Jocjoc rejected again

The Wisconsin District Court has dismissed the petition for habeas corpus of former Agriculture Secretary Jocelyn “Jocjoc” Bolante . Click here.

District Judge Lynn Adelman said, “It is ordered that Jocelyn Isada Bolante’s petition for a writ of habeas corpus is DISMISSED for lack of subject matter jurisdiction.”

Lawyer Harry Roque, who has submitted an amicus brief with the U.S. courts opposing Bolante’s petition for asylum said,”Bolante has run out of options. His only recourse is to tell the truth about the fertilizer scandal; it is revealing information of this kind that would subject him to true political persecution in the Philippines and strengthen his bid for assylum. Anytime he is willing to reveal the truth, I would be happy to take his deposition.”


Roque, who is in Sydney, Australia now, also said he was informed by his associate in the U.S, Atty Mary Carmen Madrid-Crost that the Chicago Immigration Court is summoning him to testify on Nov. 9, 2006.

Roque said, “I will appear and reiterate that he is not entitled to asylum.”

Last month, the Wisconsin District court also rejected Bolante’s petition for bail.

Bolante, wanted by the Philippine Senate in connection with its investigation on the diversion of P728 million for fertilizer fund for the campaign of Gloria Arroyo in 2004, was arrested on July 7, 2006 when he arrived in Los Angeles with a canceled B1B2 visa.

  4. Sabi naman ng mga kano, wala silang connivance with Jocjoc, and his case was in fact Immigration related. Matigas lang talaga ang kokote ni JocJoc dahil sa pag-asang binibigay ng mga kasabwat niya na akala pareho ng Pilipinas ang USA kahit na sabihin pang may gunggong din sa America. Buti na lang hindi impressed si Condie Rice kay Bansot, who actually insulted the US Secretary of State when she was a mere deputy. Kaya mahirap talaga ang matapobre. Hindi mo alam kung kailan tataas din ng puwesto ang iniinsulto mo.

    There’s one thing I wish would happen this year. Even for once, this Bolante should tell the truth. One can hide, or even deny, that he fertilized the pockets of those scams and fakes in govt., but God knows what really happened. No amount of covering, escaping, etc. can make wrong things right (or vice versa). In the end, Mr. Bolante, the truth will set you free.

    I believe if the Philippine Authorities want Bolante Back, they should file criminal charges against him and also ask for his extradition right away. Unlike Mr. Ang where there were outstanding charges against him, if and when Bolante’s is not qualified for asylum he could only be Deported out of the U.S., but not Extradited back to the Philippines. And knowing that the Lady by the Pasig River would never want to see Joc-Joc shadow back in the country to sing a lullaby for her, she could have him routed up to the Northern Border where Refugee Status claims may take another 5 years to be resolved and usually granted to political claimants or even Joc-Joc can claim Domestic Abuse, which is the common excuse for claimants from countries where no political turmoil can be used (E.I. South Korea, Malaysia, etc.) and it is also acceptable. And here refugee claimants are housed in Holiday Inn with government allowances and if you can afford on your own, you may get your own condo to stay while you’re claim is being processed. And of course, joc-joc lawyers knew all about these, when the said he might disappear from sight..

Kaya pagbaba ng bapor, naipit sa dock, inihagis ang dalang bag na may lamang baril at marijuana.

    Tiglabing-dalawang baril bawal bag na dala ng mga mokong, inihagis sa dagat. Sinisid ng mga pulis. Nakuha ang mga baril. Aba ang loko nang iniimbestigahan may gana pang sabihin na frame up daw sila ng mga pulis. Buti na lang iyong kasama na laking Maynila, nang hikayatin kong magtapat para matulungang bumaba ang parusa, nagtapat. Pero bilib ka sa lokong taga-Samar, ang tigas.     Kaya itong sanay na sanay gumawa ng kalokohan na si Bolate, I doubt kung may maaasahan sina Magsaysay diyan na magtapat. Ikulong na lang nila pero hindi dapat bigyan ng sarap sa loob ng kulungan gaya ng ginagawa doon sa mga mayayaman na nakakulong sa Muntinlupa. Kahit sa loob, buhay mayaman pa rin ang mga loko!

    Nagtrabaho kasi ako sa preso sa Japan as an interpreter. Ibang-iba sa nakita kong kabulastugan sa preso sa Pilipinas na breeding ground lalo sa mga hardened criminals at hindi reformatory!!! 🙁 Dito maayos at malinis ang kulungan. Mahigpit nga lang!

    Isn’t it that Sen. Magsaysay already furnished the Ombudsgirl a copy of the committee’s report and recommendation? As a layman, I don’t know what else shall make that office move its ass. Everybody knows what happened to SC’s directive to determine Comelec’s culpability, finding out that the bidding was anomalous. As Cayetano said, it’s ironic that there are no criminals behind a criminal act. Who are?

    I doubt if Canada will accept this guy after being deported from the USA, and I doubt if the Pandak will have the nerve to ask for special consideration for him knowing that it will have a bad reflection on her maliban na nga lang kung desperate at kapalan na ng mukha!

    I understand that the passport will be stamped with deportation, and even if for example he takes a plane that is stopping somewhere, with the deportation stamped on his passport, I doubt if he will be allowed to enter because he is a risk, not even when Bansot orders the Philippine embassy or consulate in the country of his destination to give him assistance. I doubt, too, that he can get a visa anywhere with a court ruling attached to his passport.

    This is in fact the immigration procedure here that I am sure is no different from the procedure elsewhere.

    This Bolante has underestimated the law in the US, and has overestimated himself thinking that he can do magic and get away with it. Like Garci, he can fool people around but not everybody and at all time. Sooner or later, the law will catch up with them. This is just the begining. In the end, they will pay dearly – and pay they must – including their evil protectors.

    Jocelyn Isada Bolante aka, Jocjoc is confused, mixed up she-him double personality which is the major reason Jocjoc is being detained. The USA authority is having difficulty in classifying Jocelyn gender, still going through an extensive personality evaluation. There is a good possibility that Jocelyn is a female dressed in male outfit. I believe the word is transvestite.

    I disagree with Lawyer Harry Roque only on this particular asylum subject. Lawyer Roque said, “Joceylyn is not entitle to asylum.” However, with Jocelyn JocJoc mental capacity, I believe Jocelyn belong in the Asylum, Mental Institution, for mentally ill, all the symptoms are all there including the P728 million, in and out of the Philippines without any records whatsoever. Only a mentally ill person can pull such stunt.

    Well, it’s only my unprofessional prognosis of Jocelyn since I haven’t the chance to give him a personal soap-drop test.

    The Ombudsman Malditas Gutierrez is still investigating the P728 million fertilizer scam filed by Frank Chavez and the Senate. The truth is that the case is not moving or gathering dust and cobwebs in the Office of the Ombudsman. Former DA Usec Jocjoc Bolante cannot be extradited without final resolution of the fertilizer scam. Documents from the COA showed that more than 100 House of Representatives members, 53 governors and 26 town mayors received between P3 million and P10 million each in fertilizer funds from the DA shortly before the May 2004 elections. What do we expect from Malditas? Is she a part of cover-ups operations?

    And I don’t think the judge is anything at all kinder to him, just curious maybe as to why the Philippine government would even be divided on this Bolate—the executive trying to be protective of this crook and wants him to stay in the US, while the Senate insists on bringing him to justice in the Philippines. Sabi siguro noong judge na Amerikano, “Just what do these Filipinos want me to do?” Hindi nga lang mapadali ang decision dahil nga may abogadong binabayaran ng mahal to make the case no simple immigration case that can simply be decided with a simple deportation but something criminal and complicated para hindi mapauwi agad, and another willing to make allowance basta magtapat lang siya!

    There is a criminal procedure being followed, but when both parties in the case can no longer present any options, eventually a decision has to be made. And the decision is a simple deportation because it is originally an immigration case.

    Sana masuya na talaga ang judge at magalit sa gunggong na kurakot na ito. Ang saya!

    Ystakei, anyone who crosses the Canadian border, can apply for refugee and has to go thru the process. Most would be applicants will just destroy their passport on the way and tell the first immigration officer that he is claiming refugee status and the process starts. The claimant will be immediately provided counsel and the identity re-established for the purpose of the claim. That is why every year there are thousands of refugee claimants even from the countries such as South Korea where people are just as free, and mostly from Africa, for the reason that all claimants are entitled to Social Assistance while their claims are being process. Until you’re claim are investigated, everyone is presumed to be telling the valid reason as to why Refugee is being claimed. So Bolante known background is irrelevant as far as Canadian Refugee Board is concerned, until they are done with their investigation and with the Line up of those ahead of Him, it might take a few years, because no government can tell, not even ours, the immigration refugee board or any court here for that matter, what to do. Their independence from Politicians is no longer an issue.

    Most likely, Bolate will be escorted by Immigration Officers up to the plane that will take him out of the US. I doubt if they will put him on a plane bound for Canada, and even if the US immigration put him on a plane through Canada, if he does not have a visa he cannot enter and he cannot get the chance to apply for refugee visa because of the restriction to Philippine passport holders especially with a deportation stamp. They check that, you know. I don’t think the Canadians would be stupid to take the risk of getting the same headaches the Americans are having right now on him. And I don’t think the Americans would be stupid to just turn Bolate to anybody with his visa revoked and his requests denied.

    Ano siya masaya? Hindi naman na siya opisyal at kahit opisyal siya, hindi naman opisyal ang punta niya sa America. The Americans know that they should treat him like how they treat other entrants to America, and violators of their Immigration Law. Walang favoritism hindi katulad sa Pilipinas!

Frankly, I have yet to hear of similar cases of sexual abuses these Americans are committing in Iraq, where the people are much cleaner in smell, in Afghanistan kasi doon masangsang ang amoy ng mga tao doon.     I mentioned in previous post, I have been to the Afghan refugee camps at the borders of Pakistan and Iran. Golly, hindi ako makahinga! Parang sibuyas na nabulok ang mga amoy lalo na kung hindi makaligo! Nakakasakit din pala ng ulo ang amoy anghit!

    I don’t know in the US, pero dito sa Japan, iyong mga preso naliligo, 3 times a week during the hot months, and twice a week lang kapag taglamig. At least, mabango ang mga pilipino at kaunti lang ang mga maanghit, pero itong mga kano, marami sa kanila mabaho ang amoy na parang kambing kapag hindi naligo.

    Iyon ding mga Afrikano ganoon din lalo na iyong mahilig kumain ng maanghang na tupa (lamb, veal). Kapag nag-i-interpret ako para sa mga Nigerian for example nagsusuot ako ng surgical mask at nagpre-pretend na may sipon kasi talagang sumusuot sa ilong ang mga amoy at nakakasakit ng ulo lalo na kung dalawang beses lang maligo sa isang linggo! Kaso ng mga loko estafa dahil magagaling magpeke ng mga credit card, etc.

    Ano ba ito? Sorry, nauwi sa anghit ang usapan! 😛

May $300 to $500K ka lang, immigrant ka agad. Ang kawawa iyon mga skilled worker na nag-aaply. Dapat may degree, marunong ng English, may work experience, may pera…tapos pagdating sa Canada walang trabaho. Ang daming professionals na may master’s degree pa ang pumasok bilang taxi driver, pizza delivery men, lab technician at janitor. Tutoo iyan. May pinsan akong mayaman na negosyante galing sa atin at mataas ang pinag-aralan. Ayun…sa warehouse lang nagtratrabaho sa Toronto at ang asawa naman isang kahera sa tindahan.

    Naniniwala ako sa sinasabi mo Artsee. If I remember it right, noong ibabalik na ng Britain ang Hongkong sa China, nag-imbita ang Canada sa mga Hongkonese na kung sino ang merong mga $500K ay welcome na maging immigrants. Ayon, hindi akalain ng Canada na mani lang sa mga Hongkonese ang halagang ganyan.Dagsaan sila doon. Nasa Toronto kaming mag-asawa a few years back at nakita namin kung gaano karaming Hongkonese doon na puro mayaman. May kadalian yata talaga ang immigration sa Canada. Kilala ko ng personal at kasama sa grupo (back in Pinas) ang isang pamangkin ni Lucio Tan (si LT ay hindi ko kilala at hindi niya ako kilala :))na dala ng yaman ay bitbit nito ang buong pamilya na nag-migrate sa Canada. Ayon, mayaman pa rin doon. Isang kaibigan ang bumisita sa kanyang pinsan sa California three years ago na dahil sa higpit ng US ngayon ay ni hindi pinagbigyan na ma-renew ang tourist visa ng kahit isang buwan man lang. (He was given a month to stay here as tourist). Sa halip na bumalik sa Pinas ay pumakabila na lang sa Canada. Kamukat-mukat ko eh, ayon at immigrant na doon. Kung ano ang nangyari, ewan ko pero ngayong taon na ito ay papunta na roon ang misis at anak. Well, at least dito sa personal na alam kong istorya ay isang mayaman at isang mahirap ay parehong nakalusot sa Canada.
    Kaya naniniwala rin ako na pwedeng lumusot si Bolante sa Canada, iyon ay kung idedeport siya balik Pinas at sa airport pa lang ay sisikwatin na ni FG at itutuloy sa Canada sa bisa ng yaman galing sa P728M fertilizer fund.

    I sincerely pity Joc-Joc. Panahon na para sa kaniya na bitiwan ang mga taong nagpahamak sa kaniya. Ngayon iniwan na siya at siya’y nag-iisa. Wala nang dahilan para protektahan pa niya ang mga tinamaan ng lintek na nagpagawa sa kaniya ng kabuktutan. Protektahan na niya ang kaniyang sarili.

    Atty. Roque should make sure that Bolante reveals who told him to use the fertilizer fund for the campaign of Gloria Arroyo. Less than that, he would not be telling the truth. He better rot in U.S. prison.

    Artsee, you are right about your statement of Canada inviting investors to come, but the immigration is open to all. Why do you think I am here and most of my friends and townmates, who immigrated here way, way back with less than $100. on our names. And when you immigrate here you take your chances that you might not avail of your training from your home country. We knew this things. But we either have to upgrade or take another training or the least option that a few may take is to go back. Just a few years ago, a sister of mine came and join us here and she can’t practice her medical training here. But that didn’t discourage her. She took advantage of North American Free Trade Agreement (NAFTA) and together with her fiancee also a medical graduate from Phil. found a chance to practice their profession in the U.S. instead.

    As for your assertion that Canada accepts criminal or implying that Canada is haven for criminal is not true at all. Any person, as I state a few comments up, who step on Canadian soil and claim refugee status, is given the same treatment as anyone. That means that they are presumed to be valid refugee claimants, until the immigration board decides otherwise.     I doubt if Canada would accept Bolate after his ordeal in the USA. Anyone who seeks refugee status in Canada as provided by its Immigration and Refugee Status Recognition Law, but not when one falls under the following categories prescribed by the Refugee Convention: (1) A written deportation order has been issued to the applicant; (2) there are reasonable grounds to suspect that the alien is likely to escape; (3) an objection has been filed for denial of recognition of refugee status; (4) the applicant has violated the conditions imposed under the provisions of the law; (5) the applicant has, with the intention of being recognized as a refugee, presented forged or altered materials or false materials, made false statements, or had persons concerned make false statements.

    No. 5 is most likely the main reason why Bolate cannot be accepted as a refugee likewise in Canada aside from the fact that Canada is signatory to the international agreement regarding kleptocracy and handling of kleptocrats.

    With the new policy of not giving haven to prospective criminals, I doubt if Canada would kindly accept Bolate after being deported from the USA.

Just because the Philippines is one country where even the court violates the rules of law, it does not mean that it will be the same in other countries where an undesirable alien in another country will be easily accepted in another especially in the case of Canada which has a close relationship with the USA.
