Hindi nakakasiguro si Arroyo

Dapat lang mag-alala si Gloria Arroyo kapag tingnan niya ang botohan ng Supreme Court sa MOA-AD.

Hindi dahil natalo ang Malacañang dahil sabi nga ni Press Secretary Jesus Dureza, ibinasura na nila yun na nahalata nilang nabuking sila sa kanilang pambabastos ng Constitution. Kungdi, lumalabas na ang mga taong akala niya hawak niya ay minsan nagkakaroon ng konsyensya at darating ang oras na hindi niya mapagawa ng kanyang kagustuhan.Habang palapit na ang kanyang pagkawala sa kapangyarihan, hihina na rin ang hawak niya sa kanila.

Sa mahigpit na botohan (8-7), sinabi ng Supreme Court na labag sa batas ang Memorandum of Agreement on Ancestral Domain sa pamamagitan ng pamahalaang Pilipinas at ng Moro Islamic Liberation Front o MILF.

Kung hindi pinahinto ng Supreme Court, napirmahan na sana ng chairman ng Philippine negotiating panel na si retired Gen.Rodolfo Garcia at retired AFP Chief Hermogenes Esperon , ang MOA-AD na nagpapatayo ng Bangsa Moro Juridical Entity na parang bayan ng mga Muslim sa loob ng Pilipinas.

Sinabi ng SC na wala sa kapangyarihan ng mga negosyador at ng Presidente ang magbigay ng mga priveleges na kanilang ipinangako sa MILF kasama na ang pagpalit ng Constitution.

Ang sumulat ng desisyon ay si Associate Justice Conchita Carpio-Morales. Ang sumang-ayon sa kanya ay sina Chief Justice Reynato Puno, and Associate Justices Consuelo Yñares-Santiago, Antonio Carpio, Adolfo Azcuna, Ruben Reyes, Leonardo Quisumbing and Ma. Alicia Austria-Martinez.

Ang nagsabi naman na hindi na kailangan sabihin na labag sa Constitution dahil hindi naman itinuloy ng Malacañang ay sina Associate Justices Dante Tinga, Renato Corona, Minita Chico-Nazario, Presbiterio Velasco Jr., Antonio Eduardo Nachura, Teresita Leonardo-de Castro, and Arturo Brion.

Kaya natalo ang Malacañang dahil ang dating dalawang justices na palagi nilang kakampi ay bumoto kasama laban sa Malacañang: sina Quisumbing at Reyes.

Marami ang nagtataka dahil tanggap na ng taumbayan na hindi na maasahan ang Korte Suprema na magpatupad ng hustisya dahil lahat ay mga bata ni Arroyo.

Tinatawag ng mga taga-loob ng Supreme Court ang boto ni Justice Reyes na “legacy vote” or yung pamana sa taumbayan. Magre-retire na kasi siya sa Disyembre.

Mabuti naman. Di ba ganito rin ang nangyari kay Chief Justice Artemio Panganiban na hininto rin ng Supreme Court ang tangka nina Arroyo na ibahin ang Constitution para mapalawig ang kanilang kapit sa kapangyarihan lampas ng 2010.

Si Quisumbing ay appointed ni dating Pangulong Fidel Ramos. May ambisyon din siya noon maging chief justice. Ngunit mauuna siya mag-retire kaysa kay Chief Justice Puno.

Nakukunsensya rin kaya siya? Kaya hindi nakasisiguro si Arroyo.

Iba magtrabaho ang Panginoon.

    Siyempre nawawala ang impluwensya ang isang lameduck president at saka alam nila peke pa. Kaya pera-pera ang laban niya ngayon.

    Ang problema lang ay pag nag retire na ang mga justices na di sumasang-ayon sa Malacanang. Ang matitira ay ang mga tauhan ni GMA plus mga bagong justices na kanyang i-aappoint. Yan ang dapat nating bantayan.

    Teka nga muna, bakit ba mga uto-uto yung ibang mga justices ng SC. Ano ba ang kinakatakutan nila sa pagsaway sa Malacanang? Di naman sila pwedeng patalsikin ni Gloria dahil sila ay pwede lamang masibak sa pwesto sa pamamagitan ng impeachment. Magkano este.. ano kaya ang dahilan?

    We’re reminded of former SC Chief Justice Teehankee who was appointed by Marcos but later turned against Marcos. How many are like Teehankee? I’m sure there are some decent Justices. It’s the usual Filipino trait of “utang-na-loob” which makes them submissive to the appointing power. The current SC Chief Puno so far is showing his independence. I hope he keeps up this way.

  7. Tama nga ba ang hinala ko, Moro-Moro lang ‘yan. Based on the contents of the petition, the decision was virtually a unanimous one against its constitutionality. The other ponencia was only about NOT rendering a comment or decision for being moot, it did not say the majority was wrong. Every moron and his idiot son know the deal is outright unconstitutional, it does not need a lawyer to understand that.

    The MOA-AD was a scheme trying to hit one bird with two stones. The first stone was to agitate the MILF into a full-blown war knowing fully well that it would anger them since it would just be rejected anyway. The resulting end would be the exercise of emergency powers that may allow Gloria several modes of extending her stay and perpetuate herself – this is the bird.

    The second stone was to commit and force the legislature to revise the Constitution in order to fulfill its obligations as far as the MOA was concerned in the guise of peace. She can later insert provisions that could make her president for life. This was a blackmail of Congress and was too risky. The foreign governments were there in Malaysia to witness how Gloria can actually pull it off, not to legitimize the deal.

    Coming to their senses, they need to stop the signing before real chaos sets in and endangering Gloria’s reign earlier than they have planned. That explains why no one was arrested for spreading false text messages that Iligan, Zamboanga ang other highly-populated areas were already under siege the night before Piñol and Lobregat flew to Manila. They needed to create panic and terror so it would justify asking the SC to TRO the MOA signing. They had all the chance to stop the duo from filing if they wanted to, or if they were serious in pursuing the MOA, the two even stayed in Malacañang for some hours.

    With only the MILF full-blown war option left, and that while it looked like MILF isn’t going to play that game either, they used Kato and Bravo to kick off hostilities. Bad move also because it didn’t pick up. The two are not gov’t enemies, they’ve not even captured them up to this time when any journalist can interview any of them easily.

    Now, all of her bootlickers in SC didn’t vote in favor of the MOA, did they? That was the order from the top, I guess. Reject the MOA but leave her room to disown the acts of her reps in the GRP Panel. That surely will be their defense in the new impeachment relevant to the issue of the MOA.

    Inutil talaga na binibigyan ng karapatang gawing collateral sa mga utang ng isang dorobong bobo naman ang mga pag-aari ng Pilipinas, pati na iyong mga hindi pa nalalaspag ng mga ganid na Pidal, et al na mga ariarian ng Pilipinas sa Hapon na bayad-buwis sa dugo ng mga pilipinong nadanak noong Pangalawang Digmaan Pangdaigdig. Kung si Marcos nga na sinasabing magnanakaw din, hinid pinag-interesan ang mga ariarian ng Pilipinas sa Hapon, bakit bibigyan ng karapatang magbenta ng mga iyon si Gloria Dorobo na hindi naman ibinoto ng karamihan ng mamboboto at alam naman ng lahat na nandaya lang.

    Ipakulong ang ungas, dapat lang! Isama na pati iyong mga sipsip na spokesperson daw niya gaya ni Ermita, et al. Iyan ang mga hudas!

    Every move they’ll make must count. What seemingly unrelated events are always parts of a bigger plot.

    It’s very entertaining though watching every player act his part, and how these events unfold one by one before our eyes. If only it’s a harmless game they play. But it’s not.

    When will these pawns ever see the hands that moved them? Or will they ever understand why such moves were made? If only they knew they too will be sacrificed in the end to save the King!

    Or are we one of those pawns?

    If you read De Castro’s opinion, mukhang totoo ang balitang titiwalag sana siya, at boboto sa majority. Mas mahaba ang pagsabing labag sa Saligang Batas ang MOA, at tila afterthought lang ang unang talata, na moot na daw.

    Ang may virtual debate with Carpio-Morales ay si Brion. I, therefore, nominate Arturo Brion, chief stooge. Read both opinions, and judge for yourselves, who sounds like a justice, and who sounds like a trying-to-impress freshman law student.

    The Ateneo produced CJ Claudio Teehankee. It seems the breed died with him.

  11. TruBlue, God forbid that Justice Puno should run for a public office. He should stay in the judiciary and stick to the judiciary. There is too much mud in the executive department that mere association may make one dirty.

    The decision is not shocking because obviously, the MOA is unconstitutional. Even a third-rate law student knows this.

    What is shocking is the vote of the minority.What made them think that the MOA is constitutional?

    Parang ganito ang nangyari sa MOAD: May isang batang nanguumimit ng laruan (maliit na tau-tauhan)sa isang tindahan sa gilid ng palengke. At ng aakmang ibubulsa ay nakita siya ng me ari at hinawakan siya sa kamay at ipapapulis. Sabi ng bata; “hinahawakan ko lang naman, hindi ko naman kukuhanin.” Sinabing hindi na pipirmahan ni Pres. GMA yung kasunduan dahil nalaman ang gagawing panguumit sa mga bayan ng Mindanao. Katwirang bata! Ganon ba kabobo ang mga Pilipino para hindi maniwala sa ganong klaseng katwiran?

  13. In the case, the Solicitor General, in behalf of the State filed a motion informing the Supreme Court that the Arroyo administration was not signing it. After negotiating with the MILF, Arroyo decided not to sign it due to “changed circumstances.” So what did she do? Merely start a fire?

    From the very start, there was no intention to sign. As the National Union of Peoples Lawyers stated, Arroyo only used the MOA to launch her campaign for charter change, this time saying that federalism is the cure to the country’s ailments, that federalism is necessary to achieve peace. But as the NUPL claimed, “Achieving peace, however, was never the aim of Pres. Arroyo. Her intention has been mainly to prolong her stay in power after 2010 by deleting in the Constitution that provision in Article VII, Section 4 that limits her to only one term.”

    The NUPL further stated: “But the cost of Pres. Arroyo’s current adventurism is the breakout of war in Mindanao causing death and destruction in the region. Without condoning the abuses of MILF Commanders Umbra Kato and Abdulah Macapaar alias Commander Bravo, Pres. Arroyo is primarily accountable for the deaths of civilians in Mindanao for having triggered the ongoing conflict.”

    The bright boys and girls of Malacanang knew all along that the MOA is unconstitutional. But they needed an opening for charter change. Anything, anything, to perpetuate The Queen’s illegitimate reign.

    MacCain finally said that he’s not President Bush. In 2010, the administration presidential candidate should also say “I’m not Gloria Arroyo”.

    As expected, GMA invited governors, city mayors and municipal mayors to Malacañang two days after the fourth impeachment complaint was filed.

    As expected, Gov. Loreto Leo Ocampos, city Mayor Benhur Abalos and Mayor Ramon Guico Jr., the three league presidents, pledged to help fight the impeachment.

    How much they received, we have no report yet. But congressmen have been assured releases of their pork barrel.
