Gloria support for revival of anti-subversion law assailed

A move to revive the anti-subversion law is part of President Arroyo’s “ominous plan to extend her stay in power,” Rep. Teodoro Casiño said yesterday as he warned of massive rallies against the plan.

Casiño, of the party list group Bayan Muna, and other Leftist lawmakers said President Arroyo’s support for the move exposes her intolerance of legitimate dissent and her desire to declare martial law.

Senators crossed party lines in vowing to block the revival of the law.

Staunch administration ally Sen. Miriam Defensor Santiago said provisions of the Revised Penal Code on insurrection, sedition, and inciting sedition, and the anti-terror law (Human Security Act of 2007) provide enough protection for the state against rebels and subversives.

Last Thursday, Arroyo said she was supporting a bill to be filed by Rep. Jose Solis (Sorsogon) seeking to revive the anti-subversion law as a tool to help end the communist insurgency.

Republic Act 1700, which punishes membership in the Communist Party of the Philippines, was repealed in 1992 through a measure authored and defended by then Batangas congressman and now Executive Secretary Eduardo Ermita.

Ermita last March told the Communist Party of the Philippines to denounce its armed wing, the New People’s Army, and renounce violence if it does not want the anti-subversion law revived.

Arroyo has vowed to get rid of the communist rebels before she steps down in 2010.

Presidential adviser on the peace process Jesus Dureza, who was with the President in Masbate where she made the statement, said the proposed law is not an initiative of Arroyo. It has not been discussed in any of the meetings in Cabinet.

“If Congress will pass it, it’s okay with her. My take of that statement is that Congress crafts and approves laws and she will go along with what Congress decides so. It was not President Arroyo’s own plan or intention at the time that cropped up and candidly, we have not discussed it,” he said.

Chief presidential legal counsel Sergio Apostol said it would be timely to come up with a new anti-subversion law which would specify groups that pose a threat against government.

He said mere revival of R.A. 1700 is not enough.

“We have to modify, so it will not be against the communists only…We could add some groups… iyung may mga threats sa government and those that continue to do subversive things,” he said.

Rep. Satur Ocampo of Bayan Muna said: “Mrs. Arroyo ought to rethink her mindless support for reviving the anti-subversion law, which the dictator Marcos used to arrest and detain tens of thousands without charges under martial law but failed to defeat the CPP-NPA.”

BACKPEDALING

Ocampo, former spokesman of the National Democratic Front, said the President showed her true colors, quickly making a 180-degree turn from her Human Rights Day statement to stop extrajudicial killings.

“After announcing the other day that she is aiming for ‘zero political violence’ and work with Congress to enact new laws to ‘protect’ human rights, she already backpedaled in less than 24 hours,” he said.

Ocampo said the law’s revival will not solve the insurgency problem and “will only lead to massive warrantless arrests, searches and seizures, illegal detention, and worsen the sorry state of human rights in the country.”

IMPOSSIBLE TARGET

Ocampo surmised Arroyo’s real intention “is to have another draconian law aside from the HSA to back her “impossible target to defeat the revolutionary movement by 2010.”

Rep. Roilo Golez (Ind., Parañaque), a deputy minority leader, said the repeal of R.A. 1700 is “irreversible.”

“We cannot ban ideology. We compete with it in the free market of ideas and prove that espousing capitalism and democracy is better for the country than being a member of the CPP,” he said.

CONTRADICTION

Golez, former national security adviser, said one of the first initiatives of former President Fidel V. Ramos, who spent almost his entire military career enforcing the anti-subversion law, was to work for its repeal.

“How could the Arroyo administration now move for the restoration of the anti-subversion law? That would be a great reversal and contradiction,” Golez said.

He said Ramos succeeded in reducing the size of the NPA “to its lowest level in recent history” and dramatically improved the economy without the anti-subversion law.

“We should not restore a draconian martial law instrument,” he said.

STEP BACKWARD

Santiago said the revival of the anti-subversion law “is a step backward.”

“Under the anti-subversion law, mere membership is punishable, and that would be unconstitutional because it would impinge on the constitutionally protected right of freedom of assembly and association,” she said.

She said the proposal would be blocked immediately by the Senate “because of the constitutional issues that it raises.”

“These two chambers of the legislature are very sensitive to public opinion, and I think it is indefensible to be able to arrest and prosecute a person just because he or she is a member of a political group. That is antidemocratic,” she said.

Senate majority leader Francis Pangilinan said the anti-subversion law had been around 40 years. “It didn’t work… reviving it now won’t make it work… poverty alleviation and sustained economic activity coupled with aggressive peace initiatives with all warring factions to end the root causes of poverty, dissent and injustice…”

Sen. Francis Escudero said reviving the law is a “step backward” and a surefire way to earn enemies.

DROP IDEA

Sen. Mar Roxas urged the Arroyo administration to drop the idea. “Reviving the anti-subversion law is to turn the hands of time to an era where might is right, and freedom is defined not by one’s ability to think and act freely, but by espousing only the ideas and actions that were most acceptable to the powers-that-be,” he said.

He said the problem of insurgency, the longest running in Asia, is a product of poor governance, widespread injustice, and too much corruption.

Sen. Loren Legarda said reducing if not eliminating poverty is the ultimate solution to the drawn-out insurgency problem, not the return of the anti-subversion law.

“An anti-subversion law would just force people’s organizations to go underground. It would further swell the ranks of those who see armed struggle as the only remaining option to effect change,” she said.

RETROGRESSIVE

Senate President Manuel Villar said there is no need to resurrect the “entombed” law. He said existing laws such as the Human Security Act already provide adequate protection for the State.

“Reviving R.A. 1700 is retrogressive. It is like going back to the primitive years when we label people as ‘communists’ and ‘insurgents’ It will be a throwback to the jurassic era when mere membership in a group was ground for punishment when what should be sanctioned are overt illegal acts and not mere organizational affiliation,” he said.

Lingayen-Dagupan Archbishop Oscar Cruz said insurgency will remain in existence even if a new anti-subversion law is passed.

“The insurgency in the Philippines is ideological, meaning an ideology dies only with the death of the ideologue,” Cruz said.

TOUGHER LAWS

Last Tuesday, AFP chief Gen. Hermogenes Esperon said communist guerrilla forces will be significantly reduced by 2009, or a year ahead of Arroyo’s deadline.

Esperon said he favors tougher laws to help crush 40 years of communist rebellion, favoring legislation similar to the internal security acts enforced elsewhere in Southeast Asia.

He said Philippines has a weak legal system that allows communists and other dissident groups to take advantage of the democratic space.

In an interview after presiding over the graduation of Command and General Staff College class 49 in Camp Aguinaldo, he said:

“I support a new anti-subversion law. It is the duty of the government to protect its citizens and if, indeed, they (rebels) are only after political reforms, then, they can go to the negotiating table,” he added.

Esperon said a new anti-subversion law should not only involve CPP/NPA members but also people who are seen with armed rebels, and people or organizations whose campaign materials are recovered in clashes with the rebels.

When asked if mere membership with the communist movement should be punishable by the new anti-subversion law, Esperon said: “Not really mere membership but it’s more on the actions like when you are seen with armed groups. Or when you are, for example, campaigning and armed groups join you and when your campaign materials are recovered in encounters,” he said.

Esperon said coming up with a new anti-subversion law does not in any way affect the possible resumption of peace talks with the communists.     I sure hope I’m wrong, but with that whore in the whore house, I won’t bet my last peso. Whore Gloria is quite desperate to remain in power, and I’ve this funny feeling in my bones that she’ll not relinquish the office for quite sometime, at least not in 2010. Whore Gloria is capable of almost anything. She’s getting too cocky, she thinks she’s the only individual capable of running the country. Here’s my prediction, “No presidential election in 2010.” Little pre-mature, but whore Gloria is without honor nor integrity as a human being (if she’s that), shameless and doesn’t know other else. Whore Gloria wants that whore house badly enough, because it makes her a bigger person and without that whore house she’s nobody. She wants to rule among men as her subject, and she loves it. Whore Gloria is beginning to believe, she’s the mesiah (4’6″ poor men Moses of the Philippines) with a mission, sent down here on earth to straighten out the Pilipinos. We shall wait and see.

  4. You don’t have to look at a crystal ball to predict what Gloria will do in 2008. We have a president whose psychological makeup inclines her do as she pleases. Because the House of Representatives has been bribed, and the military top brass stacked with loyalists, she has gotten away with it — so far.The way things are moving, there is infinite opportunity to diddle and dodge — in effect conducting business pretty much as usual until 2010 (or longer if the Cha-Cha train moves on)

    1)Gloria will pursue cha-cha with “urgency and vigor.” With the prospect of her staying in power beyond 2010 courtesy of cha-cha, she can still command the support of congressmen, especially when impeachment time comes again next year.

    2)Gloria will circumnavigate the world many times over. “She is unwavering in her commitment to travel on behalf of Philippine interests, and nothing will deter her. “Secretary Bunye

    3) Gloria will extend the tenure of Mr. Esperon who is supposed to retire in February 2008. Gloria’s relationship with him is no different from Marcos’ relationship with Ver.

    4) Gloria will appoint Ronnie Puno as Executive secretary. Ronnie is arguably the most powerful and most trusted cabinet member.

    5) Gloria will have more mega China deals. The ZTE deal was not the last.

    6) Gloria will find ways to replace Joe De Venecia as Speaker. Prospero Nograles will do “a Brutus”. “The fault, dear Brutus, lies not in our stars but in ourselves. ”

    7) Gloria ,in collaboration with Puno, will impose more draconian measures to intimidate the people in preparation for emergency rule (and martial law). This scenario will be considered if the cha cha move fails.

    8)As usual ,Gloria will ignore the Senate.

    9) Gloria will use the China card against the US if the Democrats win next year.

    10)Gloria will have problems with the “activities” of Mike Arroyo (again).

Sure, Glorilla plans to stay in her stolen throne beyond 2010, reason why I’m so disapponted with the “wait and see” attitude of many politicians and groups who claim to oppose Glorilla’s tearing up into ‘feces’ Pinas Constitution. We call that ‘naghihintay sa wala’!

    By supporting the revival of the anti-subversion law, she’s already preparing her stage for a Munsharaf show, only this won’t be a 2-3 months emergency rule but for as long as she lives.

    Well, why is it that I am not surprised at this ? It was very obvious from the very start that GMA has no intention of relinguishing the position that she stole twice. To do so is to invite more troubles for her and her family since they have so much to answer for. Erap’s “plunder” case will be nothing compared to the real plunder committed by GMA and her family… and the day they fear most is the day that they have to step down and face the courts…

    So why do we expect that GMA will even consider passing the power to someone else in 2010 just like that? Of course she can support someone whom she can trust of not going after her after 2010… if there is an election in 2010. but she also made known her intention to run for congressional seat in Pampanga in 2010. This is a preparation for a CHACHA in which she will go for the Prime Minister post ( for life, that is… )

    To shout to high heavens that she is the most corrupt “leader” of the country and she should step down will definitely fall on deaf ears! “Ano kayo, hilo?”, she will retort to us…

    In order to remove them from power, we need to be more practical and creative than what we are now. We have to think like them. We have to anticipate their moves and think of ways to counteract them… we have to walk a mile in their shoes… so that if something does go wrong, then at least we are a mile away, and we have their shoes… he-he-he …. but seriously…

    We should assume that GMA and her cohorts will use all available means to thwart any move to remove them in power… she will follow the rule of law … only when it suits her… she has a black ops section that will operate outside of the law when absolutely necessary… she has justices, congressmen , army, police to cover up for her wrong doings… she and her family will finance these operations from various funds both public and private ( jueteng and other commissions from large scale gov’t contracts )… in other words, we can never underestimate GMA and realize that we are dealing with a monster… and fighting her is going to be a serious business and can really turn ugly… people will disappear or “accidentally” killed… witnesses’ families will be threatened… are but a few of the possibilities… negotiations with her are futile exercises since GMA has a forked tongue…

    For starters, do not discuss your moves in blogs… If you know of some info that can jeopardise the movement, don’t write it here… Why? To assume that GMA’s agents do not come here and read blogs is naive! Informing your opponent about what you intend to do is simply not the best strategy to win.

    Sorry, but i am not aware of your movement… perhaps you can point me to where you have first written about it…

    off hand, i don’t think that GMA’s concern in staying in power beyond 2010 has anything to do with getting more money… but more on how to keep their present loot… i guess, they have more than enough to last them in their lifetime… from all the corruptions that has been committed by this couple…

    i think if GMA feels that the next leader of the country will assure her that she can keep her loot, she will be most happy to “retire” and enjoy life… much like the other one who got away with it signing PPA contracts left and right during his term…

    if you ask me if your proposal of bribing GMA will work, well, if you are GMA, will you accept your proposal? In how many ways can you screw this proposal and still keep the position? If your answer is “yes” to the first question, and ” no way ” to the 2nd question, then it might be a good plan…

    In Busan and Seoul the things I asked officials over and over what they think of the North Koreans, “Those communists….” their arms flailing like they want to swat some pests flies. In Taiwan, I asked the same thing on the mainlanders and I got the same expected retorts. I kept asking in a span of many decades. The civilians have similar views. Our visitors here would just smile at you neutrally. It only proves that certain propaganda of the US is working successfully. Similarly it works well with the US proteges in the palace.

    Didn’t GMA also dangle the possibility of amnesty to our soldiers and officers? Just recently, Esperon was mouthing this line again.
    As far s I know, part of the reason amnesty is being offered to the Reds is because they want to rub it in the faces of our honorable officers. I heard one Malacanang say, “Tignan natin kung anong re-act ng mga Oakwood boys pag nalaman nila na yung pumamatay sa kanila bibigyan ng amnesty. Sila, mabubulok sa kulungan.”
    But your posting has made me think. Could this be also be bait?

    the people are paying for the services rendered by any offices/agencies and it is the tax being paid by the people that keeps these government offices functioning.

    without the people, no government can ever be formed and exist.

    and not any single individual can ever call herself/himself the government!

    The way it looks, GMA obviously wants to remain in power beyond 2010. Only one of the following can stop her from remaining in power beyond 2010: 1. She gets assassinated. 2. She dies of illness. 3. She dies in an accident (plane or helicopter crashes). Please take note that I did not mention coup or People Power. That will not happen anymore. For her to leave the office, she must die!
