SC panel finds five CA justices violated ethics in Meralco-GSIS case

The Supreme Court is set to tackle in its en banc session Tuesday the findings of the panel tasked to investigate the controversy at the Court of Appeals (CA) on the Manila Electric Co. (Meralco) – Government Service Insurance System (GSIS) case.

The panel’s findings reportedly showed irregularities and improprieties committed by five CA justices involved in the controversy.

In a 59-page report submitted by the panel to the SC, details of irregularities and improprieties by CA Justices Jose Sabio, Presiding Justice Conrado Vasquez, Vicente Roxas, Bienvenido Reyes and Myrna Vidal were all detailed.

In the panel’s findings it reportedly stated that Justice Sabio’s unusual interest in holding on to the Meralco case seemed to indicate that he may have been influenced “to help GSIS” as his brother, Presidential Commission on Good Government chairman Camilo Sabio, advised in a phone call on the matter.

The panel found Sabio violating the new Code of Judicial Conduct for the judiciary when he allowed his brother to influence his conduct on the Meralco case. The report added that Justice Sabio was also remiss in his duty to inform the CA presiding justice about his brother’s unethical phone call.

The 3-man panel formed by retired SC justices also castigated Justice Sabio for discussing the Meralco case with businessman Francis de Borja which the panel said was highly inappropriate and indiscreet adding it broke the shield of “confidentiality” on the disposition of cases in court.

The SC panel however gave more weight to Justice Sabio’s story about de Borja’s alleged P10-million bribe offer on behalf of Meralco saying Sabio’s disclosure on the bribery attempt to Presiding Justice Vasquez contradicted de Borja’s claim that the justice asked for a counter-offer of P50 million from Meralco instead.

The panel believes that if de Borja’s claim was true Sabio would have waited for Meralco’s reply to his counter-offer.

Still, the panel said in its report that Justice Sabio was remiss in his duty to make a full disclosure of the bribery attempt when he withheld the name of de Borja as the one who offered a bribe.

The panel’s findings also hit at Presiding Justice Vasquez’s failed leadership as CA head citing his hesitation, indecisiveness and lack of action on the issue.

The panel found appalling Presiding Justice Vasquez’s silence, inaction and indifference on the reported attempt to corrupt a member of the CA.

The panel meantime found Justice Reyes discourteous to Vasquez because he did not wait for the presiding justice’s action on his letter to settle the ongoing row on the handling of the Meralco case and ended up signing the decision already.

Justice Myrna Vidal meanwhile was found too compliant for allowing herself to be rushed into signing the first version of the Meralco decision even without reading the parties’ memoranda and without any deliberation on the case.

The panel’s findings however were most harsh on the one who wrote the Meralco decision.

It cited as irregular and improper Roxas’s inaction as ponente on several motions of the parties.

The panel called Roxas dishonest and untruthful when he allegedly fabricated a transcript of the deliberation on the Meralco case and claimed there were a number of deliberations on the case.

The panel also said Roxas was disrespectful to his colleagues, Justices Vidal and Presiding Justice Vasquez in pushing for the promulgation of the Meralco decision.

The high court is set to tackle these findings in its en banc session Tuesday.

No sanctions were recommended by the panel giving SC justices of the supreme a free hand on how they will punish the erring justices. Marieton Pacheco, ABS-CBN News

  1. The revelation deepens my distress about the justice system of Pinoys, as it exposes the penultimate court from the SC apex is as rotten and corrupt as the rest of the bureaucracy. The decadence is worsened by the stink of injudiciousness in SC decisions shielding malodorous executive privilege dissembly.
    Due to a personal traffic encounter with Justice Sabio some years ago, I disagree with the polite words of Fr Bernas, Dean of Ateneo Law school, about Justice Sabio, professor of Ethics in Ateneo Law School. He was forgettable at that time, but the Meralco case fiasco is not.

    There is this story which is said true. An RTC Judge somewhere in Bicol ruled on a case. Noticing that the Judge’s courtroom was hot and humid during hearing days, unknown to the Judge, the winner of the case donated an air-conditioner through one of the employees of the Judge. The air-conditioner was installed and everyone felt comfortable and good. Now comes a disgruntled litigant and filed a case of unethical conduct on the Judge for allowing his employee of accepting the air-conditioner. It was brought to the supreme court and after hearing a decision was made on the complaint, promptly dismissed the Judge from his post and was barred from holding any public office. Though he was not disbarred. The Judge mistake was not to have his employee return the air-conditioner. Today that Judge has immigrated to the US and is working as a clerk and gives legal advise to his employer though unofficial. Was has this to do with the CA fiasco? The supreme court should decide on the case with dispatch and dismiss all the CA Justices involved. Will they do it? Not after covering-up for fatboy and glory. Some judicial mumbo-jumbo will be conjured and viola, everyone is happy in the end. Some will even be richly rewarded.

    The government has never been known to function efficiently, I’m afraid that if Meralco is in their hands brown outs will be on a reagular basis. Kailangan pang linisin ang gobyerno, then linisin ang Meralco? Double work yata?
    Let Meralco be for the moment, take away the VAT kaya on utilities like electricity, water, and even petroleum? Or is this at all possible?

    I’m with you on going after Meralco after Gloria’s administration na. Then hopefully we can find someone who will take on Meralco and examine their costings with a magnifying glass, someone who will not compromise even to the point of career ruin or prison as the Lopez’s will then use everything at their disposal, now who do we have in mind? If you ask me, I’ll sic Trillanes on them, he has nothing to lose anymore, Gloria’s taken everything away from him except his dignity.

    Considering Gloria and Winston’s penchant of driving an organization to the ground malamang malustay talaga nila ang Meralco, but at what cost? If power is compromised maraming industries/businesses ang madadamay, we will all suffer, it will be a pyrhic vistory for us, or lose/lose situation.     Talking of GSIS Winston…

    My former staff died of C recently. Six months before she died, she filed for an early retirement. All papers were submitted, everything was OK… just wait the GSIS told her. She followed it up incessantly for the sake of her adopted daughter, 6 years old. Ang tagal, hintay…

    She died and when the siblings went to the GSIS, they were told that their sister was not entitled to any benefits because she’s DEAD already and that she filed the papers when she was still ALIVE. In short, the money/benefits of the deceased was gone, and the young daughter is left without nothing.

    Oh, one more thing, the family was told by the GSIS to bring it to the court!

    (An insider, a close friend of mine said what all of us already knew, that Winston’s GSIS is already without money!)

    Hindi ito ang GSIS na pagtitiwalaan ko, pati kuryente ay lalamunin ni Gloria and Pinas will be completely enveloped by darkness, literally and figuratively.

    Bear with me…yung educational benefit ng pamangkin ko na bayad na ay limang buwan ng hindi binabayaran ni Winston. Malaking kwento pero ganun na rin ang ending…

While I was motoring along CDO’s mainstreet, a car coming from a side street (without yield sign) tried to filter into the mainstreet traffic stream without waiting for a slack to insert. Not feeling too kind to bullies at that moment, I declined to offer the space to insert on my front. The driver took it as an affront and followed me to where I parked a few blocks away. It turned out the driver is an honorable RTC judge named Jose Sabio who felt insulted by the lack of deference to his honor, threatening to hail me to court. Not wanting to waste time in court by this clear case of intimidation and harassment (no probable cause, no witnesses, no incident) I acceded to his demand for a personal apology. His egotism assuaged, we parted ways.

    How much was your former staff suppose to get s retirement benefit? I would hazard that it won’t amount to a month salary and emoluments of winston garcia and directors such as jesus santos. What is amazing is for GSIS not to pay the benefits even though she has filed her retirement six months before she died! Her retirement is suppose to take effect before her death. Like I said its is criminal and an injustice. To dare the surviving family members to bring it to court is an insult and disrespect of the deceased. Good for GSIS they have a battery of paid lawyers. While the surviving family members will have to scrounge for money to pay their lawyer(s). GSIS has become so callous that it even makes infirm senior citizen members to report to their offices to prove that they are still alive. I’ve seem this with my own eyes. An old woman whose limping her way up the GSIS office stairs to report that she’s still alive and to follow-up on her unreleased (8 months) retirement pension. So what do we call that except callousness.

    Why is it that the SC was able to say that the 5 CA justices violated the code of ethics in law, but why can’t they find the same way with the Morons who are playing gods, especially those who are involved in the scandalous contracts like the fertilizer, northrail, ZTE and others.

    The most infamous violation of the code of ethics is when one who is pretending to be the president is giving away part of the republic.

    Why is it in Thailand the SC was able to say that their PM should resign because of violation of ethical standards for government officials, while here in the Philippines, they are even protecting the great(est) pretender of all time.

    Why?? SC why??? just like the Morons, some members of the SC are oximorons. Morons!

One thing noticeable about this administration is that there are just too many graduates of Ateneo de Manila U and the PMA now among the appointees of the Pandack Omama, people who must have been promised meaty positions int he in her government for helping her and her husband to gain such power. Makes me wonder what the priests and nuns have taught these ex-students of such parochial school for them to become so immoral and the epitome of all that God hates!

  41. I could have been a good lawyer, but with the reputation of lawyers in the Philippines that I thought when I was a kid they were all candidates for hell, I chose another course. When I came to Japan and met real good, honest and hardworking lawyers, I decided I might as well take up some units to qualify for a position even just as a paralegal.

    Over here, they kind of not mix up things. At the beginning of their legal career people who take up law in college are made to choose whether to become a court judge, prosecutor, lawyer and/or paralegal. Judges and prosecutors, when they retire from public office, may try to become lawyers defending people in court as accused, plaintiff or defendant. They abide strictly by the books (Criminminal Procedure Code), etc. and I like it. No hanky panky or they lose their license to practice for life.

    Sa Pilipinas, ang daming kurakot at kahit na nakasuhan na, nakaka-practice pa rin like one lawyer who was debarred in the USA now practicing and being used by the Pidals in the Philippines in fact.

    Wala na bang pag-asa talaga? Lahat na lang graft and corruption ang labas. Tapos magmamalaking mga Katoliko at Kristyano daw sila.

    Needless to say…I have stopped thinking about Philippine politics after they toppled Estrada. There is no way out from this rathole unless the Filipinos join forces and do something to stop the shenanigans of elected either by bloodless coup or bloody revolution. As people we are timid and can smile through our gritted teeth inspite of hardship and through sadness…it has been always like this…there should be a limit to their patience and that is what I want to see.

My disgust for the Catholic Church began during the 1986 Edsa Revolt when the late Cardinal Sin and the other hypocrites conspired with other groups to oust a legitimate President. Again, they did it to Erap, a duly elected President voted by 11 millions Filipins. It was Sin and the Church again. However, Catholic apologists will be quick to defend and point out that these Bishops as well as all the Catholics are only human. That ends the discussion.

    The priests, bishops, even the pope do not constitute the whole of christianity. Its up to us to discern what is right and wrong based on the word of God that strengthens our convictions. We just have to see if what our leaders are saying are in accordance with the word, if not, then we have the fundamental option to choose.

    Contrary to what you believe, we are not expected to be automatons but must strive to live in righteousness as much as we can, of course we stumble every now and then, but its the getting up that makes us stronger each time…

    First, if you can get an online copy of Philippine Star of June 30, 2006, it says “RP inks 350M euro deals with Spain” it was really a loan from Banco Bilbao Vizcaya for which 200M euros will be for Burgundy (now called Burgundy Global Exploration Corp. or BGEC) which is an obscure investment/finance company owned by a real-estate developer which, surprise, is now drilling oil in Sulu. Another 50M euros of that loan was for Port Irene (or the Cagayan Export processing Zone which was in the news lately as a port of entry for car smuggling) which is a short boat ride from Fuga Island-a 10,000 hectare island co-owned by … dyaraann!!…Diosdado Macapagal and Burgundy! Notice how GMA seems to personally see to the fund requirements of an asset-manager-turned-oil-producer. Just a coincidence? How about this, crony firm Monte Oro (winning bidder for TRANSCO assets), whose contract SC 52 is precisely in offshore Cagayan (where Fuga Island sits) is also a coincidence? Also this: more than half of the 5 oil exploration contracts recently awarded were given to different Filipino companies…but with the same person as president! Rogelio Serafica is president of Burgundy, Helios, and Miocene all of them “lucky” enough to be awarded exploration contracts all over the country.

    Another Spanish company, Union Fenosa Gas S.A. just last month signed a joint-venture contract with BGEC for the exploration of SC 62 in Sulu Sea. What is interesting is that Union Fenosa has just sold off its 40% stake in Meralco to the Lopez family for $250M after the instability caused by the attacks against Meralco scared investors. From the gov’t “enemy” to a gov’t “friend”. Is that what the whole Garcia vs. Meralco thing all about? Getting investors out of Meralco and into funding their friends/dummies? Notice that Union Fenosa is putting in $200M – the same amount that Banco Bilbao Vizcaya was said to be lending Burgundy! Did that loan from Bilbao

    Lopez company FPHC needed money quick to buy back the Spanish firm Union Fenosa Gas-held shares for additional 40% in Meralco. FPHC has just sold its shares in NLEX for $275M, it can now buy back the Union Fenosa shares, making $25M more in the process. It further strengthened its control of Meralco with the additional shares. It would be more difficult now to remove them in Meralco.

    I’ve predicted this before, the purpose of the lapdogs is not really to bring down the price of electricity when it used Garcia to attack Meralco. But that move gave a crony company much needed funds – $200M – to finance oil exploration by snatching one of Meralco’s foreign investors. They did not succeed in loosening the Lopezes’ stranglehold on Meralco, they even strengthened it!

    This is a government run by an economist, let me remind you. From a businessman’s perspective, I can only sympathize with Meralco, expecially if people in the government is doing all it could to sabotage your business, you are limited by what the law allows, while your enemy doesn’t even follow the law.

    It is still part of the old Arroyo-Lopez clan war which started with jueteng in which everyone is collateral damage.

    RMP, it is true the Roman Catholic Church helped the nazis escape to most latin american countries, most if not all are bastion of catholicsm. The Church was also lukewarm in helping the Jews immigrate to Palestine by not providing them safe passage. If you want to go deeper with this issue
    you have to go back as far as the Children’s Crusade. For one thing no one can deny that the hands of the Church is full of blood….like a ruthless emperor expanding his empire. I could add more to what you mentioned but its not worth the effort…however, let history be a reminder even though some are in denial over facts and evidence available.

The Catholics believe and follow the teachings of Jesus Christ passed on by the Apostles..thus they are apostolic…and it is in the Catholic teachings that Jesus gave the authority to Peter (the first Pope) when He said..Thou art Peter and upon this rock I will build my church…The Apostles Creed spells out what the Catholics believe that not all Christians follow..I respect all religions..almost all of us (except perhaps the atheists) believe in a Supreme Being..and all of us will find heaven..

The criminals have to move the money fast and quietly before it gets trapped there. When large money moves around from one investment to another, look at the amounts. Then look at the final destination. I have first hand experience in this when the Spanish government witheld a large commission due from our telecoms supplier in Spain, because of the large percentage of the indent commission, they figured it was going to be bribe money since the buyer was a GOCC. Without even asking for our opinion, they concluded it was illegal. They were absolutely spot on.
