Malacañang frantic to stop Marcelino

Update: Zuño asks for relief of his illegal drugs task force saying they cannot anymore work under a cloud of doubt.

maj-marcelinoThe public should watch out for Malacañang’s attempts to smother the expose on the involvement of justice officials in illegal drugs.

Justice Secretary Raul Gonzalez tried to do that during last Wednesday hearing at the House Committee on dangerous drugs when he attempted to turn the table on Marine Major Ferdinand Marcelino, head of the Special Enforcement Service of the Philippine Drug Enforcement Agency blaming him for not arresting on the spot the the one who offered PDEA bribe in exchange for dropping the case against Richard Brodett, Jorge Joseph, and Joseph Tecson, in their early ’20s and from well-to-do families.

It is in this context that we are wary about the statement of Defense Secretary Gilbert Teodoro to review the assignment of military personnel in civilian agencies in connection with the important role that Marcelino played in the expose of the rot in the Department of Justice.

In last Wednesday’s hearing, the congressmen allowed Gonzalez, who was one of the resource persons, to interrogate Marcelino, another resource person. That was unfair. It was a good thing Marcelino stood firm against Gonzalez’ sarcastic questioning like, “Why didn’t you handle it the way you do it in Basilan?” in his pathetic attempt to put the Marine officer on the spot and to dim the glare on his beleaguered men, Chief Prosecutor Jovencito Zuño, State Senior Prosecutor Philip Kimpo, and State Prosecutor John Resado.

Marcelino told Gonzalez,”I’m not a war freak. We all know how different the conflict in Basilan is from the case of illegal drugs.” He said the bribe offer was made through text and telephones and it was difficult to make immediate arrest considering their lack of manpower and equipment. His apology to Gonzalez underscored his humility and did not a bit diminish issue PDEA raised which is difficulty in battling illegal drugs with a corrupt justice department.

Only the timely intervention of Parañaque Rep. Roilo Golez ended Gonzalez unsuccessful attempt to harass Marcelino.

Retired Navy Commodore Rex Robles, appalled also by Gonzalez attempt to discredit Marcelino, said, “why didn’t Gonzalez instead interrogate his men”? He said Gonzalez should resign: “His talking with the Alabang boy’s lawyer (Felisberto Verano) was a unethical.”

But ethics seems to have been erased in Malacañang’s vocabulary because Gloria Arroyo continues to have full trust on him. Executive Secretary Eduardo Ermita said Wednesday that Arroyo is “concerned” about the case of the “Alabang boys” case and directed Gonzalez to finish the investigation as soon as possible.

Surely we can’t expect Gonzalez to find himself guilty. In effect, Malacañang has already cleared Gonzalez. But shouldn’t Gonzalez be held accountable for the rot that DOJ is in now? How sure are we that he is not part of it?

Ermita also has cleared his protege, Justice Undersecretary Ricardo Blancaflor who made calls to PDEA on the “Alabang Boys” case and even allowed his office to do messengerial service for Verano.

What Malacañang is working on now is a white- wash of the filthy truth that it’s impossible for an illegitimate government to institute justice. An administration borne out of crime has no moral authority to run after criminals. That is what is happening in what lawyer Frank Chavez’ called the “Department store of justice.”

“ For the right amount of money , you can shop at the DOJ for any order you want,” Chavez said.

The problem of Arroyo now is what to do with Marcelino, whose superior at the PDEA, former AFP Chief Dionisio Santiago, has allowed him to tell the truth at the House hearing. Defense Secretary Teodoro’s statement suggests that Marcelino should be returning to the military where his lips would be zipped.

Teodoro said, “By performing operations that are civilian in nature, our officers could be exposed to temptations which could also affect their career.”

Teodoro’s concern is valid but considering the gravity of the anomaly that Marcelino has courageously exposed and the admirable manner that he has conducted himself, Robles said the defense secretary’s priority is “out of left field.”

Robles said the issue at hand is not a problem of military personal in civilian offices. “The issue is corruption in the justice department which a military officer has exposed.”

A Marine officer who asked not to named disagrees with Teodoro. He said, it’s been a practice since time immemorial to assign military in a civilian position because they are perceived to be disciplined and not easily corrupted. “Temptations are everywhere,” he said.”Hindi lang sa PDEA . Kahit sa Basilan meron. It is a matter of the heart of a person that brings into play.”

Sen. Antonio Trillanes IV, who was a Philippine Navy officer and is in detention after he had exposed corruption in the military, said through his staff: “Teodoro’s statement is irrelevant to the main issues of bribery/corruption in the DOJ and the moral courage displayed by a public official in resisting and exposing attempts to bribe him and his unit. He should have just praised Maj. Marcelino.”

Another Marine officer said, “I know Marcelino. He cannot be corrupted. Lalaban ‘yan. Takot lang ma-expose ang mga gago that’s why they are ganging up on him and casting doubt on his character.”

    Major Marcelino is a battle tested Marine officer. Anyone not even this Raul Goonzalez could scare Marcelino. At this point, it’s clear that Goonzalez has a part on it. This overstaying old shit must quit or die in shame now.

    More than ever, Marcelino needs all our support. His comrades in the Marines and all decent AFP officers are behind him. Marcelino is becoming to be another Trillanes. Let’s protect this guy.

    This drug case is very damaging not only to this evil government; but also to the drug syndicates and other well known personalities. It involves even international drug syndicates that will not hesitate to kill. Look at what’s happening in Columbia and Mexico. Some of our congressmen and politicians’ children are also into drugs. Even public officials. It’s an open knowledge that Rep. Sandoval, member of then Spice Boys that included Mike Defensor, is an ecstacy user. Famous entertainers and movie stars are also into it.
    Tough…it’s a very tough battle.

    Gonzalez is a veteran of wars of different kind. He had been a very loyal puppet of GMA, a behind the scene wire puller and is paid a handsome amount for such a simple task, but he at the same time is tasked to do all other extra assignments and has to sell his soul to the devil to accomplish the assigned tasks, in exchange for all the rewards. At the surface he may exhibits being his own man, but he is owned.

    Bakit, kaya ba ni Mantaring sabihin na sangkot ang boss niyang si Gonzalez? Akala naman ni Gloria Arroyo, maniniwala tayo ng result ng pekeng investigation na gagawin niya.

    Clean PDEA Director General. Gen. Dionisio “Tagoy” Santiago is clean. He refused pro offers of money to drop the “Alabang Boys” case. They point out that General Santiago had fired two sets of PDEA officials found on the take including three colonels who were close to him.

    His lifestyle is simple and he does not have any nightlife or extra marital affairs.

    He took the right step in hiring 18 Magdalo officers as PDEA enforcers.

    In contrast, a ranking DoJ prosecutor is a known womanizer and is a heavy Johnny Walker drinker. He reportedly beds as many as three women in one night. Iloilo media reported he had three women with him recently at the Sarabia Hotel.

    Teodoro and the rest of GMA’s dogs would be surprised that many are behind Marcelino and protecting him. Marcelino is another Trillanes, another Jun Lozada. With 2010 around the corner, take note that even Gloria’s allies in Congress are playing good guys.

    Mabango pa sana siya sa mga sundalo niya. But his statement only discourages do-gooders; it even hints the recall of these honest men from civilian offices so that the usual “kalakaran” can proceed without any hindrance.

    And Teodoro thinks he can pursue higher political ambitions?With his statement, he has surely lost a lot of pogi points. He can now kiss his ambition goodbye.

    We should not even bother with the statement of Teodoro, much less even print his comments on any issue. In the column of Ernie Maceda (The Daily Tribune), Maceda mentioned the rankings of politicians based in an SWS survey taken from Nov 28 to Dec 1 (http://www.tribune.net.ph/commentary/20090108com4.html), & showed that Teodoro’s ranking is at #54—the last name of the list ! This only goes to show how IRRELEVANT Teodoro is.

    Marcelino is a brave officer. He lives by his principle. You should see his mother’s small, humble house in Bulacan that needs serious repairs. All Marcelino could tell his mom was: “Ma, please forgive me I still cannot afford to fix our house.” His older sister died of cancer because he could not raise the P80,000 cost required. If he was not corrupt despite his sister’s condition, who could make him corrupt at PDEA?

    He might be further in trouble if he is thought to be part of Magdalo.

    As one Magdalo (actually the official name of the group is “Bagong Katipunero”) officer said,”We need people like Maj. Marcelino. Idealism is not our monopoly. Standing up for what is right should be everybody’s duty.”

    I wonder how many members of Congress can boast of having balls big enough to do the right thing. Why don’t the other members gang in on putragis na gunggong na Gonzales na yan at tapusin na nila. Make the guy angry so he suffers a heart attack or some seizure so he drops dead! Enough is enough.

    Teodoro’s fear applies to anyone. Only there are those that are easily caught, protected, suspected, those fish who got away and those immune to justice. Yet no one could cast the first stone.

    It’s not fair for Secretary Gonzalez to say House members were biased in favor of PDEA. It was a bipartisan expression of the House members.

    In fact, the House members from the majority sounded angrier. That is an eloquent message that Secretary Gonzalez should heed.

    Secretary Gonzalez should not have gone ballistic at young Marine officer Marcelino. Nakaka low morale yun (using peemayer lingo) to other young officers trying their best and putting their lives on the line.

    He should have gone ballistic on the three strikes happening in his Department premises:

    1. Filching of a DOJ letterhead and drafting of release order by defense counsel of the respondents.

    2. Forwarding of said obviously spurious draft release order by a Department undersecretary who had no jurisdiction to act on the matter and who should have known outright it was improper document coming from the defense counsel.

    3. Saying “ok” by Prosecutor Resado to the forwarding to Secretary Gonzalez of the spurious document when he was asked by Payoyo, the secretary of Usec Blancaflor, although he knew it came from the defense counsel.

    Three strikes within his Department, all revealedduring the hearing and the good Secretary reacted like a meek lamb and not like the raging tiger taht his fans (including grudgingly me) have admired.

    The Brodett case must really be a special case.

    1) The Congressmen’s respect for the decency, honesty, integrity, simplicity, incorruptibility of the PDEA.

    3) The support of the marines, the church, public opinion and bloggers.

    “The Palace must let Congress finish first its probe into the charges and counter-charges being made by DOJ and PDEA officials. This is because the DOJ probe may be used as an excuse to stop concerned DOJ and PDEA personnel from testifying further in the congressional public hearings,” said Loren.

    A DOJ probe of a case involving its very own personnel ranged against officials of another government agency, in this case the PDEA, may also be perceived, rightly or wrongly, as being biased in favor of the DOJ, she warned.

    Since the current controversy surrounding the involvement of DoJ personnel in alleged bribery of a drug-related case has cast a cloud of doubt on its credibility, the most honorable thing to do is for them to resign or at least take a leave of absence.

    Third, Gonzales, instead of bearing hard on Major Marcelino, should instead train his guns on his subordinates, if not himself.

    Fourth, I think Dolorfino is an idiot, if not an outright lapdog, for saying that “he hopes Marcelino is telling the truth”. This the problem with the current Commandant of the Phil Marines. He does not know his men. He does not defend his men when they are right. He is only around for his own convenience and for the convenience of his benefactors. MR DOLORFINO, IN CASE YOU DON’T KNOW OUR COMPLAINTS, HETO YUN…Mas marami ka pang travel (using government money) to attend Rotary meetings more than your travels to visit your troops.

One Fiscal even said Marcelino should take some law subjects because fighting in Basilan is different from hunting down criminals. Dumb! Marcelino is a PMA graduate. He completed all subjects and necessary trainings. One doesn’t have to be a lawyer or with legal background to apprehend criminals. Even ordinary citizens could do it. There’s what’s called “Citizen’s Arrest”.

    One does not have to be a lawyer to know the law. Magbasa lang ng libro alam na ang batas sa totoo lang. In fact, each citizen should know the laws of the land by heart, and abide by them.

    Sa totoo lang, ang trabaho ng mga pulis ay mag-imbestiga based on the order of the court via the prosecutor’s office to be able to establish a case and prosecute the guilty party.

    Dito sa amin, BE, walang na-i-indict na walang kasalanan kasi mahusay ang mga pulis sa imbestigasyon. Wala kasing politikong puedeng makialam, not even the Minister of Justice na hindi rin puedeng makialam in fact sa takbo ng korte. Kung baga, pandisplay lang iyong Minister of Justice.

    Kaya ang pulis dito lalo na iyong mga pulis ng Tokyo Metropolitan Police Department na ginaya sa Scotland Yard ng UK mahusay. At saka wala akong alam na pulis na galing sa military dito dahil alam nilang iba ang function nila. Meron kaming police academy na hindi under ng Ministry of Defense. Hiwalay ang police agency namin kahit na ang mga trabaho nila complement iyong trabaho ng mga nasa korte via the prosecutor’s office na under ng Ministry of Justice.
