“The issue is beyond Binay”

I was at the Makati City Hall yesterday afternoon up to about 9 p.m. There was a steady stream of visitors, expressing support for Mayor Binay.

There were Bishops Julio Labayen and Bishop Antonio Tobias. Later in the evening the two bishops, together with three other priests, officiated mass.

There was former Finance Secretary Jess Estanislao, whose presence many found significant, because he comes from the business community and is supposedly considered conservative. For him to go there sends indeed a message.

Also there were Vice President Teofisto Guingona, movie producer Arminda Siguion Reyna, lawyer Koko Pimentel, son of Sen. Aquilino Pimentel, Amina Razul, Rene Saguisag, Leah navarro. I saw activist Linda Montayre.

Earlier, Cory Aquino and Susan Roces were there.

Malaya publisher Jake Macasaet and wife, Karen, were also there.

Originally, the mass was supposed to be held at the 21st floor where Binay is holding office, 24 hours a day, since last Tuesday’s serving of the suspension order. But Binay said, “I feel uncomforable with us holding mass here while thousands are down there, referring to his supporters in front of the City Hall.

Against the advice of his security aide, Binay and his wife, Elenita, joined the mass in front of the City Hall. Right across the street, the Malacañang -designated caretaker Rodolfo Ferraren holds office. If they were still there at that time, they must have seen and heard Bishop Tobias say that with what Malacañang did in makati, the issue has now gone beyond Binay. He said, “it’s time to show our national anger.”

Binay wore a MABINI T-shirt. MABINI is an organization of lawyers who fought the Marcos dictatorship.

Someone quipped, “Baka kaksuhan din siya ito sa paggamit ng pangalan ni Mabini” referring to the threat of the AFP to bring Binay to court martial for wearing the military uniform improperly.

There are speculations that Malacañang is leaning hard on the Court of Appeals not to grant the temporary restraining order that Binay is asking. There are also some who said that seeing the determination of Binay to fight back and the support he is getting Malacañang now wants to save face and is the one urging the CA to grant the TRO so they can get out of the mess in Makati that they have created.

As I write this, I got a text that in anticipation of the big rally that is being organized for tomorrow by various groups working for freedom and democracy, Malacañang has ordered a dispersal of the crowd now. Both sides are now mobilizing!

    THE Armed Forces yesterday said Makati Mayor Jejomar Binay can be held accountable in civilian and military courts for wearing a Marine uniform when Malacañang suspended him for two months effective Tuesday due to graft charges.

    AFP information chief Lt. Col. Bartolome Bacarro said Binay could be charged with violating Articles of War 97 or conduct prejudicial to good order and military discipline.

    “He (Binay) is a military (Marine) reservist. He is subject to military law,” said Bacarro.

    Bacarro said reservists can wear their uniforms only during ceremonies, formal gatherings and training.

    “The Armed of the Philippines is bound by some regulations, policies and these regulations and policies should be adhered to by all members of the Armed Forces of the Philippines. And one of these regulations covers the wearing of uniforms,” he said.

    “Anybody who violates the uniform code can be subjected to military proceedings… He can be tried under the Articles of War,” he said.

    Asked if the military would pursue a case against Binay, Bacarro said: “Not now. I cannot answer that but anybody who violates rules and regulation can be subjected to such proceedings… What I’m telling you right now are the probable violations. We are not saying we will file charges against Mayor Binay.”

    Bacarro said even regular officers and men cannot be seen in the metropolis in battle dress attire.

    “You don’t see me wearing my uniform in an open manner… Even active (officers), we have restrictions,” he said.

    Bacarro said Binay could also be held for violation of Republic Act 493 which regulates the wearing and sale of military and police insignias, decorations, medals and badges.

    “It states that commissioned officers, enlisted reservists can wear these rank and insignias for military purposes only,” said Bacarro.

    Binay may face a minimum prison term of one month to two years and fine of P100 to a maximum of P2,000.

    Bacarro said Binay could also be charged with violating Article 179 of the Revised Penal Code for illegal use of uniform and insignias. The punishment is six years in prison.

Will also suggest a pots and pans protest to make the protest dramatic and catch international attention, even to show the helplessness amidst the brazenness and total lack of law by this bogus president who should have been disqualified, arrested and prosecuted like any other criminal.

  6. Ellen, is that legal? I thought any reservist can wear his uniform unless there is the intention to dupe any one like what the bogus president does. Binay is in a state of war, and he has every right I think to wear his uniform especially if his intention in doing so is to remind his fellow soldiers and fellow reservists to uphold the law and honor the rules of engagement should the bogus presidents’ puppies in the military try to take his position sanctioned by majority of the citizens of Makati by force.

    Isa pa abogado si Binay. He knows the law and he knows what he is doing. Time the rule of law is restored and upheld by all concerned Filipinos, including those who are willing to kiss the ass of the bogus president, who should be removed pronto. Kundi baka maubos na ang assets ng Pilipinas dahil sa kawalanghiyaang ginagawa, including iyong mga laman-laman ng mga pilipino that are likely to be made as the next export commodity of this brazen and illegitimate government!!!

Because this latest “escapade in power” by gloria and her “gang” is a “test” on the TRUE WILL of the people, not only of Makati but the entire country. Imagine the “abuse” their doing? Taking-out the “duly elected” leaders from office without “due process”, a process that is “CLEAN, FAIR, and JUST”.

Bacarro, “paepal” lang yun…hehehe Sinong “estupidong” opisyales ang “uupo” sa isang “military tribunal” para litisin ang isang Mayor na ROTC officer, na “gininaw at dahil maulan” ay nagsuot ng kaniyang “old unies” para gawing “jacket”? Aba’y kapag talagang ginawa nila ito…ay sus, kawawa talaga ang AFP natin, dahil “loonies” ang mga opisyales.

    mayor binay is a reservist with the rank of full col. he is a graduate of MNSA and GSC in GHQ camp aguinaldo..he can wear his uniform as he is allowed to..what ltc bacarro the AFP PIO saying is not true,,this people are always good in propaganda or in twisting the rules,,and am sure that what ltc bacarro read or said in the media did not come from the AFP guidlines on uniform..those words where drafted in malacanang epecially the office of the executive where ermita is..thats how good is ermita..they call it psywar or psyops..using ltc bacarro.ermita is one of propagandist of this administration..he is the one inventing rules and using others people office to read it..ermita has been doing this ever since he is with GMA and FG the conjugal evil..ernita is the one running the show,,even to the extent of killing and murdering people that go against them.he is the giving orders for the death squad they created togethere with Gen palparan and tolentino..and DOJ gonzales is their armour shields protecting them using DOJ`s office.now they can feel the heat..their time is now near..don`t let this guy ermita escape the wrath of filipino people..he should be arrested together with the conjugal evil couple!!!

I am not a soldier and do not actually know what kind of rules they have in the AFP, but it is common sense that Binay is not committing any crime wearing his uniform especially when he is in an apparent state of war with the puppies right outside his office pointing their guns at him!!!

    As the head of a big city in the Philippines, he is and must be allowed by law to wear his uniform since he has not actually renounced his position there. Hindi naman siguro bobo si Binay to believe these lackeys. Ano ba ang nalalaman ni Bansot na ubod naman ng bobo at puro kabulastugan lang ang ginagawa. Gosh, tanggalan mo ng power iyan na nakawin ang mga pera ng bayan, at kumpiskahin ang mga ninakaw nila, at hindi na iyan makakabayad sa mga binabayaran niyang gunggong din, pihado sira na iyan.

    Time to take out those pots and pans para gamitin sa pag-iingay! Iyong mga empleyado ng Makati, dapat sumama sa rally bukas!

    Puede bang puruhin na lang muna ang loop na ito for supporters of Mayor Binay, the Vice-Mayor and Councilors of Makati who have been voted by the people of Makati not appointees of the bogus president who should in fact be disqualified, arrested and prosecuted according to existing law? Kailangan kasi ang concentration on how we can help those wanting the return of the rule of law with this turn of event.

    I saw the picture too and didn’t know that he was an officer but the first thing that came to my mind was “he is not wearing the uniform properly.”

    Yuko is right that Binay may not be a commiting a crime as such to wear the military uniform as he did but he committed a breach of military protocol. An officer found to be breaching military protocol may either be subjected to a reprimand and depending on the superior may face disciplinary actions.

    Even if he was “disciplined” for using his reservist uniform, I still applaud him for standing up against Gloria Arroyo’s administration. Who else has the guts to do so? I wish that this political drama will end up in Mayor Binay’s favor, and ultimately in our (as citizens) favor!

  17. And for once the AFP is is right. A reservist officer may not wear his military rank (uniform) unless in a ceremony of sorts.

    Not even retired military officers (ex active duty officers)are allowed to wear their uniform unless the occasion calls for it.

    There clearly was a breach of military protocol.

    What “disturbed” me when I saw the pic yesterday was Mayor Binay wearing his officer uniform improperly too.

    I am not a soldier so I don’t know such rule, but how about the daughter of the Midget reviewing the military when she is not even a reservist or even a government employee but just the daughter of a bogus president.

    Whatever, how about the point that the AFP is not even in principle legal now with all the appointees of the bogus president heading it. Is it still a breach of protocol on the part of Binay to wear his uniform briefly and improperly just to remind his fellow soldiers that he is a soldier, too, but is a reservist now?

    Thanks for the enlightenment. Better for the soldiers there to be reminded of the rules of the military where it is still being followed to the letter.

    Re: Gloria’s daughter: I think she was wrong to do that; is she a reservist too? And even if she was a reservist, what was the occasion? If it was in her honor but if I remember rightly, she wasn’t wearing the uniform when she did it. Someone in the military should have reminded her that at best, Luli was being completely ridiculous.

    Hehehehehehehehe……… Funny thing about this administration of gloria is, they kept on telling the local executives to follow the rule of law and subject themselves to the investigation, again, hehehehehehe………. Isn’t it them who are not following the rule of law??? why not let gloria subject herself to the impeachment case filed against her??? or better yet, what is happening to the case/s of the pro-gloria, like for example nani perez??? mayor atienza of manila, joc-joc bolante, and of course who will forget the infamous garcillano and others….. before they start talking, they should look at themselves in the mirror first. They should be the one to follow the rule of law, they who killed the impeachment case in the LOWER house should really be following the rule of law. STUPID IS AS STUPID DOES as forrest gump said.

  26. Having said that, I believe that Binay’s wearing of the uniform should not be turned into a national or military issue. At worst, it is a ridiculous issue given the gravity of the situation – a stand off between Malacanang and the country’s premiere city.

    What may be thorny here is that Binay’s act might be seized upon by Malacanang to prod the AFP to drum up charges against Binay.

    In other words, Binay will have to battle on two fronts when clearly, it could have been avoided so that he could focus on the greater battle which is against Ermita and Malacanang.

    Unwittingly, Binay gave LtGeneral Eduardo Ermita (Retd) a little bat to hit him back with. Ermita could use his influence on the AFP, he being a former 3-star general to poke Binay.

    The breach of military protocol issue will then serve to waste Binay’s time particularly when by wearing his uniform, we assume he wanted to show his military affiliation, only to boomerang.

    Who knows, the tactic could have been useful had he completely, totally assumed the military persona by being properly attired.

    The military has strict and hard rules way beyond the rules of civilian life.

    Again, the administration has played its style of doing something or anything that it likes to do and daring people to disprove them or prove them wrong. Once proven wrong or rebuffed (as in this case), wala namang parusa kaya okay lang! Kahit man lang sana pingot o pitik sa tainga…

    I got information that the cha-cha movers in case there’s a system change, wants the president to be chosen by the members of the parliament without getting voted upon by the people. in short, the poeple will have no voice who we want to become the president. Stupid and crazy, most of us nga doesn’t want cha-cha at this time and now they want the president, the head of state to be chosen by the memebrs of the parliament just like the prime minister. hehehehehe… this people talaga will move heaven and earth to get what they want.

    Yeah, I agree with you Jon.. But if there’s one good thing that came out from this is that, unexpectedly, the opposition might have just found the person they have been looking for so long who could rally them to be united and really search for truth and justice in the Philippines… Personally, BINAY with his administraton skills, he really fits the job.. He has the support of the poor and the respect of the rich and the businessmen.. and the bishops support him also.. the youth?.. asks the students and graduates of the Pamantasan ng Makati and you will see how loved he is by the youths… if he can do those things for Makati, definitely he can do those also for the Philippines.

  32. They may still have the rally tomorrow at Makati with the pots and pans for dramatic ending of this saga! Nanlalansi lang si Bansot knowing that the US is in fact watching carefully with all the advisories issued in the last two or three days.

    Next time, Binay may try wearing his uniform more properly although I would rather that he does not because right now, he is a civilian, and if there is going to be a showdown, he should do it the civilian way. He should not start up like Idi Amin who took over Uganda in uniform!!!

  34. What about the warrant of arrest for the Bansot? Did she not admit that she broke the rule when she called up Garci? Why is this crook being given exemption to the rule when she has never been properly elected to the post of president?

    If Binay has to follow some military rule, this crook of a bogus president should be all means be made to follow some civilian and/or criminal rule.

    I’m for the return of the rule of law! Mayor Binay should call on his fellow lawyers to work on this by all means! What bar association is he connected with? I wonder.

    Binay’s wearing of the uniform may be out of context or a violation of some military rule that as a lawyer, he surely must know for a fact, but I have a feeling that he did so for dramatic effect just in case the military do a repeat of what they did to Panfilo Villaruel or Mayor Trinidad of Pasay. He must be aiming to neutralize the military by showing the soldiers, especially the low-ranking officers, that he was in fact one of them. In short, hindi katalo!!!

    I don’t think he had any intention to defy any military rule but just toeing the line.

    Right you are!

    Mayor Binay should not give Gloria and her generals the excuse to fire at him from another angle. The 60 day “perm” is a good one if only to allow Binay the opportunity to regroup his forces and to re-think his strategy.

    And as you said, he should not do it attired in the military in order to stave off the attack by Gloria’s dogs of war. He will need the sympathy of the good ones in the military if or when Gloria leashes her cavalry.

    Binay has fired the first salvo inflicting enough damage on Malacanang so he should proceed more cleverly now.

    I think so too – dramatic effect – but this is where the tactic could boomerang on him. That’s why I said, earlier on that the military has strict and hard rules beyond the rules that civilians are guided by.

    It would be to his detriment if by showing his military affiliation, he causes the AFP to drag him to court for a grandstanding that could have been avoided. (I can tell you that there are good soldiers out there who would have been horrified at the sight of a colonel in the reserve wearing the uniform so negligently in full view of the public and shown nation wide.)

    What bothers me really is that Malacanang might grab that little window of opportunity to pounce on Binay – it would waste his time which should be spent on battling with Ermita and Malacanang instead.

    Showdown in Makati at high noon! Illegitimate Gloria finally got something to think about and Gloria’s choo-choo express train has come to a slow down, at least temporarily. If Mayor Rambo Binay, a man of his words, with honor as a soldier on his military uniform, bloodshed can be expected. Perhaps to the extreme, but with the volatile condition everything is possible, and lets not ruled out revolution or a mini-civil war in the streets of Makati. Bogus Gloria asked for it! The fortunate grave mistake of bogus took a life of its own. Mayor Rambo Binay has now being turned every each way, and no more control of the situation if he even tries. It’s now up to the people to finish the battle, the clear passage way has been exposed, and the people’s emotion in Makati and throughout are quite to the peak, just ripen for battle with bogus Gloria.

    I guess in the battle when it become necessary, mass can be expected and acceptable, outside the house of god. But lets not forget for a minute the great cause Mayor Rambo Binay is now engaged in, fighting against a subversive administration of illegitimate Gloria. Lets be focus to the significance of the Mayor Rambo Binay critical position that bogus Gloria put him in. This one is for keep of who got the strong will to survive, and I believe on Ellen, “Justice will prevail”. And Mayor Rambo Binay is on the side of the law and his cause is just. This is no fiesta to celebrate, but I hope people be the at the side of Mayor Rambo Binay that ultimately will lead to kicking bogus Gloria out of our house. Fake Gloria has dirtied our house for six years, and now the moment, the opportune time since it presented itself, bogus Gloria’s generous gift to the people -Mayor Rambo Binay.

    Illegitimate Gloria will lose on this one!

  47. I can understand your point, Anna, but what they have now in the Philippines are no longer gentlemen of uniforms and Binay was just giving them the kind of medicine they have been trying on him and his constituents.

    Anyway, the main issue is not his wearing the uniform but the harrassment and attempt of the bogus president to consolidate even the local governments so she can have full control of the country with her husband, family, friends and cronies so she can be queen!

    My opinion, the uniforms ot the Philippines military doesn’t deserve any kind of respect, at least not for now, for they, the military prostituted the military’s honor and integrity in the name of illegitimate, bogus, fake Gloria Macapagal Arroyo. Furthermore, the commander-in-chief of the men and women in uniforms is a liar, cheat and thief, and if anybody desecrated the uniforms of the military is bogus Gloria Arroyo. Gloria used and uses the military in uniforms to do dirty work for her, cheated for her, lied for her, and killed for her. Mayor Rambo Binay is not the one who should be prosecuted for disrespecting the uniform, the commander-in-chief, Assperon, Habacon, Angelo Reyes, and others that sold their uniforms to bogus Gloria.

    Uniforms of the military are not a symbol of integrity nor honesty, many in uniforms wore it without honor only to perform Gloria’s kniving disgusting behavior. The uniforms are but a tools of bogus Gloria in order to accomplish her mission to remain in power.

    And Mayor Binay with his cause, perhaps will save the honor of the men and women in uniforms, but until the mission is accomplished, bogus Gloria is out of our House, I would considered that many in uniforms are on the wrong side of the law. Including those wearing the black robes, called themselves Supreme Court and other judges, et al.

    I’ve just been on to the site provided by John here. Have learned that Binay is a lawyer and is a graduate of the Natl Defence College of the Philippines. He should be aware of the Article of War.

    Many lawyers are not aware of military rules and regulations and perhaps, some do not even know the Articles of War but I believe Binay is.

    Anyway, I’ve just read the opinion of Alan Paguia in the Philippine Commentary, essentially saying DILG is wrong (gosh, from what Paguia says, I get the impression Puno is making “chancing” and testing the waters), so I believe Binay is on the right trek here. He should win the 1st and the 2nd round but he’s fighting The Establishment (even if it’s bogus), an entity that has a full arsenal it could use.

    But given the record (based on what I’ve read in Binay’s website), the Makati mayor ain’t the type who has never allowed himself to be bullied.

    Way to go, Mayor!

    When soldiers (as in troops) are given the order to attack, most of the time, I’m not saying, all the time, they are expected to follow orders, rightly or wrongly.

    It is up to the officers to have the moral courage to think if he can interpret the order or not, or follow it to the letter.

    The “basic goodness” of a soldier is put to a severe test when he’s under fire.
