Inquirer story: Issue is fraud, not contempt

Maguindanao election supervisor Lintang Bedol yesterday was found in indirect contempt by the Commission on Elections en banc.

He was sentenced to six months in jail and fined P1,000.

The decision was called by the opposition as just “a tap on the shoulder” and “insufficient and insulting.”

Comelec said Bedol can post bail of P15,000 as the offense is bailable.

Bedol’s lawyer, Andrei Bon Tagum, said they had filed a bail petition but Bedol was likely to spend the night at the office of the Comelec Law Department as the Comelec en banc has deferred action on the petition for today.

Tagum said they were given five days to either file a motion for reconsideration before the Comelec or Supreme Court.

If Bedol fails to do so, the order will be deemed “final and executory” and Bedol will be arrested and detailed at the Manila City jail.

The commission said Bedol violated the Comelec’s Rules of Procedure (Section 2, Rule 29) after he repeatedly snubbed several subpoenas of the commission, illegally assuming the election documents of Maguindanao, challenging the commissioners to file charges before the proper court and boasting of an armory of firearms.

Bedol looked calm minutes before the start of the promulgation. He told reporters that he was fearful of another eye operation more than the possibility of being behind bars.

Asked about the guilty verdict, Bedol said, “Okay lang”.

Tagum said: “We were surprised by the penalty. We think it is quite harsh considering that we feel the Comelec has no jurisdiction over the case.”

Tagum had questioned the filing of contempt charges saying the Comelec was acting as the National Board of Canvassers, which had administrative functions, and not as a commission en banc, which has quasi-judicial powers.

Opposition lawyer Leila de Lima said they are more interested in the continuation of the investigation of Task Force Maguindanao than the contempt case of Bedol.

“We would like to the task force to look into the bigger picture in the fraud incidents in Maguindanao by calling the other election officers,” she said.

TF Maguindanao head and elections commissioner Nicodemo Ferrer said they want to set Bedol’s case as an example of the determination of the poll body to “show its muscle.”

“Through this, we want to show that the Comelec deserves respect, not only from the public but also from our own employees. In order to preserve this institution, we must show that we mean business,” Ferrer said.

He said the filing of the other charges will come soon as they remain pending in the Comelec law department.

Bedol also faces a criminal case of infidelity in the custody of public documents for losing the municipal certificates of canvass of Maguindanao, the penalty of which is a maximum of six years’ imprisonment, as well as an administrative case of violation of the Civil Service Code, which could result in his removal from office.

Senate minority leader Aquilino Pimentel Jr. and Sen. Panfilo Lacson said the decision “is a shocking revelation of the topsy-turvy priorities of the Comelec in punishing Bedol for a very slight infraction and forgetting the major offense that he committed through electoral plunder of the elections in Maguindanao.”

Lacson said he expected Comelec to investigate further the alleged cheating operations in Mindanao such as the missing certificates of canvass and alleged pre-fabricated ballots.

“It only shows that the Comelec is not serious in solving the problem,” he said.

Sen. Francis Escudero said the punishment imposed on Bedol has nothing to do with the alleged cheating or what he did during the last elections.

He said Comelec chair Benjamin Abalos should explain to the people what happened to the investigation on alleged cheating in Mindanao.

Sen. Rodolfo Biazon said Bedol’s most contemptuous act was what he did with the missing COCs.

“His refusal to show the certificates of canvass was playing games with the will of the people – as it was needed for a timely resolution for the result at that time,” Biazon said.

Akbayan Rep. Ana Theresa “Risa” Hontiveros, pushing for Abalos’ impeachment, said: “The Comelec’s capacity to shock Filipinos with its incompetence is amazing. They could have just done away with this farce and constructed a monument for Bedol.”

“He (Abalos) should be blamed for single-handedly demolishing the integrity of the electoral process. Any attempt to reform the Comelec is impossible as long as he is the chair of the Commission,” she said.

Press Secretary Ignacio Bunye said the Comelec’s verdict was based on what “is called for by the circumstances” and the Palace respects its decision. – Gerard Naval, JP Lopez, Wendell Vigilia and Jocelyn Montemayor

He was fearful of another eye operation..dapat lang matakot siya…nagbulagbulagan siya noong election..baka mabulag ka nang tuluyan..after all ang sabi ng panggulo na nagkakasakit ang kanyang mga tauhan sa sobrang trabajo..si Gonzales, ay may bleeding ulcer, si Oscar Pimentel ay may sakit na rin..si Claudio ay ganoon din, ang asawa niya at baka siya rin.. iyon ang kasabihan na saramaha lang sanda tanan..and start paying your debt to the people..may utang na nababayaran ng pera but mayroon din na iba ang kabayaran…one by one they fall..this is just the beginning of her downfall…natural causes..God is just..

I do not even believe he will even serve a day in jail and if he does, he will have an airconditioned room with an ice box and a double layered bed box!

    Bedol lesser punishment compared to a grave crimes he committed is that; the indications are clear that justice to his cheating victims is not working well. It fails to adequately protect society from his crime. It fails to reduce crime to deter criminals like him. The Abalos COMELEC are too often motivated by a personal political agenda rather than the protection of law-abiding citizen of the society. The COMELEC is fickle and unreliable. The evidence is overwhelming that the system is broken.I think the most grievous punishment for him is to draw him from the prison to the place for his execution in Luneta, upon an hurdle of carabao in hog-tied, hang him till he’ll be half dead, and then take him down, and quartered alive; after that, his members and bowels will be cut from his bodies, and thrown into a fire. That’s the right punishment for him.

They are being charged of insubordination as their mutiny is considered simply as an act of insubordination, and punishment is only some military discipline, no combat duty and no jail term unlike what the idiots have done to the Magdalos who have been in jail for four years now with no case yet!!!

    I was disgusted to see this Bedol on TV taking his meal at Comelec. He was enjoying his meal. One night stay at Comelec with special treatment. Then, he was brought to the Comelec court accompanied by security escorts. Finally, he was given six months jail and P1,000 fine. That’s what one gets for working for Malacanang.

Panfilo Lacson, with an overall total of 19 percent, followed by Senate President Manuel Villar Jr. at 10 percent. Fifth placer was Sen. Manuel Roxas II with eight percent and Sen. Richard Gordon with three percent of the vote.

    But Mrivera, do you know what Malacanang would say about the survey? Again, they would say it doesn’t bother them. They say surveys are commissioned by those who pay them to do this for ill motive. But then when the survey is favorable to the Palace, Bunye, Ermita and the Malacanang goons would immediately cheer. Indeed, Estrada still maintains the highest rating despite the recent negative news about him especially on the alleged “Erap tape”. His popularity is unmatched in the Philippine history. If election is to be held today, Estrada will knock out Arroyo in the first round, just three seconds.

    Well yes, we’ve had so much bad experiences with the two female presidents (Cory and Gloria). Without offense to women, I don’t think women can make good leaders.     Abalos et al and this bogus government’s hope to accomplish by sentencing bedol is put closure on the anomalies of the last election. They have to think again. People are not dumb or stupid to take that kind of a band aid and moro-moro solution. It’s some kind of window-dressing to show-case to the people that they are doing something. Key events and questions have been swept under the rug without even a word mentioned about it; instead the case just centered on the contempt charges. One may suspect that the sentence was already a done deal or pre-arranged even before they hear the case, and bedol may not even spend a minute in jail as long as he is allowed to post bail. It’s a sham and shame on them.

    Every member of the family has his own role to play. Husband should perform as husband. Wife should perform as wife. However, it’s no longer the case these days with many women preferring their career over family. And the rate of men staying home taking care of the kids and household is increasing. Running a country is different, though. Even without touching on the biblical basis, my opinion is that men are better leaders than women. I’m sorry if many of you disagree. Our pinoy culture was seen as a natural order of the society. Seems while accepting the system of male dominance women usually bargain with patriarchy. For instance, it is widely believed that women’s honor is highly dependent on their husbands often times, women are subordinate to their husband. Even in bed men are always in top and the women guide the spot. Most of the women need protection, material and emotional security. This may be the reason they do not resist to males being dominant, because in return to their subordination women receive security. If males want females to be obedient and accept the system of male dominance, they better be able to provide women with economic and emotional security. Women are usually soft and small, and most of them like when males take care of them.
    Due to the emerging financial circumstances, whoever earn the most is the Boss, and who earn less will wash dishes. My friend suffered a chronic illness,-AssMa-and his wife loves HoneyDo. Sometimes when divorce arise the wife always take the child, if the husband insist, the wife can tell her ex-husband that the children are not his.Hehehe!

    Gentlemen, your arguments are well taken. Yes, the world is changing. Time has changed. But changes when it comes to the role of a man and a woman, husband and wife should be based on what the moral and ethical values say. Divorce between husband and wife is rampant today; but does it mean it is right? Live-in and premarital sex are rampant today, but does it mean it is right? I’m just citing an example. I understand that it’s up to the individual’s conscience. Still, I cannot imagine a wife dominating the family. If it’s okay to both of you, then fine with me too.

    I try to teach my kids by telling them by example what to do, not what not to do. Why, because the slogan ‘Don’t Take Drugs’ as an example didn’t work because kids don’t listen to what they shouldn’t do – but they listen to what they should be doing.

    And do you know why Bedol was charged such a light penalty? He threatened the Comelec that he would tell everything if he was given a heavy penalty. The guy knows many things. Many Comelec officials which of course include Abalos were involved.

    True, Loren Legarda’s name is being floated these days. Surveys still give her the highest rating among the presidentiables. But to me, she’s just being overrated. Until this date, I still don’t trust this woman. She was a Catholic who converted to Muslim and now who knows what religion. His past marriage life is also in question. There’s a report that she owed a lot of money in the 2004 election so much so that she was forced to mortgage her ancestral home. The bank was about to possess the house when she ran to another senator’s help. This veteran senator now affiliated with the administration has long rumored to be her secret lover. In fact, it’s already an open secret. The senator used all his might to help her even issuing his law firm’s check to pay off her debts to keep her house which she inherited from her ancestors. Since her man is with the administration, won’t it be logical that she be the administration’s candidate in 2010.
    All the more I object to a woman leading this nation…not with the likes of Loren.

    medyo pahapyaw pa lang yan, dahil malayo pa ang pagpapalit ng anino sa Malacañang.Kung tutuusin ay hinihintay pa natin ang June-December 2010. Kulang-kulang 40 buwan pa ang nalalabi para masabi talaga na mayroong legacy si tiyanak!

    Alam na naman nating lahat na 3 ang Arroyo sa Kongreso: Pampanga, Negros at Camarines.

    Lahat ito ay may asawa. Hindi malayong mangyari ang mga asawa nito ang magtutuloy ng kanikanilang mga political-economic agenda.

    Maliban na nga lang ang isang tambay ng Cebu at makapag-asawa na rin yun. Medyo mag-iiba ang ihip ng hangin.

    Pero sa palagay ko, taga San Juan(METRO MANILA) ang magsisilbing gabay sa susunod na mga eksena sa lararangan na politika sa bansa?

    Magbunga sana ng grasya ang mga itinanim na binhi sa ekonomiya ni Gloria!

    i don’t care who would be the next president is, be it a woman or a man it doesn’t matter to me. what matters most is the real personality to be a “human being” and not an “evil one” like gloria.

    when that president possessed that “soul” to be a human being’s, then i believed, the wish of everyone to live in a “healthy nation” would not be in vain, (god will). simple as that.

    Most don’t care who the next President is, man or woman. But if we base on the two female Presidents we’ve had, things don’t look good having another female president. If not for greed and lavish style, Imelda Marcos would have been a better President add to this was the beauty she possessed. Wait…do you see the many similarities between Gloria Arroyo and Bush? Both are son and daughter of former presidents. Both are least liked by the citizens. Both are war freaks. Both got elected (or selected) via alleged cheating and fraud…Bush in Floria and Arroyo in Mindanao. Both would leave their office with the lowest popularity ratings in their respective country’s history. Both are habitual liars. What else???

    Mrivera, I think you were not referring to Miriam Quiambiao but Miriam Santiago. Do you know that this Santiago underwent cosmetic surgey like liposuction. The doctor did a lousy job on her. Her physical appearance is worse today.

    Miriam Santiago’s brain used to be full of fats. She was doing okay when Estrada was the President. After his ouster and Miriam jumped over to Malacanang, she decided to have liposuction of her brain. Her brain now has become very small.
