Update: Six senators in the mongrel majority join minority to push for reopening of “Hello Garci”.
Malacañang yesterday said the revival of the investigation on the “Hello Garci” scandal that Sen. Panfilo Lacson is calling is “in aid of destabilization” and in aid of Lacson’s presidential ambition in 2010.
Apostol said he does not believe that the Senate probe is meant to improve the electoral process, saying it is “just a front so Senator Lacson could have a good publicity.”
“That’s in aid of destabilization, because he will run for president in 2010. (It is) as simple as that,” said chief presidential legal counsel Sergio Antonio Apostol.
“This is a recycled case,” he also said.
He said Lacson could be charged if he is in possession of a wiretapped recording. He said the opposition senator should remember that his parliamentary immunity only involves immunity from arrest but not from suits.
He said Malacañang will invoke executive privilege during the Senate probe after the Palace has gauged its motives through the set of questions that the investigating Senate panel will submit to the Palace.
Apostol said former intelligence agent Vidal Doble, who claimed to be a member of one of four teams from the Intelligence Service of the Armed Forces tasked to conduct wiretap operations in 2004, could be charged with perjury because he first testified that there was no tape in his possession.
He said Doble could also be charged for violating the anti-wiretapping law.
Doble appeared Tuesday in a videotape played by Sen. Panfilo Lacson during his privilege speech. He first surfaced in June 2005 when former NBI official Samuel Ong pointed to Doble as the source of the “mother of all tapes” on cheating that Ong said was in his possession.
Apostol said some senators are “not enthusiastic” about the planned investigation because they may be made respondents in the criminal case and “the Senate may be abolished because under anti-wiretapping law they are also liable.”
He said the wiretapped tape is “a useless piece of evidence” because it was obtained illegally.
Apostol said the opposition cannot initiate impeachment proceedings against President Arroyo because there are only 19 opposition congressmen at the House.
Press Secretary Ignacio Bunye said Congress should instead concentrate on passing the budget and cheaper medicines bills and in ratifying the Japan Philippines Economic Partnership Agreement.
“The agenda of economic growth and peace must prevail over attempts to pull us back from winning these goals,” Bunye said.
Bunye also said Malacañang is not invoking Executive Order 464 or Memorandum Circular 108, but the Supreme Court decision on EO 464 (Senate vs. Ermita case).
He said officials may attend e budget hearings in Congress but once the questions deviate from the budget, they can invoke executive privilege.
Executive Secretary Eduardo Ermita said Wednesday EO 464, issued in September 2005, was not totally declared unconstitutional by the Supreme Court and that only Sections 2b and 3 were voided.
After the Supreme Court ruling on EO 464, Arroyo issued Memorandum Circular 108 which gave specific guidelines on the appearance of department heads and other executive officials before Congress.
Senators Joker Arroyo and Richard Gordon said they would not be part of the planned Senate investigation that would use illegally obtained evidence such as the “Hello Garci” recordings of conversations between President Arroyo and former election commissioner Virgilio Garcillano.
“If they would insist on introducing an illegal evidence, I have to oppose, come what may,” Arroyo said in a media briefing.
Arroyo said he is compelled as a lawyer and a public official to oppose the use of illegally obtained evidence during a Senate investigation.
“No Palace cover-up here. It’s plain and simple constitutionalism,” he added.
Arroyo chided the opposition for what he said was its double standard in approaching the issue.
He recalled that during final deliberations on the anti-terrorism bill, the opposition in the Senate opposed liberalizing the proposed law fearing that it could be used against them.
Now, opposition senators now favor using illegal wiretap as evidence, he said.
Gordon said: “Why should I participate? I can’t do otherwise, the law is very clear.”
He said “mere possession” of an illegal wiretap is illegal.
Gordon said Doble and his alleged accomplice, former Capt. Frederick Windell Rebong, should be charged instead in court for committing an illegal act.
He said Press Secretary Ignacio Bunye should, in fact, also be charged for possession of an illegal wiretapped conversation.
The “Hello Garci” scandal on alleged cheating by the Arroyo camp in the May 2004 elections erupted after Bunye made public the existence of the recordings in June 2005.
Gordon challenged Lacson to file charges against Doble for illegal wiretapping.
Former President Fidel Ramos called on the Senate to focus on its legislative work instead of reviving the “Hello Garci” issue.

And with the Hello Garci investigation, the Senate can use it in aid of legislation of several laws, like amending some provisions in the Wiretapping Law, amendments on the Omnibus Election Code or the Election Sabotage Law, the role of the Military in political exercise, the law concerning the Communication companies/offices or the use of communications, etc.

Chi: when you mentioned the “silence of Bishop Villegas” I wondered whether Doble told his story in a confessional or just a story without Villegas using his clerical stole before he hears confession. From what I learned in high school..when a priest hears confession he wears the stole which is a symbol of the seal of confession in the sacrament. That means that what ever he hears in a confession he is not to reveal to anyone. Diego, guess who Malacanang immediately contacted to defend Arroyo after Lacson announced the re-opening of the Garci case? Malacanang contacted Senator Angara who became hesitant to comply what Malacanang wanted him to do. He then passed the job to his colleagues in the administration party. Few want to engage Lacson in this new debate because the evidences against Arroyo are surfacing. For those who have presidential ambition in 2010, it’s a very tough job to defend Arroyo. Good for the opposition. Good for the people. Good for the country. Let’s go and shake Malacanang till it falls into pieces!

I guessed that our Balanga Bishop was requested by the fake president to help fetch Doble from the Makati seminary, of course using his sutana. Kasi siya lang ang malapit sa Manila among the bishops na kampi ni Gloria. The one in Manila, masyadong halata dahil mataas na masyado ang ranggo nuon para gamitin. Balanga is only 1 1/2 hours from Manila by road, 15 minutes siguro by hele. Saka, close friends sila by virtue of the late Sin.

We should be glad to know that six senators have joined the minority group to re-open the Garci case. They are Villar, Escudero, Kiko, Alan and Pia Cayetano, Jinggoy. But, they would be faced with strong opposition from Malacanang die-hards Enrile, Santiago, Angara, Joker and Gordon who are all veteran lawyers. And that’s not all…what if INC’s Manalo gets into the picture and call the senators one by one just like he (Manalo) did during the first impeachment resulting in the withdrawal of many congressmen who signed the impeachment complaint?

The Department of Tourism (DoT) has asked the media to help promote the Philippines and erase its negative image in the international community.
During a recent press conference held at the Coconut Palace in Pasay City to launch the 6th Celebrate the Sea event, DoT Assistant Secretary Cynthia Carrion said in her travels abroad, she has met with some foreigners who expressed apprehension to go to the Philippines because of frequent news of killings and abductions in the country, particularly those involving the Abu Sayyaf in Mindanao.

Republic Act (RA) 4200 entitled “An Act to Prohibit and Penalize Wiretapping and Other Related Violations of Private Communication and Other Purposes,” Section 1 of the Act provides that “it shall be unlawful for any person, not being authorized by all the parties to any private communication or spoken word, to tap any wire or cable, or by using any other device or arrangement, to secretly overhear, intercept, or record such communication or spoken word by using a device commonly known as a dictaphone or dictagraph or detectaphone or walkie-talkie or tape recorder, or, however, otherwise described.”
Gaanan vs. Intermediate Appellate Court, [145 SCRA 112 (1986)]: The use of a telephone extension for the purpose of overhearing a private conversation without authorization did not violate RA 4200 because a telephone extension device was neither among those “device(s) or arrangement(s)” enumerated therein, following the principle that “penal statutes must be construed strictly.”
The “Hello Garci” tape is a taped conversation conducted through cellular phones. The wording of the prohibition is relative to tapping “any wire or cable,” and cellular technology does away with both wires and cables. Thus, 4200 inapplicable.
In Navarro vs. Court of Appeals, GR 121087 (Aug. 26, 1999), the court differentiated between public and private conversations. Thus, it said a heated exchange between two persons in the presence of a third who recorded secretly the exchange was not private in nature, and therefore even if secretly recorded, was admissible in evidence.
A conversation between a President and an election commissioner involving the conduct of an election is NOT a private conversation.

It is, however, permissible to intercept and record a telephone conversation if one of the parties to the call consents, absent a more restrictive applicable law. This is known as a one-party consent regime. The statute applies to cellular and cordless conversations as well. In no cases is it legal to intercept the conversation of two or more parties where no one is aware that it is being recorded. It will become legal if it preceded by verbal or written consent of all parties to the telephone conversation. Some courts have found that employees may have consented to the recording of their telephone conversations while on the job, provided sufficient notice has been given, but only if the employer makes very clear to the employee that their conversations may be recorded. Also if a landlord informed a tenant that all telephone calls were monitored as a prerequisite of the lease, that the tenant had consented to the monitoring and recording of the calls. Then it is legal.
In Ramirez vs. Court of Appeals, “G.R. No. 93833 (Sept. 28, 1995) The Supreme Court disagreed with the petitioner. It stated that Section 1 of R.A. 4200 clearly and unequivocally makes it illegal for any person, not authorized by all the parties to any private communication to secretly record such communication by means of a tape recorder. The law makes no distinction as to whether the party sought to be penalized by the statute ought to be a party other than or different from those involved in the private communication. The statute’s intent to penalize all persons unauthorized to make such recording is underscored by the use of the qualifier. Consequently, even a person, privy to a communication who records his private conversation with another without the knowledge of the latter will qualify as a “violator” under this provision of R.A. 4200.
In this “Helo Garci”,The tapes was illegally obtained and Garci can file a charged against those who has position with the taped recorded conversation. Garci did not gave anyone his consent to record his comversation.
Now,why Garci did not file a complaint in court for violating his secrecy right under republic act (RA)4200 also known as anti-wiretapping laws, because he knew that the court will deliberate on the content of the tapes and the truth will come out and he don’t want to break his silence.

1. WHO is the brains behind ‘Project Lighthouse’?
2. Who ordered the ISAFP to wire-tap Garcillano? Doble and the other groups will not do it on their own. As he said they were ordered to do it by their superiors, Col. Sumayo, Capt. Rebong, Capt Lindsay at MSgt Villedo.
3. Who is/are the higher officer/s who gave order to these ISAFP heads? And who is the highest officer who gave the order?
My point is… the order should be WITHIN the Chain of Command. If not, meaning, the order came from a civilian (like Ed Ermita or Norby Gonzales), then there might be a case of TREACHERY or TREASON! And that would be very, very, very dangerous to our nations’s Security and Patrimony!

Gordon challenged Lacson to file charges against Doble for illegal wiretapping. The wiretapping is the brainchild of DOJ. He wanted to collect all telltale evidences on the destabilizing schemes of the opposition. He gets updated immediately on positive wiretaps. Remember he announced there were 2 colonels involved during the FPJ interment? The primary office, Isapf had to submit all records at each end of the day. Garci and his buddies were on their watchlist to see if other people are calling for devious reasons. When there was imminent trouble brewing on the Garci tape, the conversation was immediately recovered from the files for the hurried damage control task given to Bunye. Isafp keeps its own copy and thats where Doble and company got a copy for their patriotic business. Thats not the only copy they used for blackmail.

Vidal Doble is just following orders from his superior and as I understand, is not the one who made the wiretap but just made to listen to the conversation and recorded it. Another group of Mig21 is responsible for the actual wiretapping. So kailangan na tukuyin ng imbestigasyon kung saan nagmula ang utos. Because if ANY military official will follow an order from any CIVILIAN (like Ermita, Gonzales or FG Pidal) to use the organization is a breach of national security and may therefore constitute TREACHERY or TREASON. These military officials should be penalized heavily even death sentence!

The so-called “Mother of All Tapes” started with Garci asking a man to “tape” something. It ended with him giving a man instructions to text Gloria and even clearly mentioned Gloria’s number. 25 star witnesses if not him, would reveal a crime so big it couls only mean massive cheating, nothing less.
Is it hard to spot blackmail masterminded by Garci himself, in cahoots with ISAFP personnel and SMART Telecoms technicians, funded by the Pinedas?
From the above facts, it appears that Gloria Arroyo was herself victim of blackmail from Garci’s group. Possible. Talagang delikado ang Pilipinas. Ibinebenta na hindi pa kumikilos ang Pilipinas. Mismo ngang mga hapon, wary sa mga deals ni Madame Bobary sa Tsina sa totoo lang. Collateral pati mga ibang bansa sa Asia sa totoo lang sa mga inuutang niya sa Tsina para lang ipangtakip butas niya at ipangyabang na malakas ang peso laban sa dolyar!
Sabi nga ng Mr. ko, bakit daw hindi nababahala ang mga pilipino! Hindi totoo ang economic progress na sinasabi niya. Sa guni-guni lang nilang mag-asawa iyon.

Syndicate? I don’t think so. I believe this blog is a tool to express and expose what is being suppressed! Different angles and views are presented regarding an issue. It is up to the readers to weigh things and believe what they want.
Thanks Luzviminda. I find comfort in your responses unlike the others. I said “syndicate” because some are acting as if they belong to one. And do you honestly believe there is a so called “Internet Brigade” or is just being floated by some crazy nut here?

Some of us here believe that there is a so called Internet Brigade. There was a time na talagang malala ang naranasan na panggugulo dito sa Ellenville lalo na nung panay ang bato hindi lang kay Gloria kundi pati kay Mike Pidal at hanggang sampahan na nga ng mga kaso ang mga journalists kasama na si Ate Ellen. Halata namang nanggugulo kasi karamihan sa comment nila ay non-sense at halos patulan lahat ng comment ng bloggers. Eh tatak na ng Ellenville talaga ang anti-Arroyo. Kaya kung may mga baguhan dito sa blog naq medyo iba ang tono ay naba-brand na kasama sa brigada. Pero kung di naman guilty eh just explain. Ganun lang. Parang baptism of fire.

Gokusen, when did I ever insinuated that you’re from Japan? That Zen2 is but I don’t think you are. If you review my posts and my responses to yours, nothing indicated that I was critical of you except my curiosity about your background. Since you joined the blog, you have given the other heavy bloggers some stiff competition which is good. In the past, it’s only two or three controlling it. One is on vacation but her partner is still here picking on those she thinks she can bully under the protective arm of the owner.
Luzviminda, I’m aware of some bloggers planted by Malacanang trying to sabotage this blog; but not those who have personal conflict with some spoiled brats. In fact, it’s only one who keeps yacking about Internet Brigade and she uses this to get back at those she hates. I also learned about Ellen’s receiving threat in the past; but nothing was heard about it since then. It could have been just made up to gain sympathy and there was no truth at all. I remember it happened at a time when she was among those being sued for libel by Mike Arroyo. Journalists sometimes are good actors too. It’s their profession. Their profession comes first before anything else. There goes the credibility problem. If she cannot even treat well-meaning bloggers fairly, how can everyone believe in her? Sorry but her consistent bias posture has diminished my respect for her.
If she keeps spoiling some bloggers here and making side, then she would lose supporters (some already were lost). In the meantime, she’s still very happy with the kind of sweet talks many are providing her not knowing that these people are just out to take advantage of this blog for their own selfish interest. It feels good if people kiss your ass; but don’t be too complacent ’cause someday these same people might kick (not kiss) your ass. Ellen, with all her years of career and intelligence might not have learned yet to distinguish between genuine and fake bloggers. As of now, Ellen is in cloud nine. Let it be…I don’t care. My only
wish is for her to learn how to be fair and not be blinded by sweet talking bloggers.

Luzviminda, you’re just echoing what Ellen always says when there’s no more room to argue. I expect you to know more than to say one is free to go. Is that the reason why many like you are silent and are afraid to offend the powerful bloggers and Ellen? What if I pose similar query to you: If you don’t like the way Arroyo runs the government, why stay in the Philippines? Get out of the Philippines! We’re not solving problems if we decide to be mum on things that can be discussed. Yes, it has often become personal but it’s because of the moment of passion. The statement “you’re free to go” is the easiest and most convenient way of hiding one’s guilt.
I prefer Mrivera’s advice. Thank you brother. I know I’m the most misunderstood blogger here; but God knows how much I care about our country and people. I’m just disappointed to see the same kind of people here like those we’re trying to remove in the Palace. Similar bunch of arrogant individuals, divisive attitude, hypocrites!

I am just stating the truth! Bloggers come and go. They can leave anytime if they are no longer happy in the blog. I blog to other sites too pero di ako masaya kaya dito ako nagbababad… To answer your question why I prefer to stay in the Philippines inspite of my dismay of Gloria? Simple lang maski bata alam ang sagot dyan!… I AM A FILIPINO and I HAVE THE RIGHT TO LIVE IN THE PHILIPPINES like the other 80+ million Filipinos. Gloria does not own and have no exclusive right to do what she wants to my country Philippines. Unlike here in Ellen’s blog, She has the right to kick or shut anyone out if she wants anytime. Bisita kami dito at ayaw naming maging bastos na bisita kaya ginagalang naim ang maybahay.Ang bisita hindi pwedeng gawin kung ano na lang ang gusto niya. Yan ang may galang!
