Court denies Magdalo petition to dissmiss coup d’etat case

Citing the “strong and sufficient evidence” presented by the Department of Justice, the Makati regional trial court yesterday denied the petition of members of the Magdalo group, including that of former Navy lieutenant-turned-senator Antonio Trillanes IV, seeking the dismissal of the coup d’etat case filed against them in connection with their short-lived mutiny in Makati.

In dismissing the petition, Makati RTC Judge Oscar Pimentel gave credence to the prosecution’s claim that the crime of coup d’etat was committed by the accused when they seized the Oakwood Premier Hotel on July 27, 2003.

“After considering all the evidence presented, the Court is convinced that there is sufficient evidence to strongly believe that the crime of coup d’etat was committed under Article 134-A of the Revised Penal Code,” said Pimentel’s 40-page ruling.

All the 31 junior officers, including the six core leaders of the Magdalo group: Marine Captains Nicanor Faeldon and Gary Alejano, Navy Ltsg. James Layug and Trillanes and Army Captains Gerardo Gambala and Milo Maestrecampo, acted as petitioners.

In their petition, the accused said the prosecution failed to prove three vital elements that will establish the crime of coup d’etat: that there was swift attack accompanied by violence, intimidation, threat, strategy and stealth; that the attack was directed against duly constituted authorities of the Republic or any military camp, communication networks, public utilities or other facilities needed for the exercise and continued possession of power; and that there was conspiracy among the accused.

The group of Gambala and Maestrecampo, mostly Army junior officers, said they “just stood their ground for their political beliefs and aspirations,” noting that this is guaranteed under the bill of rights.

Gambala’s group also argued that the case against them should be dismissed since the DOJ has already dropped the charges, citing lack of evidence, against the Magdalos’ alleged instigator Sen. Gregorio Honasan.

Pimentel, however, gave weight to the prosecution’s arguments that there was overwhelming evidence against the Magdalos, citing the testimonies of 22 witnesses, including former AFP chief Efren Abu who served as ground commander of the government troops during the incident, several unindicted co-conspirators who turned state witness, and recovered materials allegedly spelling out the plan of the group.

The prosecution said the logistical preparations involved indicated that the move was a “long-planned conspiracy” with the intent of “seizing or diminishing state powers” contrary to the accused’s claim that the takeover was a spontaneous act in protest of corruption in government.

“It would appear that the sudden occupation of a first-class hotel in the commercial district of Makati by all the accused who at that time are all officers of the Armed Forces of the Philippines, carrying automatic rifles, accompanied by laying of explosives, placing snipers and machine gun nest in the Oakwood twin towers and followed by their announcing of demands, including but not limited to, the resignation of President Gloria Macapagal Arroyo, Secretary Angelo Reyes and Brig. General Victor Corpus and other high-ranking government officials, thus even briefly, are all constitutive of what appears to be elements of coup d’etat,” Pimentel’s ruling said. – Ashzel Hachero

But God is just..ang sabi nga sa Prov. 22: “don’t take advantage of the poor just because you can. dont take advantage of those who stand helpless in court. The Lord will argue their case for them and threatens the life of anyone who threatens theirs.” He undergoes dialysis twice a week and is not in good health as Ellen had mentioned previously…well ano kaya ang ibig sabihin nito? And come to think of it si siraulo ay nasa hospital din?… well, well a dark cloud is hovering but underneath the cloud is a silver lining. Ang sabi nga..”Hiram sa Dios ang ating buhay..”

    Frankly, it is at times like this that I thank God and my father for encouraging me to find my place under the sun so that when I was already of age, and hated living in America, I told him I’d just settle down in Japan, the land of one of his ancestors. As a police and court interpreter as well as a paralegal, I have first hand experience of what real justice is all about.

    Over in the land of the rising sun, perjury is not encouraged. In the Philippines, it is even apparently considered normal with the prosecutors, lawyers, and even judges conniving to commit perjury. Yuck, nakakai-Yuck talaga! Kawawang bansa!

    gloria conspired with officers of the military led by angelo reyes, the church under cardinal sin and the evil society, grabbed power and forced Erap out of the presidency through coup de etat disguised as edsa dos. That’s the same crime they are imputing on Trillanes and company. If it’s alright then for Gloria and company, why is it wrong now in the case of Trillanes? Is it because the former succeeded and the later failed? If so, where is justice and rule of law in all these cases including Erap’s.

    As I said in my post in another thread,the very basic of the case is why Honasan who was tagged as the mastermind on the alleged coup is now a freeman. Now, if I were Trillanes and the government continue to persecute me, the best thing for me to do is to finger at Honasan as the mastermind and oh how I love to see the reactions of Siraulo Gonzales and his prosecutors. If all of them point to Honasan as the mastermind behind the failed operation, the government has two options, put back Honasan in jail and prosecute him or dismiss all the cases against them. Honasan is now a member of the arroyo loyalist so it’s a wonder how they handle the situation.

    Goji, totoo yan. I heard that one of his RAM members ended up paying his investor relatives for decades just to save face with the relatives dahil nabangkarote and funds ng RAM. Whether it was Honasan’s fault is unknown. I know too for a fact that most of the “men of honor” do not share honasan’s ideologies now. The Honasan now is not the Honasan they knew then!

    if the magdalo group would say “sorry” particularly AT4 and plead support to gloria, then the case would just be “mutiny” instead of “coup d’etat” and most probably, the case even dismissed. as i have said repeatedly, gloria is the “supreme judge” among all the supreme judges in our judicial court, nothing else !

    the court has it right. it was coup d’etat. though better presidents before her have seen the wisdom of moving to have rebels welcomed back into the fold, this one will take no prisoners. she has exercised the presidential powers of pardon wrongly enough (regardless of the question she has the right to exercise it) i doubt it isn’t possible in this case. but as usual, the fervently rabid is blind to everything else. anyone who talks or acts opposite what they want are instantly branded as under the thumb of Malacanang. forgetting that in the most crucial times, the courts are the only ones who fought to upheld our freedom. Goji, go disparage someone else, but not those who are better than you. you think you are better than everyone else. this is why most people here pisses me off. they think they’re the only ones holding the light of wisdom. blind hate rules you all.

  26. I feel sorry for Nur Misuari. I knew him as a student at the Asian Studies Institute at UP. He was a scholar there then. Tahimik. I never expected him to become a rebel. Mas mukha pa ngang rebel iyong kababayan niyang si Mukhtar who has become a high-ranking DFA official. Sayang siya talaga, but then, I guess if I had stayed in the Philippines myself, I could have ended up being a rebel myself.

    My father actually cautioned me about joining those student rallies we used to hold in front of the US embassy during my college days at UP. I never actually imagined Nur becoming a rebel. Siguro talagang iyon lang ang paraang magagawa ng mga may tunay na pagmamahal sa bayan. Lumaban!

    Parasabayan, Honasan has not explained where those funds go until this day. Same with Sen. Angara who was reported to have stolen the bulk of the FPJ funds donated by the Fil-Chinese Community and businessmen. Why these people never
    make any accounting of the funds trusted to them remains to be a mystery to me. Could it be that many others were involved?

It’s this kind of attitude that encourages thieves to steal more. Anyway, since you’re quite knowledgeable about the political events, can you tell me why Jinggoy is now behaving the way he is now? To my surprise, he defended Mikey and Iggy Arroyo for heading two powerful House Committees saying the two should be given a chance to prove their worth. Among those in the opposition, I least expected Jinggoy to make such a statement. At the very least, he should have just kept quiet. Either he is now acting on his own that’s independent from his father or his actions now have the blessing of this man in Tanay. That now gives more teeth to the rumor that Estrada might have struck a deal with Malacanang. It’s sad….but I hope not.

Could it be that many others were involved?” and my answer? bec. thieves stick together. or they all fall down like London bridge. imagine if one thief accused his colleague (who may have angered him/her somehow) of theft and produced fantastic evidence to back up his claim. this accused theft would produce his own evidence agst accuser accusing him of theft also. and since both of them are guilty of it, both are damned. that’s why thieves stay silent and cover for each other. that is a thief’s honor. that’s why the anti-dynasty law isn’t given teeth in congress. no one wants to apply it to them and their families.

    I guess the judge ruling on Trillanes case need to invite legislative action, people need to be very careful in predicting how the court will rule on this certain issues, In judicial restraint, It is not the court’s role to write law, that philosophy will have a bearing on how they decide cases. We hope that our legislature will amend the law that going to return to what the traditional role of the court is, that’s to interpret the law, not just strike down laws they don’t like based on the bigotry of the judge to a person.

    Sorry, if some people here pisses you off. But we are not ruled by blind hate, dahil ang pagkadismaya namin kay Gloria at sa administrasyon niya na talaga naman apaw na apaw na ay naniniwala kaming may matibay na basehan. The Philippines is at worst under Gloria. At iyan din ang nararamdaman ng karamihan sa mga naghihikahos na nating kababayan. And this is how we express our OUTRAGE against this evil regime!     its true that the judiciary only interpret the laws which created by the legislative body…but there is also common law that can be apply and overlook by those who implement the laws that in every rule there is an exception. and if the government offering amnesty to the rebels that is given, for humanitarian reason. rebels are rebels they need to have new life, hence, why amnesty or pardon cant be applied to those 28 men who speaks for the truth..kasi ba iba ang pag-interpret at pag-apply sa dalawang grupo? government is for the people, by the people, senator trillanes voted by 11million filipinos. can’t the judiciary look on it that this 11million people are also included to those ‘for the people’ and ‘by the people’ wherein those rebels who where given amnesty are not such as many as those 11million filipinos who wanted him to be a part of legislative to speak for the truth…

    The way I look in Trillanes case and the ruling of the judge on the case, the fulcrum of justice will not tip the balance on the 11 million plus who voted for him under the present despotic regime. The only hope for Trillanes to get the judge compassionate ruling; Someone has to circulate a petition for the entire 11 million and present an argument in the Sala of the judge and convince the court that; This is what the people want–To attend the senate deliberation and perform his duty as an elected legislature–It is a long shot, but who knows!

    To me, I no longer have any confidence in the Judge overturning his ruling. The Supreme Court is the last stand against this insidious destruction of equality, liberty and justice for all. Think that I am overreacting and losing confidence, Then look around listen to what several of their alibis. Pandakikay and Esperon keeps pushing their hands on judicial process, have said about making sedition a capital crime offense punishable by death and outlawing the withdrawal of support by Gen.Lim and Col.Querubin. The cretin fake president succeeds in getting the Supreme Court vacancies filled with his favorite judges, then the female mentally handicaped senator threatening the public that she will pose naked just to fill that vacancy also, if that stripped naked bear positive results, Filipinos can kiss their human and civil rights goodbye. Alternative plan for Filipinos is to be ready for the resurgence of an Underground Railroad.
