Officers fight for justice

It was most fitting that Brig. Gen. Danilo Lim’s petition before the Supreme Court, through his lawyer Vicente Verdadero, to stop the special general court martial convened to try him, Maj. Gen. Renato Miranda and 26 other marine and army officers for the alleged coup plot in February 2006, started with the statement:

“The fundamental rights guaranteed in the Constitution apply to all persons, including those subject to military law. It would indeed be paradoxical if military men who are called upon in times of the gravest national crises to lay down their lives in defense of peace and freedom would be the very people to be singled out for denial of the fundamental rights for which they risk their lives.”

Miranda, Lim, Col. Armando Bañez, Maj. Jose Leomar Doctolero, and Capt. William Upano, who are now detained in Camp Capinpin in Tanay, Rizal, also asked the High Court for their release. The officers have been accused of either one or two or all of the following violations of the Articles of War: mutiny, disrespect towards the president, willfully disobeying order, and conduct prejudicial to good order and discipline.

To the people, the accused officers are heroes because how can one disrespect a bogus president? How can one be guilty of a crime by disobeying an order from a person who thwarted the will of the people? How can one be accused of conduct prejudicial to good order and disciple by not participating in cheating?

That’s the biggest tragedy under Arroyo’s immoral administration. The honorable officers are in prison while those who participated in cheating and are engaged in extra-judicial killings have been richly rewarded.

Next week, the other officers are expected also to file similar petitions before the Supreme Court. Lawyers Vicente Caoile (for Bañez) and Dante Xenon Atienza (for Doctolero and Upano) said they need a fighting chance which they believe they cannot get from the special general court martial (SGCM).

Miranda’s lawyer Rolando Cipriano said their petition is a novelty because this is also the first time that the convenor of the court martial panel is also the accuser, will be a witness and the reviewing authority of the panel’s decision. That person is AFP chief Hermogenes Esperon.

Verdadero said this is also the first time that a chief of staff, who is supposed to set the tone of respect and dignity for the armed forces “has acted so brazenly against his fellow officers. Atienza said, “Esperon is the single biggest obstacle between justice and our clients.”

In their petition, the lawyers cited that by a single memorandum, dated Nov. 17 2006, creating a general court martial for the 30 officers (Lt. Col. Valentin Hizon and Lt. Col. Romulo Gualdrapa were later dropped from the case) Esperon ignored the recommendations of the panel that conducted a pre-trial investigation of the case.

Caoile said constitutional provisions require that all decisions must conform with facts, law and jurisprudence upon which it is based. “All three are absent in Gen. Esperon’s MR,” he said.

The PTI conducted by a team headed by Col. Al Perreras recommended that the charge of mutiny be dismissed for lack of factual and legal basis. The recommendation was to charge majority of the officers for conduct unbecoming of an officer and gentlemen.

In their petition, the officers disputed the findings of the panel that they should face the charge of conduct unbecoming an officer and gentlemen. They also averred that their incarceration is baseless and illegal. They cited Article 70 of the Articles of War 70 which says “Any person subject to military law charged with a crime or with a serious offense under these articles shall be placed in confinement or arrest, as circumstances may require; but when charged with a minor offense only, such person shall not ordinarily be placed in confinement.”

The officers have been in detention for more than a year now. As pleaded by Frank Chavez, one of Gen. Miranda’s lawyers in a previous hearing, “the rhythm of their lives has been disrupted.”

Not only that of the officers but also that of their families. Members of their families were at the Supreme Court last Monday during the filing of the petition. It’s their prayer that the High Court will give them justice that they cannot get from the establishment their husbands served with loyalty and honor.

    The terrible things about punggok and assperon is all rhetoric,fueled by their own egotistic goal to stay in power.Coasting sufferings and miseries of this brave soldiers that they incarcerated.They keep on talking good governance and strong economy but,they don’t understand what the families are dealing with.They never communicate a message about how grave things are really are.If they understood the families of these soldiers they would just come out an release all of them.These is the main issue that damaging assperon and his master reputation and character as a leader.Leaders has to do what’s best for the collective,not just to stick on their personal agendas.

There is a kind of tyranny going on in the Philippines as when these soldiers are deployed to all the barrios even in Manila, which is supposed to have the best police unit in the country, the so-called “Manila’s Finest,” that is apparently reduced to nothing but a bunch of rowdy boy scouts.

    That what happens when the country is turned into a war zone and the military is used also to police the country as some military police, and everywhere you go you see them carrying their guns, and still not be able to feel secured because they surely look more like hoodlums than men of law, peace and order.

    With the more than 800 community leaders, lawyers, journalists and even ordinary citizens crying out for justice being sent to their graves before their time, the country is being turned into a killing field by this ambitious crook, who thinks that it is her birthright to stay in the palace by the murky river and by all means, she will stay there!

    Point now is how do Filipinos intend to remove these creeps?

    You bet, Ellen. This is how majority of ordinary Filipinos, regardless of whether or not they are opposed to the bogus president, perceive this persecution of these honorable men.

    It is time that Filipinos should join these honorable officers of the Philippine military to demand for the removal of the crooks the creep at the palace by the murky river has installed for her own survival especially this Esperon, known also as “Assperon,” whom everyone knows is part and parcel of the cheating and voterigging done in the last election, and why he now occupies a position so powerful that he can now do what he wants sans the rule of law.

    He should in fact be sent to jail together with the bogus president he serves. There are the Garci tapes together with testimonies of soldiers like Gudani, et al., who refused to be used by the Tiyanak so she could be declared winner, to prove what they did in 2004.

    Filipinos should be encouraged to support these honorable men and their lawyers as they seek redress for injustice done not only to them but to the Filipino nation as a whole.

    They should clamor for the removal of these creeps, including the unconfirmed Secretary of Justice who acts more like a lunatic who should confined in a mental institution where he surely belongs.

    As Luzviminda has stated, panahon na. Rebolusyon na! The revolution need not be bloody as a matter of fact. Filipinos can revolt by casting their votes for the people who are opposed to these creeps and promise a better Philippines with the removal of them creeps.

    They should not waste their votes. Boycotting the election will not work in the Philippines where the politicians are mostly thick-faced crooks. Boycotting elections work only in more advanced societies as that of Japan, where disgraced officials commit suicide by hanging themselves in some hotel bathrooms or jump from the roof of some highrise building that can truly be messy as a matter of fact. Sabog ang utak sa sementong binabagsakan!

    Casting votes for the opposition should be their answer to the challenge of these creeps as when the Tiyanak tries to make another lousy political gimmick that can spell another precious life being sacrificed for her silly ambition, or the sucking of the national treasury that OFWs can hardly fill up with their remittances and reason why the Philippines remain a 3rd world country!

    Pathetic? You bet it is!

    Someone (a Pinoy) is being interviewed on TV by Hard Talk host about Filipina women who are recruted to work abroad.

    The Filipino whose face can’t be seen says in Filipino (with voice over in English): as a recruiter, he’s lied to the families, promising them decent jobs abroad for their women, but he knows full well that the women will be sent to brothels and sex shops abroad.

    While we somehow know that Gloria’s 100,000 export of Pinoys includes the rag=tag pimping of Pinoy women (and this female midget pimp should admit that this is happening), hearing it viva voce by a Pinoy on BBC confessing IS QUITE SHOCKING.

    Two of the recruiters who were identified by the interviewee as front=line children kidnappers are policemen.

    The Pinoy who is being interviewed said, “I have no choice but I have to make a living.”

    Gloria should die of shame instead of going about boasting that her government is championning human rights and lifting the poor and the dowtrodden of their misery. BIG FAT LIE.

    It was a relief indeed when the Japanese government finally banned the Japayuki, a name used only for Filipino women deployed to work in Japanese bars and clubs and ending up in brothels in the remote parts of Japan.

    In the early 80’s when the leftists even used this issue to fund their organizations even when Marcos had nothing to do with their deployment, and why the Philippine Embassy was not in any way helping these women when they ran against the law, I was able to interview in fact a lot many of these prostitutes under the employ of some illegal recruiters with Yakuza connections.

    One or two of them turned out to be 12-year-old teens being corrupted in their youth. What was shocking was when these kids would get used to what they did and not feel any feeling of guilt especially when they would even be called “heroes and heroines” for saving their families from hunger.

    I was reminded in fact of some teaching in our church about being careful and able to discern between what was God’s and what was of the devil as when they would even indirectly condone this kind of evil for funding a corrupt government and labeling these lawbreakers for they were in fact breaking the laws of Japan that prohibited prostitution and working in Japan without proper permits, for a lot them kids were in fact overstaying, and that was before Cory Aquino was able to get a special quota for Filipino entertainers a year in 1986 as Japan’s contribution to the Philippines’ economic recovery after Marcos.

    At lest, now they cannot enter Japan with proper permits even when they still come illegally. In fact, my friends and I in the movement versus the Japayuki are still wary that the plan to pimp and deploy Filipino caregivers to Japan is only a camouflage of the plan to smuggle these wannabe prostitutes to Japan once again.

    Worse is when Filipinos do not realize that with 40,000 a year prostitutes being smuggled to Japan between 1986 to 2004, what they have there in fact are a lot of moral wrecks, whom the Tiyanak in fact rely on to keep her in her present bogus position.

    I have actually warned my friends at the police department in Tokyo to be careful of the plan exodus of wannabe Japayukis once again in two years’ time as I am told of the frequent visits of Lagman, et al to Japan to convince Japan to renew the quota for Filipino entertainers even when the Japanese should have known their lesson that these officials cannot guarantee that only genuine entertainers (not bed entertainers) will be deployed to Japan.

    Presently, the recruits are being deployed mainly to Korea, and then to China. Would you believe that there are Filipinos in North Korea, too, doing the same kind of work kidnapped Thai women are doing there? This, I have heard in fact from Japanese who have had the opportunity to visit North Korea even when Filipinos are not allowed to go there legally.

    Much of the report centered on young girls from slum areas and barrios forced into prostitution in towns/cities in Pinas. Staggering report.

    The report is undoubtedly worldwide. After grabbing headline news concerning extra judicial killings, Pinas is once again in international limelight.

    Gloria should be asked to go on stage again and refute the BBC report – I bet she will say again, “We are a democratic country. I don’t tolerate human righst abuses.”

    Damn midget must be lectured – extra-judicial killings are only ONE form of human rights abuse; the worst form of human rights abuses is prostituting children.

    She doesn’t tolerate human rights abuses? Well, she should go on a promenade around Malacanang, less than 10 km from where she sits her big fat behind she calls her ass, she will see that human rights abuses on children are being committed by some of her own policemen.

  16. I bet you the BBC report is not a hoax. I doubt if they had actually removed all those brothels especially in Pasay and even Bocaue, Bulacan, two of the most notorious places where they deposit these girls they kidnap in the provinces.

    I believe the report, Anna. I have interviewed women in the police over here of being first recruited to work in Manila as domestic helpers only to end up in these casas before being shipped to Japan as Japayuki. Why lawmakers like Lagman would even act as emissary for the pimp in the palace by the murky river is proof enough of the involvement of high-ranking officials in this scheme.

    Long time ago, when I was working for a big travel agency in Japan as a tour escort/guide, I had the opportunity to join a night tour and our group being driven to a mansion-like house that I was told was owned by a high ranking military officer. I was shocked in fact to know about the involvement of men supposedly of honor in such illegal activity for prostitution was likewise illegal in the Philippines as it was/is in Japan. The girls there did not even have freedom to go out of the casas as they would be delivered to the hotel where the clients stay after being chosen and money for them paid to the establishment.

    The asking price from Japanese tourists even as early as the 70’s or the 80’s was 35 to 50 dollars an hour or a night for which the price would be higher. It was nauseating, mind you, and why I had trained myself to consider myself more as a foreigner than some fellow Filipino pimping fellow Filipinos to foreigners even when I made sure to be there only to protect our clients more than to make them buy those young Filipino prostitutes. It was one reason why I had to quit my job after two or three trips to the Philippines with Japanese tourists only to find them being directly pimped here a few years later.

    I dont know if you guys has seen the news this morning, that according to mike the defender, some of the TU(TA) candidates for senator will be junked??? hmmmmm??? that’s sound funny, and to think we all know who these candidates are??? they are the ASO gang of three, hehehehehehe…..

    Another things is, in the tribune news “GMA WILL TAP CABINET MEMBERS TO PUSH TU CAMPAIGN” what does it means, they will cheat, for example who has the direct communications with our OFWs or our kababayans abroad, isn’t it the DFA?? definitely with this instructions from the leprechaun, our embassies and consulates aborad will be asked to campaign hard for the TU(TA) candidates, hmmmmmm….

    Lastly, Ms. Ellen and guys maybe we could ask mayrial candidates in Manila to tear down the posters of Lito and ali atienza in all the LRT stations, not only in Manila, but from Monumento up to Baclaran, they are hanging there prominently, Ms.Ellen, maybe you can call the attention of COMELEC and inform other Mayoarial aspirants in Manila such such Sen Lim, Vice Mayor Lacuna and the others.

Parang panahon pa rin ni Jose Rizal when he wrote in his novels this kind of abuses.

    Bayaran lang niya ang mga amo ng mga magbubukid tapos na, luto na ang mga balota unless of course, between 2004 and now, Filipinos in the provinces have learned their lesson and are now firmer in their resolve to practice and enjoy their inalienable right to vote according to the dictate of their conscience.

    tungkol naman sa paghahanap ng trabaho ng mga nakatapos sa pag-aaral, ihalimbawa ko na ang aking mga anak na babae. ilang taon na silang nakatapos sa pag-aaral at nagbabakasakaling makahanap ng maayos na trabaho subalit walang mapasukan. kung meron man, contractual. kulang pang pambayad sa boarding house, pamasahe araw araw at kapag nagkakasakit, sagot pa rin ng pobreng tatay. wala pang anim na buwan, balik bahay. mga mistulang palaboy na nangahulog ang katawan dahil sa kagutuman.

    napilitan tuloy ang isa sa kanilang mag-aaply sa agency upang makapagtrabaho sa abroad. pinalad naman. ‘yun nga lang, ang ipinagkalihim lihim sa akin na pinasukan, domestic helper. at nandito siya sa saudi arabia. ang suweldo? DALAWANG DAANG DOLYAR! tsk. tsk. tsk.

    Kahit alam ng ating mga kababaihan na malamang magiging flesh vendor sila sa Japan (o sa HK o Macau) pumupunta pa rin sila dahil sa tingin nila mas mabuti na ang maging ganoon kesa mamatay ng gutom.

Sariling desisyon nila ang pagpunta sa mahirap na kalagayan kaya kailangan din nilang maging responsible sa mga kahihinatnan ng kanilang desisyon.     KITCHENER, Ont. (CP) – Canadian soldiers who have done so much for freedom and peace deserve a government that is responsive to their needs, Prime Minister Stephen Harper said Tuesday in announcing an ombudsman and bill of rights for veterans.

    Speaking to scores of former soldiers, many sporting numerous medals, at a legion hall in this southwestern Ontario city, Harper said his government was delivering on an election promise to ensure veterans get the respect they deserve from Ottawa.

    “Brave patriotic men and women like you are the reason we’re here,” Harper said. “If it weren’t for you, and tens of thousands of others like you, we wouldn’t have a secure and peaceful country.”
    Last month’s federal budget set out $20 million annually to create the ombudsman’s office and address concerns raised by former soldiers.
    On Tuesday, Harper announced that the bill of rights would take effect immediately and be written in “clear, concise” language.

    It will allow Veterans Affairs to ensure that all veterans are treated with the “fairness, dignity and respect to which he or she is entitled,” he said.

    The ombudsman’s office, created in consultation with veterans groups, will operate at arm’s length from the government. It will report annually to the minister of Veterans Affairs, who will in turn send the report to Parliament for all Canadians to see.
    “This individual will play an important role in raising public awareness of the needs and concerns of veterans,” said Harper, who added the government hoped to fill the position this spring.

    “Anything we can do to improve service standards and get a better sense of any problems that exist in the government’s relations with its veterans community, those things are all very important.”

    Pinoys still prefer GO over Team Unity

    Opposition senatorial candidates continued to lead administration bets based on the Social Weather Stations’ (SWS) first quarter survey, ABS-CBN News learned Wednesday.

    The survey, which was conducted nationwide from February 24-27, indicated that among those who would vote for opposition candidates for congressman, governor or mayor, the Senate race scores are consistently 8-2-2 in favor of Genuine Opposition (GO)

    The survey also said that for those who would vote for administration candidates, the score would be 6 or 7 for GO, 4 or 5 for Team Unity (TU) and 1 for Independent.

    For those who prefer independent candidates, the score would be 7 or 8 for GO, 3 for TU and 1 or 2 for Independent.

    The SWS said the survey used face-to-face interviews of 1,200 adults divided into random samples of 300 each in Metro Manila, the Balance of Luzon,
    Visayas, and Mindanao (sampling error margins of ±3% for national percentages and ±6% for area percentages).

    Local opposition candidates are also leading in the survey, which said that 36 percent would vote for an opposition candidate for representative, 28
    percent would vote for administration and 26 percent for an independent candidate. The remaining 10 respondents have no answer.

    For gubernatorial candidates, 28 percent said they would vote for the opposition, 25 percent for administration and 21 percent for an independent candidate.

    For mayoral candidates, 35 percent said they would vote for the opposition, an almost equal 33 percent would vote for administration and 23 percent for an independent candidate.

    I do think that those that did not get away with their cheating and lost, are still holding grudges… It became easy for them because you guys won’t let up… Enough already… go to the poor area and help the poor.. do not let your government do all the work… help the needy, instead of spreading the seeds of hatred and using your time planting and nurturing those seeds.

    Once, a non-pilipino convenience store clerk told a fellow Filipino (Pilipino) “salamat” after she was helped, and it surprised her… She asked herself (afterwards asked me), “how did he know I was Pilipino”? She unintentionally (or maybe intentionally) disassociated herself from our race… why…? to be a Pilipino is to be too traumatic and traumatized, and a lot more…

    I tried so hard to find news from the Philippines, and the first thing I find are the words “tiyanak” and “bisyo”… Honestly, I was so nauseated to read it.. The web made Pilipinos open and available for scrutiny and analysis by other nation… to speak tagalog, do not bar other nation (who may want to invest or contribute or donate into the Philippine economy and social causes) to find a Pilipino translator to translate verbatim what the people of this Philippines is all about….

    Did Pacquiao asked anyone of you to go up in the ring and fight his fight for you???? Why can’t he spend his hard earned money without you salivating about what he want to do with it? At least he uses some of it to help out… When did you guys last picked up a “pulubi,” fed, dress, treated and respected them enough to help them? Pacquiao is not a saint, yo’… he’s a human Filipino (Pilipino) who got lucky to “broke face,” win, and get rich… got to be well known..most especially here in the US and other countries… but criticized by his own country men… I hope he leaves the Philippines and migrate here, so he does not have to deal with the likes of you… “Que Vadis Pinoy?” Bakit kayo ganyan???????

    PHILIPPINES NO. 4 IN UN HUMAN RIGHTS COUNCIL ELECTION

    NEW YORK –The Philippines proved critics of its human rights record wrong when it landed in the top five in today’s race for 14 seats in the United Nations Human Rights Council.

    In its report to Foreign Affairs Secretary Alberto G. Romulo, the Philippine Mission to the United Nations said that Manila’s fourth place finish demonstrates the international community’s continued confidence in Manila’s commitment to uphold, protect and promote human rights.

    Ambassador Hilario G. Davide Jr., Permanent Representative to the United Nations, said the Philippines received 179 votes or 43 more votes than it had during last year’s elections. India topped the elections with 185 votes followed by Indonesia and Madagascar with 182 votes each.

    “The reelection of the Philippines to the United Nations Human Rights Council is a vindication for the Philippines and President Gloria Macapagal Arroyo,” Ambassador Davide said, referring to the campaign launched by non-government organizations to frustrate the Philippines’ reelection bid because of alleged human rights abuses.

    This was the Philippines’ first election victory under the watch of Ambassador Davide who assumed as Permanent Representative only three months ago. This reelection follows Manila’s successful one-year term as member of the 47-member Council. With the reelection, the Philippines will serve another three-year term until 2010.

    In Manila, Secretary Romulo welcomed confirmation of the Philippines’ election to the Council and thanked the country’s partners in the community of nations for their “overwhelming support.”

    “Our reelection to the Council is a clear vote of confidence for the Philippines and President Arroyo’s efforts to move further forward the global agenda of upholding and protecting human rights,” Romulo said.

    “With this fresh mandate, the Philippines has been given another opportunity to strengthen further its advocacy in key human rights areas,” Romulo added. “This fresh mandate likewise underscores the success of our Foreign Service Posts in harnessing and sustaining global support for Philippine initiatives in the United Nations.”

    Secretary Romulo cited in particular the efforts of Ambassador Davide and Ambassador Enrique Manalo, the Permanent Representative to the United Nations in Geneva.

    In its reelection candidature, the Philippines indicated voluntary commitments that include strengthened resolve to address politically-motivated killings of media members and activists, sustained leadership in promoting interfaith dialogue, continued advocacy of the rights of migrant workers and commitment to making the Council a more efficient and effective organization.

    Aside from the Philippines, India, Indonesia and Madagascar, the other member-states that were elected to the Council are Qatar, Italy, Netherlands, Bosnia and Herzegovina, Slovenia, Nicaragua, Bolivia, South Africa, Angola and Egypt.

    The Human Rights Council was created by the 191-nation UN General Assembly on 15 March 2006 with the adoption of Resolution No. 60/251.END

    RP NO. 1 CONTRIBUTOR OF POLICE OFFICERS FOR UN PEACEKEEPING

    NEW YORK—The Philippines is now the No. 1 contributor of individual police officers to United Nations peacekeeping operations, the Philippine Mission to the United Nations said today.

    The Philippine Mission, citing statistics from the UN Department of Peacekeeping Operations (DPKO), said that the Philippines emerged last week as the main provider of police officers with 288 individual officers from the Philippine National Police (PNP) deployed in seven UN peacekeeping missions around the world.

    “The Filipino police peacekeeper is doing our country proud by helping restore peace and rebuild lives in places as near as Timor Leste and as far as Sudan,” Ambassador Hilario G. Davide Jr., Permanent Representative to the United Nations, said in his report to Foreign Affairs Secretary Alberto G. Romulo.

    Aside from the Philippines, the others in the list of the top 10 contributors of civilian police officers are the United States (284); Turkey (275); Germany (230); Cameroon (167); Niger (165); France (159); Ghana (144); Zimbabwe (121); and Burkina Faso (120). The figures cover individual police officers and do not include police officers belonging to so-called Formed Police Units.

    “The Philippines climbed to the top position as a result of Manila’s positive response to the calls of the UN for Member-States to contribute personnel in view of the unprecedented surge in the demand for peacekeepers worldwide,” Ambassador Davide said, as he cited the cooperation of the PNP led by Director General Oscar Calderon.

    “It is also an indication of the high regard of the UN for Philippine police officers who have proven their professionalism and competence in the various UN field missions as well as in the UN Headquarters where three PNP officers have been seconded,” he added.

    The bulk of the Philippine police officers (145) are deployed with the UN Integrated Mission in Timor Leste (UNMIT) where former PNP Director Rodolfo Tor is presently the Police Commissioner. The rest are deployed in Kosovo (44); Sudan (39); Liberia (34); Haiti (19); Cote d’ Ivoire (6); and Afghanistan (1).

    Ambassador Davide expressed confidence that the Philippines will remain on the No. 1 spot especially with the commitment expressed early this year by Secretary Romulo to UN Secretary General Ban Ki-moon for the Philippines to further enhance and expand its participation in UN peacekeeping operations. ###

    RP JOINS CLAMOR FOR INTERNATIONAL UNITY, ACTION ON ENERGY SECURITY CLIMATE CHANGE
    NEW YORK—The Philippines on Tuesday joined the mounting clamor for greater international attention on energy security and climate change, saying member-states of the United Nations must work together to attain the much needed consensus for speedy cooperation and action on these issues.

    “There is an extreme urgency for international community-wide prioritization, including at regional and national levels, to address the challenges posed by energy security and climate change,” Ambassador Hilario G. Davide Jr., Philippine Permanent Representative to the United Nations, said in his statement during an open debate of the Security Council.

    Aside from Ambassador Davide, those who spoke to call for greater international cooperation and action on energy security and climate change included United Nations Secretary General Ban Ki-moon and representatives from at least 50 other member-states.

    “The years 2007 to 2009 will be critical in testing the resolve of member-states to take bold and decisive steps to mitigate climate change,” Ambassador Davide said in the first statement he delivered before the Security Council since assuming as Manila’s envoy to the world body in February.

    “As long as the approach involves all stakeholders—governments, parliaments, non-governmental and civil society organizations, the private sector, faith communities, and above all, the peoples themselves—and a determination and political will to make and fulfill commitments, we will be able to save mankind and make this planet a beautiful place to live in,” he said.

    In his statement, Ambassador Davide underscored the importance the Philippines places on the issue of energy security and climate change. A delegate to the 1971 Constitutional Convention and the 1986 Constitutional Commission, Ambassador Davide cited the Philippine Constitution which expressly provides that the State shall protect and advance the right of the people to a balanced and healthful ecology in accord with the rhythm and harmony of nature.

    A former Chief Justice, Ambassador Davide also cited a landmark Supreme Court decision (Oposa et al vs Secretary of Environment Fulgencio S. Factoran Jr.) that allowed children, on their own behalf and on behalf of children of succeeding generations, to sue the Government to enforce such constitutional right, thereby enunciating the doctrine of intergenerational responsibility and intergenerational justice.

    “Mankind’s survival on our fragile planet faces a serious threat posed by our fast deteriorating climate,” the ambassador said. “In [that] landmark decision, the Supreme Court declared that unless something must be done now, mankind may inherit a parched earth incapable of sustaining life.”

    Ambassador Davide also cited the creation in February by President Gloria Macapagal Arroyo of the Presidential Task Force on Climate Change, which is mandated to conduct a rapid assessment of the impact of climate change to ensure strict compliance with air emission standards, combat deforestation and apprehend violators.

    In the regional level, the ambassador mentioned the Cebu Declaration on East Asian Energy Security adopted during the Second East Asian Summit on 15 January 2007 where the Philippines and the nine other member-states of the Association of Southeast Asian Nations (ASEAN), together with Australia, China, India, Japan, New Zealand and Korea, agreed to work closely to mitigate greenhouse gas emissions through effective policies and measures.

    The ambassador, who is presently chair of the ASEAN New York Committee, also referred to the Cebu Declaration on Sustainable Development issued by ASEAN environment ministers in November 2006 where they expressed their concern over the impact of climate change on ecosystems and reiterated their commitment to address global environment issues through national and regional cooperation.

    He said climate change is also built in the ASEAN Plan of Action for Energy Cooperation which mandates the inclusion of environmental and sustainable development concerns in regional energy policy development.

    Ambassador Davide also cited the 16 th Ministerial Meeting of the Foreign Ministers of ASEAN and the European Union, where the Cebu Declaration on East Asian Energy Security was discussed. In that meeting, the ministers agreed to promote cooperation on climate change, energy security, sustainable energy and multilateral measures for stable, effective and transparent energy markets. ###
