CA justice dismissed; another suspended, 3 more censured

The Supreme Court yesterday dismissed Court of Appeals Justice Vicente Roxas and suspended Justice Jose Sabio Jr. for impropriety and irregularities in handling the Meralco board elections case, upon the recommendation of the three-man panel created by the tribunal.

In a 58-page per curiam decision, which takes effect immediately, the SC upheld the panel’s report finding Roxas guilty of multiple violations of the canons of the Code of Judicial Conduct, grave misconduct, dishonesty, undue interest and conduct prejudicial to the best interest of the service.

The Court also voted to forfeit all of Roxas’ benefits, except accrued leave credits if any, with prejudice to his re-employment in any branch or service of the government including government-owned and controlled corporations.

Roxas was unavailable for comment.

His staff said the justice locked himself in his chambers the whole day and left early after learning from the media about his dismissal.

Sabio was found guilty of simple misconduct and conduct unbecoming of a justice of the CA and was ordered suspended for two months without pay, with a stern warning that a repetition of the same or similar acts will warrant a more severe penalty.

Sabio also could not be reached for comment. He was in Bohol on official leave. His staff said that he was to return to Manila late in the afternoon as he still had classes at the Ateneo Law School in the evening.

The Court also severely reprimanded CA Presiding Justice Conrado Vasquez Jr. for his indecisiveness; Justice Bienvenido Reyes got a reprimand; while Justice Myrna Dimaranan-Vidal was admonished by the Court to be more circumspect in the discharge of her judicial functions.

Except for Chief Justice Reynato Puno and Justice Antonio Carpio, who were allowed to inhibit themselves from the case, the magistrates voted as follows: 12 voted to dismiss Roxas, while one voted for his suspension for six months.

For Sabio, 10 justices voted for two-month suspension, one voted for six-month suspension, one for reprimand only as he should be credited for being a “whistle-blower,” and one for dismissal.

Eight justices voted to reprimand Reyes while five voted for his suspension for one month.

As to the rest, the voting was unanimous.

Associate Justices Martin Villarama Jr., Edgardo Cruz and Apolinario Bruselas escaped censure.

The Court also referred to the Bar Confidant the action of Sabio’s older brother, Presidential Commission on Good Government chairman Camilo Sabio, of influencing the judgment of a member of the judiciary in a pending case.

The Court also referred to the Department of Justice the allegations of Sabio that businessman Francis de Borja offered a bribe of P10 million in exchange for his inhibition in the Meralco case.

The Court said Roxas “inexcusably failed to act on a number of motions of the parties prior to the promulgation of the (Meralco) decision,” such as the GSIS’ motions to inhibit himself and to lift the temporary restraining order that the Eighth Division issued in the initial stages of the case.

Fabrications

The Court said Roxas had been dishonest and untruthful in relation to his disclosures to the panel, citing the alleged fabrication of the “transcript,” which it said was “designed to deceive that there had been compliance with the prerequisite of the Internal Rules of the CA (IRCA) that consultation and/or deliberation among the members of the division must precede the drafting of a decision.”

“Indeed, the fabrications and falsehoods that Justice Roxas blithely proffered to the panel in explanation/justification of his questioned handling of the Meralco case demonstrated that he lacks the qualification of integrity and honesty expected of a magistrate and a member of the appellate court,” the decision stated.

Under Rule 140 of the Rules of Court, dishonesty is considered a serious offense that may warrant the penalty of dismissal from service, even for a first offense.

The panel found Sabio to have committed improprieties, citing the phone call by his brother, Camilo. It stated that Sabio failed to uphold the standard of independence and propriety expected of him as a magistrate of the CA.

It further noted that although Sabio signed the TRO in favor of Meralco contrary to his brother’s advice, his “unusual interest in holding on to the Meralco case” seemed to indicate that he may have been actually influenced by his brother “to help the GSIS (Government Service and Insurance System).”

Shield of Confidentiality

The panel said that “Justice Sabio broke the shield of confidentiality that covers the disposition of cases in the Court in order to preserve and protect the integrity and independence of the Court itself,” when he talked with his brother and with De Borja about the Meralco case.

The panel said Sabio adamantly refused to yield the chairmanship of the Special Ninth Division although its regular chair, Reyes, returned to duty on June 10, 2008.

The Court said Vasquez failed to provide leadership expected of him.

As for Reyes, the Court adopted the panel’s finding that he was “discourteous” to Vasquez when he signed Roxas’ ponencia despite his July 22, 2008 request-letter to the Presiding Justice to decide which division of the CA – the Eight Division with him as chairman or the Special Ninth Division chaired by Justice Sabio – should promulgate the decision on Meralco case.

On Vidal’s role , the SC panel found her “too compliant” particularly when she deviated from the rules when she allowed herself to be rushed by Justice Roxas to sign the Meralco decision on July 8, 2008, without reading the parties’ memoranda and without the deliberation among members of the division required by the IRCA.

Second Magistrate

Roxas is the second magistrate to be dismissed during the stint of Chief Justice Reynato Puno.

Justice Elvi John Asuncion was fired in March 2007 for gross ignorance of the law and delaying motions of considerations before his division.

Roxas’ dismissal followed a resolution of the SC last August 19 where he was fined P15,000 for his failure to resolve two motions for reconsideration in another case lodged in his division, with a stern warning him that his commission of any act of impropriety in the future will merit a more severe penalty.

In that case, Roxas was charged with dishonesty and grave misconduct but the SC dismissed these charges and found him liable only for failure to resolve the motion for reconsideration and accountable for undue delay in resolving the motion for reconsideration.

The SC’s decision was based on the report and recommendations of the panel, chaired by former SC justice Carolina Griño-Aquino with members retired justices Flerida Ruth Romero and Romeo Callejo, that found the five justices liable for administrative offenses, including violations of the IRCA and the Code of Ethics of lawyers and justices.

    We congratulate the Supreme Court for promptly disciplining the erring Justices. However, the decision or decisions are not totally fair. Why Roxas was hit the hardest is something that merits analysis. And what about the big mouth lawyer of Mike Arroyo, Atty. Jesus Santos? He played a part in that scandal. Not even a spank on his bud?

    Thanks Chi. But, the civilian De Borja who contacted Sabio was reprimanded. Much more Atty. Santos must be disciplined since he belongs to GSIS and personally meddled.

    For his indecisiveness, CA Presiding Justice Conrado Vasquez Jr. should have been dismissed also. An indecisive judge is not healthy to promulgate any decisions. Sinadya yata e!

    Was the indecisiveness due to his children and a grand kid getting fat paychecks also from Winston’s GSIS? Just asking. Kilala ko iyang si Leonora, nakaaway ko ang sepsep na yan.

What a nerve for this envoy to say such a thing that is definitely a violation of a Constitution of their host country, the Philippines. Dapat diyan binabatikos. Better still, Filipinos should demand for the removal of this diplomat from the Philippines. Sa amin iyan, mag-iingay ang media hanggang sa matanggal ang ungas.

    CA justices Jose Sabio Jr., Conrado Vasquez Jr and Bienvenido Reyes should voluntarily resign if they have sense of delicaedza left. They can no longer be trusted by the public. Their misconduct and misjudgment had tainted the judiciary and a big setback in fight against corruption. Supreme Court’s shift action against erring CA justices is a right step to discipline scalawags within the judiciary. However, it’s not easy to erase public perception that justice is for sale in the Philippines. It’s a long way to go.

    Jose Sabio teaches at the Ateneo College of Law? How about his brother, Camilo? No wonder, si Mike Arroyo is what he is…he is a graduate of Ateneo..And Fr. Joaquin Bernas is the dean? Iba talaga ang mga magkakaibigan…they have respect for each other! Iba ang pagkakilala ko kay Camilo..noong araw…when he was with the Federation of Free Farmers of Montemayor…full of ideals, honesty and integrity. Kaya lang pag dumating ang bagyo gaya ng corruption..at malakas ang agos ng pera natutumba ang puno..isn’t that true in real life..pag malakas ang hangin natutumba ang mga puno? sa Antique nga, noong dumating si Frank many illegally cut logs from the mountains of San Remigio came tumbling down..as what happened in Infanta, Quezon in 2004…Malungkot talaga pag dumating ang bagyo…

    I have tried to go down that path with my thought processes but in my opinion,You only have a part of the puzzle.Those people who opposed Marcos and died for it have made no gains.Left to their own devices,military would just assume hang the commies and those who are opposed to Marcosian laws.

    I once lived near the border in Mexico where Spanish speaking Mexicans are racists when it comes to the slightly darker skinned Indigenous people of their own nation. What is obvious to me is that those Indigenous people are very skinny, because they are not allowed to participate in even this third world society, to feed themselves and their families. Mexico is for all intensive purposes a sham of Socialism as the elite are wealthy beyond any reasonable measure and the average Mexican makes an average of $1 US Dollar and hour. The indigenous people make an average of S.35 an hour. Without a system of rules and laws protecting those not in the elite in-group.

    This is how the Philippines which you always insulted Filipinos compared to Mexico. An indigenous person running for public office in the Philippines will be assassinated. It may be foolish to oppose this kind of practice. It may take away some liberty to have laws to protect those not in the majority.

    Maybe congratulations are in order for the supreme court. Well good for you. But why not go deeper into investigating more improprieties in the courts. Why end with the CA? For sure the CA fiasco is just the “tip of the iceberg”. Include the DOJ, ombudsman and the sandiganbayan. Improprieties and corruption are in every nook and cranny of those offices. Filipinos have a very low trust rating on those offices. Don’t just sweep a little corner of the house, clean the house completely! It’s frightening that this virulent type of disease of corruption has infected the whole government system of the country courtesy of gloria and cabal. And this little victory in the supreme court though tasteless makes a little blessing. I’m not jumping with joy neither am hopeful. I still maintain that the supreme court as the leader of the justice system is still rotten.

    And yes, chi, thanks. Patay na ninakawan pa ng GSIS benefits iyong staff mo na namatay sa big C. Tingin ko tatawanan lang nina garcia at santos ang kasong ito.     This may be a first in the world, even a world record! The Philippine supreme court has uncovered a new and frightening disease! It’s virulent virus is called gloriaticos corruptus aroyotica. Its vector or carrier lives in malakayang by the Pasig river. It affects primarily congressmen, senators, judges/justices, military personnel particularly generals, police personnel and officers, cabinet secretaries, executive secretary, government personnel, some lawyers that associates closely with the host vectors, government controlled corp. It is trying hard to mutate to infect the people. Its nature is destructive while trying t appear benevolent as in the MOA-AD and it is also parasitic. The question is how do we fight this disease and eliminate the vector-carrier-hosts? Any suggestion?

    Actually,The legal system in the Philippines is under fire, and much of the ire is directed at the Judge for dishonest and corrupt actions,Their decision is always base on “Highest Bidder” and the jaded acceptance of the lack of any semblance of truth telling in a courtroom setting.The misrepresentation becomes so rampant,it is difficult for the many honest lawyers to practice in such a system. Ethical lawyers are hard pressed to win their case in such as system unless they rely on similar aggressive adversarial tactics.

    The most frightening measure of what the legal professional has lost is that most trial court judge do not even remember the trust that society once placed on them.If my friend Meztizo want to become Atitiway and came to Philippines to study its laws and customs he could never come up with the idea that the lawyers were the country’s natural aristocracy. Lawyers blame the law schools, the law schools blame the lawyers, the judges blame the lawyers, the lawyers say the clients made them do it. Others blame the culture: It’s a jungle out there; ethical standards are down wherever you look. Wall Street brokers who hold themselves out as agents trade for their own account to their clients’ disadvantage. Even the clergy seem more prone to scandal than they used to be.The loss of ethical fibre at a time when ethical decline is so widespread, Because lawyers and Judge are supposed to be the custodians of a country’s legal and ethical sense.These CA judge that are involved in these scandals must be disbarred.–I think the SC want to clean it’s file and if that the case I will review for a Philippine Bar exam although it has been 30 years ago I enrolled in Law school.

    The Ellen I know wouldn’t ban anyone from this blog, there must be something else wrong. She may edit your entries if its all in bold letters though or probably mention the “R” word, or anything extremely violent, but thats just about it.
    I can see you for what you really are, you’re not that “BAD” at all, just “baaaaad” and I mean that in a good way. Your “tough love” policy reminds me of my father, you may get some desired results with that but you run the risk of being resented by those who cannot understand.

Ang mga maliliit na tao lang ang kaya nilang kasuhan. Yung mga “big” fish na katulad ni queen korap, ang asawang baboy, joke-joke bolante, sabit swingson atbp, scott free! Such is the justice system sa atin. It is a selective justice system. Baka ningas cogon lang itong dismissal at suspension na ito. Yung mas malaking kaso, kay Nering executive privilege eh nakatakip ang mga mata ng 9 na justices.

    Roxas handled the case of Col Querubin a few years ago. At that time, it was already so known that he is a super corrupt justice. His dismissal serves him well. I hope he gets disbarred.

  53. Corruption in the justice system is so widespread, straight guys are harder to find than crooks.

    Dennis Villa-Ignacio over at ANC said that being Special Prosecutor (Tanodbayan during Marcos), he has to be independent of even the DOJ and the Ombudsman. He revealed that in a celebrated case (was it Nani Perez’?) he together with the deputies have agreed of a heavier charge but as the charge sheet was submitted for his signature the text had been prepared differently to favor the accused of a lesser crime. When he hesitated, Merceditas Gutierrez made life difficult for him, even the office he could have gotten from a GOCC should have cost them only one peso a year but Gutierrez let it drag until he was ejected from his present office then, while the cheap offer expired. He now occupies a one-room affair where he works, researches and receives visitors.

    To top it, he was even charged with estafa by a subordinate for a donation he received on behalf of Gawad Kalinga. Pure harassment. He said the lawyer who filed it was stupid enough to attach all the evidences, including receipts, which for all intents and purposes only proved that the transaction was above board. Still, the case is pending with the Ombudsman who should have dismissed it outright.

    I have not been fond of Villa-Ignacio, but from that show I saw that he looks genuine and straight. Of course, it’s his type that the Arroyo lapdogs do not want around them, hence he is now being harassed.

    Malacañang really prefers criminal types like Singson, the Gonzaleses, Esperon, et al.

    But Cocoy, it’s wrong to compare Renato to a dog. Renato sure is much better than a lost dog, so he should be welcomed here.
    But, if he was banned in other groups and now allegedly banned here, something’s wrong with him. But you’re right, he has some good points and ideas.

    maybe klingon, and/or atty, can help clarify as to why the SC meted disgraced CA member (am averse using the term Justice for certified scoundrels) Vicente Roxas a relatively very light punishment.

    i was hoping against hope that someone, somebody, 2 or three of them, in the inner circle of CA should have been sentenced to a jail term.

    can a disinterested party file a separate case say, for racketeering, against these crooks in court to push authorities in having them jailed?

    a thought cross my mind; if CA just-tiis member Vic Roxas displayed acts being ‘untruthful’ and ‘dishonest’ (SC exact words) in his handling of Meralco ownership case, most likely, he may have been both in the past, too.

    for a crooked lawyer once, a crooked lawyer almost always.

    perhaps it would be wise for the Col Ariel Querubin’s lawyer to argue once again in the same court invoking SC words?

    sure would be interesting to watch CA members shift in their seats.

    at least, the SC help paved the way, for disgraced, former CA member Vicente Roxas to end moonlighting, and formalize his entry among the ranks as an attack dog for Meralco.

    but will he be effective outside the judiciary…abangan!

    It’s very clear…both the government through GSIS and Meralco tried to influence the SC decision. It’s no different from the ZTE deal wherein many personalities were involved. In the ultimate analysis, FG Mike Arroyo and Malacanang had a major role in this latest scandal. Atty. Jesus Santos interfered on instruction from Mike.
