SC thrashed fake people’s initiative

You have already heard about it and some of you have already commented in the previous post.

The Supreme Court by a vote of 8-7, dismissed the petition by Singaw ng bayan and Union of Local Authorities of the Philippines (Ulap) for a charter change through their dubious version of People’s Initiative. Click here for the decision.

Justice Antonio Carpio penned the decision.

Chief Justice Artemio Panganiban broke the deadlock against the Malacañang-initiated People’s Initiative. The other seven justices who voted against were Consuelo Ynares-Santiago, Angelina Sandoval-Gutierrez, Antonio Carpio, Romeo Callejo Sr., Ma. Alicia Martinez, Conchita Carpio-Morales and Adolfo Azcuna.

Those who voted for the petition were Justices Reynato Puno, Leonardo Quisumbing, Renato Corona, Dante Tinga, Cancio Garcia, Minita Chico-Nazario and Presbiterio Velasco Jr.

Telling the Singaw and Ulap to respect the Constitution, the majority decision said:

“The Constitution, as the fundamental law of the land, deserves the utmost respect and obedience of all the citizens of this nation. No one can trivialize the Constitution by cavalierly amending or revising it in blatant violation of the clearly specified modes of amendment and revision laid down in the Constitution itself.

“To allow such change in the fundamental law is to set adrift the Constitution in unchartered waters, to be tossed and turned by every dominant political group of the day. If this Court allows today a cavalier change in the Constitution outside the constitutionally prescribed modes, tomorrow the new dominant political group that comes will demand its own set of changes in the same cavalier and unconstitutional fashion. A revolving-door constitution does not augur well for the rule of law in this country. ”

The majority decision also tied the fake People’s Initiative to Gloria Arroyo: The Lambino Group claims that their initiative is the “people’s voice.” However, the Lambino Group unabashedly states in ULAP Resolution No. 2006-02, in the verification of their petition with the COMELEC, that “ULAP maintains its unqualified support to the agenda of Her Excellency President Gloria Macapagal-Arroyo for constitutional reforms.”

” The Lambino Group thus admits that their “people’s” initiative is an “unqualified support to the agenda” of the incumbent President to change the Constitution. This forewarns the Court to be wary of incantations of “people’s voice” or “sovereign will” in the present initiative.”

The SC’s final words: “The Constitution, which embodies the people’s sovereign will, is the bible of this Court. This Court exists to defend and protect the Constitution. To allow this constitutionally infirm initiative, propelled by deceptively gathered signatures, to alter basic principles in the Constitution is to allow a desecration of the Constitution. To allow such alteration and desecration is to lose this Court’s raison d’etre. ”

    “Once again, albeit by the slimmest of margin, the SC chose the path of righteousness, justice and rule of law by junking the fake people’s initiative petition.

    “Chief Justice Panganiban and his magnificent seven colleagues have secured their place in history. They now belong to the pantheon of the country’s demigods of democracy.

    According to Philippine Commentary, the thrashing was due mainly to insufficient in form of the petition… a technical formality, so how on earth could 7 justices have voted in favor of the petitioners when if, from the very beginning, the petition was already legally, technically flawed?

    8-7 is a close shave. So, what happened to the 7 justices that they should vote for the Sigaw’s petition?

    From what I’ve gathered from reading here and there, the petition posed no real moral dilemma to the justices, eg, abortion, etc. and such a close call was surprising. If there was a basis for voiding the petition it should have been legalistic from the very start – insufficient in form, yet we have 7 justices voting for the petition.

    Ellen, please tell Rep. Goilez, he should lead the protest, etc. against any attempt to ignore the decision of the Supreme Court especially by his fellow Congressmen like JdV, who has been country hopping in fact promoting the ChaCha to OFWs, even luring them to support it and in exchange for their patronage, he will make sure that they would get ample representation (kuno) in the new parliament! Dito nga ang kinausap iyong mga walang alam sa mga parlia-parliament. Iyon ngang gobyerno ngayon, hindi nila maintindihan ang sistema lalo pa iyong sinasabing Parliamentary daw na iba naman sa Diet ng Hapon halimbawa. Hindi rin nila alam na marami sa kanila ang madi-discriminate ng Constitution na ginawa ni Abueva dahil karamihan ng mga pilipino dito, high school drop outs pa nga gawa nang na-recruit sila nang first year o second year high school pa lang sila para maging Japayuki dito sa Japan!!! Tawagan sa akin sa telepono at tinatanong kung ano daw iyong parliamentary form of government. Susmalosep!

    Waaaaaahhhhhhhh! Gusto kong sumigaw at tumalon. Minsan lang tayo nakabawi sa Supreme Court. Parang nanalo tayo ng championship. One point lang ang lamang.

  9. (I am re-posting here a comment I made in the previous thread because while I am basically happy that the good triumphed over evil in this instance, we have a long way to go.)

    How sad that we are forced to celebrate when a morsel of victory is bestowed upon the honest people of the Philippines when it is clear that the rule of law should be the clear cut standard by which a nation should live and be guided…

    While I accept that a little morsel of fairness and justice ‘thrown’ here and there should not be taken for granted, I do find that these little morsels of justice thrown in the way of people by powers that be are a huge blot to the dignity of a nation.

    In fact, where is dignity in that? The rule of law should be the prevailing order but the process with which it is tackled is typical “balato” culture.

    If we look at the Justices who voted for and against the PI, we can tell that even up to the high court the effect of partisanship is still the norm. Before the decision was handed down, there were already a lot a speculations of who will vote for or against. We already knew that the vote will not be a unanimous or a clear majority but by the slimmest of margin. I believe that if another major issue is be resolved which involves the fight between the administration groups and the opposition’s, the same Justices will be making the same decisions. So the reality are these justices are not making decision based on the merit of the case, but to whose side they are beholden. But I reserve my firm conclusion for more future decisions and the pattern of their votes..

The next battle ground will be in 2007 election. The end of corrupt and inept Arroyo regime is expected soon. ROPE for Gloria!

    SC: still manages by the skin of their teeth to cling to their raison d’être

    AFP: definitely altering and desecrating the Constitutional rights of Lim and company and their solemn duty to be the ultimate protector of the Filipino people from the enemies of the State.

    COMELEC: the worst desecrator of the Constitutional right of each and every Filipino – one citizen, one vote!

    MALACANANG: their squatters today are gross violators and abusers of power that was not theirs in the first place by Constitutional right.

    HONEST PEOPLE OF THE PHILIPPINES: the whipping dogs of these lucid thinking desecrators of the Constitution.

We should then take this so-called victory as a matter of fact; after all, the rule of law should govern us. Great comments.

    Also, it seems that there is a rift between “The Firm” (Villaraza law office) and FG. Maybe that’s why lately Tony Carpio has been voting “against” Gloria…

The peoples’ court will decide their fate under the new regime. Supreme Court Chief Justice Artemio Panganiban has redeemed himself or restored his reputation after his vital role in the “illegal” swearing-in of then Vice-President Gloria Arroyo as president of the republic in a successful Edsa Dos coup d’etat. Chief Justice Panganiban has sided with the people.

    This is the story I just gathered…When Gloria went to meet with the League of Mayors and Governors in Manila Hotel earlier today, her intention was to announce that the People’s Initiative (PI) won in the Supreme Court by a vote of 8 to 7. It was apparently Justice Reynato Puno who was suppose to write the decision. HOWEVER, a classmate of Justice Puno by name of Justice Consuelo Ynares-Santiago, voted AGAINST the PI; a move that was not expected at all. Malacañan was so sure that they would win!

    Justice Ynares-Santiago was the swing vote. She even was quoted to have said that she never prayed so much in her life! As a result of what we now know (8 to 7, in favor of JUNKING THE PI), the one who wrote the decision instead was Justice Carpio.

    Our gratitude should be to JUSTICE CONSUELO YNARES-SANTIAGO! Hers was a vote of conscience. Her vote made all the difference in this batlle. Although, the rule of law should govern, it is a sad reality that we rejoice when something appropriate happens. We have reached this point when doing and/or saying the right thing under this EVIL REGIME OF GLORIA is a rare commodity. JUSTICE CONSUELO YNARES-SANTIAGO and the other 7 JUSTICES are the FEW GOOD MEN IN THE JUDICIARY! It is TOUGH when the DEVILS OF MALACAÑAN surround you; that is an AGONY we can only imagine.

    House Majority Leader Prospero C. Nograles and his CON-ASS allies will try their lost cause when Congress resumes session on November 6. Constituent assembly option needs the senate vote/help to revise the constitution. Time element is not on their side. Majority of the senators want to convene elected delegates to Constitutional Convention after the end of Arroyo regime. Government funds and resources are used in Singaw ng Bayan-ULAP fake people’s initiative. Most likely funds from Pagcor and local governments are utilized in the propaganda campaign. Lawyer Raul Lambino is a known surrogate of Speaker Jose De Venecia. Both hail from Pangasian province. I hope Metro Dagupan City residents will dump traditional politician Jose De Venecia in the next election. NOG-Nog-rales huwag ka ng humirit saying lang ang oras mo. Tapos na ang mga maliligayang araw ninyo. Riena Gloria Pandaka should be planning her “honorable exit” or end up like Romanian dictator Nicolae Ceausescu in a bloody revolution.

    The pinoy SC is aping the US SC in rendering ‘close shave’ decision no matter how glaringly assinine the issues are. The justices are playing the numbers game, rather than an intellectual exercise of common sense… all for the benefit of d’glue. In other words, the supreme court is playing moromoro, and with reason of course. If there is any rhyme with the decision, it is the reason behind it.

    chabeli ,give credit to where credit is due. or better still don’t give anyone credit in the result of the voting in the SC. in fact, none of the justices of the supreme court wanted any credit for the outcome of the recently decided case lambino, et al vs. comelec. they merely deliberated and voted on the issues based on their own perception and understanding of the legal and constitutional precepts involved in that case. but most importantly i would like to believe that each of the justices voted in a way God allowed them “to see HIS light”. to divide them into two groups and put a label on each group as good or evil is the greater evil because it would only damage the institution.

    the chief justice is always the last to cast a vote on any issues deliberated upon by the SC. so how can an associate justice’s vote be the one to tilt the balance of the result. the SC is a collegial body. it is not like a forum group or blog group merely drawn by common interests, political biases and prejudices and whose delight only rests on their ability to scratch each other’s back.

    we mouthed democracy too often but we always refuse to accept the immutable fact that its own survival hinges on divergent opinions. no one can claim the monopoly of truth. the SC has spoken and the citizens should bow and respect the decision. it would raise the level of our political discourses and disquisitions if we try to dissect and dwell on the finer legal and constitutional points involved in that case rather than nitpick on the person of one justice or another because he or she hold opinion diametrically opposed to ours.

    don’t expect uniformity of minds in the SC because it that happens this country is doomed forever.

    Hindi kaya dapat kasuhan itong mga promotor ng PI. Sa decision ng SC, it said that PI was “propelled by deceptively gathered signatures to alter the basic principles in the constitution….”. Clearly there was an offense. So, ganoon na lang. Even if they lost, they were able to do away with it without retributions.

    The voice of truth and justice reverberated throughout the country today. The spirit of fairness flew its highest and the fire of patriotism rekindled with conscience providing the spark, defeating the morally-bankrupt regime’s manipulative, deceptive, opportunistic and sinister scheme to silence all forms of dissent while marauders shamelessly perpetuate themselves in power as they plunder the nation’s wealth without end.

    Indeed, God was there to make sure Satan and his mistress would not prevail. While the ensuing jubilation is rightfully deserved, it is guarded with much caution, we cannot fall into a false sense of security that the Beast called Chacha has been deep-sixed. Like any zombie which rises from its grave upon the workings of the devils, the legions would continue to haunt us. I bet the final score has not been settled yet as Chacha may be resurrected into another bestial form, this time as ConAss with Joe DeVilnecia breathing life into his pet monster.

    I wish to thank all those who prayed with us yesterday and the days before that even if the other side was also, er, “preying”.

    The narrow margin vote was expected. That would give these Malacanang crooks the chance to file motion for reconsideration. Anything can still happen. Let’s not be too sure about that. What if the SC grants the motion for reconsideration? We’re under this evil regime when even the most impossible things do happen.

    Plan XYZ Scenario: 8-7 is a close call. Chief Justice Panganiban broke tie at 7-7. CJ Panganiban retires on December 6, 2006. Mrs. Gloria Arroyo will appoint new justice before the year ends. Motion for reconsideration will be filed by Lambino group ASAP and will be decided by January 2007. The new associate justice possibly a die hard Gloria Arroyo supporter may swing in favor of Sigaw ng Bayan petition for reconsideration (8-7 for Sigaw). Reina Gloria Encantada declares victory at SC rematch. Everything is possible under the evil empire. What Gloria wants she gets by hook or by crook. She can offer heaven and hell to justices. ONE SWING VOTE is her final goal to remain in power beyond 2010.

    Puno led the pro-PIG (Peoples Initiative ni Glue). Not surprising really. According to reports he and Quisumbing were “serenaded” by the Glue during their dinner party at Malacanang. Puno was promised the chair of chief justice, and a juicy position in the Glue’s government after he takes an early retirement and thereafter, Quisumbing will replace him as the chief. Lutong-luto na pala ang plano, at hindi kasama sa plano ang kinabukasan ng bansa, mabuti na lang at nagkaroon ng konsiyensiya si Panganiban. Dapat lang, makabawi man lang siya ng kaunting respeto sa mga tao sa naging papel niya sa ginawa kay Erap. At least in the twilight and in his last days as chief justice gumawa siya ng isang bagay na maipagmamalaki at ikakarangal niya at ang kaniyang pamilya.
    But how long will be the people’s euphoria with this victory? After Panganiban who will retire soon, Puno as the chief and an obvious lapdog as the next appointee, what will happen if the court grants them a motion for reconsideration? Just thinking about it, nakakakilabot na, dahil nakakakilabot talaga ang mag-asawang , hindi ko na alam kung ano ang itatawag ko sa kanila

And how prophetic ang tawag mo kasi, iyong legion na nagmalaking they were many, lumabas sa katawan ng pinasok nilang taong matagal na nilang pinerhuwisyo, at pumasok sa isang kulumpong na baboy na nagtatatalon patungong dagat.     Militant workers greet SC junking of chacha but insist fight not yet over

    “The workers and poor were prepared to declare a day of mourning in case the
    people’s initiative was allowed but with the Supreme Court’s junking, we are
    pleased to have a halloween party instead. It is good to have chacha buried
    before ‘undas,'” Gerry Rivera, vice-chairman of Partido ng Manggagawa
    declared.

    While PM thanked the so-called brave men and women of the Supreme Court, the
    group said that the real heroes in the anti-chacha fight were the people who
    have consistently stood against revising the constitution for dubious
    reasons such as extending GMA’s illegitimate reign and extending privileges
    for foreign capital.

    “The real bulwark of democracy are the people and their organizations who
    maintained their anti-chacha stance. The Supreme Court after all is an
    institution that can be influenced one way or the other, as candidly
    confirmed by no less than the Chief Justice. Between the favors being
    offered by the agents of Malacanang and the fear of an angry populace, we
    believe the Supreme Court chose the path less travelled by,” Rivera
    elaborated.

    Despite the junking of the people’s initiative, the militant workers group
    reminded the people that the fight is not over. “The PIG or people’s
    initiative of Gloria is only half-dead. Sigaw and ULAP have already
    announced that they file a motion for reconsideration. The minions of
    Malacanang will do more than just pursue all the legal avenues at their
    disposal. They will no doubt even go for illegal and illegitimate ways to
    achieve chacha,” explained Rivera.

    He added, “And they still have con-ass as plan B, however dimmer the
    possibility and dirtier the manuevers necessary to push for it.”

    Thus PM is gearing to continue the anti-chacha campaign in reaction to the
    expected maneuvers of Malacanang and its allied groups. “The fight is not
    yet over until the fat PIG is slain together with its con-ass cousin.
    Education campaigns and mass actions by the workers and the poor are slated
    in the coming days,” Rivera announced.

    Palace orders eradication of ‘ghost employees’ in gov’t

    10/26/2006

    Malacañang yesterday ordered the eradication of “ghost employees” in the entire government bureaucracy, including government-owned and -controlled corporations (GOCCs).

    President Arroyo issued a memorandum instructing Department of Budget and Management (DBM) Secretary Rolando Andaya to “review the table of organization, plantilla positions and conduct an audit of all personnel of all departments and agencies, including government- owned and -controlled corporations with the end in view of ferreting out ghost employees in their organizations, if any.”

    Department of Interior and Local Government (DILG) Secretary Ronaldo Puno was instructed by the Palace to ensure that the local government units (LGUs) comply with all laws, rules and regulations in the hiring of their employees, including the prohibition against the hiring of ghost employees.

    Executive Secretary Eduardo Ermita said both Andaya and Puno were given until Dec. 30 to submit a comprehensive report on their findings which they are to submit to the President.

    Ermita said once recommendations were made, they will ensure that those found guilty will be properly punished through filing of administrative charges.

    Ermita, however, emphasized the memorandum was not inspired by the administrative case of Makati City Mayor Jejomar Binay.

    “Not necessarily, because we really want to get rid of ghost employees in the bureaucracy, if there is any,” Ermita said.

    Ermita said the memorandum he issued was consistent with the “strategic review and ongoing rationalization of government agencies under Executive Order 366 (series of 2004) and pursuant to the government’s drive against graft and corrupt practices acts.”

    The Palace approved the preventive suspension of Binay for allegedly keeping ghost employees in the city government.

    The suspension order delivered by DILG, however, failed to push through after Binay succeeded in filing a motion before the Court of Appeals which granted the petition and issued a 60-day temporary restraining order.

    Press Secretary Ignacio Bunye said they ignored the statement of Binay that the Palace, through Ermita, committed a big mistake in approving his preventive suspension.

    In a chance interview, Bunye said they will not mind Binay’s statement anymore because his case is already under the jurisdiction of the court.

    The Palace spokesman, however, also urged Binay’s camp to refrain from issuing remarks related to his case.

    Bunye said they will let the DILG to make a proper reply to Binay’s claim.

    “We want to leave this thing under the DILG and to the lawyers tasked to answer the decision. We are respecting our courts as independent branches of government, so I hope the opposition would also cease from making any more related comments,” Bunye said.

    In short, walang nangyari, and I doubt if the Bansot pursued it kasi sila-sila mismo involved sa iba’t ibang klase ng mga racket mula noon. Ang masama pa hindi mahuli kahit na may magsumbong kasi kasabwat iyong mga dapat na humuli sa mga nanloloko.

    Since the Supreme Court decision to junk the PI was won by a mere one vote, we can expect more anxiety and tensions to arise in the coming weeks..when Chief Justice Panganiban retires in December and the Gloria-JDV-Lambino combine file for reconsideration. The country is headed for more divisiveness and trouble.

    All battle paths again lead to the doors of the Supreme Court. This administration because of its arrogance and foolhardiness is running the Highest Court to the ground like no other president has ever done. Bastusan na talaga. Simply no more respect for the Magistrates’ decisions. Desperation leading to madness.

    Malacanang has completely been enveloped by a force so dark and evil, it would take a thousand Father Merrins to exorcise the demons lurking inside the Palace walls. And the Chief Resident’s gurgling raspy voice is sounding more and more like that of the Chief of the Legions from Hell.

But I have yet to see one where good loses to evil in the end, unless of course in those that intend to have a sequel or prequel.

    Be that as it may, it’s still an unsettling that such an event may actually occur and if it so happens, it may well be the nightmare of all nightmares. I have no doubts, this Regime of Evil and Terror is capable of doing such.

    To remind everyone that the fight is far from over, I have a suggestion to Pinoys who may be attending a Halloween parties next week.

    Why not organize a party where all masks have one familiar feature, a big mole in the cheek! That way we remind everybody that the Evil Mistress will continue to haunt us unless we get rid of her. We started this in last year’s Halloween and everyone had a blast. The more creative ones can also dress up in costumes and masks of the Ermita-nyo, a very old man in military shreds, Joe Devilnecia – the puppet with big eyebags, Assperon – the general with broken eggs and mud in his face and uniform, Bunye in Pinocchio nose and clothes carrying his 2 disks, etc.

    Wouldn’t that be a good bash?

    A critical analysis of the SC’s decision as penned by Justice Carpio and of the dissenting opinion of Justice Puno glaringly shows the far superior intellect of Justice Carpio vis-a- vis that of Justice Puno whose statements and logic are not only weak but incoherent and nothing but platitudes and apple-pie statements. Justice Carpio was not the class valedictorian of the UP College of Law for nothing. I hope he continues to show independence of mind and to uphold the Constitution as opposed to undermining it, as when he made that infamous “fax” to the SC in an effort, unconstitutionally, to help install gma to the presidency. I only hope he finally came to the realization–once and forever–that his foremost loyalty is to the Constitution and to the Filipino people, and his decision on the PI is only the beginning of making amends for that outrageous faux pas on the “fax.”

    For those who have been waylaid by the hocus-pocus of the Palace or for those who ingratiate themselves to the powers that be ( I prefer the phrase “powers-that-are”), it’s never too late. Redemption is possible if one is guided by Truth, Justice and (true) Love for the country, and not blinded by power and false honor and glory.
