Nicole lawyer files contempt charges; US resumes Balikatan

Evalyn Ursua filed contempt charges against those involved in spiriting Daniel Smith out of Makati City Jail and bringing him to the US Embassy.

FOR “utter disregard and disrespect” of the court, the lawyers of Subic rape victim “Nicole” yesterday asked the Court of Appeals to cite for indirect contempt several Cabinet officials who facilitated the transfer of convicted rapist US Lance Cpl. Daniel Smith to the US Embassy shortly before midnight Friday.

Evalyn Ursua, a private counsel of Nicole, also asked the CA Special 16th Division to immediately issue a warrant of arrest against Smith, saying his transfer to the custody of the US Embassy was “an assisted escape.”

“It is thus clear why respondents should be cited in indirect contempt. Failing in their prayer to ask the CA to issue a temporary restraining order, they unilaterally and in utter disregard and disrespect for the CA, took the law into their own hands and forcibly transferred custody over Smith to the Americans,” said Ursua in her 12-page petition for contempt.

Smith was convicted by Makati Judge Benjamin Pozon on Dec. 4 and ordered detained at the Makati City jail.

The US government, citing provisions of the RP-US Visiting Forces Agreement, demanded custody over Smith.

Pozon denied the petition.

The issue is pending before the Court of Appeals.

Smith was transferred to the US Embassy on the night of Dec. 29 based on an agreement signed on Dec. 22 by Foreign Affairs Secretary Alberto Romulo and US Ambassador Kristie Kenney.

Named respondents in the contempt petition were Interior Secretary Ronaldo Puno, chief presidential legal counsel Sergio Apostol, Executive Secretary Eduardo Ermita, Justice Secretary Raul Gonzalez and Makati jail warden Deogracias Tapaday,

Nicole was joined in her petition by Zenaida Quezon-Avanceña, former Senate President Jovito Salonga, former Sen. Wigberto Tanada, Dr. Quintin Doromal, Emilio Capulong Jr., and UP professor Harry Roque Jr.

Ursua said the “misbehavior” of Apostol and Gonzalez, who are both officers of the court, in smuggling Smith out of the city jail is tantamount to an “unlawful interference with proceedings in the present case before the CA and constitute improper behavior tending to directly and indirectly impede, obstruct or degrade the administration of justice.”

“Respondents committed contumacious and contemptuous acts when they transferred custody over the convicted felon Smith to the US authorities during the pendency of the special proceedings,” she said.

Nicole’s legal team said Smith’s transfer practically in the dead of the night was illegal because it was not authorized by the appellate court or by Pozon.

Ursua added that the CA should dismiss outright Smith’s petition for certiorari since he is now considered “a fugitive from justice.”

“If the court were to still take cognizance of the appeal of Daniel Smith, the court would in effect be rewarding Daniel Smith, a convicted criminal, for his escape. Taking cognizance of his appeal would be to countenance the blatant affront to the power of the court that Daniel Smith committed by his escape. It would be against the rule of law,” Ursua said.

Forcibly transferred

In a separate petition, Nicole’s other lawyers said the issue on whether the Philippines or the US government should take custody of Smith was actually brought before the CA by Smith and the respondent government officials.

When they failed to secure a temporary restraining order on the implementation of the December 12 order of Pozon denying Smith’s motion for reconsideration, the officials “forcibly” transferred Smith to the US Embassy, the petitioners said.

Gonzalez, in a nine-page legal opinion sought by Puno, said the reason for the denial of the Makati court to release Smith from the city jail ceased to exist when it was remedied by the submission of an agreement signed by Romulo and Kenney.

“Considering that the CA has noted the agreement, which the Solicitor General has brought to its attention, without pronouncing its objection, it is our considered opinion that it is in keeping with our obligations under the Constitution, international law … to work for the return of custody of (Smith) to the US military custody inside the US embassy until completion of all judicial proceedings,” he said.

The agreement erased whatever legal impediment there was in Smith’s transfer from the Makati City jail to the US Embassy because the DFA, which is the party-in-interest involving the RP-US Visiting Forces Agreement, has already entered into an agreement with the US Embassy expressing no objection to Smith’s transfer to the US custody, he said.

Publicity

The legal opinion, dated Dec. 27, was used as basis by Puno in ordering the Bureau of Jail Management and Penology to relinquish custody of Smith to the US Embassy.

In an interview, Gonzalez said he is not affected by the charges filed by Nicole’s camp, saying Ursua was just trying to gain media mileage.

“Tell her I said ‘thank you.’ I’m not affected. I’m giving her the opportunity to get publicity. That is what she wants, anyway,” he said.

In an interview, Ursua expressed apprehension Smith can be easily spirited out of the country, saying the US Embassy is a territory of the United States over which the country’s judicial system has no jurisdiction.

Puno allayed fears of Smith being spirited out of the country by US authorities, saying an agreement was secured allowing Filipino officials to check on Smith at the embassy.

Smith is staying in a room at the Rowe building inside the heavily guarded embassy along Roxas boulevard in Manila.

US Embassy spokesman Matthew Lussenhop allayed fears Smith would be flown to the US.

“We will be responsible in compliance with the Visiting Forces Agreement. Right now, he is basically in detention,” he said.

He said the detention facility where Smith is being kept was inspected by a representative of the interior department yesterday afternoon.

“There are no plans to allow media to see the detention facility,” he said.

Strong relations

Lussenhop said despite the custody issue, bilateral relations between the Philippines and the United States “remain strong.”

“We continue to have a strong economic partnership. We also have a dynamic development assistance program and a strong cooperation in military projects,” he said.

Lussenhop maintained the transfer was done was in accordance with the VFA.

“What we are doing is according to the bilateral treaty both countries have signed. This has nothing to do with the verdict,” he said.

In a statement released after Smith’s transfer, the US Embassy said it has complied with the VFA throughout the trial.

“Article V, Paragraph 6 of the Visiting Forces Agreement specifies that ‘the custody of any United States personnel over whom the Philippines is to exercise jurisdiction shall immediately reside with the United States military authorities, if they so request, from the commission of the offense until completion of all judicial proceedings.’ Lance Corporal Smith will now return to US military custody in the same facility at the US Embassy which he was previously held for the duration of the trial.”

Full responsibility

Puno said he is taking full responsibility for Smith’s transfer.

He said the decision was made without disregarding Pozon’s order.

“We had to make a judgment here and sa amin, kung hindi katanggap-tanggap ang ginawa namin, pasensiya na lang, pero trabaho lang talaga,” Puno said in a radio interview.

Puno said President Arroyo was present when they discussed on Dec. 28 the transfer of custody.

He said all the President told them was to be careful in handling the issue “because this has a lot to do with our relation and of course our local political situation.”

Puno said before coming up with the decision, he read Pozon’s court decision to get the “general tenor.”

“Nung may mention of this temporary order… Alam ng judge na may Visiting Forces Agreement. Alam niya na may kontrobersiya, so hindi rin siya sigurado na kung saan dapat. So sinasabi diyan ‘temporarily’ hanggang maka-agree yung mga gobyerno,” he said.

“We did not, in our opinion, commit contempt of court,” he added.

Romulo-Kenney agreement

“The Corpus panel would make sure that the US fully conforms to the provisions of the Dec. 22 agreement between Secretary Romulo and Ambassador Kristie Kenney as well as provisions on the VFA on the custody of American servicemen facing charges in Philippine courts,” Puno said.

Puno was referring to DILG Undersecretary Mario Corpus, who will head a five-man inspection panel to regularly check on Smith.

“This would help allay apprehensions that Smith might be whisked off by US authorities out of the premises while he is appealing his conviction,” he added.

The agreement said Smith was to be locked up in a 10 by 12 foot room at the first floor room of Rowe building.

Puno said Washington has assured the Philippines the Corpus panel be given full access to Smith.

Inspection team

The four other members of the inspection committee are Chief Supt. Clarito Jover, officer-in-charge of the Bureau of Jail Management and Penology; Senior Supt. Serafin Barretto, BJMP director for the National Capital Region; Director Alejandro Lapinid, PNP director for intelligence; and Senior Supt. Mario San Diego, PNP director for legal service.

Criminal charges

Amado Valdez, former dean of the University of the East College of Law, said Puno and others responsible for the transfer could face criminal charges.

“Violation po yan ng tinatawag na courtesy sa husgado, yung system natin na separation of powers and it is bordering on a criminal offense dahil meron tayong tinatawag na consenting evasion of sentence,” Valdez told ratio station dzMM.

“Mga six years din ang kulong niyan kung mapapatunayan na merong criminal intent sa ginawa nilang yan,” he added.

Valdez said Puno and company should have waited for the decision of Court of Appeals because there are different interpretations of the law concerning Smith’s case.

Valdez also said that under some provisions of the VFA, a US serviceman who has been convicted should be placed under the custody of Philippine jurisdiction like the Makati City jail, New Bilibid Prisons in Muntinlupa City, or any other camps under Philippine authority.

Pinoy’s interest

President Arroyo said Smith’s transfer is in the best interest of the Philippines and will prevent the further deterioration of relations between the two countries.

Arroyo, in a statement, appealed for public understanding as she said the custody transfer would not in any way affect the handling of the case “nor impede justice and the rule of law.”

She said government is prepared to face whatever legal challenges would be raised against the transfer.

“The government had to take this action in order to forestall the further deterioration in our strategic relationship with the United States, which was being rapidly eroded by our non-compliance with the Visiting Forces Agreement,” she said.

“This difficult decision was made and taken with only the best interest of the Philippines in mind. I therefore ask all Filipinos to stand behind it and to stand behind our alliance with the United States to fight terror and poverty,” she added.

Apostol said the President was informed about the transfer only after Smith was brought to the US Embassy.

Apostol also said he is determined to file disbarment complaint against Ursua for ignorance of the law. – With Raymond Africa, Czeriza Valencia, Ashzel Hachero and Jocelyn Montemayor

  1. I must say that Carlos P Romulo, in spite of his old age in 1976, had bigger, greater f.. balls than Bert Romulo would ever have.

    I’m referring to the US Consul that Sec Romulo declared persona non grata, the first time ever in the history of US-RP relationship (and perhaps in the history of US foreign affairs relation) and sent off packing from the Philippines after the US Consul was found having violated Philippine hospitality.

    It was a cause celebre that was backed to the hilt by columnists headed by the late Doroy Valencia!

I’m not a lawyer pero gumanda ang araw ko sa statement na ito at napakalakas ng aking halakhak. Hahahahahahaha!!! This Apostol is really for laughs even during the Erap impeachment trial. Kaya siguro ito kinuha ni GMA pero may katuwaan naman.

    But go ahead, Senor Apostol! Huwag lang si Atty. Ursua. Lahat na abogado who are against the unlawful transfer of Smith. Idemanda ninyo lahat na tao na pupunta sa kalsada upang iprotesta ang muli ninyong pagyurak sa ating batas. At kapag nasa husgado na ang kaso, may chance kayong muling muling magpatawa sa pamamagitan ng: Yur wetniss yur hunur!

    It’s one person’s word against another. Apostol says Ursua is ignorant of the law. Ursua can say the same about Apostol. At the end of the day, the court has the final say; not Arroyo or Malacanang. Arroyo is not the government. Hindi niya puwedeng ma-over power ang decision ng korte. To think that the matter of custody is pending at the Court of Appeals, why the haste of the transfer tapos sa kadiliman pa ng gabi nilipat. To avoid traffic daw sabi ni Puno. Pero inamin na ni Arroyo na siya ang nag-utos para daw manatili ang magandang relation ng US at RP. What she means by that is so that the US would continue to protect her. Malinaw pa sa sikat ng araw at liwanag ng buwan ang dahilan. Kapit sa patalim wika nga. Shame on her!

    Mr. Cruz, I think it was a reward for his role at the Erap’s impeachment and defense of Arroyo in her two impeachments. Apostol is also closely identified with Imelda Marcos and the Marcoses. He was the Quezon City Fiscal during the Marcos regime. And since Imelda is now in sweet relationship with Arroyo, that makes one plus one equals two. Kahit na itong si Atty. Oliver Lozano na abogado din ni Imelda. Iyan ang sumira sa impeachment. Hindi naman gagalaw iyan na walang utos ni Imelda. Then now, Imelda’s KBL party is reported to be allied with Arroyo’s party. Lozano is among the candidates to be fielded by KBL kasama ang ibang senatoriables ng administration.

Not to mention, how painful it must be for the families & friends of journalists, activists, etc. who were brutally killed. Gloria has not lifted a finger to solve all these killings, & w/ a snap of a finger, she moves heaven & earth to “save” L/Cprl. Smith. Where is justice under Gloria ?

    And then she asks the Filipinos to understand why she did what she had to do ?

As far as I’m concern she’s a UP. graduate and she’s tough. The philippine court lost it’s integrity when Davide resumes the post.He always banged his gavel from the order of Malacanang.I’m not sure if Puno can restore it back.
    Ursua could not fight this battle alone,she need supports from the masses.Wala ng pakiaalam ang masa natin ngayon dahil karamihan sa kanila ay kumakalam ang sikmura.     I bet you thank your lucky star that your are in Germany which does not compromise the welfare and interests of its nationals for any international treaty especially with bullies like staff of the US Embassy in Manila.

    It’s the same in Japan, you know. I should know because I have in fact interpreted for a lot many of them erring US servicemen in Japan. Walang patawad dito kung may kasalanan ang kano lalo na kung ang biktima ay hapones.

    Last case I handled was a rape of a foreign national by an American. There was a conviction, and the erring soldier got what he deserved.

    Bakit iyan hindi magawa ng mga pilipino. And what the heck is this bogus president doing meddling in the activities of the court? Her justice secretary in fact has no business quacking over there in favor of the horny US soldier because he needs to be confirmed yet. Gosh, ilan taon nang nakaupo iyan without a valid portpolio.

    No wonder, walang tiwala ang mga kano!

Next time, they send a contingent of US soldiers on this Balikatan, dapat iyong mga matitinong mga magulang itago na nila ang mga dalaga nila. No dice encouraging them to hook these soldiers. Mare-rape lang sila lalo na ngayong alam ng mga iyan na Philippine laws are useless against a VFA! Saan nakakita ng ganyan katangahan?!!!

    I wonder if those who approved the VFA really understood the provision of that treaty. Over in Japan, not many Japanese speak English, but they make sure they understand anything they sign up with foreigners, especially with the American bullies. It is not anti-Americanism, mind you. It is plain and simple common sense!!! And yes, a bit of love of one’s country!!!

    Patriotism is not limited to the Americans, you know!

    As we speak, China has 600 billion dollars worth of collectible debts from the US so much so that if China decides to collect those debts, the US could find itself in an atrocious economic depression.

    I don’t wish that at all on the US because realistically, an economic fallout of that magnitude will have a reverberating negative effect on the entire world, the dollar being the international currency used for trade.

    Such occurence might trigger a 3rd world war…

    Mang Rivera, TV lang pala eh. Gusto mo ba ng HDTV? Ang High Definition TVC na uso ngayon? Padadalhan kita ng dalawa na tig-52 inches. Pero ikaw na ang bahala sa cable. Huwag mong gayahin ang ugali ko na kapag nagagalit sinisira ang mga gamit. Noong Bagong Taon, nagpaputok ang mga pamangkin ko sa may garahe ko at nasunog ang isa kong BMW. Buti na lang ang Expedition SUV ko nakapara sa ibang garahe. Sa amin kasi, tig-iisang garahe ang mga sasakyan ko. Sampu ang sasakyan ko kaya kayo na ang magsabi kung ilan ang garahe ko. Kay Ate Chi naman, alam ko naman mabait ka sa akin. Di tayo talo kasi marunong ka ng Tai Chi. Pero may kilala akong kasama dito na taga-Hawaii iba ang alam…TAE CHI.

    artsee? 52 intses na HDTV? eh, wala na akong pupwestuhan sa laki n’yan. kaliit lang ng kwarto ko sa kampo namin. ano bang keybol ang gamit d’yan? meron akong tinatagong isang rolyo ng 50 megawat ng kuryente, pwede na ba ‘yon?

    Mang Rivera, nasa kampo ka ba? Anong kampo? Huwag naman kampo ni Satanas. Biro lang brod ha. Ayaw mo ng 52 inches. Sige mga 40 o 32 inches na lang. Kung gusto mo para magkasya ang 52 inches eh lumipat ka na lang sa malaking apartment. Maghanap ka ng malaking lugar at ako na ang bahala sa rental. Magandang idea ano pards? Para hindi masayang ang 52 inches na HDTV.
