Constitutionality of VFA affirmed

The Supreme Court has ruled that custody over convicted rapist Lance Corporal Daniel Smith should be transferred from US to Philippine authorities and ordered the Department of Foreign Affairs to negotiate the move.
While affirming the constitutionality of the Visiting Forces Agreement (VFA) that governs the military exercises between the two countries, the high court said the subsequent accord which Foreign Affairs Secretary Alberto Romulo and US Ambassador to the Philippines Kristie Kenney signed and which granted the US custody over Smith was “in violation of the VFA.”
The court said that under the VFA, US servicemen convicted of crimes in this country should be held by Philippine authorities.
In the same ruling, the court has ordered the Department of Foreign Affairs to “negotiate with the US representatives for the appropriate agreement on detention facilities under Philippine authorities.”
The high tribunal decision stemmed from a petition filed by Senate President Jovito Salonga and former Senator Wigberto Tañada that questioned the continued detention of Smith by the US embassy here.
The Salonga group said the transfer of Smith in December 2006 from the custody of a local court to the US Embassy showed that the VFA had virtually amended the Philippines’ rules on criminal procedure on arrest, bail, arraignment, and plea.
“Said provision of the VFA, in immediately vesting custody of any US personnel over whom the Philippines is to exercise jurisdiction, to the US military authorities, if they so request, from the commission of the offense until completion of all judicial proceedings, effectively violates and impinges on the power of Philippine court to acquire custody over the US personnel,” they said.
They said the issue of custody should remain a matter of court decision.
A court official, who asked not be identified, said the high tribunal had decided that Smith should be detained in a facility under the Philippine government’s control and that the US embassy did not qualify as such a place.
Smith was sentenced to 40 years in jail in 2006 for raping a Filipina after military exercises north of Manila in 2005.
He was initially detained at a local jail pending an appeal, but was later transferred to a detention facility inside the US embassy.
Smith’s conviction prompted Washington to threaten to call off large-scale exercises with Manila until Smith was transferred to the detention center within the sprawling embassy compound on Manila Bay.
The rape case has outraged nationalist and leftist groups, who are demanding that Smith be held in a local jail.
Despite two years in detention at the US embassy Smith is still waiting for his appeal to be heard.
Much as I will fight for the country’s sovereignty, I have misgivings about this case because I still can’t accept that it was rape.
Smith met the woman in a bar, drunk. Why would she be there if she were not looking to hook someone.

My reading of the incident was a consensual amorous encounter between two adults which was transformed into rape by force of public emotions. Call me an old-fashioned prude, but I firmly believe that a female who goes to a bar, gets tipsy enough to turn randy and chases a willing male deserves to be screwed.
The SC decision will have wide-ranging impact on U.S.-Philippine relations starting with the VFA with nationalistic fervor probably prevailing over reason. Nicole’s lawyer Ursua has fired the first salvo and initiated the move to abolish the VFA, the link to the military assistance goodies the AFP takes for granted. Worse, as when the Yanks abandoned Subic and Clark, we risk losing the protective umbrella of security of the U.S. Navy (although a remote possibility as this would break the chain of mutual security arrangements with nations surrounding China.) But with a protectionist President Obama, who can tell for sure?

Daniel Smith’s custody issue is a test case on Pres. Obama’s foreign policy. Anyways, Uncle Sam won’t allow his boy/s to be sodomized inside Bilibid prisons. Gloria Arroyo will try to sell herself again as a willing partner to take out so-called terrorists in exchange for Smith’s US Embassy custody and continued US support on her bogus presidency.
This reminds me of the the case of Michael Fay who as an 18 year old living in Singapore then was sentenced to 6 strokes of caning for vandalizing several cars in the Lion City. Several high US gov’t officials including then Pres. Bill Clinton tried to pressure the Singaporean gov’t not to push thru with the caning. The Singapore gov’t stands it’s ground by not giving in to pressure although the caning was later reduced to 4 strokes.
My question is, can the gov’t of gloria resist pressure from the US just like what Singapore did back then? Or is she hoping that, finally, Barack will call her up to discuss the case of Smith after being snubbed by the US Pres. 3 times?

That being said, major financial institutions are actually heading towards Indonesia and totally avoiding countries that are “on the wrong side of history”. You just can’t imagine the power of mere words when spoken by a US president.

If you examine US foreign policy pertaining to South East Asia, you will find that even under Bill Clinton (and even those before him, and maybe even under Dubya Bush but of course we don’t know how well or badly Dubya did things since, as we all know, the guy was clueless), Indonesia was always on top of the US agenda — Indonesia is the country that has the largest Muslim population in the world.
Back in 1998 or 1999 (or was it in 2000?) when Anwar was put in jail by Mahathir, did you know how often Madeleine Albright went to Indonesia? 3 times in a span of a few months. That was a lot!!!
Not even the Philippines, so-called major non-NATO ally of the US had that privilege but Indonesia had the constant attention of Washingtn; although RP was lucky to be visited by a deputy secretary of State in the person of Cristopher Hill (at the height of Gloria’s state of emergency nonsense).
Matter of fact, one week after the jailing of Anwar, Albright went to Jakarta right away; the US needed and still needs a friendly Muslim nation in that region of the world or the US was banking on Anwar following in the footsteps of Mahathir (contrary to popular belief, Anwar was an Am Boy while Mahathir was detested by the US). But Anwar was jailed by Mahathir (following intelligence reports that he was at the beck and call of the CIA) so the US needed to immediately set up some kind of foothold in the region, hence Indonesia became one of the favourite diplomatic watering holes of Sec of State Albright.
Obama, and of course, Hillary, will keep the diplomatic lines of communication open with Indonesia, not only because Obama’s younger formative years took place there but because geopolitics dictate so — if there’s one potent Muslim nation that could erupt in that part of the world, it’s Indonesia.
And of course when Cristopher Hill went to Manila at the height of Gloria’s nonsense, he went para pagalitan ang duwendeng walang moral!

We were transformed into an inferior submissive and willing national rape victim because of our race, to a superior and savior rapist because of their white race.
They developed an entire generation of our governing system to be composed of only alienated to our heritage and submissive and collaborative of foreign invaders.
This heritage injuring virus has been replicated for generations. This is the reason why our dignity is being continously raped by either foreigners or foreign collaborators like GMA and we accept it as just a legitimate political exercise.
Are we going to continue to allow this replication of raping by the Americans?

Hindi sayang natalo tayo patria adorada. Hindi rin mas matapang tayong Filipinos noon que sa atin nayon. Hindi lang alam nang marami sa atin ang nangyari noon. Hindi lang alam nang marami sa atin kung saan ang ating inuuwian at kung gano ka precious itong atin na kinuha nitong mga invaders at tinago sa atin.
Ang totoo, itong ating resistance contra sa mga invaders ay hindi pa tapos. Ang kailangan lang ay malaman nang cada isa sa ating Filipinos ang nangyari noon. The timeline, JM, was 1898. Aguinaldo in fact made a pact with Dewey who probably promised him a meaty position in case the US would succeed in driving out the Spaniards, who were apparently by the getting weary of the sporadic attacks of the natives, who were first organized by Bonifacio. I understand the Spaniards did not want to surrender to the KKK, so the US and Spain staged the mock battle of Manila while Aguinaldo was declaring independence at Kawit. That was 1898 not 1899.
The treaty of Paris that granted US full ownership of the Philippines was dated 1898. And the US probably was able to run the country without interruption in 1899 after capturing Aguinaldo and his men in Isabela although Sakay and the other Katipuneros continued the fight as they refused to be under US rule.
The Sakdalistas, in fact, continued the fight for Philippine independence, and became the foundation of the MAKAPILI before the movement was contaminated by the dugong aso of Macabebe when their leaders, including Ricarte, escaped to Japan prior to WWII.
At least, now we hear of these massacres committed by Americans in the Philippines with articles written by patriotic historians like Constantino, et al. Hindi na puede iyong history books written by people glorifying Americans in the Philippines, and based only on the random reports done by H. O. Beyer for the Taft Commission prior to Philippine occupation by the US in 1898.
