Accuser and judge

Straight from Esperon’s mouth: aside from eliminating the New People’s Army, he wants the trial for the 28 officers he accused of mutiny for allegedly planning to withdraw support from Gloria Arroyo in February 2006 finished.

Esperon said this in an interview at ANC. Esperon said that the officers should be punished for what they did.

This is precisely what is wrong with the special general court martial no. 2 trying the case of Maj. Gen. Renato Miranda, Brig. Gen. Danilo Lim and 26 other officers for the February 2006 allegations. This is what the officers have been complaining about: it’s a kangaroo court. And Esperon’s interview at ANC confirmed it.

Esperon is the accuser, the convening authority of the court trying the officers, will be a witness and the reviewer of whatever decision the court makes.

The Constitution, the highest law of the land, states that “no person shall be deprived of life, liberty or property without due process.”

That was what the accused officers stressed in their statement read for them by Atty. Rolando Cipriano, counsel for Miranda, in last Friday’s hearing. They said, “All that we demand is to be treated fairly and decently. That is the universal yearning and right of every human being. This right and need is so fundamental that it is embodied in our Constitution under the ‘Due Process’ clause, and even in the Articles of War. Yet, we have not been accorded that right. We have been repeatedly condemned and publicly adjudged guilty by the Convening Authority, the Chief of Staff, even before formal charges were filed against us. This is the same officer who caused the filing of the charges against us, the same officer who will review the findings of the court martial before whom we now stand.”

To make sure that Esperon exercise his power, the court resorts to railroading of the process by doing the arraignment by batches because the prosecution panel and the court cannot deal with lawyers of 28 officers demanding justice and due process for their clients. For the hearing last Friday, only seven officers (Miranda, Brig. Gen. Danilo Lim, Col. Ariel Querubin, Col. Orlando de Leon, Col. Januario Caringal, Col. Armando Bañez, and Col. Nestor Flordeliza) were given notice to attend the hearing.

The court is supposed to be independent but apparently the idea of arraignment by batches has the blessing of Esperon. In the ANC interview, he said, “Arraignment should happen. It could be in fact individual by advice from our lawyers. It’s just a reading of the charges.”

Defense lawyers said arraignment by batches violate the right of their clients to be present in all stages of the hearing much so because the charge is conspiracy and the decision on one affects everybody. They advised their clients not to attend the hearing.(Click here for the lawyers’ letter:dont-attend.doc) That’s the reason why the officers refused to attend the last friday’s hearing. It was incidental that Colonels Querubin and De Leon were sick.

Tanay ‘boys’ resist try to bodily carry them to court

The arraignment of seven officers accused of attempting to grab power from government in February 2006 was stalled anew yesterday.

The military said four of the officers – Maj. Gen. Renato Miranda, Colonels Ariel Querubin and Orlando de Leon, and Lt. Col. Nestor Flordeliza – resisted being brought to Camp Aguinaldo from Camp Capinpin in Tanay, Rizal where they are detained.

But lawyer Rodrigo Artuz said Querubin has flu and bronchitis while De Leon’s blood pressure was up.

“I don’t know what happened to the others,” he said referring to Miranda and Flordeliza.

Only the three other officers – Brig. Gen. Danilo Lim and Colonels Januario Caringal and Armando Banez – were present, prompting defense lawyers to call for an adjournment.

Lim is detained in Camp Crame. Caringal and Banez are confined in a medical facility in Cavite.

A total of 28 officers are facing court martial for the supposed February 2006 power grab attempt. The military court is arraigning them in batches.

All except Lim and Capt. Dante Langkit are detained in Camp Capinpin.

“I believe there was resistance from the accused, that’s why there were not brought down,” said Maj. Emilio Felicen, court martial spokesman.

Felicen did not elaborate but sources said Querubin refused to go with his custodians led by Col. Arnulfo Marcos, the head of the AFP Custodial Center in Tanay, because of his ailment.

Maria Flor Querubin said he had a fever of 38.4 degrees Celsius and was suffering from urinary tract infection and bronchitis.

De Leon’s blood pressure was 170/100.

Despite this, the custodians tried to bodily carry the two officers out of their detention cell but they and their co-accused resisted, she said.

Mrs. Querubin said her husband, a recipient of the Medal for Valor, the highest military award, asked his custodians to just give him “some dignity and respect.”

“Despite that Col. Arnulfo Marcos wants to forcibly carry them. Ariel was in his bed because he was dizzy. Still, Marcos insisted he bring Ariel because his career will be affected. He gave orders to his men to carry them (Querubin and De Leon),” said Mrs. Querubin.

“Ariel was woken up while he was having his chills at 5:30 a.m. He had been diagnosed to have UTI and bronchitis. He has plenty of medication but his fever is off and on. Then you will be forced to attend a hearing? He was feeling dizzy so he had to lie down,” she added.

She quoted Marcos as saying Querubin could travel because he would be accompanied by a doctor.

She said De Leon suffered bruises as he resisted.

In the process, Marcos’ blood pressure shot up and he “fell on top of Jojo de Leon.”

Mrs. Querubin said the other custodians did not know what to do as Querubin’s co-accused told them not to touch the officer while Marcos was shouting “I’m your boss.”

She said her husband also shouted as he told the soldiers, “We’re going to have fistfight here if you are going to force me…I have a right to life.”

She said the coaster, the ambulance, and a V-130 armored personnel carrier that were to transport the officers to Camp Aguinaldo left Camp Capinpin past 11 a.m. when the court reset the hearing.

Before the proceedings, defense and prosecution lawyers met and agreed to expedite the proceedings.

Defense lawyer Vicente Verdadero told the court about the agreement when the proceedings opened at 10:30 a.m.

The court gave the defense and the prosecution until February 6 to submit their proposal and counter-proposal and set the next hearing for February 7.

Shortly after the proceedings began, a defense lawyer read a statement of the accused who demanded to be “treated fairly and decently.” The accused said it is their constitutional right to be accorded due process.

“Yet, we have not been accorded that right. We have been repeatedly condemned and publicly adjudged guilty by the convening authority, the chief of staff (Gen. Hermogenes Esperon Jr.), even before formal charges were filed,” they said.

    Nakalulungkot isipin na ang mismong kapwa nating Pinoy ang yuyurak sa ating mga karapatan at ang kalayaan ipinangako ng demokrasyong pinagbuwisan ng maraming buhay upang matamo lamang ito.

    Wala na bang bait sa sarili ang rehiming Arroyo sa pagdusta sa karapatan ng mamamayang Pinoy? Di na nila iginalang ang mga magigiting nating sundalo na nag-alay ng buhay para lamang sa Inang Bayan.

    Sayang ang pagkakataon na kanilang iniuukol sa AFP kung ganito pala ang trato sa mga Bayani natin na nakipagbakbakan sa mga kaaway ng ating lipunan, subali’t ang pinakamalaking dagok eh mismo ang gobyerno ang siyang pasimuno upang supilin nila ang karapatan ng malayang pagpapahayan ng saloobin at damdamin ninuman.

    Saan tayo patutungo nito kung ganito ang mga nagpapatakbo sa ating bansa at bakit ang AFP/PNP eh napagagamit sa iilan lamang na tao? BAKIT?

    Being an accuser and a judge, parang niluto sa sariling mantika ang mga pobre nating Kagalanggalang na mga sundalo. Wala talagang hustisya na nag-aantay kina Col. Querubin and co. kaya nawa eh mag-alsa balutan na buong pwersa ng AFP/PNP kasi po wasak na ang imahe ng inyong hanay.

    Kung babayaan nýo na apakan ang inyong dignidad ng dahil sa iilanng Heneral, sana magising na na kayo sa katotohanan sapagka’t sayang ang mga sinumpaan nýong tungkulin para ipagtanggol ang bayan at kapwa-kababayan.

    Ano pa ang inyong inaantay, magsikilos na kayo hangga’t di pa huli ang lahat?

    How about you Mr. Esperon? Esperon and his boss Gloria Arroyo must be prosecuted and punished for what they did in 2004 presidential election and its subsequent cover-up. Government resources and taxpayers’ money were utilized to hide their crimes. Both are liable for obstruction of justice and fraud. Masgrabe ang kanilang kasalanan sa taumbayan.

    Kulang pa…Accuser, Judge and…Executioner. Esperon’s extension is not to fight the NPA and rebels, but to make sure that the detained soldiers are convicted before he finally retires.

    Laski, matagal nang kampi kay GMA ang mga religious groups na binanggit mo. Last Edsa 3, El Shaddai and INC joined forces against GMA. Unfortunately, they did not succeed because INC decided to withdraw from the rallies. Had the two groups continued, GMA would have been ousted right there. Hindi ba nasa stage pa sina Miriam Santiago na nagsisigaw na mag-martsa at atakehin ang Malacanang. The evidence is clear as shown on the video footage. She together with Enrile were then fierce enemies of GMA. Pero nagbago na ang takbo. Today, Miriam is even criticizing her colleagues in the Senate for arresting Neri. Imbes na tumahimik at hayaan ang mga kasama niya sa Senado na gawin ang nararapat, hinaharang pa niya. The Trio, Enrile, Joker and Miriam are the most loyal defenders of GMA today. Isama din natin si Angara na kahit na tahimik ay kampi din kay GMA. That’s the sad situation…mga balimbing sa Senado ngayon. Sabi nga ni grizzy, ang mga tunay na consistent na opposition ngayon sina Pimentel, Trillanes at Lacson lang.

    I wonder if these incarcerated officers can file a counter suit against this asspweron for rigging the court martial and for wearing all hats so he can convict these men of honor. Siya ang nagsampa ng kaso, siya ang nag-convene ng court martial, siya ang witness and then he will be the ultimate judge. Di ba bawal yan? From day one, sinabi na niya na itong mga officers na ito ay mapaparusahan! Hindi ba yan na ang ginagawa niya sa kanila? Ano ang tawag mo doon sa nakakulong? Hindi ba parusa na yun? It does not matter if these are soldiers, they too have constitutional rights. I hope the brilliant lawyers in our country are following the court martial hearings and I hope that they would help to defend these men of honor!

    Has any of your active and retired military bloggers ever thought of, or even discussed in passing that the Tanay heroes was the sole primary reason esperon’s tenure was extended? That no other AFPgeneral can be trusted to continue to torture and terrorized these true heroes and eventually put them away. They are esperon’s ACES. He has 3 months to do it. Failing he can just asked for another
    Extension. Wait, watch and see!

    The point? Kunyari hindi na puede ma-extend uli si esperon. Yano and other candidates are now forwarned to make up their minds and start kissing arse. The other best shot is recall of palparan. Impossible ? Improbable? Preposterous and farfetched may be but certainly not under undeclared martial law.

    The important point? Dead or alive, free or imprisoned these Tanay Heroes had already sealed through other patriots the fate of their incarcerators.

    Jay, precisely the point. Asspweron was extended to make sure that he finishes off these incarcerated officers. This is why there is really no justice at all for these officers because asspweron has already proclaimed that these “adventurists” will be punished. So, I can not blame the officers for defying the court martial. They already know that they will not have any justice under this kangaroo court. Why will they subject themselves to a futile excercise of going through the motions of a semblance of justice when obviously, there is NONE!
    If I remember it right, asspweron was just the Army Chief when he already declared war against these officers. Unlike Yano who is kind of playing it safe, asspweron then was making pronouncements through the media of what will be the fate of these officers. He was not yet the “cheat of staff” then but he already pre-judged the fate of these men. Remember when the media was showing the detention cell where they were going to be incarcerated? Day after day, asspweron was reiterating that these men will be detained in Tanay! Asspweron did just that! He made sure that these officers were to be incarcerated just where he wanted them to be! So now, would there be any hope for any kind of justice for these officers? NONE, because asspweron has already made up his mind that these officers ARE GUILTY and that they should be PUNISHED!

    jay: it seems to me that for GMA and Esperon, with the silent, thus tacit approval of all the active, retired generals and members of the military (armed forces, navy, marine and air force) guilty ang 28 na ito na para sa kanilang lahat brothers nila kuno are to be punished..what by a firing squad? saan sa Luneta? In their silence these retired generals (graduates of PMA, ROTC, at baka may West Point pa),approved (signed kaya).. where is Renato de Villa, Cimatu, etc.? Oh I forgot advisers ni GMA na nga pala sila and well fed..thus they just fade away…Boss na rin nila..ang sabi nga noong si Marcos (colonel pa lang siya) I am the Boss! ano pa kaya si GMA and Esperon: “I” (the two of them united) AM YOUR BOSS! AND SHOULD ONLY BE THE ONE OBEYED AND FOLLOWED. and to which they bowed their heads and said: AMEN!

    kung lethal injection na man ang gagamitin to kill them sino ang tuturok ng injection kay Gen. Lim, Miranda, Querubin, et. al.? ang asawa ni Esperon? hindi ba doctora? kung firing squad naman..sharp shooter si martir hindi ba? kung electric chair naman..sino ang mag switch? yong dalawa..they are all qualified in all sense of the word..malagim?..I have not read a horror and gory story in my entire life (and I am now retired) but my mind seem to run wild but I don’t want my pressure up kaya sinulat ko na lang..ang sabi nga scream therapy!

    I doubt it very much if GMA and Esperon will put these 28 men to death..hindi sa wala silang conscience..but they are cowards..ang takot nila na magkaroon ng revolution..kung gagawin man nila..sila mismo ang dapat magbaril..magturok or mag switch ng electric chair…ang takot lang nila na ang uutusan nila ay magkaroon ng conscience at hindi gagawin..kaya if they have to ..they have to do it themselves..hindi ba ang sabi: “if you want to do a thing right you have to do it yourself” kaya ang takot lang nila!

    Mabuti nga at walang death penalty ngayon sa Pilipinas. ang meron at “liquidation” squad na nakamotorsiklo. Lately, yung patayan ng mga village chiefs at mayors ay nakakaduda. Ano kaya kung meron ding standing orders itong mga squad na ito na patayin ang mga local leaders na nasa oposisyon, yung hindi nila mahawakan sa leeg.
    It is a real threat to the 28 men of honor ang “systematic liquidation” ng kahit sino man na gusto nilang iligpit. This is the reason why a lawyer for one of the officers advised the men of honor to refuse to go to the hearing in Camp Aguinaldo for security reasons. Napakadaling sabihin na ang mga ito ay nagtangkang tumakas kaya binaril sila. It is a very real threat indeed! Dahil ang mga 28 officers na ito ang nakakaalam ng malawakang pandaraya ni DOROBO na ginamit ang mga generals(kasama doon si asspweron). Lahat na lang ng panggigipit ay ginagawa sa kanila. Sana naman tulungan natin sila sa pamamagitan ng dasal. Divine intervention is the only recourse in these men’s fate.

    parasabayan: You are right..wala na palang death penalty sa atin..and ito ang pinagmalaki ni GMA sa Pope as her achievement..Kung ipa liquidate niya ang 28 mas mahirapan siya..kaya seguro by “batches” silang dadalhin..8 at a time ang hearing..pero 8 is a large number to liquidate sabay sabay..mahihirapan pa rin sila at sa palagay ko pag kinawa nila ito..mag hahalo ang balat at ang tinalupan..and this will be a puzzlement to them..how will they do it..

    Panoorin mo iyong “Rendition.” Lalo kang maiinis doon sa claim ni Dubya about terrorism hat he actually propagates and perpetrates. Isa pa iyang na magra-rot in hell!

    Nakita ko si Romney sa funeral ng prophet namin kahapon. Sayang siya kasi hindi siya kasing-tatag ng tatay niya. Stay away ang mga member ng simbahan namin as a matter of fact sa candidacy niya. Kung manalo siya over McCain, OK lang but I doubt if dissapointed Repbulicans will vote for him.

    dapat ikanta na nila ang mga nag udyok at ang mga nagbayad sa kanila para mag aklas….ano sa tingin nyo – gagalaw ang mga iyan ng walang bayad? there is a party / parties behind their actions that provides funds for their operations…(walang nang libre sa Pilipinas.) helllooooo evident namang iwian sila sa ere ng mga baluktot na partidong nagbgay ng pondong pang galaw nila….

    Kung may perang ibinigay sa mga ito hindi na nagkakandarapa ang mga pamilya nilang tumutulong sa mga anak ng mga nakakulong. Hindi na rin sila nag-pafund raising para gastusin sa pagpapaayos ng detention cells nila na parang kulungan ng mga baboy noong una nilang madatnan ito. Most of the kids of these incarcerated officers are sent to schools by family benefactors and some friends who care.
    You have not been to the detention cell but I was there several times. Nagaambagan sila ng pera para bumili ng pagkain nilang mapagsaluhan kapag nandiyan ang mga pamilya nila.Karamihan sa kanilang mga pamilya ay sumasakay lang sa public transportation.     Alam ng mga Rangers at Marines na iba ang court martial sa regular courts. In fact, some of their lawyers can recite the provisions of the Manual on Courts Martial and the Articles of War chapter and verse.
