Challenge to Asean

The 12th Asean summit in Cebu on Saturday, Jan. 13, makes for good study on the vagaries of international diplomacy – a president gasping for survival hosting a summit of an organization threatened with irrelevance.

The most important document expected to be signed in the Cebu Asean summit is a framework charter of the 40-year old organization. The leaders will just agree on the basic principles, not the charter itself. A final draft of the charter is expected to be presented to the leaders in the 13th summit in Singapore in December.

Last week, S. Jayakumar, Singapore’s deputy prime minister, warned “”If it just continues to do more of the same, I think over a period of time, Asean will just become one of those organizations which will slowly fade into the sunset.”

Jayakumar, as quoted in the Singapore Straits Times further said, “Asean — as an organization — will atrophy and become marginalized” unless it reinvents itself.

Jayakuma represented Singapore, Asean’s most economically advanced member in the Eminent Persons Group, an advisory group to the Southeast Asia grouping.
Former President Fidel Ramos, who represented the Philippines zeroed on the Asean’s policy of deciding by consensus which is a tedious decision-making process.

Ramos said consultation and consensus should be retained for sensitive and important issues. “But if consensus cannot be achieved, decisions may be taken through voting among members,” he said

If it’s a comforting thought, Asean has shown that it’s capable of adjusting to regional realities. Established in 1967, one its declared aims was include, “to promote regional peace and stability through abiding respect for justice and the rule of law.”

With the five non-Communist countries in the region (Indonesia, Malaysia, Philippines, Singapore and Thailand) as its original members, the group were united in preventing communist Vietnam’s expansion in Indochina.

In 1998, Vietnam joined Asean, a reflection of the changing realities in the region. Aside from the original five and Vietnam, Asean now includes Brunei Darussalam, Cambodia, Laos, Malaysia, and Myanmar.

In its first Asean summit in 1976, Asean came out with a Treaty of Amity and Cooperation in Southeast Asia which set as their guideline the following fundamental principles:

· Mutual respect for independence, sovereignty, equality, territorial integrity, and national identity of all nations;
· The right of every State to lead its national existence free from external interference, subversion or coercion;
· Non-interference in the internal affairs of one another;
· Settlement of differences or disputes by peaceful manner;
· Renunciation of the threat or use of force; and
· Effective cooperation among themselves.

Countries that are Asean’s dialogue partners have to accede to the Treaty of Amity and Cooperation.

The case of Myanmar, however, is challenging Asean how to carry out meaningfully its 1967 declaration of “abiding respect for justice and rule of law” while adhering to its principle of “non-interference in the internal affairs of one another.”

Ramos said “In exceptional circumstances the traditional policy of non-intervention may be adjusted and sanctions imposed for non-compliance.”

He added, “And yes, that may include suspension of a member state but not expulsion.”

Jayakumar was quoted as saying Asean must push ahead with the “hard-nosed decisions” to make itself more effective.”

    The claim to parts or entire Spratley islands by some ASEAN countries is a test case of such cooperation. It’s like a volcanoe that can erupt anytime even among the best of friends.

    Sa ngayon, may kanya-kanyang mga tropa ang ilan bansa kasama na dito ang bansang Pilipinas. But when things come to worst, ano ang laban ng Pilipinas? Kung sa bagay, nandiyan ang Amerika sa tabi natin.

    But what about China? The Spratly islands and the Taiwan issue would be problems in the future that might involve China and neighboring countries (including US) into an armed conflict. It’s good to keep a close watch on this matter.

    About former President Ramos, nagsalita na siya tungkol dito sa ASEAN meeting. He has been quiet for a long time. Itong si Ramos unpredictable. Kapag tahimik siya dapat kabahan tayo. Kapag nagsalita, may gusto o ibig makuha.

  5. Mandirigma, FVR spoke about Asean because he was the Philippine representative to the Eminent Persons Group,a high level advisory group to Asean.

    On the conflicting claims of other Asean countries (Philippines,Malaysia, Vietnam, and Brunei) to parts of Spratly, Asean could serve as a moderating influence to prevent violence in the area. China is Asean’s dialogue partner.

    The conflicting claims in the Spratly’s will never be resolved. Asean could be a venue for cooperation in the area.

    If only they could move beyond just talking and being nice to each other.

    Another test case is the Sabah issue between the Philppines and Malaysia. Kung hindi lang siguro kapwa kaibigan ng Amerika ang dalawang bansa, matagal nang nagka-giyera ang dalawa. If Malaysia is not America’s friend, America would not mind the Philippines declaring war on Malaysia to claim Sabah and might even support the Philippines.

    Ms. Tordesillas, thanks and your response is well taken. However, the Spratly issue is not only limited to ASEAN countries but outside of it. America, China, Russia and other countries have a stake in seeing to it that they too have a bite in this piece of cake. About Ramos, is he invited to the ASEAN meeting or would he be present? Siguro mas kilala mo siya kesa sa amim. I think you’ve been with him in some foreign trips in the past. Ang sa akin lang po, mahilig si Ramos sa international limelight. Gusto niya lagi siyang sikat sa mundo.

  9. The Philippines takes a benign neglect attitude about our Sabah claim. It’s short of dropping the claim.

    I LOVE Rudyard Kipling. I mean that!

    I love his books, his poetry, his literary genius but sad to say, Rudyard Kipling was one of the greatest racial bigots our civilization has ever produced. He was one of the most hateful racists although he loved India but for the splendour, the mystery and the exoctism of its culture, people and its land.

    Having said that, I simply adore his writings.

    My reaction to the above final list: Good. But, it would have been better if the following not included: Pangilinan, Recto and Joker.

    Joker Arroyo almost didn’t make it. It was a package deal made by Manny Villar something non-negotiable. All or none. Isa pa, malapit kay Mayor Binay si Joker. The list may not be acceptable to some of you but that’s final. Talaga pong ganyan. The only way they can be replaced, I mean those we don’t like, is for them to be seriously ill or die. Otherwise, that’s it !

  18. ASEAN is doomed. The Great Switik has actually set the bad example. Wait till Indonesia, et al will do a copycat when they get into similar national crisis that the crooks in the Philippines would like to hide from foreigners, but actually cannot.

    Just what will they accomplish now with biggies in the organization even shunning away from this conference or leaving before the conference is over, and only to deliver some already prepared speeches that have lost their meanings on the way.

    If Filipinos can tolerate this nincompooping members of the ASEAN, surely the leaders of member states must be talking in hush-hush, especially about this government’s determination to quell all freedoms to look cutie-cutie!

    Countries like Malaya for instance is not buying her pro-US stance and cajoling of a horny American versus a victimized native of her country. Kakahiya siya!

    I’ve also read somewhere that western lobbyists will be there to make sure the fastest growing group of nations will be kind to their investments, but as it appears now, more and more big names are shunning the event (or non-event). Terrorist scare or insignificance? Or is it just Gloriatically dumb to do so?

    On Sabah: The Philippines has given up its sovereignty several times before, Smith’s case was the latest. It’s probably stupid that we should even care if we quit all claims for this oil-rich territory being rented out to a foreign state. Pathetic, eh?

    It was actually the Sabah issue that made me vote against the 1987 constitution. I believed then what Ka Turing Tolentino said that the proposed constitutonal silence was in fact abrogating the claims to strategic lands in South China Sea and Sulu Sea when it could bolster both our defense and economic needs. But at the time, no one listened to him, everyone else was festive about Marcos’ removal and anything related to Marcos (Kalayaan Group and Jabidah massacre) had to be considered bad.

    Marcos calls Princess Tarhata Kiram “aunt” because the Sulu Sultanate, through the late Sultan Esmail Kiram, had authorized him with a power of attorney to act on its behalf in the resolution of the Sabah claim. Marcos was known to call himself Sultan Juhan E. Kandaw.

    Inquirer’s Noralyn Mustafa writes:

    …once upon a time there was a kingdom called Maharlika, whose founder, an Arab from Mecca, Arabia, traced his origins to Toledo, Spain. He set up governance in Buansa, in the island of Jolo, in 1108 A.D., by virtue of a land title issued by the Spanish monarchy covering the entire area of what is now the Philippines, including North Borneo and the Spratlys, with reserve funds in gold that would amount to about $100 billion today.

    The validity of Original Certificate of Title 01-1, ratified by the Royal Decree in 1864, was confirmed by the Supreme Court, and the deeds of absolute sale were duly recorded in the Register of Deeds. Among the recorded sales covered 3,000 hectares in Bulacan and 500 hectares in Tagaytay for the amount of P3.5 million, in favor of Don Emilio Ejercito and spouse Doña Mary Marcelo Ejercito. The sale was made on April 19, 1938, when one centavo could buy you a glass of sorbetes! There was also one engineer, named Ramon Magsaysay, who bought 700 hectares, also in Tagaytay, for P1.4 million on June 7 of the same year.

    In Japan, there are the 5 properties the Pidals are salivating to get rid of for big cash. Ramos has made big money with the Roppongi property and blames Erap for it just because he managed to have the inauguration of the property during Erap’s early presidency even when all deals were done during his reign.

    Why is the ASEAN Summit being held in Cebu and not other places? Puwede din naman sa amin sa Bacolod. Baguio is also a nice place or Metro Manila. Has it got something to do with security. Mas may tiwala yata si Arroyo sa mga Cebuano kesa taga ibang region.

    Cebu as the site of the ASEAN summit is politics in its own right. Holding the summit there is another instance of the govt pouring money to a few people responsible for legitimizing Gloria illegitimate regime.

    As a member of the Eminent Persons Group, they are supposed to be part of the pre-Asean meeting. They are supposed to finalise their recommendations and present it to the Leaders. They are invited to a dinner with leaders.

    The EPG was held last week in Singapore. Probably Ramos would still be there in Cebu for the presentation of their recommendation and the dinner.

    Para malaman kung gaano ka paranoid itong gobyerno, the Philippine Navy cordoned the sea surrounding the ASEAN Summit meeting. Another overkill. I have not heard of such a security arrangement even to larger and more powerful nations. Kahit sa Amerika kapag may world meeting, hindi naman sinasara ang dagat. Why not also cordon the air space? Some enemy planes might drop the bomb on the meeting venue. Pa-impress lang iyan ni Arroyo sa mga lider ng ibang bansa. O baka naman siya lang ang takot?
