‘Sinning’ bravely

‘Abnormal times require extraordinary actions.

Last week journalist Jarius Bondoc wrote in his column in the Philippine Star some of the things that Romulo Neri, former chief of the National Economic and Development Authority, had told him in confidence about the controversial National Broadband Network-ZTE deal, the latest anomaly shaking the Gloria Arroyo’s shaky presidency.

It will be recalled that when Neri appeared before the Senate, he revealed the “Sec, may 200 ka dito” bomb that did in Comelec chairman Benjamin Abalos. But when the trail reached the doorstep of Gloria Arroyo, he invoked “executive privilege” which is defined as in the Supreme Court ruling on EO 464 as “the right of the President and high-level executive branch officers to withhold information from Congress, the courts, and ultimately the public.”

Neri’s withholding a crucial truth angered many who felt that as taxpayers, they have the right to know what the government is doing especially why and what for they and their grandchildren would be paying P16 billion. The question on everybody’s mind was: “Will the truth be forever kept from us?”

In his column last Oct. 1, Bondoc wrote this,

“Romy bared many frightening things when he called me morning of Apr. 20. I had written that the government was rushing to award the ZTE contract the next day in Boao, China, and that the NEDA, which he headed then, had approved the overpriced telecoms supply in a huff. Before I could ask anything, Romy blurted three items in succession: “This deal was the handiwork of Ricky Razon and Comelec chief Benjamin Abalos … I warned President Arroyo about this, and also told Speaker Jose de Venecia Jr. … Abalos tried to bribe me P200 million.”

“I was stunned, and asked him to start over again by answering some basic questions. Like, how the NEDA got involved in this, and why a build-operate-transfer project suddenly became a negotiated supply purchase. He said “NEDA had to make an evaluation any which way.” Too, the law “allows the President to waive ODA (overseas development assistance) rules in a bilateral or government-to-government agreement.” He stressed that NEDA had no capacity to determine any overpricing, then explained the three steps in any NEDA project review.

“Three times Romy repeated he had warned Arroyo about the deal. He told her about the bribe offer, and she allegedly replied “then don’t accept it, but work on the approvals just the same.” He said Arroyo kept blaming Joey for the mess that was then brewing.

“The culprits in this deal, he said, are ZTE Corp., Razon, Abalos – and one more. When I asked why his NEDA approved the ZTE proposal when he knew all along it was stinky, he said, “GMA was pushing it, and it’s our job to process.” With pain in his voice, Romy said he had almost resigned the day before.

“Before he hung up, Romy said that my exposé had the potential to mar the administration’s chances in the May election. It was so explosive, he counseled, so I must be very careful.”

Many times, in a journalist’s work he is given information in confidence and nobody, not even a legally-elected president can make him reveal the source and things he had sworn to keep “in confidence.” Clearly, Bondoc broke his confidentiality pact with Neri.

But was it wrong?

I believe, Bondoc did the right thing in upholding public interest over journalistic ethics.

I can imagine it was not easy for Bondoc. But in life, we are all confronted with dilemmas. A sensitive writer once said, “There are dilemmas in which one ‘sins bravely’ however one decides.” That was what happened to Bondoc.

Some say that because of what Bondoc did, sources would be reluctant to share confidential information to journalists in the future. Maybe. Either way, the decision would result in consequences some of which may be difficult.

But I believe Bondoc’s revelation served public interest which should be paramount in every citizen’s order of priorities. Neri was wrong in following Arroyo’s order to invoke executive privilege when the information would reveal her complicity to the crime.

In Sen. Miriam Santiago’s speech last month on executive privilege, she quoted Lawrence Tribe, professor of constitutional law at Harvard, who said executive privilege is confined only to state secrets, informer’s privilege and internal deliberations.

State secrets relate to national defense or international relations. The information is of such nature that its disclosure would subvert crucial military or diplomatic objectives. Informer’s privilege is “government’s privilege to withhold from disclosure the identity of persons who furnish information on violations of law to officers charged with enforcement of that law.” Internal deliberations is defined as “intergovernmental documents reflecting advisory opinions, recommendations, and deliberations comprising part of a process by which governmental decisions and policies are formulated.”

Neri’s information regarding Arroyo’s order to ” work on the approvals” of the NBN ZTE contract despite her having been briefed about the flaws of the deal and the bribe offer of Abalos does not fall into any of three justifications for executive privilege.

But what is now clear to us is that Gloria Arroyo violated the Constitution that as president (even is it was illegally acquired) , she had the duty to “ensure that laws be faithfully executed.” Bribery is a criminal act and she closed her eyes to that. By forbidding Neri to tell the truth, she is obstructing justice.

Neri’s testimony will in no way destabilize the state. Gloria Arroyo, most probably. But Arroyo is not the state.

If Bondoc’s disclosure of Neri’s confidential information leads to the downfall of Arroyo, well and good. That would be good for democracy and the country. Thank you, Jarius.

    Neri does not need to directly implicate GMA for her role in the ZTE deal. In one media interview in China, GMA confirmed that Neri told her about the bribe and she admitted to have told Neri to continue with the deal. The case is closed. Even a non-lawyer would say that GMA should be charged as well for the crime. Ang problema lang…hindi sa proper forum sinabi ni GMA na talagang may suhol si Neri. She would again say she was misquoted by the media. Then, we have another denial over and over again. Walang mangyayari ano man gawin natin na paaminin o isakdal si GMA as long as she’s in power. Dapat sa kanya itumba na ngayon!

    The only executive privilege i have known is the privilege of elected official not to be subjected to lawsuit for his actions or words in connection to government business. (Debates and discussions and allegations and accusations in Parliament) Their is no immunity for Criminal offense.

    As for a journalist exposing the “confidential source” I don’t agree with Bondoc actions, unless it involves national security which is of paramount public interest.

    Jarius Bondoc might be redeeming himself for his past mistakes. He might also have a political ambition. Succeed or not in his expose, his popularity as a journalist has risen. Mas madaling tumakbo bilang mayor o congressman sa kanyang bayan in 2010 which I think is somewhere in Pampanga.

    Personally, never liked Bondoc… his exposés of the past rang of something not quite right.

    Not saying he’s wrong on this one but even that, I reckon it started because I have a suspicion he did that for Joey de Venecia.

    …elementary, Ana. Try again, and this time expose how gloria is selling the sovereignty of the pinoys to China and Inda. That tantamounts to treason. Rather than torching her at stake, I prefer strapping her to a balete tree on an anthill.

    AdeBrux, many journalists are indeed politicians’ dummies. If one is identified with rich and influential politician, then he is well compensated. Marami ang ganoon. That’s their livelihood. How can those like the Tulfo brothers sustain their lifestyle? Alex Magno? And now this Ducky Paredes? It’s sad…Ellen knows who they are and what kind of games they play.

    Bondoc may have violated the “rules” in journalism but he took the risk in informing us. I thank him for that. GMA, her family and the entire office all sin bravely..cheating, lying, stealing, killings etc. are all sins against God..and we let her get away with that..Alin sa dalawa ang mas grabe? It is so frustrating. Last Friday, my friend and I went to the JFK Library Museum in Boston..and we listened and went through the exhibits..and as I listened how I wished the Phil. would have a President like JFK no matter how short a time.. JFK served for three years at nakakahinayang..sabi ng kaibigan ko ” the good die young”. Kung ganoon di matagal pa ang paghihirap sa atin.. Malungkot isipin.

    You bet, it’s suspicious. And with Neri not telling it all, make this expose in fact useless. Over here, Anna, we are prohibited from getting involved in writing about people we are closely related with, not even when that subject has committed a serious crime. What they do is have other people write the “confession” and the journalist supplies the details with or without credit given him. It’s called “conflict of interest,”

The crook should not have been allowed in fact to serve as president at all, but what can you do when she, together with her husband, has managed to befriend fellow crooks in the court, military and the police, agencies that actually should have arrested her on the spot and jailed her.     Tungkol naman dito kay Boyba na asawa ni Glorya, hindi daw siya puwede dumalo sa hearing ng ZTE dahil daw sa sitwasyon niya. Noong siya ay nagreklamo kay Cayetano tungkol doon sa Bank Account niya sa Germany at nagsumbong sa Kamara .. agad agad gumawa sila ng hearing at si Cayetano ay buong tapang niyang hinarap itong Baboy na ito kahit siya ay minumura na. Yong mga columnistang idinemanda niya .. hinarap nila ang kanyang reklamo. Pero ngayon siya na itong takot humarap. Duwag din pala!!!!! Kaya pala pag nagsalita alanganin sa laki ng katawan niya.     Re- Mike Arroyo’s heart condition could they not get another doctor’s opinion? Puede bang ipakita ang medical examination report niya? Kung baga sa financial reports of a company..an outside audit?

    There should be another neutral doctor to check Mike’s condition. I bet you Mike will not attend. If he does he will invoke the “right to privacy” or “executive privilege”.

    May I be clarified on the law regarding the confidentiality of the sources of a journalist? Was the law designed to protect the source or the journalist?

    My understanding is that the law says that a journalist cannot be compelled to reveal his source/sources. If this is so, what if the journalist was not compelled by anyone but volunteered to reveal his source and the matters he and his source discussed? Is this a violation of the law?

    I can understand that this could be a violation of the journalist’s code of ethics but is this a violation of the law? The two are different.

    At any rate, I agree with the actions of Jarius. The morale law is higher than any law made by man.

  24. Phil, I know that the Constitution protects the journalist’s right to protects his sources. The Bill of Rights says “The privacy of communication and correspondence shall be inviolable except upon lawful order of the court…..”

    You are right about journalism ethics providing that “off-the -record” information should be “off-the-record”. But as I said in my column if dcaught in a dilemma, the journalist has to amke a choice between public interest and professional ethics.

    No law is violated. But I also go back to the bigger picture of the environment that we operate. Gloria Arroyo has destroyed institutions. You have a president who has not been elected by the people. Is that normal?

Ang pagkakaintindi ko rin ng protection of the source is to protect the source especially if there is this threat of freedom of expression, press and threat on the life of the source kaya may ganitong ruling. Otherwise, there is nothing wrong with exposing those who are involved in a scandal.

    I don’t know this Bondoc, but I’ll give him credit where credit is due. It is not idolizing. Just being fair.

    BTW, I don’t idolize anybody. It is against the Commandments of God. Remember, the Commandments about worshipping anybody other than God? But I’ll be willing to give credit where credit is due to be fair.

    This may sound farfetched, but has Jarius been asked whether he is the only with whom Neri has shared his secrets with? If indeed he was the only one, then I guess there must have been a lump in Jarius’ throat when he decided to come up with items not revealed by Neri during the hearing.

    On the contrary, if Neri has also mentioned the same things he mentioned to Jarius to one or two other confidants, and Jarius had knowledge that he was not the only one, then it would have been a lot easier for him to reach his decision to reveal more details. There wouldn’t be any reason to let the issue of confidentiality be too much of a load on the shoulders of Jarius.

    After all, Jarius was allowed by Neri to come up with his series of columns leading to the investigation by the Senate. Perhaps, Jarius also had the same clearance from Neri when he added more revelations. Afterall, the things told to a journalist is supposed to see print at the proper moment. Besides, Neri has not complained, or, has he?

    Agree but with a caveat: Jarius must name the other people who in his knowledge were also privy to what Neri had told him earlier on and on the basis that these 3 or two other people agree.

    Just my thought.

    In case you want to know where Abalos is, he’s regularly playing golf at Wack Wack. He might have enriched himself so much so that he doesn’t need to work anymore but play golf. Pero eto ang matinding binitiwan niyang salita: Hinding-hindi na daw siya babalik sa Senado. So there you go ladies and gentlemen…isa na naman hayop na tulisan ang makakalusot sa kurakot.

    Jarius telling what Neri told him is good for public information but it has no probative value in court. It’s hearsay. It’s different if it’s Neri himself saying it in public. I understand, that’s what Neri is avoiding- to be the one to cause the downfall of Arroyo.

    He is giving himself too much credit. If Arroyo, falls, it’s because of herself.

    Whoever can cause the downfall of Arroyo, let it happen. Ang tagal naman. Kahit sino…kahit sinong tunay na nagmamahal sa bayan. Ang importante ay mawala na si Impakta. To me, it’s not only about Jarius, Neri or whoever. The ones who can really cause GMA’s downfall is us, the people. So, let’s go!

    What do you think is the reason why Neri has not yet resigned? After indirectly implicating his boss in the ZTE scam, he knows that Gloria knows that he threw her into one big heap of trouble. He is now a pariah in the Palace.

    So why does he not resign now? I know it’s not for lack of job opportunities in the private sector. What’s the probable reason, Ellen?

    Phil, didn’t you remember what Neri said when he was about to appear at the hearing? He said he’s afraid he might lose his job. So, it looks like his current job is that important to him. Siguro pangako ni GMA sa kanya na kapag hindi niya sinabit ang Malacanang, hindi siya tatanggalin. Neri did not say anything damaging to GMA, Mike or any of his family. Si Abalos lang ang diniin niya. Kaya ayan…hindi pa resigned.

    Are you referring Neri, Ellen? Millions of Filipinos are asking the same question. For someone in the stature of Neri na well respected din daw, bakit takot siya? O baka naman may lihim din siyang alam ng Malacanang? Neri has destroyed himself. But it’s not too late…he can still change his mind and choose to be on the side of the people.
