Army officer in court martial for molesting ‘mistah’s’ wife

An Army lieutenant colonel is being tried by a court martial for the alleged sexual molestation of the wife of his classmate at the Philippine Military Academy.

A copy of the charge sheet against Lt. Col. Marlo Guloy showed the incident happened about two years ago in Zamboanga City.

Guloy, of PMA Class `90, is facing violation of Article of War 66 or conduct unbecoming of an officer and a gentleman and violation of AW 97 or conduct prejudicial to good order and military discipline. The violations carry the penalty of imprisonment and dishonorable discharge.

Guloy was last assigned with the Army’s Intelligence Security Group based in Fort Bonifacio.


The complainant is a godmother to Guloy’s youngest daughter. A son of the victim is also a stepson of Guloy.

The charge sheet accused Guloy of sexually assaulting the victim, taking advantage of her “weak and defenseless condition” on May 3, 2008. The incident took place La Vista del Mar Beach and Restaurant in Zamboanga City.

Army spokesman Lt. Col. Arnulfo Marcelo Burgos confirmed Guloy is facing military trial for a sex-related offense.

Burgos also said the trial began last September and the prosecution panel is wrapping up its case.

He said Guloy was taken into custody months prior to the start of the formal trial.

Burgos could not say if Guloy has been charged before a civilian court.

Col. Marian Aleido, the Army’s Judge Advocate General, also confirmed that Guloy is facing trial.

Apparently uncomfortable over the case becoming public, Aleido asked the media how it got a copy of the charge sheet which she said is a “confidential document.”

She also asked the media what its purpose or intention is in writing the story, noting that the trial is still ongoing.

Asked why she was asking, Aleido said: “None. Because if the complainant wants status update, they can always ask the trial judge advocate because they make the after-trial report. They can also ask for update. Even in open court, the trial judge advocate can give a briefing.”

When asked if she was confirming that Guloy is facing trial, Aleido said: “Of course, it’s in the records.”

The complainant, in her affidavit, said she went to the resort on Guloy’s invitation. She said she had to talk with Guloy about the extension of the term of the family’s security detail, Cpl. Zosimo Flores Jr.

The victim worked in Zamboanga City.

She said she was accompanied to the resort by Flores, Sgt. Mike Ibarra who is also a security aide, and her son.

She said only Flores was with her when she met with Guloy at a cottage of the resort. Guloy, she said, was with a number of officers and enlisted personnel, including Maj. Aldwaine Almase.

“Upon arrival, I was requested to sit beside respondent Guloy while my bodyguard Cpl. Flores sat at the other side of the table together with the enlisted personnel of the Army,” she said.

She said Guloy gave her drinks and “after a few shots, I was already drunk.” She said she later noticed the other officers were no longer in the cottage.

She said she then asked Guloy where the comfort room was. She said she was led by Guloy led her to an “abandoned restaurant but the toilet was closed.”

She said Guloy then pointed her to a corner nearby so she to relieve herself.

The victim said Guloy later led her to a bench and began kissing her. She said she tried to stop him “but I was overcome by his strength.”

She said she also shouted but Guloy covered her mouth.

She said Guloy then pinned her down and tried to undress her while touching sensitive parts of her body. She said she succeeded in stopping Guloy from completely undressing her.

But Guloy then “pulled me in a sitting position” and forced his organ into her mouth. She said she was too groggy to stop him.

After this, she said Guloy “carried me out of the abandoned restaurant” and “placed me on a bench and, still nauseated, I crawled to a nearby cottage where I vomited.”

She said Flores saw the incident but all he could do was to create noise to stop Guloy.

She said Flores left the resort “after creating the noise for fear of reprisal from his superior, respondent Guloy.”

The incident is considered rape under the law.

    It looks like this Guloy is a bad egg. And what do you do with bad eggs? You remove them from the basket so as to prevent them from spoiling the good ones.

    For every Guloy there are 10 or more who are upright.

    Why some women put themselves in dangerous situations by drinking alcohol is a puzzle. It is downright reckless in this case, since she had her son with her?

    Of course nothing justifies Guloys actions. If Guloy were an USM, the gates of hell would have opened wide. Where are the Gabriela bunch? Shouldn’t they be out after this guy or do they only go after white guys?

  8. Agree with Isagani… No need to take unecessary risks especially with a son in tow. Say she was used to drinking alcohol and could easily down a glass or two but people (men and women alike) need to know that it’s easy to spike a drink too with sedative or other drug.

Taking advantage of the wife of another mistah is the most painful thing one can do to a mistah. I really hope na di totoo ito dahil walang kapatawaran ang ginawa nya, if ever. There are sacred limits that a military officer, PMAer or not, should never cross. One of these is coveting another’s wife, how much more if it’s a mistah’s wife who is in fact also called mistah by classmates. Demonyo tingin ko sa mga taong tulad nito, kaklase ko man o hindi. Pasensyahan na lang.

    Saka napakadaling palabasing ambush din ang isang paraan upang huwag na ‘yang pamarisan.

    Kung hindi man, dapat sa opisyal na ‘yan ay budburan ng asukal ang etis at hayaang papakin ng pulang langgam para mabawasan ang sobrang pagiging uragon. O kaya’y pitpitin ang bayag upang hindi na pakinabangan.

    I remember ‘yung nangyari sa aking klasmeyt na na-assigned sa 31st Inf Bn sa Quezon Province after they were pulled out from Sulu for re-training dahil sa hindi malilimutang Pata Massacre.

    He was the Company Ex-O of his unit during that time when he was shot dead by one of his men after being complained of molesting (or having an affair with) the latter’s wife.

    During our school days, napakatahimik ng taong ‘yun at hindi namin kinakitaan ng masamang ugali. Maging noong muli kaming magkita sa Sulu kung saan nauna akong ma-assigned sa kanya. He was later reassigned sa 31IB at nanlumo ako noong mabalitaan ang dahilan ng kanyang maagang kamatayan.

    Maaaring kaya rin nga nagkakaroon ng lakas ng loob ang isang lalaki na makagawa ng hindi tama ay dahil na rin sa kapabayaan ng babae na hindi rin iniisip ang maaaring kahantungan ng pagwawalambahala sa sariling kaligtasan. Dangal man o buhay.

    Come on people! Most of us remember the classic case of the “woman raped for wearing a tight mini-skirt”. The rapist was incarcerated. The prosecutor was so right when he made his closing statements and the most glaring was this: Why would you rape someone for wearing a mini-skirt?

    In this Guloy case, what gave him the right to sexually attack her; because she was merely having a drinking spree with him? That’s insanity. Let’s be realistic about cases like this.

    This PMA’er deserves prison time, daming chicks dyan sa paligid-ligid; kumare pa ang nakursonadahan only coz she decided to have a friendly drink. Even if they were having a pot-session is not a pretext to sexual attacks.

    i do wonder why this case have to be “tabloid” where in fact it was already being tried in a military tribunal? i really don’t see the intention of writing such story. take note that the accuser’s husband, is also an active member of the afp.

    With this kind of irresponsible reporting, where the story only centers on one aspect, on a certain indvidual…do you think you are giving your profession a favor and that everything is reported/done on a “level playing field”?

    i am not a lawyer, pero maraming inconsistencies sa statement ng asawa ng mistah:

    ke sarhento flores:anong klaseng personal security to, iniiwan yung ginagwardiyahan.it was said that he saw the whole incident,and he DID nothing? kung natatakot siya sa reprisal ni guloy, hindi pala siya takot katayin ng asawa ni ma’am, dahil pinabayaan niyang protektahan ang binabantayan..(strange huh)

    too harsh naman ang comment mo about the whole class, im sure sa ibang organization din may ganyang case pero it wasn’t publish kaya it was secretly kept. hindi naman ibig sabihin na accused si Guloy ng ganon eh buong klase na damay. eh if that’s the case, kung sayo nangyari yun at ikay ang accused, ibig sabihin buong clan mo can also be tagged as rapist. just comment to the subject wag igeneralize ang buong class.

    i have a close friend who was also falsely accused by a woman with an intention to seek revenge because of a failed promise by my friend.. similarly, i have learned a little from insiders in camp that this woman is vindictive. no delicadeza, doing business in almost all camps even in the unit where her husband belongs. she is not the type who will keep silent for 2 years to cry for rape. she has a secret that she is trying to divert attention of everyone by making up this story. it’s true people who do not know the whole story will easily condemn Guloy, but once you do..you will pity her husband (who is playing dumb) and you will turn your ire to her bodyguard Flores for causing the mess.

Hindi mo naman kailangan i-omit ang pangalan ng woman accuser.Nasa charge sheet yun, basis ng report mo. Kung kanino mo nakuha, others guess is as good as mine. Suggestion: isulat mo na ang pangalan ng accuser. Alamin mo naman ang pagkatao ng accuser, ang galing niya sa pag-arte, este, pagdrama, pagsisinungaling, at ang paggamit ng pera niya.

  54. Sanvil, there’s rule in journalism that even if its in the charge sheet, you don’t name the victim.

    If you recall the Daniel Smith rape case, the real name of the victim was never used by media. She was just known as “Nicole” which was not her real name.

    In other countries, It is generally considered inappropriate to comment publicly on cases subjudice, which can be an offence in itself. Leading to contempt of court proceedings. Publicly discussing cases may constitute interference from the due process.

    So May I pls suggest …that we end this discussion and wait for the Military Court to give it’s verdict.

    yes i was informed that the accuser was not provided or given a copy of the chargesheet ms sanvil, not only in this case but all kinds of cases filed in the provost martial. maybe you could check it out with the concerned office. the accused was given a copy of the chargesheet to answer the charges against him or her. now if u think it is unfair to the accused, then every one should stop posting since this case is already in court now as clearly explained to you by ms ellen.
    i urge u to read some stories and articles of rape cases to enlighten u ms sanvil because it seems like your being carried away by your emotions. Let’s be fair to both parties since they will have their time to present their evidences in court. besides we don’t know their backgrounds and its their privacy that we are trying to violate.     ellen, will you please enlighten me. are military wives like the demure accuser privileged to have a bodyguard?? is that in the afp policy? if it is baka maubos na ang mga sundalo pag ganyan ang whims ng mga wives. VIP ba si accuser? and based on common sense, how did the rape happen with the bodyguard with her?? what about police blotter that night? or what about report of the bodyguard to proper authorities in the AFP? ano ba talaga?? this story seems really scripted. ano ba talaga relationship ni madamme with the bodyguard?? baka naman meron relasyon itong 2. if so..it will be a big question on their credibility!

  64. Col. Guloy has been accused of rape. That’s a fact. That’s what the reporter said based on the charges which the military court accepted after a preliminary investigation.

    That’s why there is an ongoing court martial trial.

    If Col. Guloy is proven innocent later,I’m sure the reporter will also report that.

    As to naming the victim, that’s a no-no in journalism unless the victim herself goes out and indentifies herself.
