Arroyo revokes EO 464; Senate turns down SC compromise

1.President Arroyo revoked today Executive Order 464, which bars top government officials from testifying in legislative inquiries without express permission from the President.

“Effective immediately, I am revoking E.O. 464. Executive officials may no longer invoke E.O. 464 to excuse non-attendance from legislative inquiries. Executive officials are instructed to abide by the constitution, existing laws and jurisprudence when invited to legislative inquiries.”

2.Senators on Wednesday rejected the compromise deal offered by the Supreme Court that would have allowed former National Economic and Development Authority chief Romulo Neri to testify in the Senate but without arrest or detention if he invokes executive privilege.

Senators argued that accepting the SC proposal would curtail the upper chamber’s legislative power to conduct inquiries in aid of legislation. Click here for the rest of the story in ABS-CBN Online.

    The scrapping of EO 464 is not a gift as it simply restores what rightfully belongs to the people: public accountability and right to information possible only when top officials like cabinet members and military and police generals are not prevented from appearing before congress.

    But while EO 464 may have been scrapped, what cannot be restored and exhumed are all the information, records, docuiments, testimonies and other skeletons that may been forever buried from the time EO 464 was promulgated in 2005.

    In other words, what dastardly acts have been covered forever by EO 464? What irreparable damage has EO 464 inflicted on the constitutional principle of public accountability and freedom of information.

    GMA’s scrapping of EO 464 will have little or no effect on the public’s search for truth.

    The revocation of the order, provisions of which were previously declared unconstitutional by the Supreme Court, will amount to nothing without a direct and unequivocal command from GMA for Neri and other executive officers to tell the truth about the ZTE deal and to not hide behind claims of executive privilege.

    Now that the EO has been revoked, they can argue before the Supreme Court that the TRO of Neri is moot. That obviates the need for a Supreme Court decision. They did this, dahil naamoy na magpapahayag ng decision that would be a stinging rebuke to this claim of executive privilege.

    Of course, the Senate can counter by citing Acop v Guingona, that the Court will decide, even if an issue is moot and academic, if the Constitutional violation is capable of repetition, evading review by the Courts.

    In other words, kung ni-revoke mo lang para hindi kami mag-decision, and there is a chance na uulitin mo, then we will decide, para hindi na maulit.

  7. In the compromise agreement that the senators rejected, Neri could not be asked the following three questions (as they are deemed asked):

    1. Whether Ms Arroyo approved the project inspite of the bribery disclosure;

    2. Whether she had dictated on neri to approve the project;

    3. whether she had followed up on her directive.

    Dapat lang that the senators reject it. What kind of a solution is that, that would keep the truth from the public?

Granted naman, ng Court.

    Ang pleadings ay public document, ganoon din ang joint undertaking between two governments.

    Ang daming magandang Constitutional issue. Nasaan ang mga batang abogadong gustong malagay sa lawbooks?

    Ito ang aking pagkaunawa sa compromise na iminungkahi ni CJ Puno. Ang compromise ay para lamang mapabilis ang pagtestify ni Neri sa Senado habang pinag-aaralan ng Supreme Court ang tatlo o mahigit pa na mga katanungan kung ang mga ito ay saklaw nga ng executive privilege.

    Halimbawa, sa pag-testify ni Neri at sa pagtatanong ng mga senador, may idadagdag pa si Neri na mga katanungan ng mga senador na ayaw niyang sagutin dahil ang dahilan niya’y executive privilege, isasama ang mga tanong na iyon sa tatlong katanungan na iminungkahi ni Puno na huwag na munang itanong. Ayaw ng Supreme Court na mag-issue ng blanket ruling for or against the executive privilege sapagkat madadamay sa ruling ang mga future presidents or future senators, ang gusto ni Puno ay “por piraso” approach sa mga questions kung ito nga ay saklaw ng executive privilege.

    Press Secretary Ignacio Bunye said the decision of the President was “welcomed warmly” by those who attended the meeting.

    Bunye said they are not at liberty to disclose the identities of the “influential religious group” that attended but they included members of the CBCP.

    —-Who is this “influential religious group”? It could either be El Shaddai or Iglesia Ni Cristo. El Shaddai particularly her leader Bro. Mike Velarde likes publicity. This group wants media attention when it plays a role on controversial issues. On the other hand, INC is known to be a more secretive and low profiled organization. Manalo might have asked that Malacanang not mention INC’s name. Between Catholic Church or CBCP and INC, it’s safe to assume and even say that Gloria Arroyo respects and fears INC most.
    Three out of four demonstrators in Edsa Three that resulted in some killed and many injured were INC members. Since the group votes as a block and totally submit to the leadership,
    Arroyo realized that she couldn’t play tough with this group. Should we now thank INC? Of course not. Why only now when the Supreme Court appears to be rendering a decision unfavorable to Malacanang? Why the long silence from Manalo?

    “Deputy presidential spokesperson Lorelei Fajardo, for her part, said: “This is a sad development. We earnestly appeal to the senators to reconsider their position on the compromise proposal of the SC while we await the final ruling of the high tribunal.”

    She added: “It would be to best interest of the curious public if we can work within the framework of the SC proposal. The President has responded positively by revoking EO 464.”

  37. I am shocked actually to observe all these things that are happening in the Philippines now. I am amazed at the seeming glorification of graft and corruption with a criminal being given free reign to circumvent the law for her own personal gain with the husband definitely serving as her principal adviser.

    It is just unbelievable how the Supreme Court could be privy to these crimes, even kind of connive with the criminals by allowing them to choose the kind of questions to be asked of them so they may not be forced to answer questions that will implicate them to the crimes.

    Worse is allowing the mastermind of a crime gang sort of to dictate on the judges of the Supreme Court that has definitely been rendered useless because of the crook’s own appointees heading it.

    This kind of privilege given to the president should be scrapped as well considering the padrino mentality of the Filipinos. Someone should initiate having the laws of the land reviewed and revised especially laws that can be used for evil like how a criminal, who had managed herself to be declared president, does at present.

For instance, a Malacanang boy like Carpio might be scolding Atty. Bautista and then when it’s time to decide, he sides with the latter. Similar game is being played at Ombudsman, Sandiganbayan or other courts the judges and justices of whom owe their position to Malacanang.

    Came somewhat late in this “deal or no deal” by mlq3. Just heard the news this morning that EO 464 was revoked. But Memo Circular 108 is still there, according to Sen. Biazon, which is “exactly the same” as EO 464.

    Also, the executive can always invoke so-called “executive privilege” as if the issue never happened before “hello Garci” and the NBN mess did.

    And how does a generally passive SC take the matter? Wait for another complaint on that circular which, in effect, is another gag order to conceal the “truth” (read: stink) of the executive?

    Yes, that’s the problem if it’s in the constitution. The law or laws of the Constitution prevail over other laws of the land. For as long as there’s an executive privilege as provided by the Constitution, we cannot expect the whole truth. Half truth won’t help. What’s needed now is to amend this rule. The Congress must act on it (amendment) now without delay.
