Out of whack

It was not only very wrong. It was stupid.

The argument by the Department of Justice which was upheld by Judge Oscar Pimentel’s pitting the more than 11 million who voted for detained Antonio Trillanes IV for senator against 85 million Filipinos was simply out of whack.

The exact quote by DOJ prosecutors is: “As the prosecuting arm of the government, it’s shield and sword of law and order represents not only the 11,138,067 voters who voted for him but the People of the Philippines, with all its 85 million citizens and counting.”

It’s the kind of argument that can only come from persons so detached from the people who have shown their disgust for their master, Gloria Arroyo, by voting eight of the opposition senatorial candidates despite the millions of money they spent on TV advertisements and buying votes.

They have already deprived the people of one senator, Aquilino Pimentel III and they are robbing the people of another one.

The argument does not only reflect deficiency in math. It’s mental and moral dysfunction.

It’s basic that in an electoral system, the candidates who get the most number of votes represent the people. They should know that of the 85 million, only a little more than 40 million were registered voters. Of those 40 million voters, only 75 percent were able to cast their votes.

To pit Trillanes’ more than 11 million voters against 85 million Filipinos is also to pit the votes of the other winners, like Loren Legarda’s 18 million voters against the whole population. It’s stupid.

Estrada’s almost 11 million votes in the 1998 presidential election represented the wish of the Filipino people to have him as president. It was Gloria Arroyo’s almost 13 million votes in 2004 that were not representative of the votes of the Filipino people because as we all found out later, those were products of the crime of electoral fraud.

In his decision denying Trillanes’ motion to be allowed to attend Senate sessions, to set up a working area in his detention cell in Fort Bonifacio, and for media access, Pimentel said he was “not persuaded” by the reasons forwarded by the accused.

That’s disappointing.

What we found significant among the comments of the commanding officer of the Marine Brig, Lt. Col. Luciardo Obeña.

Obeña did not object to Trillanes’ attendance at Senate sessions. “The Honorable Senator will be picked up and transported back and forth by the Senate sergeant-at-arms or his representative with adequate Senate security every time he attends the purposes being mentioned.”

Obeña objected to the setting up of an office in the Marine Brig but he suggested “other areas at the Bonifacio Naval Station or the PMC staff quarters located within the Marine Barracks Manila.”

Obeña didn’t object to Trillanes granting interviews to media in his detention quarters.

Not surprisingly, AFP chief Hermogenes Esperon overruled Obeña.

This case, People of the Philippines versus Lt (s.g.) Antonio F. Trillanes, IV et al. has been rendered obsolete by the result of the recent elections. The people have spoken. The people of the Philippines support Trillanes and the causes he fought for in Oakwood four years ago. The people want him to serve them in the Senate.

We are trying to understand Pimentel’s refusal to see merit in Trillanes’ request to be allowed to respond to the people’s mandate.

At his stage of his career, when he is due for retirement and he is not in the best of health, we imagine the kind of pressure being brought on Pimentel.

Pimentel has shown in the past that he is capable of enlightened decision by allowing Trillanes media access during the last stage of the campaign up to proclamation day.

He still can do it again. That would be his legacy to the Filipino people.

    I find it absolutely unfortunate that a duly-elected Senator of the Republic will not be able to discharge his mandate — his duties and responsibilities.

    As a member of the Senate, and consistent with the constitutional mandate on the separation of powers, I fully respect the court order.

    However, we must stress that attending (Senate) sessions forms an indispensable part of Senator Trillanes’ mandate.

    Senator Trillanes’ involuntary absence from plenary deliberations will totally deprive him of the opportunity to clearly assert his views and introduce proposals that could contribute in a big way to the crafting of crucially important new legislation.

    Thus, I still find it tragic that the mandate of over 11 million Filipinos will not be given any meaning. This mandate clearly includes seeing Senator Trillanes in the halls of the chamber, and hearing his views with respect to issues of national and public interest.

    Given the background and history of Loren Legarda, I’m not too certain about her future position especially when 2010 comes to a close. More than the others, she has her eyes focused on the 2010 Presidency. So far, she’s speaking like a true blooded opposition. But would she remain that way? Only time will tell. I have a question, though. Her election protest is pending. Now that she has been elected as Senator, what happens now to her protest? Does it now become moot and academic. Filing protest with the Election Tribunal is a nightmare and never-ending agony not to mention the amount of money one has to spend. I now worry about Koko Pimentel…can he survive emotionally and financially such agony? And what if the decision is in his favor later? How can he take back those time and days that he has missed? The same question can be asked of President Estrada. What if he’s acquitted? What about those years taken away from him?

    It’s simply foolish that the DOJ prosecutors muttered such lines they represent the 85 millions Filipinos and counting. Like Judge Pimentel, they failed to see the merits as to why the more than 11 milllion voters cast their lot with Sen. Trillanes and for that matter, most of the opposition candidates for senator. They failed to see that the electorate abhorred what the government has been doing thus a clear repudiation of the administration candidates inspite of its vaunted political machinery and plenty of money the buy votes. The government prosecutors cannot anymore claim that they speak for the 85 million Filipinos because most of the cases they espoused that reached the Supreme Court were decided against them. It means, they are completely and totally inept, inutile at walang kakayanan except to follow the dictate of their forever acting permanent secretary as dictated by the forever acting, lying and cheating panggulo ng Pilipinas.

    The legal battlefield at lower courts is tedious and lot of surprises. The Supreme Court has the final say on Trillanes case.

    Is Gloria Arroyo scared of the Senator Trillanes? There’s no surprise why Makati RTC Judge Oscar Pimentel is parroting Malacanang’s line of argument. Gloria and Esperon want him in jail. He is a direct threat to GMA’s stolen political power and her corrupt generals.

    I confident that if Sen. Trillanes is given a chance to do his job as duly elected senator of the republic, he will investigate what went wrong in Tipo-Tipo fiasco. The unnecessary death of 14 Philippine Marines cannot be hidden under the rugs. There are more questions than answers what really transpired before, during and after the firefight.

  8. Pimentel’s decision reflects the kind of government we have – a government that doesn’t give a damn about votes; it seems the only election process that this government and the judiciary (starting from Davide) respect are people who can steal votes.

    Those whose votes are genuine matter not an iota. Gloria stole her votes so she’s ‘respected’ but those won honestly by an incarcerated officer who moreover has not been convicted don’t matter. Absurd in the extreme.

    Wonder if the right honourable Pimentel has ever read any of the treatises by Jean-Jacques Rousseau!

Just because the DoJ is considered the state prosecutor does not mean they represent the people. They are presidential appointees, not elected officials. As for the senile Judge Pimentel, may the Lord have mercy on his soul.

    I sympathize with him in his situation but that’s no reason for him to sell out on a case that involves not only the life and career of an elected senator but also the fate of the Filipino people.

    Yes, Trillanes’ lawyer, Reynaldo Robles said they are filing a motion for reconsideration because in the past Judge Pimentel had reversed his decisions. He is capable of an enlightened decision.

    If they still fail there, they may go to the Court of Appeals, then to the Supreme Court.

    Meanwhile, he said, Trillanes has instructed them to just continue doing their work. They are preparing two bills. One is to address the inequity of soldiers who die in defense of the country. (Families of soldiers are okay if the cause of death is high profile like the 14 Marines but there are others who die in unpublished battles and they don’t get that much financial support.)

    The other is to address the problem of child malnutrition and abject poverty.

Gamitin niya ngayon kung hindi magiging lisya sa tuntunin ng pork barrel. Gamitin niya ang nasabing pondo para sa kapakanan ng mga sundalo. Para sa mga sundalo lamang.

    It’s really disgusting. It’s all political and the decision is surely influenced if not dictated by the mighty imp in Malacanang. It’s just that not only Trillanes is on the wrong side of the political fence but has shown that he is a fighter and never minced words in speaking out his mind and that makes the great thief and cheat really scared the shit out of her wits. But the most important to her is to deny one vote for the supposed majority/minority, so that her tutas in the senate has a greater fighting chance to bag the chairmanship of all the most important committees especially the Blue Ribbon. That’s how the “Hello Pimentel” came about.
    What boggles the mind however is the blatant inequality in the prescription of justice. The very basic of the case is why Honasan who was tagged as the mastermind on the alleged coup is now a freeman. If the case against Honasan is dismissed, it follows that all the cases against his followers are deemed dismissed too. It’s just plain common sense, but that’s not the case. Trillanes and company are continuously persecuted because they refused to toe the line, while Honasan learned to swing and dance to the tune of the Pidals, So, that’s how life is in the two-tiered system of justice in a country under the governance of a devil personified.

    Kapag naging matagumpay ang layunin ni Sen. Hindi na natin pagtatakhan kung magkaroon sila ng lakas ng loob na magkaisa upang palayain si Sen.     The 11-page decision merely juxtaposed the arguments of both sides. Then at the end, he says, “Wherefore, premised considered and the Court not having persuaded by the reasons given by the accused Sen. Antonio F. Trillanes the IV, and for lack of merit, all the requests of Senator Antonio F. Trillanes IV are hereby denied.”

    folks, am trembling and breathless in this issue, as i have said in my previous thread, there’s no any other brain behind the unjust decision of judge oscar pimentel but gloria and essperon (no doubt i bet!).

    judge pimentel can not compare jalosjos’ case with that of trillanes. in mathematics solving problem, you need to proved how you arrived with the answer by derivation of formula until you come up with a balance equation.

    what judge pimentel did is, he just copied the answer of one’s without proving it correct ! because her professors (gloria & essperon) tell him to do so !!!

    Gago din ang judge na iyan na ikukumpara ang 11M na pilipinong bumoto kay Senator Trillanes doon sa bilang ng mamamayan ng Pilipinas na hindi pa nga nila alam exactly ang tamang bilang kasi mali-mali naman ang statistics ng mga pilipino dahil sabi ng mga intsik, mahina daw sa Arithmetic ang karamihan dahil hindi naman tinuturuan ng tamang pagbilang. Ang dami pang pekeng mga birth certificates, etc.

    The fact that he should have considered was that Trillanes was voted by the people, who have the mandate over his judgment especially with recommendations coming from criminals like Gloria de Poohtah and Esperon de Daya! Gosh, everybody knows these two were partners in crime in 2004, and even before and after that. Bakit hindi iyan ang ikumpara noong judge na iyan doon sa rapist na si Jalosjos! Ang bobo naman! Puro yabang lang. As my mother says, “Lastog talatta. Awan met nakim na!”

    Gordon actually makes sense … now if only I can be convinced that he really believes in what he is saying and has no vested interests in the matter. Alam mo naman ang mga politicians natin, they can make brilliant arguments – either pro or con – for any issue regardless of what they know is right; and of course, there is no doubt that they would be willing to sell their own mothers to get what they want. (JDV has practically sold the souls of his children, both dead and undead.)

    If Gordon really believes that the law applies to ALL, then he should start showing a good example by giving up all his “perks” (both those granted and forcibly gained) as a senator. These assholes push their weight around 24/7
    even in the most unnecessary situations: like this ex-senator (buti nga natalo) from Eat Bulaga who has his bodyguards jump the business class line at airport check-in counters – he doesn’t even approach the counter for
    personal identification.

    Going back to the Trillanes thing – if there were issues with his legal qualifications to take office, should this not have been addressed before the elections – on whether he should even have been allowed to run in the first place? Nagmumukhang sour-graping tuloy.

    And of course, it doesn’t help Gordon to have Brenda on his side of the vote – another one of those who have sold the souls of their dead children.

    Of course, the cheat-of-staff and his bodyguards will not bring themselves to embarassment by addressing Senator Trillanes “Your Honor” when the later interpelates/questions Asspweron in the hearings.

    Therefore, inutusan ni Asspweron si blinky Gloria who in turn ordered (bought) judge Pimentel, who out of gratitude for his dialysis machine, wrote (signed) the most ludicrous decision of all time!

    We cannot have a systematic cara-cruz justice just because the fellow is undergoing dialisys. (Very expensive by the way – wonder where he gets the money!)

    Either he can do it or he can’t. If he can’t he must withdraw from the case.

    Conrado de Quiros in his column at the Daily Inquirer was spewing fire when he said of the wrong math of the DOJ prosecutors and Judge Pimentel with 11 million votes of Sen. Trillanes being pitted against the 85 million Filipinos.

    De Quiros was right in saying that once a candidate is elected in a nationwide election, it means he ceased to just represent the people who voted for him but by and large, the whole population. It is clearly the case of Sen. Trillanes. He is a Senator of the 85 million Filipinos and counting!

    i have a different reading here in the sense that the prosecution’s mentioning of the “85 million people and counting” (ang yabang, ano..ngitngit!), pertains to the power that they weild as prosecutors. Nevertheless, it is poor comparison as there is no real data to compare apple to apple. Judge Pimentel is way out of bounds if he buys such nonesense, and should go back to learning basic math. Then again what can we expect from our in-justice system..

    Damn! This judge should use the dialysis machine for his brains. Filter all the dying cells and rejuvenate the old ones.

    I suggest the same procedure for nincompoops Esperon, Gonzales, Ermita and the whole Arroyo family including the maids! Miriam is exempted. If she undergoes the same, she’ll be left brainless.

    On second thought, it might be just what she needs.

    Ayon sa argumento ng DOJ na sinangayunan naman ni Pimentel ng Makati RTC, kung papayagan si Sen. Trillanes na magtrabaho as mandated by the voters, ito raw ay parang inayunan ang boses ng 11 milyon LANG laban sa 85 milyon and counting!

    Kung ganun pala e di meron nang karapatan ang mga pinoy na tawagin si unelected Senator Dayana Zubiri na that “Maguindanao Senator”!

    Napakabobong argumento ng DOJ at ni Pimentel! Tailor-made for the twin cheats of Gloria ang Asspweron!

    puede bang mabawi ni Pimentel ang decision niya..and say I am sorry I made a mistake? Or does Sen. Trillanes have to file an appeal for an overturn of this decision? Wala na akong tiwala sa mga judges sa atin kahit sa Supreme Court..Ang lungkot ng pangyayari.
