Boomerang kay Esperon ang panlalait

This is turning to be absurd. Navy Chief Admiral Rogelio Calunsag said they are studying filing of charges against the 28 officers detained in Tanay for issuing statements urging AFP Chief Hermogenes Esperon to tell the truth. Click here for Inquirer Online story.

Ang hirap talaga kapag ang isang taong makitid ang utak ang ilagay sa isang makapangyarihan na posisyon.

At delikado kung ang pakiramdam ng taong yan ay delikado ang kanyang kapit sa kapangyarihan. Kadalasan ay nagpa-panic at kung ano ang nasasabi at nagagawa.

Ganyan ang nangyari kay AFP Chief Hermogenes Esperon noong nakaraan linggo ng sabihin niya na na kaya hindi niya pinapayagan si Maj. Gen. Renato Miranda na magkaroon ng executive check-up ay dahil ang nakakulong na dating marines commandant ay “destabilizer”.

Ito ang eksaktong sinabi ni Esperon noong Lunes: “If they are asking for an executive check, what I know is that an executive checkup is a privilege for those who are not resorting to violence. For example, if you are not doing something illegal, you can have an executive checkup. But if you are a destabilizer, you are detained, why then are you asking for an executive checkup? We (military leadership) are not the ones who are at fault why you are being detained.”

Sa court martial hearing noong Biyernes, inireklamo ito ni Atty. Frank Chavez, abogado ni Miranda, sa panel na naglilitis at hiningi nila na –buwagin nila itong sariling korte kasi klarong-klaro na walang patutunguhan ang trial kungdi sa conviction ng mga akusado dahil nasentinsyhan na sila ni Esperon na siyang nag-buo ng panel, accuser, magiging witness at mag-apruba ng desisyon sqa paglilitis na ito.

Sinabi ni Chavez na hindi “destabilization” ang ginawa nina Miranda at iba pang opisyal noong February 2008 na nanindigan laban sa paggamit ng military sa dayaan noong 2004 eleksyon. Iyon ay “patriotism” o pagmamahal sa bayan.

Dahil talaga namang hindi maaring depensahan ang sinabi ni Esperon, sinabi ng Trial Judge Advocate news report lang daw yun at hindi sigurado kung totoo. Alam ko sa Malaya, ang aming defense reporter na si Victor Reyes ang sumulat ng report. Alam ko hawak pa ng mga dfense reporter ang tape at transcript ng interview na ito kay Esperon.

Binatikos rin ni Chavez ang hindi makataong trato kay Miranda nang hindi pinayagan dalhin sa ospital sa loob ng kampo nang siya ay matumba sa bathroom dalawang linggo na ang nakaraan. “Security risk” daw.

Sabi ni Chavez, alam ng mga miyembro ng panel na wala silang magagawa kungdi sundin ang gusto ni Esperon kaya naman tahasang bulgaran ang nangyayari sa court martial trial. Nag-apela si Chavez at ang mga 20 pang abogado na kasama niya sa miyembro ng mga panel .”Do not be a party to injustice.”

Sa tindi ng banat nina Chavez sa court martial panel napa-iyak si Col. Marien Aleido at isa-isa silang nagsabi na hindi sila mag-inhibit dahil “impartial” raw sila at wala silang kinikilingan. Talaga ha.

Malakas na ebidensya ang sinabi ni Esperon laban sa court martial na kanyang binuo. Mabuti naman at siya na mismo ang nagbigay ng pruweba.

    Hindi ba pwedeng i-akyat na ng mga incarcerated gallant soldiers ang issue na ito sa Supreme Court para mabuwag na ang impartial court na ito. Kung may tape recording ng interview, lalo na kung video clips, ay magiging ebidensiya na biased ang Kangaroo Court na ito and will not be able to render fair justice.

    Is the Assperon Kangaroo Court co-terminus with Mr. Esperon’s retirement February 2008? We don’t expect a fair trial under corrupt Arroyo regime. Assperon is following orders from his bogus Commander-in-Chief Gloria. The detained military officers may have direct knowledge Esperon’s cheating role in 2004 fraudulent presidential election.

    No. But the charge of “conduct unbecoming of an officer and a gentleman” would be prescribed (atty, help me on this) if the accused are not arraigned within two years after the commission of that offense, which would be in February. That’s the reason why Esperon’s panel is rushing the proceedings at expense of justice so that the officers would be arraigned beforet hat date.

Hopefully, the few good men in incarceration will remain strong and healthy and will not allow themselves to succumb to this new technique of depriving them health check-ups, good food, etc. It’s the new tactic of getting rid of them without resorting to the more brutal way of shooting them enmasse and burying them or tell them to bury themselves in their own self-digged graves as what has happened to the 800 or more victims of extrajudicial killings.

    Deprive them of proper medical care so they can die a natural death. Ang tindi!

    The few good men in incarceration should then do their best to stay alive, physically and mentally sound by all means until justice is restored with the removal of these crooks with or without a people’s power revolution. Puede naman sa totoo lang, if we can believe the claim now that 18,000 Filipinos have signed the anti-DH petition and more are signing daw according to a friend of mine in New York. I have asked him to have another one against the continued occupancy of the palace by the murky river of the GLORC!

  8. There was one good development in the later part of the hearing last Friday. I think the reporters will file the story today. it was discovered that the pre-trial advice which was the basis of the charges did not have the signed approval of Esperon. Clerical lapse, maybe. But since the lives and careers of the officers are at stake, pwede ba yun?

    Sana nga Ate Ellen ay gabayan ng Diyos ang mga justices para magkaroon na tayo ng FAIR and JUST Judiciary. At sana naman ay totoo ang hangarin ni Justice Reynato Puno na malinis niya ang sangay na ito ng gobyerno.

    i can only speculate on what may have happened at the PMA when these personalities were attending and what payments/privileges/promises have been given to Esperon for him to treat a fellow soldier/PMAer/roommate this way.

    But how can Puno lead a prayer gathering with most of the participants being Catholics? Puno is a Protestant. Protestants don’t offer long repetitious prayers. Baka hindi masanay ang mga nandoon.

    In other words, there’s not even an OFFICIAL basis for a court martial to be convinced or what? Are you sure there’s an official authorization by the commander in chief daw to convene one? Baka fake iyang court martial na yan pareho ng fake na presidente ni Esperon?

    Seriously, what if they send pre trial documents back to Esperon for signing today or as we speak, will it change anything?

  15. That’s the question raised by the defense lawyers. The court martial panel could not decide. so it adjourned.

    There was a memo of transmittal of esperon saying here’s the pti and pta which the prosecution said is implied approval. the problem is the recommendations of the pti and pta are contradictory. PTI recommends dismissal of mutiny charges. The charge of conduct unbecoming was only against some, not all the 28 officers. In the Constitution, presumption of innocence takes precedence. Ang labas nito, illegal detention for almost two years.

    Under the Human Security Act, a victim of illegal detention can claim compensation of P500,000 for every day that he was illegally detained.

    The election of Trillanes manifested strongly the belief of the soldiers and the Filipibno people that the AFP/PNP had been misused by the political leadership in perpetuating themselves in power.

    The recent actuations of Esperon to block to block the AFP personnel to reveal the truth in the ongoing investigations are part of an orchestrated, brazen scheme to cover up for their criminal acts in frustrating the people’s will during the 2004 and 2007 elections.

    The AFP objection for Trillanes to discharge his senatorial duties for flimsy reasons is an utter disregard for the voice of the people. It is only a matter of time before the divided elements of the military and the police will unite and join the Filipino people in the search for truth and justice.

    FYI, I interpreted for Manny Pacquaio when he came to Japan in 2005. Kasa-kasama ko sila for 5 days para sa boxing ng mga pilipino doon sa gym na pinanggalingan niya. Kasama niya ang Misis niya. But so what? I don’t idolize them kahit na sikat sila lalo na kung ang kilos nila ay para sa akin ay parang mga yagit! Hanga ako sa mga matatapang na gaya ni Ellen!

I was surprised to see her bloated on TV in the US when I was there and Manny was training for his fight at natsismis pa doon sa bomba star na anak ni Mayor Mathay. Yuck! Maski nga si Jinkee, nagtaka ako kung ano ang nakita kay Manny. Kung sa pangit, walang itinago.

    Malacañang yesterday said there is no more room in the military for the 28 detained soldiers who have been engaging in partisan politics after they called on Armed Forces of the Philippines (AFP) Chief of Staff Gen. Hermogenes Esperon Jr. to speak up the truth on his participation in the fraud-marred 2004 presidential elections led to the victory of President Arroyo.

    “The fact that this officers were obviously engaging in partisan politics, it’s high time that they should quit and get out from the military service because their statement against Esperon shows that they’re no longer loyal to the Constitution. There’s already a lost of a military discipline on them. That breed of soldiers has no room within our AFP,” chief presidential legal counsel Sergio Apostol, during a phone interview, stressed.

    The Palace official maintained that the military organization should remain apolitical.

    He added they are not threatened with that kind of political noise in the AFP, saying Esperon is already conducting loyalty checks among the men in uniform.

    “It’s regularly being done, the loyalty check. General Esperon is already checking on that,” the Palace official said.

    Apostol also warned that the disrespectful detained soldiers may be denied of a general amnesty from the President.

    He said their attitude could backfire on them since Mrs. Arroyo might decide not to grant them a general amnesty in the future.

    “That’s why we’re watching them because the more they criticize this government, their being disrespectful to the chain of command is not healthy. It only shows that it’s not even healthy for our President to issue them a general amnesty. She might forego this plan and rather let the courts decide on their fate,” Apostol stressed.

    Mrs. Arroyo earlier issued a general amnesty for the Communist Party of the Philippines-New People’s Army-National Democratic Front, which was sent to the legislative body in both Houses of Congress for concurrence.

    Apostol reminded the detained soldiers to be grateful on the government treatment on them, saying they are in jail, not VIP (very important person).

    “It’s not true that our government has been neglecting them, that we’re not giving them their medical needs or attention, there are doctors who have been checking on their health conditions. We have to remind them that they are in detention but should not be treated as VIPs,” he said.

    The 28 military officers were charged with staging the foiled power grab on Feb. 24, 2006.

    Why should these 28 officers quit? What crime have they done against the Filipino people that they should quit?

    If big mouth Apostol can prove that these 28 officers were involved in govt scandals like IMPSA, Joc-Joc Bolante, rigging of 2004 elections, in NBN-ZTE deal, then I agree they should quit.

    Follow the leader as we say. Mr Apostol would be doing the nation a great deal of good if he can persuade those leaders in Malacanang who have looted and are in the act of looting the national treasury to RESIGN or QUIT, then he may start asking anybody else to quit. Until then, he should put his mouth where it belongs, in his ass!

He was confined twice at Cavite Naval Hosp in Dec 2006 and January 2007, his attending physicians were a radiologist and a surgeon. The Cavite Naval Hospital does not have complete facilities. So when Mrs Querubin was interviewed in Bandila where she complained about Col Querubin’s health, early the next day, they immediately brought Col Querubin to V Luna Hospital where he was found positive of malaria palcifarum.

    One group is headed by Executive Secretary Eduardo Ermita and supported by DPWH Secretary Hermogenes Ebdane. Jr. The other group is led by DoTC Secretary Larry Mendoza supported by Undersecretary Tom Lantion and Assistant Secretary Rey Berroya.

    This stemmed from Gloria’s appointment of another ex-general, Art Lomibao, to succeed Berroya in cash-rich LTO, but Mendoza rejected it, knowing it was the handiwork of Ermita. Maceda now says Ermita is threatened that Mendoza may be out to grab his chair in Malacañang.
