Elephant”, Presidential Commission on Good Government would be in my opinion is the prime example. It has been proven PCGG is nothing but a duplication that the govt can do without, certainly such institution was a conspicuous failure. And Commis Ricky Abcede obviously as commissioner has no respect for the law as many others under Gloria’s spell. I think the Senate finally woke up that they’ve such power vested to them by the people. Hooray! Hooray to the Senators! It’s about time to kick ass!

    Welcome to the club. Anna and I have been in this “treasure hunt” for some time now, and I’m surely pleased to hear of her participation in the rallies for Filipinos in Brussels even dominated by foreigners!!!

As of this writing more than 750 na ang naligpit! Latest is the bodyguard of Mayor Binay, who is the only one bold enough to give permits to protesters sans the blessings of the sipsip PNP Chief!

    Apparently, the crooks have found Germany a convenient place to try a new venture with the Swiss banks no longer willing to hide laundered funds after the Marcos fiasco, and with the Joc-Joc Bolate case, I doubt if their friends and cronies will stil openly volunteer to be their dummies.

    I wonder how much public funds they are baiting wannabe dummies in Germany to hide their so-called loots. If you are a citizen of Germany in fact you have the privilege and right to ask for an investigation of any secret transaction of these crooks there. Even a tidbit of a clue would be enough for the police to start an investigation especially when they realize that it would be detrimental to national interest.

    With the Fraport experience, I doubt if the serious traders there would be willing to have anything to do with this couple. Their partners must be the desperate ones, if not members of the underworld gangs.

    Garapalan at bastusan na talaga. Garapalan dahil ang perang technically ay galing sa nakaw dahil pera ito ng taumbayan, ninanakaw pa ulit ng mga walanghiya sa gobyerno. Bastusan dahil kunwari ay prinsipyo ang pinaninidigan ng PCGG pero sa totoo lang, ayaw lang sumagot dahil halata ang pagkakamali. Executive Order No. 1 was never intended to absolutely exempt the PCGG from legislative investigations.

  31. Hay naku, with all the problems in the world, I have decide this instant to take things easy. Taipan is right, take it easy, be happy.

    I will sleep over the horrible news of late because I know that tomorrow, I’ll wake up bright as the sunshine that hovers over this part of the world (at least when it feels like it) and then briefly check on the net if the world has changed.

    If the world has not moved or if I feel that it is determined not to do anything other than to stay as it is, I will make myself some real Darjeeling tea, potter around in my garden, paint the new pots bright pink, yellow green, and light orange, fix the crazy ivy plant that’s threatening to throttle my young peach tree and perhaps, re-read “I Claudius” (which I always manage to sort of finish reading but never quite remember what I’ve read hence the re-reading ad vitam eternam exercise), a highly interesting historic-fictional read but also one of the most boring literary work of semi-fiction I’ve read. Go figure.

    That is my “agenda” for tomorrow, Monday, which I intend to follow as soon as the kids leave home for school.

    Diego, the manner by which the $628M held in escrow at PNB was released for GMA to pocket, is yet one of the many “creative” decisions under Hilarious Davide’s court of clowns.

    The escrow agreement with the Swiss bank provided that for he money to be released to gov’t, the Marcos should first be convicted in a court.

    What the “constructions” of Davide achieved was to simply declare the money as gov’t property, totally bypassing the agreement, presto, another win-win solution…for Gloria and the Marcoses.

    Phil Cruz is partly wrong in saying that Glora is above the law. Well, she’s not above it. She IS the law.

    COMMISSION on Elections (Comelec) Chair Benjamin Abalos is caught between a rock and a hard place. The Supreme Court, acting as the Presidential Electoral Tribunal (PET), has summoned him to the hearing on Sept. 18 to testify on the authenticity of election returns (ERs) that came from the poll body. Former senator Loren Legarda, whose election protest against Vice President Noli de Castro is being heard by the PET, presented the documents at the Sept. 12 hearing. The poll results in the Comelec copies were different from those presented at the House of Representatives, which declared Gloria Macapagal-Arroyo and De Castro the winners in the 2004 elections.

    The Comelec official in charge of the ballot boxes, Wilfredo Gonzalez, has already testified that Legarda’s ERs are authentic. They were identical to six other copies held by Namfrel and the major political parties. Only the copy in Congress was different, and it gave De Castro a big lead over Legarda.

    One doesn’t have to be a genius to deduce that the Congress copies are fake. And that’s what Legarda is claiming. The genuine ERs, she claims, “had been substituted with fakes while in the custody of the House of Representatives.”

    That’s the quandary of Abalos. If he admits that the Comelec copies of the ERs presented by Legarda are authentic, he would be admitting that the House’s copies are fake. This would tend to prove that Legarda was cheated, and it would make President Arroyo angry because it would also show that her votes were also padded.

    On the other hand, if he testifies that the Comelec’s copies are not authentic, he would be hard put to explain why all the other copies distributed to different groups are identical while only the House’s copy is different. He may also be prosecuted for perjury for lying to the PET.

    How do you solve a problem like that? My advice to him is: Tell the truth. Never mind if Ms Arroyo gets angry. It is not likely that she would finish her term anyway. She may even have him impeached. But so what? His conscience will be clean and the truth will set him free. Moreover, the people will love him for it. Honest people are very rare in the Arroyo administration. He would be one of the exceptions, and history will judge him kindly.

    Legarda told the Kapihan sa Manila media forum last Monday that even if she had run for senator in the 2004 election (the surveys put her as the top choice of the people), she would still pursue her election protest and assume the vice presidency if she won it.

    “Won’t running for the Senate be interpreted as abandoning your electoral protest, as did Sen. Miriam Defensor-Santiago?” she was asked.

    “We will let the Supreme Court decide that,” she replied. “If I am not mistaken, Senator Santiago voluntarily abandoned her protest. I won’t do that. If, under an existing law, a senator can run for another position and still return to the Senate, why can’t a senator assume the vice presidency if he wins it? Anyway, that is still an unsettled issue. I hope the Supreme Court will settle it as justice, not technicality, requires.”

    it is because of section 1 of executive no. 1 that encourage pillage in the assets sequestered by the agency. it also embolden crooks to continue raiding sequestered assets to enrich themselves because of the provision that unmistakably defies public accountability so enshrined in the present constitution. in my one cent of opinion, that provision now invoke by the PCGG commissioners is unconstitutional and should be striken down by the SC in the instant habeas corpus petition of chairman sabio. expect fireworks in the session hall of the SC when legal minds clash in the oral argument set on sept. 21.

    while graft and corruption pervades every government offices in this country, PCGG is a standout. the notorious fiscal agents then assigned in sequestered companies started to work in PCGG as ordinary bureacrat most of them becoming millionaires in a year or two in the agency, living in expansive mansions and driving the latest models of expensive cars. most of them formerly jobless, they became instant millionaires. their only qualifications is strong political connection. how lucky can these people get. of course they are now all gone and so with the assets entrusted to them then and the filipino people were left behind with a big fat ZERO in the bag. they were replaced by another group equally if not more sophisticated in making sequestered assets easily vanished in thin air.

    it is interesting to note that sen. salonga, who himself was the first chairman to sit in that agency, said in an interview on tv that chairman sabio was misapplying that provision because absolute immunity to answer any questionable act of PCGG officers was not really the legislative intent of that provision. i am sure sen. salonga will be invited to submit his comment in that petition as “amicus” and i wonder how he would explain the provision, assuming if it is left untouched. the language used in that provision is clear leaving nothing to be interpreted. in statutory construction, the court will interpret the law only when it is vague but will merely apply it if it is written in clear and equivocal terms. of course, the court can always declare a law or a part of it as unconstitutional, thus invalidate it.

    how would it be reconciled with the constitutional provisions on public accountability would be an interesting legal discourse from a brilliant mind like former sen. salonga. i am sure his advance age will not diminish his superior ability to render a wise opinion on complex and difficult question of law in this habeas corpus petition. i can bet though that the SC will later on declare a portion of executive order no. 1 unconstitutional.

    of course, the senate could probably lose this case and be ordered to release chairman sabio if the SC finds it did not stricly follow the procedure in the exercise of its power of inquiry already laid down in the recently decided case involving e.o. 464.

    well said vic, but conducting legislative inquiry here in the philippines or a politician exposing graft of another opponent politician in public is often suspected as the most effective way of getting wide media mileage without spending so much in hefty media advertisement fees. experience shows that the country keep on kicking one grafter only to be replaced by another grafter more rapacious that the first. that explains well why, after the war, the philippines was economically sound next to japan only to land tail ender as of now.

    i can only wonder aloud if a generally clean and honest society can fail to put clean and honest leaders in government. are we not deserving the kind of government that we have put in place?

    who needs a commission on good govt if the govt is good.in any case if all the 3 seats of power are functioning the culprits will always be judged. it is when the executive dominates the other 2 when there should be independence from each other that things become problematic.corruption exist even in the most advanced democracies but it is limited on the lower echelons.the work of a commission should be limited in time and scope but now many seems to be eternal.

    Now it is clear. Any and all critics of the administration are considered its dangerous enemies. They are perceived as destabilizers of the government and they are therefore made targets of threats, accusations and summary executions even. This has become clear and certain not only in the country but also abroad.

    For the government, it is a crime to tell the truth. To protect its tenure of power and might, to extend its influence in intensity and extent, there are no holds barred. To assure its continuous unconscionable affluence, this odious end justifies all devious means. Nothing and no one is allowed to be on its way in pursuing its questionable options and dubious motives.

    Leaders and members of cause oriented groups are gradually diminished in number. Protesting farmers are not spared. There are dissenting professionals who are eliminated. Critical media practitioners now live dangerously. Even students are abducted and pastors are killed without qualm or remorse. All of these people are considered “enemies of the state” by the government and should therefore be silenced temporarily or permanently.

    The government has turned its persecutory attention to six Filipino bishops according to their own list. In so many words, the administration tells them to behave like little good boys. They are told: Play dumb. Keep quiet. Stay still. The national leadership and its avid followers are one in wanting the same bishops to act like the proverbial three monkeys: See nothing. Hear nothing. Say nothing. Or else.

    This government that now wields power and has command of unlimited money and firearms of all kinds is in fact pitiful and pathetic. It forgets that there is no way of killing the truth. Guns and bullets do not vanish ideas. Even murders keep ideals alive first and foremost. It might be good to remind this government that doing away with six bishops simply means that six or even more new bishops will simply come to fore.

    Woe to this government if it wants to think that lying, cheating and stealing should not be the concern of bishops, that injustice, oppression and killings should not get the attention of the church.

    But in the Philippines, pati doctor kasabwat!!! Pwe!!! Kaya dasal na lang natin matuluyan na lang sana, or something like a Tsunami to remove these crooks if the Senate is rendered useless and made to look merely grandstanding. Amen!

    Articles on Sept. 9 and 10 about the Japan-Philippines free trade agreement confirm that the pact was overhyped and leaves much to be desired. Focusing on the issue of Japan accepting Filipino medical-care givers, the cynical observer has to wonder at the results of years of bilateral negotiations.

    It seems to me that Japan, by setting the qualification standards so high, has never seriously considered accepting but a few token Filipino medical professionals. Unfortunately, due to racial stereotypes, Filipino doctors and nurses, irrespective of their education and qualifications, will not be accepted as equals in this society for the foreseeable future.

    What this country really wants is the equivalent of hundreds of “home helpers” annually to perform some needed medical services in exchange for scant compensation, while providing prospective brides for Japanese men to hopefully boost the country’s abysmally low birthrate.

    Japan is not displaying its good will to the Philippines with this part of the free trade agreement. It is simply a marriage of economic and social convenience.

    The operators are surnamed Montenegro, Atayde, Tan and Yu. The estimated take — P50 million a day or P1.5 billion a month”.

    We can see how these people rob the treasury. Instead of the taxes going to the coffers, it is going directly to the pockets of the robbers. And somebody here still is idolizing and adoring the evil queen who is illegally sitting in Malacanang.

    MABUTI at matapang magpahayag ang World Bank na ang Pilipinas ay walang ginagawang matibay na paraan para malutas ang lumulubhang corruption. At least ang nagsabi ay taga-labas mismo kaya walang preno sa paglalantad ng kanilang reklamo o batikos. Bukod sa talamak na corruption na inireport ng World Bank na nakasaad sa kanilang “Governance Matters 2006: Worldwide Governance Indicators” binatikos din ang klase ng pamumuno sa Pilipinas. Sabi pa ng World Bank, sa kabila na ang Pilipinas ay isang demokratikong bansa at isa sa may pinakamalayang pamamahayag, hindi pa rin maputol ang nangyayaring corruption. Palubha pa nang palubha. Ayon sa report ng WB, noong 1998 ang ranking ng Pilipinas sa pagkontrol sa mga corrupt ay 50.5 percent subalit nakapagtatakang bumaba sa 37.4 noong 2005. Malaki ang nangyaring pagbaba na nagpapakita lamang na walang ginagawa ang gobyerno para malutas ang pagnanakaw sa gobyerno. Tinalo pa ng Indonesia at Cambodia ang Pilipinas na tumaas ang ranking at lumalakas pa para labanan ang katiwalian sa kanilang bansa.

    Hindi pa natatagalan nang ireport din ng World Bank na ang Pilipinas ay nasa nakadidismayang puwesto na iniiwasan ng mga dayuhang investors. Ang dahilan ng pag-iwas: Talamak na red tape. Only in the Philippines na maraming papeles na kakailanganin bago makapagbukas ng negosyo at hindi kikilos ang mga papeles kung walang “padulas” na pera. Kung malaki ang nakaipit na pera hindi na mahihirapan at ayos na agad. Kung maliit, tatagal ang proseso. Ony in the Philippines lamang ito. Dito sa Pilipinas may mga “buwaya” na walang kabusugan.

    Ang sinabi ng World Bank ay mariin namang binatikos ng Malacañang. Hindi anila nagkukulang ang gobyerno ng Pilipinas kung ang tungkol sa pamumuno ang pag-uusapan at lalong hindi naman naging malambot sa paglaban sa mga tiwali sa pamahalaan. Walang katotohanan ang sinabi ng World Bank.

    Mahinang pamumuno at labis na katiwalian ang nakikita sa Pilipinas. Nakadidismaya at nakahihiya ito. At natural na hindi tatanggapin ng Malacañang ang komentaryo o obserbasyon ng World Bank.

    Walang pinakamabuting magagawa kundi unahin ng Malacanang na malutas ang labis na katiwalian. Hindi na sekreto ang problemang ito. Ang taumbayan ay sukang-suka na sa mga katiwaliang nagaganap. Iprayoridad ito.
