Trial turns into protest forum

Indeed, the all-powerful unseen hand has a way of spoiling the most calculated plans.

Just like what happened in the court martial hearing of the mutiny case against 28 Marine and Army officers involved in the Feb. 2006 aborted withdrawal of support from Gloria Arroyo.

If the reason for the holding the hearing a week ahead of the agreed schedule had something to do with rendering the accused irrelevant for whatever the government is planning in the coming days, the opposite was achieved because the hearing served as a forum for the Marines to express their sympathy to their fallen comrades and disgust for the inept manner that the military leadership is handling the situation.

Showing up in the courtroom with their heads shaven, Colonels Ariel Querubin, Orlando de Leon, Januario Caringal, Armando Bañez, Custodio Parcon, Achilles Segumalian, and Maj. Francisco Fernandez staged an eloquent protest action.

The perfect timing was served to them on a silver platter by the court martial panel.

There was something disquieting the way the panel headed by Lt. Gen. Alexander Yano tried to hasten the hearing last Wednesday just like the many other things that seem not to fit in this country these days (like ultra-rightist Norberto Gonzalez acting as interim defense secretary for a month at the time when the in Human Security Act is to be implemented).

In the morning, defense lawyers asked and begged (Atty. Vicente Verdadero, lawyer of Brig. Gen. Danilo Lim did this) for the return to the original schedule of the hearing which was July 27 because 17 of the 28 accused were not represented by their lawyers. All requests for reconsideration were denied, denied, denied.

Pushed to the wall, the accused had to exercise their peremptory challenge when the hearing resumed in the afternoon. Yago was expelled. They tried to ram down Major Generals Raul Caballes and Cirano Austria in violation of rule that no official should be tried by somebody lower in rank in the seniority list. Miranda is senior than Caballes and Austria.

In the end, after hours of weary exchanges that centered on the return to the original schedule of the hearing which was July 27, the panel adjourned. What a waste of time and emotions.

In the June 15 hearing, it was agreed that the next one would be on July 6. Then it was re-scheduled to July 13. Then it was re-scheduled to July 27.

Last Monday, July 16, the lawyers were informed that the hearing was reset to July 18. Naturally it made a mess out of the lawyers’ schedules. Some tried to ask for the re-scheduling of previous commitments like Atty. Verdadero who earlier asked for the postponement of last Wednesday’s hearings but showed up anyway after he managed to have his other hearing in a Manila court moved.

One accused after another told the court the difficult situation they are in. Capt. Ruben Guinolbay, remembered as the hero of Lamitan, said that since he is not allowed to have a cellphone and other means of communication to the outside world, he does not know the whereabouts of his lawyer, Trixie Angeles. (She was able to catch up in the afternoon hearing.) Other accused officers echoed Guinolbay’s situation.

Betraying insensitivity to the plight of the detained officers, the panel denied their motion for postponement saying that they should have gotten another lawyer. Besides, Col. Marian Aleido, the lawyer in the panel, pointed out the presence of military lawyers who can represent them.

Lt. Belinda Ferrer, the lone woman among the accused, declined the services of the military lawyer and insisted that she wanted to exercise her right to be represented by a counsel of her choice.

Verdadero stood up to enlighten the panel that “it is physically and financially impossible” for the detained officers to get a new lawyer in a matter of two days. He disclosed that most of them are taking the cases pro bono because where would the imprisoned officers get the money pay them? To lessen their financial drain, family members of the officers give the lawyers a free ride to Tanay which is a six-hour trip both ways.

But the most insensitive comment came from prosecution lawyer Lt. Col. Jose Feliciano Loy, who attributed the absence of the defense lawyers to a delaying strategy until the case prescribes in February 2008.

The allegation railed Guinolbay who tried to approach Loy to tell him “we are not enjoying our lives as prisoners.” Cooler heads intervened.

Convened illegally, violations of the law are no longer surprising in this trial. But as what happened last Wednesday, they don’t always get their way.

    Someone in Esperon’s surrender gang entourage should tell him what ever he does there’s no turning around that he is incompetent and that as in Murphy’s Law, “In any hierarchy, each individual rises to his own level of incompetence, and then remains there.”

    The sentry said, “Halt, who goes there?”

    The chauffeur, a corporal, says, “General Yago.”

    “I’m sorry, I can’t let you through. You’ve got to have a sticker on the windshield.”

    The general said, “Drive on!”

    The sentry said, “Hold it! You really can’t come through. I have orders to shoot if you try driving in without a sticker.”

    The general repeated, “I’m telling you, son, drive on.”

    The sentry walked up to the rear window and said, “General, I’m new at this. Do I shoot you or the driver?”

    Conscious of his new position, Lt Colonel Jose Feliciano Loy quickly picked up the phone, told the enlisted man to enter, then said into the phone, “Yes, General, I’ll be seeing him this afternoon and I’ll pass along your message.
    In the meantime, thank you for your good wishes, sir.”

    Feeling as though he had sufficiently impressed the young enlisted man, he asked, “What do you want?”

    “Nothing important, sir,” the enlisted man replied, “I’m just here to hook up your telephone.”

    So we see even the military justice has turned into a broil of incompetence. It is short of a terroistic act on the persecuted. Such things happen due to the half cooked manipulations, whims, or panic spoiling what to be said on the SONA and to the foreign monitors. Of course those things happen and not new anymore to us and the world audience.

    Your story about this Lt. Col. Feliciano reminds me of a petty officer in the US Navy I met, who would always introduce himself with his P. O. title as if it was something big. One day, I went to the Yokosuka Naval Base in the outskirts of Tokyo to visit a friend, and she and her husband fetched me at the gate. Then, we met this Filipino there, who was making yabang again. He introduced himself to my friend and her husband with “Petty Officer Something” (Sorry I forgot his name).

    I saw the American husband of my friend raising an eyebrow, and when we were a distant away, he burst into laughter. He actually introduced himself as just “Mr. Lewis” even when he was in fact a Commodore, and this Filipino was in fact a nobody!

    But then, it’s a sickness I guess because it is not just this Filipino in the US Navy who would do that but also others of ranks back in old P. I. who do that because they think they are already a somebody with this and that title!

    Kahit hindi na nga Congressman, tinatawag pa ring Congressman for example as if the position is permanent one kahit na dahil sa naboto lang sila. And I guess, this is one of the main reasons why this Zubiri or this Poohtah would do anything to grab their positions—kahit ibenta ang kaluluwa kay Satanas!

    Diyan nakikita sa totoo lang ang pinanggalingan—nobody! Talagang mayabang lang!

Lim, et al na maraming common sense, and would defy anyone who would tell them to do foolish things. Same with Trillanes and Company. Malas nila maraming duwag na ayaw magutom I guess kaya hindi sumama! Iyong matatapang, tignan mo naman ang ginawa—pinapugutan pa ng ulo, and then the leaders wash off their hands! Hindi pa man talo na sa guerra!

    The petty officer in the U.S.Navy are those enlisted men. Petty Officer third class, Petty Officer second class then Petty officer Ist class. Next they become CPO-Chief Petty Officer, then Senior Chief and the highest enlisted rank is Master chief. Most naval recruits in the Philippines during those times were not lucky enough to retire as a CPO. Only those who has brain and pass the tough exams can make Chief. Most of them were stewards in the ship. They only peeled potato everyday and wash dishes and some mop the deck and tik-tik kalawang. I am not putting them down and I pity some of them.When they become CPO,they manage the kitchen,Chief cook. But,as you said they are mayabang. I could not question that, I’ve seen most of them when they spent vacation in the Philippines and they get all the beautiful girls in town. They cleaned the beer stock of Manang Lagring sari-sari store and the astray dog of Andoy.

    I don’t know and I am not sure, but, I am having a mix-emotion about this Fr.Bossi and the beheading of those gallant Marines. Coincidence about those previous events. First of all people are outrage about the close senatorial slot regarding Dayana and Koko, wrath and disgust on the pending proclamation. Abalos was having a headache how to douse the situation think it was an orchestrated ploy to divert attention and anger of the people. Since, the sick-boy gonzales is a good manipulator, maybe, he come-up with a plan and Pandakikay agree to have a Zarsuela of moro-moro to keep people’s mind busy watching the play.

    CBCP has an iced-cooled demeanor on the event of Father Bossi, because for sure they knew that he will come back alive. Also, the Tipo-Tipo scenario,9 hours firefight with no rescue. Diversion tactics on Dayana’s proclamation. That’s the way how I look at it, close to my Tiagong Akyat fictitious story.

    Father Bossi just got released. Thank God but there was something bugging me. Why was the news of the release read in other countries first? Secondly, it just occured to me that the many syndicate ring leaders actually belong to the military. What if Father Bossi was actually with this military syndicate and they got away with multi millions in the operation. This is just a pigment of my imagination, maybe, but it may be true. If some of these military mafia can actually kidnap and kill, kidnapping a priest for ransom is too easy for these crooks! Never mind if the 14 marines were killed as long as they got the boot. Was the reason for assperon’s matter of factly response to the death of the marines an indication that someone up there may have known that Father Bossi’s abduction was just to milk more money for the military mafia’s pockets?

    Now, Let me comment some thought on the unlawful plight of these incarcerated gallant soldiers through politically motivated persecution. It will be a regrettable mistakes to proceed the court martial on this soldiers, But, obviously wether I and you like it or not, we have no power to halt the tyrant not to proceed his evil will to convict these soldiers and put them to death. But, we have every right to express our disgust to stop this tyrannical misdeed on our soldiers. Luckily we are not on their shoes but, in essence we can feel their despair, anger and agonies.

    They are under a dictator and inept military commander. A commander who is a shame to humanity and he deserve no respect not even a left-handed salute, although middle finger may work. Their commander is not a defender of the constitution but, a commander of criminals and a hold-uppers in robes. One most important things I can say that:== Esperon can jail the resistors, but he can’t jail the resistance.

    I don’t see anything wrong with being an Enlisted Sailor, Soldier or Marine. The same way I don’t see anything wrong with people who do construction work, garbage disposal, maintenance etc..Enlisted personnel address themselves with rank because it’s what they have been taught and trained since Basic Training. Officers commonly refer to fellow officers on a first name basis and all of this is common among us military.

    A “commodore” who finds it amusing that a CPO will introduce himself with rank is definitely not the norm. This officer who I think is just plain insecure because he couldn’t do the cool things some people do in the military probably gets the same look from enlisted personnel in Special Operations. What a loser

Wala talagang aasahan ang mga detained officers and their lawyers na fair trial sa kalbong yan kasi tuta yan ni assperon. In exchange of a juicy position in the AFP, ipagpapalit ni Yano ang kanyang kaluluwa. Yan ang turo ni assperon sa kanya, yan ang turo ni tyanak kay assperon.

    Mam ellen, kindly look into this matter: Parang kaduda duda yong prison break sa basilan just happened earlier. Malamang kasama yan sa deal para irelease si fr. bossi. I don’t believe that the priest was released because the captors were pressured from military and pnp operations. Baka ang afp and pnp ag pressured sa taong bayan kasi di nila alam kung anong solusyon gawin nila. Pressure pa sa malacanang kasi mag SONA na.

    I’m just so sad for the loss of lives of 14-30 marines in this supposed rescue, as if their death meant nothing to this despicable government of pidal-arroyo!

    Except for the kidnapped foreigners, who if not recovered, will mean an international blackeye again for the pidal woman, a Pilipino life doesn’t count, gloriawise!

    i agree with you chi when it comes to comparing the jonas and bossi stories.gma can send batallions of soldiers to find a foreigner whereas jonas is sent to the sea of forgetfulnes.the bossi story is more like an american film with a happy ending for the hero while the extras were beheaded. the more lamentable is that this is true life and the scriptwriter is a filipina.

    When an enlisted personnel in a military camp introduces himself to a visitor, it’s SOP to introduce himself with his ‘rank’, eg., Petty Officer Galungong, etc.

    I have been asking myself lately, what if those beheading are actually committed by same group who are responsible for all these Forced Disappearances and Extrajudicial Killings?

    Glueria needs to justify this Anti-terror Law [HSA]. And what could be the most effective way of winning public opinion than a 911-type barbaric act? Something she could have easily learned from her Master Bush.

    Remember, the MNLF were honest enough to acknowledge on the first day that they were engaging the Marines for incursions. They denied the beheadings. And they want international human rights group to investigate the matter.

    So what if the Marines’ Beheading were actually committed by gov’t intelligence forces [Bert Gonzales Group]?

    Afterall, these soldiers are not of their kind.

    A unit of the Philippine Marines were ambushed last July 10 while they were out in Basilan, MILF-Abu Sayyaff country searching for the kidnapped priest; 14 Marines were killed (or 30 depending on whether we could believe the MILF spokesman E Kabalu or not); there was enough public “outrage” following the beheading of the 10 Marines among them; Chief of Staff AFP Esperon made a Surrender Gang declaration saying he wouldn’t jeopardize the current Malaysia-chaired peace talks with the parallel army in the South and went on to propose a 3-year truce with another parallel army, the NPAs; the forked-tongue pronouncement gave us inkling that Esperon was prepared to go into a protracted war with the Muslim insurgents in the South – materially, the AFP cannot fight both fronts simultaneously; MILF continuously denied their “troops” were responsible for the beheading; same insurgents had also insisted they did not know who kidnapped Bossi; 9 days after the beheading of the troops and a few days after all the AFP chief’s hypes before the media, Bossi was released.

    (And guess who broke the news? Prime Minister of Prodi all the way in Italy!)

Let’s face it, the threat of an all out war in the South prompted them to produce Bossi, of course a little prodding by Malaysian advisers must have helped but there can be no doubt the MILF knew which button to push to get his kidnappers to produce Bossi from the very beginning! Bastards! And they had to kill 14 or 30 Marines to prove their point?

    I don’t disagree that Gloria did not shell out the money (swapang iyan) but am pretty sure she was privy to the transaction – she knew that the Italians would be shelling out the money eventually (just like with the Sipadan hostages, Europeans paid for their release) but the transaction couldn’t have taken place without the brokering by people licensed by Malacanang.

    In other words, they Gloria “knew” who was keeping Bossi! That they should even acknowledge MILF pronouncement that the insurgents didn’t know is pissing and spitting on the dead.

    And as you say, the mutilators and beheaders are more well off than before.

    I understand that our church has missionaries in Mindanao, but for some reason, leaders of our church have the wisdom to remove them when they get this promptings that they should do so.

    So far, I have not heard of any of our missionaries getting killed in the Philippines by the tulisans. In South America, we have had quite a number of missionaries getting killed there but not politically related. I doubt if our church also pays kidnappers. Dinadaan sa dasal.     Maybe, you have a point it automatically became part of the law. If you are talking about the statue of limitation. But, to my little knowledge and understandings about government if the President does not like a bill, she can refuse to sign it. When she does this is called VETO (not veto deodorant,ha).If the President veto a bill, it will most likely never become a law. However, Her Tongressman in Congress can override her veto, but to do so two-thirds of the Tongressman must vote against her.   103. Rose, I agree that if the AFP implodes, not only the foot troops will take the brunt of the implosion but everybody will lose – the institutions will become shaky. The ‘chaos’ can only serve to strengthen the Surrender Gang headed by Gloria and Esperon.

    But that can only happen if the “news” that the marines were sacrificed reached the bowels of the braver units of the AFP, that’s when restiveness might happen. But truth is I have misgivings – I think that in spite of the “danger of restiveness”, nothing will happen. Our APF is basically not cohesive. There’s a moral vaccum that makes it difficult to be cohesive.

    The Angie Reyes-led mutiny succeeded because it was organized, galvanized, and led by civilians (it was really just a mutiny because there was no movement of troops to take over important institutions or zones, i.e., airports, broadcast stations, etc.)

    In that sense and ironically enough, Banana Republics are more progressive in the military sense than our republic.
    Not because our military men are physically coward but to me, it is their lack of moral courage that makes them incapable of committing a coup d’état to topple a corrupt civilian government (not that I am for a coup d’état at all and certainly not with the kind of AFP leadership we have) – or we know that moral courage is the backbone of any successful military or para-military undertaking.

    Hi Rose: I’m afraid (but really this is just my personal thought based on my little knowledge of how the military works, RP’s included) that not even Biazonn Ping and Trillanes could bring cohesiveness in the military.

    Firstly, by definition, the military is a martial institution – and as is lead by people from within that martial environment so that people who are retired and gone from service are not in a position to martial those still in service. The three senators we speak of are already retired and as such are considered GONE, completely gone from the military, no longer in their books and can no longer officially marshall elements within – and these senators know that. If they want to do anything of the kind, they have to course it through the people still in active service to achieve results.

    Secondly: That being said, only those who are existing within the service can establish or have realistic influence on cohesion.

    In this regard, the 3 Senators who were formerly military officers may act — and should act — as fiscalizers; the results of their actions may well — and should — trickle down to the military but officially and technically, they cannot do anything more than that — the laws that they may promulgate will be adopted but in the end it is the officers in the active duty that will make that happen — not these Senators even if they were once in the military.

    That’s why it’s all very well to count on, depend on, rely that these former military officers to change things in the military but at the end of the day, only the laws that they promulgate can effect the changes that we want in the AFP.

    However, it seems to me that there are 2 senators, i.e., Ping and Trillanes (I am discounting Biazon because while he is a fiscalizer today and I say good on us, he has failed in many instances to show moral courage), today who have not only the physical courage but also the moral courage to do more than just promulgate laws in the hope that they would have positive effects on the AFP — they may actually influence leaders within the military to move in the direction our two senators would like them to move.

    But these two senators must be able to count on those officers and men without whom nothing can be done within the AFP that they (Ping and Trillanes) want done.

    To Chabeli: Yes, I believe the Marines can launch a successful coup d’état — they possess a real and more pronounced esprit de corps than most of those units in the AFP, the capability to mobilize at short notice, the ability to accept to put their lives in the line of fire, the tactical intelligence (training) to engage the enemy in combat, but they need air power (Air Force) and a bit of help from the Rangers (Army) without whose material help, they cannot do it unless of course, they become truly vicious. Otherwise, would be difficult to succeed on their own.

  116. If there are changes to be made in the military, the guys who can realistically do and effect them are those in the military themselves.

    This is what’s happening in the British Army. General Dannatt, Army chief whom I believe has just blown his chances of becoming the chief of the UK armed forces for going public, is the one who’s going on the offensive to obtain the changes he wants in the military. His moral courage is extraordinary but that’s what sets an effective military leader from a mere follower.

A seminar refresher course in Military Justice is a requisite to appointment to a commanding officer position.
    A closely cropped haircut, or crew cut, even a shaved head is not an offense in the military manuals. It has significance only in the unit’s traditions. As to deliberate unjustified changes in schedules, Captain Guinolbay’s lament that “we are not enjoying our lives as prisoners.” has merit. He and his fellow detainees desire freedom, more so if charged falsely.

The Code applies to all soldiers that if you are a soldier; You must be ready to give your life for your country. Never surrender your own free will. If captured make every effort to escape. Make no agreements to obtain parole or accept especial favors. You must keep faith with your fellow prisoners. The senior prisoner eligible for command, wether officer or enlisted, assumes command secretly if necessary within the a PW-prisoner of war-camp or with groups of PW’s, according to rank, without regard to service. Others obey the lawful orders of their superiors, regardless of service, they support superiors in every way.

    These are a good soldiers and officers kaya kung nagpakalbo man silang lahat ay dahil sa utos ng most senior officers na kasama nila sa kulungan who is in command..Everyone of them must follow his order kahit na nakakulong sila.
