Defiance as tool for justice

Col. Ariel Querubin was running a high fever this morning but Col. Arnulfo Marcos. commander of the Custodial Management Unit attempted to forcefully bring him to Camp Aguiinaldo to attend hearing. Take note of Querubin’s medal of valor beside him. When an officer wears his medal of Valor, even the President salutes him.

Court martial hearing for the 28 officers accused of mutiny in connection with the February 2006 alleged plan to withdraw support from Gloria Arroyo was again cancelled when the seven officers that got notice of hearing refused to attend unless the whole batch of 28 accused would participate in the hearings.

Tension ensued in Camp Capinpin in Tanay ( where four of the seven officers are detained) when custodians tried to forcibly bring the accused to Camp Aguinaldo where the hearing was held. In the end, the accused had their way. (I‘ll write more about this tomorrow. I’m tired!).

The detained officers issued the following statement:

Justice and due process

All that we demand is to be treated fairly and decently. That is the universal yearning and right of every human being. This right and need is so fundamental that it is embodied in our Constitution under the “Due Process” clause, and even in the Articles of War. Yet, we have not been accorded that right. We have been repeatedly condemned and publicly adjudged guilty by the Convening Authority, the Chief of Staff, even before formal charges were filed against us. This is the same officer who caused the filing of the charges against us, the same officer who will review the findings of the court martial before whom we now stand.

NO CHARGES SHOULD HAVE BEEN FILED AGAINST US IN THE FIRST PLACE, BECAUSE AS THE PRE-TRIAL INVESTIGATION SHOWED, THERE WAS ABSOLUTELY NO BASIS TO ACCUSE US OF MUTINY. Yet, charges were indeed filed against us, after the Chief of Staff reversed the findings of the Pre-Trial Investigation Committee. All this, after the Chief of Staff refused to officially furnish us with copies of the PTI Report and the Pre-Trial Advise, to which we are entitled to anyway under the Articles of War. Even in the proceedings before the court martial, the attempt to railroad the proceedings at the expense of our fundamental rights was evident and most recently, many of us were denied the right to peremptory challenge. Now, we are under the very real threat of being denied our right to be present at every stage of the proceedings, and to have counsel of our own choice. These rights are again embodied in our Constitution as well as in the Articles of War. It has become clear to us that these proceedings, with all due respect, are part of a grand charade to give a semblance of legitimacy to what is in truth and in fact an illegal, immoral and unconstitutional attempt to instill fear and suppress legitimate dissent among our citizens. A “moro-moro” could not possibly result in a just or valid decision.

Our regard for the professionalism of the members of the GCM panel is very high. This regard extends to our belief that each one of you is aware of the circumstances surrounding our presence here. Thus, we don’t expect anyone of the honorable members of the panel to feign ignorance of the manner that the Convening Authority, the Chief of Staff, has conducted himself. The attendant deceit and gross disregard of our rights has characterized this process from the very start. They are too numerous to enumerate here.

At every start of the hearings, the Trial Judge Advocate opens the proceedings with a prayer that emphasizes discipline as the paramount reason for this whole process. As officers of the Armed Forces who have seen combat in the field for many years, we are the very first ones who will agree that DISCIPLINE is indeed the backbone of our institution. However, discipline is founded on fairness and respect, and the acknowledgement of common values and shared vision. This discipline is but an element of what are necessary for the achievement of the common good or interest. It cannot be used as an instrument – of oppression, or to protect the interests of a few, or to entrench those in power.

In the imposition of discipline, fair dispensation of justice is also expected. At the last hearing, we were cited by the panel, thru its President, as being undisciplined, thus the alleged necessity for us to be handcuffed. We believe that the members of the panel totally missed the point in our display of disgust and defiance. As commissioned officers of the Armed Forces of the Philippines, we cannot stand idly by and suffer the blatant lies propounded by the TJA with regard to our right to peremptory challenge. It is precisely because of our sworn duty to uphold, not only the Constitution, but also that of the intent of the Articles of War, that we have to fight, with whatever weapon we have, the bastardization of these two institutions…Unfortunately, our only weapon left is defiance. Your Honors, that is not a mark of indiscipline, but rather of discipline in the face of deceitful attacks on our military justice system.

Your honors, what we do today will have profound and lasting effects on our organization and our military justice system. We will be hounded by any precedent we allow to happen today by complicity, silence and submission. We fight not for ourselves, but for our children and for that elusive vision and dream of a just, humane and prosperous Filipino society that our people can be proud of. We are imprisoned, and we have been deprived of our most basic human rights. So we fight with what we have left, our dignity. And we show this by resisting or defying any attempt to further abuse our Constitution and our military justice system.

We do not dread the outcome of this process. But we surely dread for your Honors and for those coming after us…because in the scheme of things, you might well be sitting here right where we are.

  2. Excerpts from a letter sent to his client by a lawyer of one of the officers detained in Camp Capinpin who got a summon to attend court martial hearing which took place this morning.

    I am advising you that you cannot be legally compelled to attend the said hearing, and that you may therefore desist from attending the same.

    First. Under Section 45 of the Manual for Courts Martial, an accused “shall have the right to be represented in his defense before the court x x x by counsel of his own selection x x xx” Since not all the counsels of the accused were notified of the hearing, whatever proceedings may be had on 29 January (note: postponed to 01 February) will be null and void.

    Second. Under Section 53 of the Manual for Courts Martial, “the attendance of the accused throughout the proceedings is xxx essential.” All of the accused, therefore, have the right to be present at every stage of the proceedings. This right is even more important in this case since all the accused are charged with having allegedly conspired with each other to commit the purported offense charged. Since, in this case, not all of the accused and/or their counsels were notified, whatever proceedings may be had on 29 January 2008 will again be null and void.

    Third. Previous conduct of Special General Court martial No. 2 also indicates that, if the Trial Judge Advocate fails to give notice of hearing to all the counsels, the scheduled hearing is then cancelled. You may recall that this is in fact what happened at the hearing of 29 November 2007, where the court cancelled the hearing precisely because not all the counsels were served with notices of the hearing.

    Fourth. I am also disturbed by the recent conduct and pronouncements of the court which tend to indicate that they are intentionally conducting the hearings/arraignment of the accused by “batches” in order to “fast track” (i.e., railroad) the proceedings by limiting the number of accused and lawyers who attend in order to make the proceedings by limiting the number of accused and lawyers who attend in order to make the proceedings more “manageable” from their point of view. As your counsel, and as an officer of the law, I cannot participate and lend legitimacy to what is, at the very least, a clearly irregular procedure.

    Fifth. In the last year, all our hearings have been held in camp Capinpin, Tanay, Rizal. Further as you are aware, the defense counsels have requested several times that the venue of the hearings be transferred to Metro Manila. All our requests were denied.
    Now, without previous notice to any of the accused or their counsels, with a mere five (5) day notice to only a few of the counsels, in complete reversal of their earlier position, and without explanation, the military hierarchy (whom we have consistently charged as managing/manipulating the proceedings to ensure a conviction), suddenly changes the venue of the hearings to Camp Aguinaldo. This is, to me, highly suspicious. In light of this, I am also voicing my concern about your physical safety and security.

    Hence on both legal grounds and security reasons, I am reiterating my advice that you cannot be legally compelled to attend the hearing on 29 January 2008, and that you may therefore desist from attending the same.

    Kung ganyan ang aksyon ng mga custodian na walang respeto sa mga heroes, patunay lang na handa nilang ilikida ang mga detenadong opisyal para matuwa si Gloria Asspweron!

    Hindi lang para sa mga kaliwa ang warning ni Ass na “the following months will be bloody”. Kasama diyan ang mga military opisyal na ito!

If crooks are allowed to fake their sickness by being confined in the hospital to avoid Congressional/Senate and court hearings, why would they force these gentlemen officers who were truly sick? Double standard. Ang masasabi ko lang sa mga inaaping mga mahal nating opisyales at sundalo na nakakulong ngayon, kaunting tiis na lang at makakaganti din ang bayan para sa inyo. One day if you’re all back in your duties as protectors of the land, don’t forget these military officials led by Esperon who don’t stop harassing and abusing you and your rights. Tandaan niyo ang mga mukha at pangalan nila…

    Mapapadali talaga ang katapusan ng hearing kung ganito. Mapapadali dahil isa-isa kayong mawawala!

I’m glad to hear that the lawyers of these brave men are showing bravado in insisting their own rights even to keep silent about the contents of their conversations, consultations, etc. especially matters that will jeopardize the welfare and interests of their clients. They should in fact be protected by an equally powerful bar association.

    They should not allow themselves to be subject to a kangaroo court.

    Tuloy ang laban. Walang uurong!

  11. Unbelievable! I find it nauseating that Filipinos are allowing the Americans to hold their guns and point them at Filipinos during the so-called “goodwill visit” of a US military fleet. Bakit hindi iyang binabatikos ng media sa Pilipinas? Tarantado din ano?

  13. Sobrang primitive ang sistema, no doubt. Dito sa amin, kapag may sakit ang accused, pino-postpone ang trial. At saka dito ang mga detention houses at prison, may sariling hospital complete with doctors and nurses. Palibhasa kasi iyong perang dapat ginagamit for improvement of facilities sa Pilipinas binubulsa ng mga ganid. Ang dami nang EDSA ang nagdaan, ganoon pa rin. Saklap!

    Palabasin na si Senator Trillanes para makita natin ang gilas niya. Bakit ba takot na takot si Gloria Dorobo sa kaniya kung talagang bilib na bilib siya sa sarili niyang mas maganda ang Pilipinas sa ilalim ng pagnanakaw niya? 😛

    Grizzy, hindi naman ako anti-America. I have relatives in the US, Canada, UK and Australia. Pero itong mga Kano sobra na talaga. They have been pointing their guns at Filipinos from way back during the Fil-Am War. I’ve no military or police background, but soldiers are not supposed to point their guns at civilians unless their (soldiers) lives are in danger. The correct way is to hold the guns down pointing to the ground. Tama ka…bakit pinapayagan natin ang mga gagong mga dayuhan na ito na mag-hari sa ating bansa. There’s even no closure yet to that Sulu hospital incident. Now, can we blame those who are joining NPA and the Left? Ang pang-aapi ng mga Kano at pag-hahari nila sa Pilipinas ang isa sa mga mabibigat na dahilan kung bakit sila (NPA) humihiwalay sa gobyerno.

Querubin ang medal of valor it would only prove that indeed they are not worthy of respect..grabe talaga ang dagos ng satanic cult sa military..bakit pa nagdadasal before the trial starts? hindi ba nangingilabot ang judge na ito sa pagdasal pagkatapos iba ang ginagawa.. nagdadasal sila, so can we…palakasan ng dasal..hindi yong palakasan sa simbahang catolico..hindi palakasan sa santo..hindi palakasan sa pera..individually if each of us say an extra prayer for truth and justice in the Phil..united together we will win…Feb. 6 is Ash Wednesday ..the start of Lent–40 days lang naman so we can give some time to say extra prayers…we can do this, hindi ba?     I just watched the original Spartacus and couldn’t believe it..parehong pareho ang mga politicians and Gloria’s militar dun sa Roman’s. Crassus was so fearful and envious of what Spartacus has become, just like Gloria to Trillanes and Asspweron to the Men of Honor!

    For acts of conspicuous courage, gallantry and intrepidity above and beyond the call of duty as Commanding Officer, Marine Battalion Landing Team-1, Philippine Marine Corps, Philippine Navy during a 24-hour firefight against an estimated 300 fully armed men belonging to the separatists Moro Islamic Liberation Front at Bgy Inudaran, Kauswagan, Lanao del Norte from 18 to 19 March 2000. Tasked to capture the formidable MILF Camp John Mack (ABDULLATEF).

    Headquarters of the 303rd Brigade, 3rd Field Division of the MILF commanded by the notorious Abdul Rahman G Macapaar, alias Commander Bravo, LIEUTENANT COLONEL QUERUBIN spearheaded the 1st MBLT composed of 117 officers and men in this hazardous mission against the enemy, superior in numbers and mastery of the terrain, and believed responsible for the spate of bombings in Central Mindanao and the siege of and hostage-taking at Kauswagan, Lanao del Norte. On or about 181815H March 2000, while enroute to their objective, he and his men were subjected to heavy volume of fire by rebels from their well-entrenched dug outs, bunkers and trenches.

    Unable to maneuver due to darkness and intense devastating fires from both heavy and light machineguns, B-40 rockets, mortar and snipers, he nevertheless ordered his men to hold the line and directed the Special Operation Squad to close in on the enemy camp and pinpoint its location to the Marines battalion artillery supporting fires, and the V-300 and V-150 armored vehicles to dislodge the enemy from their heavily fortified bunkers.

    Unmindful of his own safety, LIEUTENANT COLONEL QUERUBIN continuously moved from one forward position to another, thus drawing enemy fires to his own location, purposely to pinpoint enemy targets for their artillery support fires. The battle which had raged continuously until the following day, did not deter him from rallying his men in repulsing wave after wave of enemy reinforcements and continued assaults in their attempt to encircle his unit.

    Despite dwindling ammunition and increasing casualties on their side, subject officer never lost his aggressive spirit as he continued to move around while urging and inspiring his men, including the wounded to continue crumble. Under his inspiring leadership, his men fought ferociously forcing the enemy’s last line of defense to collapse and sending them scampering to different directions along with their dead and wounded and leaving behind their vaunted rocket launchers and high powered firearms as well as documents of high intelligence value.

    The capture of Camp John Mack resulted in the neutralization of the MILF’s most strategic staging area for operations and, more importantly, liberated the residents along the coastal municipalities of Lanao del Norte from the oppressive MILF revolutionary collection estimated at P 38M annually.

    By this gallant deed, LIEUTENANT COLONEL QUERUBIN distinguished himself in combat in the finest tradition of Filipino Soldiery.

    My fellow folks, this is the time NOW to judge who is traitor in our Beloved Land? A Man of Honor who received Medal of Valor or this present regime who put them in jail?

    Bb, I think mga gun-tooting American military na tinutukoy mo ay mga low-ranking-teenaged to early 20’s American boys who’s just trigger happy or should I say, nagpapakyut lang sa kamera. Just like the Manila Pen incident, nagpapakyut din sila although overkill. I probably know what I’m talking about, but, I will not confirm or deny that I have a militay background. Just letting you guys know from a u.s. military perspective. 🙂

    Sa kaalaman ng buong bansa Chi, Col. Querubin is not like them (Generals) who trampled the Constitution, but he was a Hero, a man of principle and loyal to our Constituion. Why this government treating them like a common criminal but they forgot their bravery against enemies who killed our people? This is my personal question to ALL loving Pilipinos who still believe and respect our Constitution, WHY?

    I myself is so disappointed with pinoy’s attitude towards Pinas events, especially in this case of the Men of Honor. More than majority, led by the tradpols, just sitting it out till 2010! Hanggang kailan na ganito ang kalagayan ng Pinas? Hangga’t pinapayagan ng kapinuyan!

    A senior military officer shouting “I’M YOUR BOSS!” Hahahah! Ano yan? Mafia organization or truckers union? Heheheh!

    How could you trust the institution of a country that’s supposed to be the vanguard of discipline and defence professionalism when by way of a verbal command, a senior officer like Marcos, instead of saying, “I’m your commanding officer, I order you to whatever, shit, crap, grovel, or what…” instead, yells “I’M YOUR BOSS!”

    I agree with you, alam mo during my school days ang binabasa kong mga DATOS eh di galing sa mga tabloids kasi nga di mo makikita ang tunay na nangyayari sa ating lipunan sapagka’t ito ay ayon lamang sa pangnegosyong panulat, unlike today mayroon tayong nationalist newspapers like Malaya, Abante and The Daily Tribune yan ang mga binabasa ko kasi totoo ang mga nakasulat dito.

    Noon ang gusto kong basahin eh galing din sa mga kapwa nating estudiante na ang mga Datos eh pawang totoo lamang kaya di natin masisisi ang mga students organizations sa buong Pinas to express their grivevances sa bawat rehime.

    Pag sa tabloids ka nag rely ng totoong issues eh half-bake ito at walang substance in truth. Subukan mong magbasa ng Malaya at The Daily Tribune mabubuksan ang iyong panananaw sa mga tunay na pangyayari sa ating bansa.

    I apologize for my strong reaction to your defense of the US young soldiers, ipaglaban mo. But, being young should not be made as an excuse. I agree that there are few bad apples that ruin the entire establishment. But, I don’t buy that statement entirely because there are as many older soldiers and military officers who are as bad. Who ordered and condoned the abuses in Iraq and other parts of the world? These were and are being committed right in the very nose of the commanders who are older. The soldiers underwent special training. Young or old, they are expected to uphold the duties entrusted to them by the country…to protect not only their country but also respect other countries’ sovereignty and rights. The rate of crimes and arrogance these soldiers (young as they are) display outside the US has become so alarming that they are now looked at as criminals rather than peace keepers.

  73. Actually, I sympathize with Col. Marcos. He is a decent person serving an indecent commander-in-chief and chief-of- staff.

    As custodian in Camp Capinpin, he was obliged to follow orders from headquarters to bring the five officers who were given notice to attend the hearing. As a soldier, he was supposed to execute that order.

    The problem is that order is part of the bigger scheme of injustice which violates not only the country’s laws but respect of human rights. It can even be a breach of criminal procedure as prescribed by the law that can render the case useless, moot and academic unless of course such law exists in the Philippines as it does over here. Believe you me, a lot many cases here are dismissed simply on the basis of negligence in following strictly the rules as when for example a foreign suspect or accused are arrested, investigated and indicted without providing a qualified interpreter, or when the police fails to find a really incriminating evidence to establish a case as in the case of these soldiers who refused to follow orders from a criminal who has broken the law, and worse use them to carry out her criminal intentions, etc.

    Just out of curiosity, I researched the economic growth of our neighboring countries. Ang ipinagmamayabang ng DOROBO ay walang binatbat. Most of our neighboring countries have their growth over 8 %. Yung iba nga ay mayroon pang double digits na growth last year. Besides, there are so many other indicators of economic success. The gap between the rich and the poor is one of the indicators and we are not anywhere close to our fast growing neighbors. The distribution of wealth is another thing too. In the per capita income, we are one of the laggers. So, ano ang ipinagmamalaki nitong DOROBONG ito? As a matter of fact, we are one of the “topnoth” when it comes to poverty and poor education. Dahil sa mas nakararaming mangmang sa atin, hindi naman naiintindihan ng mga mahihirap natin ang 7.3% growth. Tinatanong lang ng mga gutom na kababayan natin kung nakakain daw ba yung “7.3 %”. Heh,heh,heh…

    Hi, 13 years na akong sundalo ako with the US Army and currently deployed in Iraq. Somebody mentioned an Inquirer photo showing US troops pointing their weapons, but all I see in the website is a US Sailor pulling security, weapon pointed in a safe direction. Can someone please tell me where I can find that photo. If a US Serviceman really was in violation of the RUF/ROE in the Philippines, all it would take is a simple phone call to the JUSMAG and it will be swiftly dealt with.

    To Ipaglaban Mo: This “briefing” your talking about, are you reffering to the unit level Cultural Awareness Class during pre-deployment preparations? This non MOS or NEC (depending on your branch) training really just covers the basics but it compliments all Command Policies. If your saying that you know for a fact that members of your unit/organization are in violation of the numerous In-Country Theater Command Policies, your obligated to raise attention through your CoC and other channels if necessary and it will be swiftly dealt with. Some of us who actually work outside the wire have consistently performed under the ROE/RUF and we continue to do so despite the disadvantage. Stay safe

Kabastusan iyan. I have never heard of such even when the US is allowed to maintain military installations in Japan. It is being monitored by citizens here that they do not abuse the welcome accorded them. Filipinos should be encouraged to do the same. They should call the shot in their own native land, not the American visitors.

We take your position also in concurring that being young and aggressive is no excuse. I also agree with grizzy that Filipinos must now allow these GIs to behave in a foreign land like ours. Dong, do you think something would be done if reported to JUSMAG? I doubt. How many reported cases have been acted by the US military command? If not for media following high profile cases like the Nicole rape case, nothing would have been done. What the US does is usually transfer the erring soldier to a different unit most often in another base abroad. How many have been charged and convicted? If the US soldiers have not been completely and properly punished in the US for those abuses in the Middle East, what more in the Philippines? Anyway, we’re proud of you for serving in the US military. Please take care in Iraq. I know there are many Fil-Am soldiers; and there were quite a number who have given their lives. Finally, while it is true that only citizens and permanent residents can enlist in the US military, I think you would agree that there are illegal aliens who managed to join. How they did it, I’ve no clue.

    Brownberry, If there was a photo and it turned out that US Military personnel in the Philippines were actually pointing their weapons indiscriminately and without cause in violation of the set Rules of Force /Rules of Engagement , I would be more than willing to call JUSMAG myself and certain that it would be swiftly dealt with. There’s always two sides of the coin when people talk about “abuse” in the Middle East. The US Military is known (especially to service members ) to consistently bring down the hammer on personnel who violate command policies, Military Regulations , State and US Federal Laws. In regards to high profile cases such as that of Nicole, being a Filipino American Soldier who have had multiple visits in Angeles City, gives me a different perspective. I respect the fact and understand that many will disagree with what I think actually took place. I have never met an illegal alien in the US Military, but I’d suspect one has to present a fake US passport or birth certificate to pull it off, and that’s a Federal Offense that will eventually get them in prison.

Taguba who testified against the US soldiers’ abuse on Iraqi prisoners? Well, he was forced into early retirement. Instead of promoting him to the next higher rank, he received a call from the higher ups to retire early. No explanation was given by his superior. He was just ordered to retire. And that happened not long after he testified. In the military, it doesn’t always pay to be the good guy. There’s camaraderie and code of silence. Over in Japan, at least, we are calling the shots but gracious as the people here are, we allow the Americans to stay for the meantime. All US servicemen in fact here are told to behave by their superiors if they do not want to find themselves in jail. In fact, I am in possession of a video they have produced to guide these Americans on how to behave in Japan.

    My comments were never intended to “tell the whole truth” about anything. I just wanted to find out if there was a photograph of US Military personnel “pointing their guns” to Filipinos. It was not my intent to imply that the US Military is the all perfect organization run by angels with all members as saints. In regards to Gen. Taguba, I can’t claim to have any personal knowledge with what goes on at that level of pay grade and the pentagon. What I do know, especially with “Iraqi abuse” based on my experience, is that perception does not always equal what is reality. I can certainly admit that we do have camaraderie but with the “code of silence” thing, so far I’ve only seen that in movies.

    ZAMBOANGA CITY — The US embassy said the RP-US Balikatan ’08 bilateral exercise will give emphasis to humanitarian training when it kicks off on Feb. 18.

    In a statement, the US embassy said the Philippine and US armed forces will conduct humanitarian assistance projects in Central and Western Mindanao, the Sulu Archipelago, and Palawan during the Balikatan ’08 exercises.

    “They will offer free medical, dental, and veterinary care and construct and repair schools and other community infrastructure in communities that are in need of assistance,” the US embassy said.

    Whoever the next AFP chief of Staff is not a big deal for all of us Jay cynikho, why? because we are not concern who will be the next in line but what we need from them is to honor their allegiance to the Constitution and respect the peoples’right and freedom.

    They need to clean first their rank and purify their turnished image, so walang problema kung sino ang gusto ni GMA.

    Selecting a new Chief of Staff is their business and we only admiring who from them the best and has guts to lead the whole military establishment.
