Esperon passes buck to Pimentel

In Strictly Politics (ANC) last night, AFP Chief of Staff Hermogenes Esperon showed a copy of a letter he was sending Judge Oscar Pimentel of the Makati Regional Trial Court today (Wednesday) asking the judge clarification on the custody of Senator-elect Antonio Trillanes.

He said if Pimentel, in whose court the coup d’etat charge against Trillanes and fellow Magdalo soldiers in connection with the July 2003 “Oakwood mutiny” is being tried says Trillanes should be released to civilian custody, he will release Trillanes from his confinement at the Marine Brig in Fort Bonifacio.

But, he said, if Pimentel says Trillanes stays under military custody, he (Esperon) will not allow him to attend sessions in the Senate.

Esperon’s move is seen as passing the burden of persecuting Trillanes to Pimentel.

Esperon has been widely criticized for attempting to block the proclamation of Trillanes last Friday. He later allowed Trillanes, an hour later than scheduled, but in handcuffs.

Aside from the charge of coup d’etat in a civil court, Trillanes and his fellow Magdalo officers are also being tried for conduct unbecoming of an officer and a gentleman under the Articles of War

The punishment for conduct of unbecoming of an oficer and gentleman is discharge from service while for coup d’etat, it’s life imprisonment.

Meanwhile the three Cavaliers (graduates of the Philippine Miltiary Academy) in the Senate – Senators Rodolfo Biazon, Gregorio Honasan, Panfilo Lacson said they will find means to have Trillanes perform his duties as senator. One way would be to express “a sense of the senate” to the approrpriate court and agencies.

Esperon throws Trillanes detention to Makati court

Armed Forces chief Gen. Hermogenes Esperon yesterday asked the Makati Regional Trial Court to rule on whether Sen.-elect Antonio Trillanes IV should remain under military custody.

“Considering his (Trillanes) change of status from a military officer to a civilian… the question has arisen whether the Senator-elect continues to be subject to confinement in a military detention facility,” said the two-page “request for clarification” filed before Judge Oscar Pimentel of RTC Branch 48.

But this may become moot and academic, as Executive Secretary Eduardo Ermita yesterday talked about possible amnesty to both Trillanes and Sen.-elect Gregorio Honasan.

“There is a high probability that indeed, in the spirit of reconciliation and in the spirit of making things move forward, in the name of good governance, (and) for the sake of our people, there is nothing that would prevent the President and I think the President may just do that,” he said.

Trillanes, a Navy lieutenant when he led the Oakwood mutiny in July 2003, was considered separated from service when he filed his candidacy last February.

On April 16, Ermita wrote Defense Secretary Hermogenes Ebdane Jr. informing the latter that President Arroyo has already approved Trillanes’ resignation, effective the date of his filing of his candidacy.

Despite this, the military retained jurisdiction over Trillanes, saying his offense % violation of Article of War 96 (conduct unbecoming an officer and a gentleman) % was committed while he was in service.

The Makati RTC authorized the military to confine Trillanes and some of his co-accused in the coup d’état case at the Marine Brig in Fort Bonifacio in June last year.

A general court martial is hearing Trillanes’ AW 96 violation.

The Makati RTC is hearing the coup d’état case filed against Trillanes and about 30 other junior officers in connection with the mutiny.

Esperon said if the court decides to remove Trillanes from military custody, his new custodians should be ordered to ensure his appearance before the general court martial.

Pimentel told reporters the custodial issue would likely be resolved next month.

“I have to resolve first the motion for the demurrer of evidence filed by the defense counsels on the coup d’état case,” he said.

Defense lawyers, in filing the motion, said the Department of Justice failed to present convincing evidence to prove its case.

Pimentel said: “It all depends. If the demurrer is accepted, then the case is dismissed but if it is denied, Trillanes will remain in custody.” If the demurrer is denied, Pimentel said he would communicate with the justice department in resolving the question of who will have custody of Trillanes.

“I cannot decide alone because it involves the military,” he said.

Last Tuesday, Esperon said he was facing a dilemma on the custody of Trillanes. He said he wants Trillanes to perform his job as senator by allowing him to leave detention but he might be compelled to extend the same treatment to other officers facing court martial.

Under Article of War 70, any person subject to military law charged with crime or with a serious offense under the Articles of War should be placed under confinement or arrest. AW 74 says any person who releases a prisoner “without proper authorization” shall be punished as a court martial may direct.

Lt. Col. Bartolome Bacarro, chief of the AFP public information office, said the military is “not softening” on the case.

“We want to clarify that this is an unprecedented case… We have no law on how we will deal with such a situation,” he said.

Bacarro said military lawyers recommended that Esperon ask the Makati RTC for clarification.

Esperon admitted he did not expect Trillanes to win.

“Frankly, I did not but it’s not important. He has won. So my personal feelings about it are not important,” he said.

Esperon said he could have “probably” underestimated Trillanes “but I was not in the election process. I’m just a voter as far as this election is concerned.”

Esperon said he is not griping over Trillanes’ victory.

“He is a senator most of all. I should not gripe. He won, that’s it. He has the mandate of 11 million plus people.”

Ermita said the authority of the military, particularly Esperon, over Trillanes emanates from the judge.

“Should the judge feel that authority should be withdrawn for his own reasons, then, I suppose the military would just have to turn over the person of Senator Trillanes to the disposition of the court,” he said.

“What happens after that, I cannot tell you because only the judge would have to exercise his better judgment. I think suffice you to know that he (Trillanes) is charged with a capital offense that is not bailable. As to how court will handle that particular case is beyond me,” he added.

National security adviser Norberto Gonzales said Esperon’s move to seek clarification from the court was a wise move that would help calm the situation.

    As the AFP’s detention of AT4 is merely custodial, meaning they are holding him for the Makati RTC trial, Esperon cannot exercise powers beyond that of the Makati court. He probably realized that when Judge Pimentel ordered him to allow AT4 to attend his proclamation.

    The idiot now knows that even if AT4 were found guilty by court martial, or even if AT4 just pleads guilty, he will just be dismissed from service. But he has already resigned, so what for?

    The reason why AT4 is in his custody is because it is the wish of the civilian court, not because this Asshole-person wants him there!

    You don’t even have to ask Pimentel for clarification, stupid.

    Esperon said that if Trillanes stays in Military custody, he would not allow him out. But I also believe that the Military has its own Court that the General or an AFP chief is Independent with each other. Just like in a Civilian Government with its own Court independent of of the President. Unless the Philippines is now Under a dual dictatorships of Esperon and Gloria, then that maybe the Case.

The sovereign will of the people is always supreme in a democratic society. Passing the buck to a civilian authority is like a white flag or act of surrender. Esperon and Gloria Arroyo are humiliated and defeated as a result of Trillanes’ polls victory. Amen

  4. Haemorrhoid Assperon is, as seen on Strictly Politics last night, out of his depth relying on an Articles of War crafted in the 1930’s. He is desperately looking for a way out to be able to reach retirement. Retirement is the best he can offer the AFP.
    Just continue to be patient folks, the ship is sinking with leaks soon appearing everywhere when the Garci case is continued, the Pidal Accounts case, the Fertiliser Scam etc. etc. and Haemorrhoid Assperon and his crooked generals will be effected because they nailed their colors to the Schitoglo and her gang of thieves.

Esperon has been dribbling for too long and when he realized his opponents are swarming over him, he panicked and knows any moment, he will fumble. Then he saw an open man which is Pimentel. Ipinasa na niya. Siguro nasa loob niya, hindi ko na kaya ito, bahala ka na dyan, judge.

    Even Kiko Pangilinan is now saying that he will join in asking for Sen. Trillanes release. Pretty soon, others will issue similar statement. Natabunan na lahat sila ng Trillaens Tsunami, hindi na pinaguusapan ang ibang nanalo. It’s Sen. Trillanes all over the papers, airwaves and of course, in the internet.

    Bravo to all of us! I read a blog which acknowledged that Ellen Tordesillas’ blog is the most vocal in its support for Sen. Trillanes.

    This is proof, Ellen, that the idiot is reading this blog, for were we not saying that Senator Trillanes now being a civilian should be surrendered to the custody of the civilian court? Simple lang naman. Hindi naman kailangan maging abogado ang isang tao para maintindihan ito. Common sense lang since there must be a lot of unwritten laws likewise in the Philippines as there are in other countries.

  17. Off topic but this interesting. Inquirer reports, “Arroyo seeks media support in last 3 years of term.” Oh yeah! Tell it to the marines. Hopefully, good journalists like Ellen Tordesillas, et al will not succumb to this attempt by the creep to lure journalists again that she is sincere, and not self-serving her own personal interests.

    What media people should not forget is that a crime has been committed. They are duty-bound to help find proofs and evidences to enable the authorities concerned to pursue the people’s case against this creep and her cohorts.

    A crime is a crime, hindi iyan dapat na pinalulusot. The creeps do not deserve a minute longer to stay at the palace by the murky river and lord it over the Filipinos.

    Napahiya kasi si Idiot Esperon nung malaman na wala palang karapatan ang AFP na i-detain si Trillanes, dahil ang non-bailable case na coup d-etat ay sa civilian court. Yung kaso niya sa Military tribunal ay discharge from service lang ang parusa. Therefore wala siyang karapatan na i-hold pa si Trillanes at iba pang akusadong sundalo. Pasimple na lang siya na kunyari eh si Judge Oscar Pimentel ang mag-decide. Kaya lang MAS LALONG INGAT dapat ang gawin ni Trillanes dahil kung maaalis siya sa custody ng militar ay baka PAGANAHIN ang DEATH SQUAD ni Palparan at ipa-AMBUSH siya at gawin siyang special mission!

    Can Esperon, Gloria, and Bunye be charged and tried in a criminal court? Sana nga para if found guilty they willl be all sent to Muntinglupa Prison for a taste of life inside a prison cell. Kon sabagay si Bunye familiar na sa pagtira sa Muntinglupa. His father was Superintendent in the early 60’s at nagaaral palang si Ignacio sa Ateneo.
    ystakei: I doubt very much if Ellen will succumb to Gloria’s request. She may forgive the sinner but not the sin.

    dito sa america jurors (8-10 jurors) ang nagsasabi kung acquitted or guilty ang isang offender. Kay Trillanes kung ang taong bayan ang jurors (11M) not guilty ang hatol. Dapat Judge Pimentel should allow Trillanes to attend the session or allow Trillanes to post bail. Sa america 10 jurors lang dito imagine 11M ang nagsabing not guilty.

    Wala namang dapat ipag-amnesty sa kaso nina Trillanes at mga Magdalo dahil wala naman silang kasalanan. Maari siguro na administrative lang dahil ‘nag-rally’ sila sa Oakwood nuong hindi pinakinggan ang kanilang hinaing. Tama isang patibong ang alok na amnesty for reconciliation dahil nanganganib na sila Gloria at Esperon sa kanilang ilegal na pwesto. Hindi na nila hawak ang kasundaluhan!

    Esperon’s ploy is actually a well-thought out scheme. If Pimentel insists on military custody, then Assperon can try to block any and all Senate appearances for AT4. If Pimentel assumes civilian custody, Trillanes will be sent to a local jail for detention. He may be stupid but he has the support of his Queen who can pay for all the brains her asshole sorely lacks.

    In both cases, Assperon will ensure that things will continue to be difficult (or be MORE DIFFICULT) for AT4.

    I would prefer that AT4 remains in AFP custody, though. Assperon may try all he wants, but in the end, the upright officers and men of the AFP may be pushed to the limit and God knows what it would lead to.

    If the 3rd Infantry Brigade led by Col. Narcise has gone public in its support of Trillanes, the colonel surely knows he has the same sentiments with that of his co-equals, though he has bigger balls to come out in the open first. The brainless CSAFP has realized from the survey they conducted that there is an emerging consensus among his men, and whatever that is, he is gonna be on the losing side of it.

    Check, general. Your move. You sacrifice your queen to the knight or checkmate?

    By virtue of approval of his candidacy to the Philippine Senate it was deemed without doubt that he ceased to be a member of the armed forces (naging senador pa nga). Separated na siya bakit nakakulong pa siya. Naparusahan na siya ng separation dahil kumandidato siya, dahil sa estupidong provision of the articles of war napakahalaga ng membership sa armed forces, pag nawala yun laking sakripisyo. So, ano pa ang ngawngaw ni Esperon at members ng court martial?

    jay cynikho, magandang punto yan. kahit “found guilty” si Trillanes ng military court, ang MAKSIMUM na parusa sa kanya ay: dishonorable discharge from the military service.

    dahil duon sa pag-file pa lang ng kandidatura niya, considered resigned na siya mula sa serbisyo, burado na dapat ang kaso sa harap ng militar.

    at bilang konsekwensiya, ang civilian courts na lang dapat ang natira.

    1. political betrayal ang ginawa kay Sonny; pinangakuan at pina-niwala na walang ihahaing kaso sa kanya sa labas ng korteng militar sa negosasyon sa Oakwood;
    2. politikal ang kulay ng pangyayari sa Oakwood, at gayon din ang mga kasong isinampa sa korteng sibilyan;
    3. ang halalan ay isang kilos-pulitikal, at ang mahigit na 11 Milyong boto nakamit ay patunay o pagkilala sa kadakilaan ng kaganapan sa Oakwood.

    AFP Should Drop Case vs Trillanes – Lawyer

    It’s useless for the military to pursue court-martial proceedings against senator-elect Antonio Trillanes IV now that he’s a civilian, a lawyer said today.

    To break the legal impasse that the military is faced with as to who has custody over Trillanes, the general court martial trying him can simply move for the dropping of the case, which charged the rebel-turned-senator with conduct unbecoming of an officer and a gentleman, according to Theodore Te, a lawyer for some of the detained military rebels and professor at the University of the Philippines.

    It’s now moot and academic. The penalty for the violation of Articles of War- the conduct of unbecoming officer and gentleman is removal from the service. Senator-elect Trillanes automatically resigned from the military service when he filled his certificate of candidacy. Even if he is found guilty by Esperon’s Kangaroo Court, Antonio Trillanes IV is already voluntarily removed from the service. It’s a useless political persecution. I think the majority of 11+ millions who voted Trillanes, approved the Magdalo protest action against the corrupt and illegitimate Arroyo regime.

    The bottomline is, Assperon does not have any bargaining chip anymore on Sonny’s case. He is “inutil” and he knows it together with the tiyanak! They can try to prevent Sonny from being a senator. This is all they can do. But the over 11 million voters will make sure that Sonny will deliver!

    The justice system may be prostrituted but there are still a few good men in the system too. The same is true with the military.

    Sooner or later the much awaited justice will prevail and it will be a very sweet one!
