Midnight Madness

At this very moment, a few minutes past midnight, the majority of members of the House of Representatives are trying to railroad the convening of the Constituent Assembly without the participation of the Senate.

I just came from the Batasan where 161 congressmen voted for the deletion of the sentence, “The adoption of resolutions proposing amendments to or revision of the Constiution shall follow the procedure for the enactment of bills.” in Section 105 of their own Rules.

There were only 25 opposition congressmen who voted “No.” (Click here for news report)

Having succeeded in laying down the groundwork for violating the Constitution and taking advantage of their numbers, the majority congressmen want to go all the way and convene Con-Ass so they can change the form of government from presidential to parliamentary while the rest of the country are asleep.

After they have succeeded in changing the rules through a violation of their rules, the majority became bolder in violating more rules even in the simple matter of “point of order” , collective and private privilege, etc. etc.and other House rules.

When Minority floor leaders Francis Escudero and Rep. TG Guingona tried to give them a dose of their own medicine by using their method in revising Sec. 105, they were outvoted.It was a classic demonstration of “tyranny of the majority.”

Rep. Alan Peter Cayetano called the blatant violation of rules and the Constitution as “Midnight Madness”.

  3. As I watched how the few opposition try to prevent a dictatorship from being born, I wonder what would happen to our country? The soldiers who pledged their loyalty to flag and country should protect the constitution and the people. We are headed for a civil war not a coup. These hoodlums in the majority should be arrested, no trial anymore, let’s just hang them.

Con artist Jose De Venecia and his Dagupan Express-CON+ASS is like a run-away train destines to be destroyed at stop point. Silly CON+ASS is tainted with fraud, deceit and conflict of interest. These shameless lawmakers cannot ram the fake Arroyo-DeVenecia constitution against the will of the Filipino people without a civil unrest. The battleground is now shifted to streets and freedom parks. People power uprising, revolution or civil disobedience is the answer to JDV Dagupan Con Express.

    He could not cite any House rule. Tinulungan pa siya ni Villafurte maghanap ng House rule to cite. Walang makita. Umupo na lang.T talaga. Dinadaan sa kapal ng mukha. It’s good that he is now with the administration. The deserve each other.

It’s still the Supreme Court who would have the last say.

    It’s really a waste of time and taxpayers money. The Lower House version of Constituent Assembly to revise the constitution without the Senate participation is a lost cause. It’s unlawful and unconstitutional. They are going in circle; the Supreme Court has the final say.

    Ellen, I want to cry for our country, and at the same time laugh at the harebrained Jerome Paras and his kind. They are doing everything without thinking, but it’s no surprise to us anymore with Glueria at the helm of all this. Bayad na ang mga Tangnang ‘yan!

    hi ellen,
    i’ve been a fan of this blog for as long as i’ve been out of the country. its a way for me to keep abreast of the duping we as a people have been getting from our government.
    i know there are a lot of names involved but shouldnt we publish the names of the reps who’ve ripped us off and voted for this move? and i dont mean in this blog alone. its a move that may inform each of these reps constituents of the moral imperative to take them out of office come may.

    while the media has had its front slowly decimated by the onslaught of a bloody purge, it must continue to make people understand that it can no longer just print, read, and discuss. what must be involved is legitimate action that has real potential for actual consequences. i use the word legitimate only because it is the most prudent way for an already fearful public – middle class, in fact – to rise above the situation and act. kahit ako kung pwede lang rebolusyon para lang mabitay yung mga nagsasamantala ng poder, kaya lang this may not work because the sector that can provide the critical mass to resist the presnt government’s actions will not move beyond what it sees as “safe.” may takot din sila, and its all understandable.

    from what i’ve read so far, there’s a railroad of the process which takes advantage of the supreme court’s adjournment this december. perhaps, coaxing people out to vigil in the SC, to implore the magistrates to take an extraordinary show of fortitude and keep its functions open or ready in this critical period, may prove to be productive. it is a legitimate course of action. because it is legitimate, more people may tend to act on their already well-documented moral stance. it will make the representatives hesitate, and may delay the process long enough for the people to exercise their mandate in may.

    any other action must either be overwhelmingly brutal or unforgiving, in order to succeed. i am a fan of such a thought. but i doubt it can ever be so. it will tend to fracture an already divided opposition. if there must be military action, let it be the coup de grace.

    A representative form of government like the Republic of the Philippines would only work with an informed and involved citizenry. The congressmen are supposed to be representatives. As such they have the moral obligation to solicit the opinion of their constituents and act accordingly. It seems the citizenry is asleep, or it doesn’t care. Polls and surveys are meaningless.     If we follow house rules and the constitution, JDV and his congressmen cannot do what they are trying to do. But they are doing it anyway because they have the numbers – so they are saying to hell with the people, they are listening to and are being misled by the opposition.

    Actually, the opposition are not doing anything to stop the majority from ramming down the throat of the people whatever Gloria wants. They have accepted that they are estopped by the numbers of the administration in congress to do anything and they are pointing this out to us. I don’t know about this, because the people are counting on them and when a completely amended constitution passes the halls of the House of Representatives, I for one, will blame them, if only because they are there and could have done something to stop it.

    This is no longer time for speeches but for ACTIONS. They should not let the militants and radicals to do all the work. Gloria will do all she can to stop the 2007 elections and the question is what are they going to do about it. THIS NOW IS FOR ALL THE MARBLES.

    All of us Ellen bloggers had said the worst description of these people in power but I think there is no word that can really describe their scheming, oppressive, tyrannical and evil ways. The only solution may really have to be a revolution! The people have had enough and if the tyranny of numbers in the house can delete laws from our sacred constitution, the 85 million ( maybe 75 % of this populace- because the rest of the 25% are in the same camp as the trapos who are just content with their wordly possessions that they just close their eyes to what is happening in the country) can have the tyranny of numbers too to simply overthrow the trapos. SOBRA NA!

    Fiji just have had it too. The military defenders, gising na kayo! There are only a few of the ranking officers who are the “fattened” officers,anyway. Why rely on them to do something? I am pretty sure, there are more of you who love our country. MOVE BEFORE IT IS TOO LATE! Tengang daga is worst than Smith. Smith only raped Nicole once but tengang daga is raping the country again and again!!!!!

    The Philippine nation rebelled against foreign invaders and colonizers only to find themselves becoming a colony of a handful of their own people meaning Gloria and Congress.

    This situation cannot go on. The situation whereby the nation allows 161 people + 1 (Gloria) to determine their lives is unacceptable by any standards of a poeple with a minimum of self-respect. The Filipino people today must level the playing field, otherwise, this country will go down in infamy as a nation of sheep with no will nor regard for what is right or wrong.

    If this nation allows these 161 thieves to get away with murdering the Constitution again (the toppling of Erap being the first), the Filipinos will be hard put to earn the respect of the international community.

    The Filipino people must show a little bit of will, a bit of teeth, a bit of self respect – they must act and show their indignation in action and no longer in words because to do less would make them accomplices in their own doom.

    People must go out and fight! If it results in a revolution, so be it!

  31. What more can I say, Anna? You said it all. What more can I say but to encourage Filipinos to rise up in arms now if they want to be free, at least the kind of freedom there was when we were growing up in the Philippines, when Filipinos held the Constitution as sacred and not something that they can easily discard at the wiles and whims of these crooks the way they ignore the provisions of the 1987 Constitution that replaced the one made during the Marcos rule that in turn replaced the much easier to understand Constitution made under the tutelage of Uncle Sam.

    We have a similar dilemma in Japan at present as a matter of fact. A lot many of us in fact are opposing the plan to revise the pacifist Constitution of Japan especially the part that bans Japan to re-arm. There is a strong movement to remove that clause because of the North Korean threat and pressure from the US for Japan to participate actively in its wars especially under a president whose family’s business is selling arms to country’s that actually do not need them because it is not necessary, which we have found out to be true. Japan is what it is at the moment because people here are more concentrated now in improving their lots without the use of force, and reason I guess why God, even when majority of the people do not profess to believe in a god, has blessed them and the Japanese reap the seeds of their labors.

    What more can I say, Anna, but agree with those who believe that now is the time for Filipinos to RISE UP IN ARMS versus these oppressors who want to rule the Philippines the way they do in Darfur or any of the countries now in chaos and war where those opposing their oppressive governments are vanished to kingdom come.

    Your description of this present republic is aptly said, “Bastusan Republic.” What more can I add? Wala na, nasaid na. Still, let me add these phrases from a hymn we sing in church: “Fear not, though the enemy deride; courage for the Lord is on our side. We will heed not what the wicked may say but the Lord alone we will obey. We’ll not fear the wicked nor give heed to what they say, but the Lord, our Heavenly Father, him alone we will obey!     As the newly appointed in charge of US presence in Iraq says, America has made a bad performance in Iraq. So, why should Filipinos expect better performance (meddling) in the Philippines?

    Huwag nang maghintay ang mga pilipino. Baka mamuti ang mata nila ng kahihintay kay Kanuto! Ngayon pang walang pera ang mga kano! The US has already spent $347,741,212,293 for the Iraqi war. It cannot afford to spend on other countries brewing trouble around the world with its own domestic problems filing up due to some natural calamities likewise that are in fact signs of the times. Golly, hanggang ba naman sa pagrerebolusyon, parasite pa rin ba ang dating ng mga pilipino?! Por dies, por singko naman!

    i’m glad you all are pretty piqued at the recent events. but read all the comments and just about everyone is waiting for someone else to solve the problem for all of us!

    tulong tulong tayo makapaghanap ng paraan na pwede na nating gawin. i understand the need to convince other people to act, and many here seem hopeful that the military act and now. but what about us? what do we do? is there anything, anything at all we can do that is within our individual power? something we can do while we wait for that time which may not come if we continue to just talk about it?

    so maybe those here who may hold influence over a group or a particular resource, maybe you should open up here and tell us readers where to go? is there a mobilization in japan, for example, where we can convince governments to censure, if not withdraw support over our government? or in the US? is there a symposium or conference that any one here can attend to show support for our opposition? does anyone have a campaign plan we can all jump on to show solidarity against the manipulative sectors of our government?

    should we perhaps, encourage and campaign for everyone to turn our backs on these politicos? it may sound simple but think about it? whenever we see any of these people, anywhere – the market, in universities, in offices – we should just stand still for a second, and turn our backs and make sure everyone notices. pero di kelangan mag skandalo. imagine this, at church where “she” attends mass. just continue hearing mass but turn your back from wherever she is at. if everyone does it, we will succeed in getting the message across that we do not like these people and what they are doing. in a school speech, this could be done too. use your imagination.

    it may sound silly at first, but think about it. kung paunti-unti napapadama natin sa tao na may lumalaban, dadami at dadami yan. lalo na kung ang paraan ay di gaano makakagulo sa buhay nila. then, maybe people who can actually do the greatest damage against this abuse of power will find the mettle to stand up and actually do something.

    Uncle Sam is at the moment is busy dealing with another guy named Hugo Chavez, which is trying to embarass the U.S. president which ever way. And Venezuela has a lot of OIL. The Philippines right now, as far as uncle Sam is concerned is a Status Quo, same old, same old, let it settle by itself. Not worth its precious time, and an embarassing to deal with an illegitimate Head of State, who thinks, she knows more than the Rest of the others Head of States.     thank god. i do hope i’m wrong. from your previous posts, i’m quite confident in fact that you’ve done or are doing more than your share. as well, perhaps, as all the others here. but that’s exactly my point – sayang yung venue na ito if, apart from all your other discreet moves, there’s no information for transient readers like me to seek a productive method of joining up and doing something. imagine all the other readers who may want to act but are not coaxedinto doing so because of a lack of venue.

    when you act, we may all be grateful. but till then, we have not been asked to help. if this is to be good for our people, let the people be a part of it.

    Amending the constitution if this will benefit the people is not wrong. What is wrong is the manner in which the amendment is being made. Laws are being twisted to suit the ones who benefit most from the amendment; and that’s no other than JDV and all Malacanang crooks. I have long maintained my position that no kind of argument or bla-bla could change these crooks’ minds. Their minds are set to remain in power for as long as they can. The only solution to this is an immediate People Power or Revolution!

I have no idea how it started, but, it crossed my mind that what happened was some kind of a message relayed to him as a warning and guide to transform himself from a tradpol to real and genuine Filipino leader who has nothing but for the good and welfare of the country and its people.     Rep. Constantino Jaraula has introduced a resolution to convene a Con-Ass without the Senate to amend the Constitution. The minority was trying to derail the _GMA-JDV Express train by citing the very rules they crafted.

    Rep. Mario Aguja is being interviewed on ANC right now and he said they parted at almost 5 a.m. and they will resume the debate at 4 p.m. today.

    At least give the minority credit for fighting it out. Despite their lack of numbers, their resolve remains firm. They are not making it easy for Arroyo’s minions to et away with it.

    Aguja is appealing to the public to pressure their representatives to being back decency and respect for the law in the House.

    One suggestion is to bombard these Tongressmen with emails. Problema lang is that they always return the mail. So, what I used to do is have a cousin get my message via her email to them, and deliver it to the Tongressman in question directly by her husband. That’s how I got known by some Tongressmen there and look for me when they visit Japan.

    OK, OK….. guys, If the great YODA and his cohorts wants to ram into our throat their Cha-cha, may answer is, why not “WE” the populace boycott’s next year’s election, whether its a plebescite to change the consitution or the “mid-term” elections”??? that way we are sending a strong signal to these TONGressmen and especially to YODA that that are not in the best position to tell/impose on the people’s will.

    IF the my suggestion is not accepted, let us push for the mid-term election, BUT……. please!!!!!! we should put “NOTA” in the ballots. MEaning “NONE OF THE ABOVE”, again that way we are showing the so called “HONORABLE????”TONGressmen, enough is enough!!!!

    This actually has been prompted by the numerous cases of insurance scams perpetrated in the Philippines in connivance with some Filipino mamamataytao. Until then, Japanese, who commit crimes there unless they are properly established with incriminating evidences, could not be prosecuted in Japan for crimes committed abroad because of the problem of legal jurisdiction.

    This will help reduce the number of Japanese committing crimes in the Philippines especially because of the corruption there even involving corrupt Philippine policemen, etc.

    “This is one of those rare instances where words are no longer enough to describe the disgust over the latest — and by far the most brazen — attempt to ram Charter change down the people’s collective throats,” he said.

    Lacson said pro-Malacañang lawmakers threw away all pretensions about being an independent co-equal branch of government during the session from Tuesday evening to early Wednesday.

    “Like thieves in the night, they pounced upon the unsuspecting citizenry just as it was fast asleep,” he said.

    Lacson said Malacañang and its allies must wake up to the reality of a defeat in the May 2007 elections as he insisted that a constituent assembly will require both chambers of Congress to separately issue resolutions for a joint session.

    The administration and its allies in the House refute this view, claiming all they need are a three-fourths majority of all members of Congress and not both chambers voting separately.

    We should be preparing ourselves to understand and publish the flaws of their proposed amendments to the constitution para may ibuga tayo pag-dating ng deliberations. The opposition should also do their homework. They are not short in terms of the fight, i agree, but still the number rules. In the end, they go home to lick their wounds. The opposition should realize that they are up against people who doesn’t respect the rules, so why respect them. Remember, respect is earned not demanded or given away. Find a way to defeat them at their own game.

    Otherwise, it’s time for the residents of the Cordilleras and Banahaw to come down and liberate us. A sad state of affairs..

  112. There’s another comic situation last night. Francis Escudero moved for a roll call on motion on hand as what happened in the amendment of Section 105. It was put to a vote through “Aye” (Yes) and “Nay” (No).

    These congressmen, being used to saying “Aye” without even thinking said “Aye”, which means Escudero’s motion was carried out. So dapat roll call.

    Then they realized they voted wrongly. Binawi nila.

    It was a comedy.

    Despite e-VAT haul, ’07 debts to hit $6.7B

    Despite what the Arroyo administration has been claiming as an improvement in the country’s fiscal situation, foreign borrowings next year will still reach a total of $6.67 billion from foreign and local sources, the Bureau of Treasury said yesterday.

    While foreign lendings will drop to $2.47 billion next year from $2.85 billion this year, $4.2 billion will be borrowed from the domestic market, according to National Treasurer Omar Cruz.

    The Treasury said the debt program, however, would be far less than that of this year.

    Of the planned $2.466 billion borrowings in 2007, $1.466 billion will be in official development assistance loans and $1 billion from commercial sources.

    Cruz announced that the reduced borrowings will cut the debt load of the government next year to just 62 percent of the gross domestic product from 68 percent of GDP this year.

    The government borrowed abroad a total of $2.85 billion this year.

    “We said earlier we will rely less on foreign borrowings and we have done that. Next year our borrowings will come down even more,” he said.

    Cruz said local borrowings are targeted at P208 billion or $4.2 billion in the domestic market in line with the previously announced 67 to 33-percent borrowing mix program in 2007.

    Domestic borrowing next year will be nearly 16 percent lower compared to P247 billion in borrowing in 2006.

    The government still relies heavily on borrowings to fund its budget deficit, despite the introduction of an expanded value-added tax (e-VAT) and the sin tax last year. The fiscal deficit is expected to reach P63 billion in 2007 or 0.9 percent of projected GDP.

    Last month, the government narrowed its 2006 budget deficit goal by up to 16 percent to P105 billion to P115 billion, or 1.7 percent to 1.9 percent of GDP against a target deficit of P125 billion, or 2.1 percent of GDP.

    After the first 10 months, the budget was only P56.3 billion in the red, less than half the figure a year ago, largely due to a drastic cut in spendings after Congress failed to pass the budget for the year.

    Last year’s outstanding government debt totaled P3.888 trillion, which required an outlay equivalent to 12.6 percent of GDP or P678 billion for debt service.

    This year’s debt service should improve a bit to just 12 percent of GDP or P721.7 billion and further to only 9.3 percent of GDP next year or P622 billion.

    Data from the Bureau of Treasury show outstanding debt totals P3.998 trillion at the end of June this year, a 2.8-percent jump from year ago total of P3.891 trillion.

    Of the amount, some P2.035 trillion was obtained from local creditors and the equivalent of P1.837 trillion were obtained from foreign lenders.

    The government’s foreign borrowings already represent a 4.8 percent contraction from a year ago considering it obtained foreign loans totaling P1.856 trillion in the first half last year.

    The government’s foreign borrowing plan for next year was seen to generate positive impressions on the Philippines and its economic prospects over the medium term.

    With macroeconomic conditions stabilizing and the external environment relatively calm, the government’s next hurdle, the departing team from the International Monetary Fund (IMF) said earlier, was to transform the gains into actual investments.

    The IMF has expressed optimism the country’s strong fundamentals should hold together for the short term at least.
