Testing Martir’s credibility

Maj. Gen. John Martir, whose two -star rank remains unconfirmed by the Commission on Appointments, finally showed up at last Friday’s court martial hearing of the mutiny case against 28 officers in connection with something that did not happen in February 2006.

This was the time when the people, including men in uniform, were restive about the revelations of massive cheating in the 2004 elections in favor of Gloria Arroyo using military and police officers and personnel.

It was the start of his cross examination which should have been last May 26 but Martir was a no-show giving the excuse that he was on a “confidential mission.”

It became evident during the cross examination of Atty. Sigfrid Fortun, counsel for Col. Ariel Querubin, that the court was protecting Martir in his case of AWOL (absence without leave) which is pending before the Ombudsman.

It’s another case of the “Old Boys Club.”

It was a delight to watch the highly competent Fortun lead Martir, who had testified against Querubin and other officers who participated in the 1989 coup d’etat against the Aquino government, up to the time he went to the United States because he was disgruntled that Querubin and his fellow 1989 “coup plotters “ were restored to military service without loss of rank. (The return to service of military officers who participated in the 1989 coup was a result of a peace process initiated by the Ramos administration.)

Trial Judge Advocate Serme Ayuyao knew that Fortun’s questioning would lead to Martir’s 477- day AWOL. He objected citing irrelevancy. Gilbert Gallos, counsel of Col. Orlando de Leon, said, “the TJA keeps on harping irrelevancy. If you are attacking credibility, you can ask anything.”

Fortun said “relevancy is not germane to cross if we are testing the credibility of the witness.”

Defense lawyers cited section B of Article 121 of the manual for court martial which states that “As one purpose of cross-examination is to test the crediblity of the witness, he may always be cross-examined as to matter bearing upon his crediblity, for instance, he may be interrogated as to his relationship to the parties and to the subject matter of the case, his interest, his motives, inclinations, and prejudices, his means of obtaining a correct and certain knowledge of the facts about which he testifies, the manner in which he has used those means, his powers of discernment, memory, and desription. Leading questions may be freely used on cross examination.”

At one point when Fortun asked if during his stay in the United States from February to April 1997 he took courses in HTML and Windows, Ayuyao objected invoking the witness’ right against self-incrimination.

Fortun said he will accept that if it’s Martir himself who will say that. Ayuyao approached Martir. Fortun objected saying under the rules of court counsel cannot coach, even approach, witness on the stand. “The witness has to decide on his own.”

The court called for a break. When it resumed, Martir said he will answer the question. He admitted it was not authorized by the military. He said he was on leave. When Fortun offered a record of Martir’s leave credits which showed that 477 days of his stay in the United States were not deducted, Ayuyao objected citing again relevancy.

The exchanges went back to testing credibility. Gallos said the documents will show that the witness has lied and has forged documents before. “If we destroy his credibility, we destroy his testimony.”

Fortun said his questions have impact on propriety, credibility and integrity of Martir who had executed a 29-page affidavit accusing the 28 officers of having committed mutiny punishable by life imprisonment.

He said upon the documents that he would be presenting to test the credibility of Martir “ rest the freedom of the accused.”

“ You want me to link that? It’s directly linked to the 29-page affidavit of this gentleman.” Fortun told the court.

In the end, the court sustained the objection of the TJA and Martir’s lies and forgeries didn’t go into the court records.

So much for search for truth as prayed for at the beginning of each hearing.

    Martir’s homecoming to the AFP after being AWOL for 477 days is hard to understand because it defied logic that instead of being dismissed from the service he is even being promoted.

    It really pays to be a first-rate rat and a grandmaster of the art of lying, and ass-licking. Knowing the soft spots and weaknesses of the power holders and how to take advantage of the opportunity it presents, was best exemplified by Martir. These qualifications are his tickets that win the hearts and trust of his masters that’s why he is being well-taken care of.

    Ayuyao has no business sitting as a trial judge. His bias is very obvious and disgusting. He should not be playing as a mythological god who can rule and do whatever he pleases to favor the other side. This is about finding out the truth and he should be helping by being fair. This is a serious matter and the lives and the future of these officers and their families are at stake and he should not be playing with them.

    According to Martir, he was on a confidential mission on May 26, 2009 that is why he was not able to attend the Court martial hearing.

    But he was seen jogging inside the Marine Camp in Fort Bonifacio on May 26, 2009.

    Martir is the J-6, Assistant Chief of Staff for Communications and Electronics, so what is so confidential about his position? Except that he is the older brother of J-2 (Intelligence), Commodore Victor Emmanuel Carr Martir AFP, member of PMA Class 1978. He can easily get a Mission Order from his younger brother.

    Martir admitted during the court martial hearing that he called Boygee Pangilinan, after Col Querubin visited him on Feb 23, 2006. Martir did not follow the Chain of Command. Martir is a Marine but he called an Army Officer who is not in his chain of command.

    Pangilinan was in the Marine Camp during the Marine Stand off but he was told to leave the camp and was escorted outside.

    Ellen, I don’t know him personally but I do know that a certain Jonathan Martir is very close to and has worked very closely for “intel services” of the AFP and govt at the highest levels. I’m afraid that if this is the same Jonathan Martir (and he should be; how many Jonathan Martirs can there be?), from what I learned, not a few folks from the military owe him a few favours.

    I heard that CGPAF Rabena of PMA Class 1978 (siya ba ang best friend ni Boygee?) will be the next CSAFP maybe in November or December this year. Bangit will remain as CGPA because he is so controversial and they need him as head in PA. Anyway, Bangit is retirable in July 2011 pa, so he can still be CSAFP after Rabena.
