Batting for Chiz to fill a dangerous power vacuum

Raissa Robles, Philippine correspondent of the Hongkong-based South China Morning Post, has waged an online campaign to have Sen. Francis “Chiz” Escudero elected as interim Senate president to be eligible to be the acting president in case there would be a failure of election in the May 10 polls.

In her personal blog, Raissa said, “ Pssst, let’s urge senators to elect Chiz Escudero as Senate President to avoid dangerous power vacuum… in case a new President is not proclaimed by June 30 – the same day the tenures of President Gloria Macapagal-Arroyo, Vice-President Noli de Castro, Senate President Juan Ponce Enrile and House Speaker Prospero Nograles all lapse.”

I join Raissa in the campaign to elect Chiz as Senate president before June 30. But an election for a new president can only happen if there’s vacancy in the position. So let us also ask Senate President Enrile to do the patriotic act of resigning as Senate President.

Why is this necessary?

The Constitutional provision on succession states: “When no President and Vice-President shall have been chosen or shall have qualified, or where both shall have died or become permanently disabled, the President of the Senate or, in case of his inability, the Speaker of the House of Representatives shall act as President until a President or a Vice-President shall have chosen and qualified.”

The Constitution further provides that “The Congress shall by law, provide for the manner in which one who is to act as President shall be selected until a President or a Vice-President shall have qualified…”

I am l praying that the first nationwide automated election in May will succeed but because it’s untested and the performance of the Commission on Elections is not something that gives us confidence, the spectre of a failure of election cannot be ignored.

Even if the failure of elections is only partial, that is still worrisome because if winners in the local level including members of Congress would be proclaimed before June 30, 2010, there is a good chance that Gloria Arroyo might become Speaker of the House of Representatives and become the interim president.

As interim president she can call for the changing of the Constitution to realize her long-held plan to shift to a parliamentary form of government so she can return to power as prime minister.

Arroyo can be thwarted from executing her sinister plot by a simple Senate resolution. Since the 14th Congress is on recess and will meet only after the May 10 elections as a national board of canvassers to proclaim the winners in the presidential and vice presidential contests, they can pass a resolution to replace Enrile by whoever their choice is. If Enrile signs the resolution, he would be considered resigned.

The new Senate President will then be qualified to become acting president after noon of June 30, 2010 in case there would be failure of elections. As acting president for a period of 90 days under the Constitution, his main responsibility will be to keep peace and order while determining who really won in the elections, or failing to determine the same, call for a special election to finally resolve the political contest.

There are 12 senators whose term ends in 2013 and a new Senate president to replace Enrile should come from this batch.
Raissa assessed the acceptability each one of the 12 to their colleagues who would be choosing the third person in succession ladder to the presidency.

Her assessment:

* Senators Benigno Aquino III and Manuel Villar are both running for President.
* Senator Loren Legarda is Villar’s running mate.
* Senator Alan Cayetano is aligned with Villar.
* Senator Francis Pangilinan is aligned with Aquino.
* Senator Joke Arroyo is aligned with President Gloria Macapagal-Arroyo who is suspected of angling to stay on in office.
* Senator Edgardo Angara is also aligned with Pres. Arroyo.
* Senator Miguel Zubiri is also aligned with Pres. Arroyo and suspected of electoral cheating by veteran Senator Aquilino Pimentel Jr.
* Senator Panfilo Lacson has gone missing because of double murder raps.
* Senator Antonio Trillanes is in jail on rebellion charges.
* And who will trust a habitual failed coup plotter like Senator Gregorio Honasan to assume the post of Acting President?

Raissa said ,”And so that leaves only Senator Francis “Chiz” Escudero, a man without a political party – the man least likely to power grab for himself. A man who is credible and competent in law.”

    Chiz is a good politician, he withdraws from race even with high survey ratings, that was an act of wisdom. Unlike others like gibo who was a tail ender and yet still persist to run.

    Para ang Kongreso – na binabalak kontrolin ni Cong. Gloria Arroyo – at ang Senadong walang lider ang siyang magdesisyon kung sino ang magiging susunod na pangulo?

    Masisira ang ulo ko talaga sa eleksiyon. Balik na muna ako sa ospital.

    I agree. Senator Chiz Escudero is credible enough to do the job without much for people to hesitate about. Sadly, if one will really look at things in perspective, we have a system of government and laws to follow and yet most in government don’t seems to grasp what to do (much more understand what rule of law and public service is all about). They seems to prefer sowing intrigue and confusion at the detriment of many and country as a whole. At the same time, our Judiciary seems to be in a slumber in many situations. They are not proactive when resolving issues at hand, ending with having too many expert interpreting the law. How else can people follow and respect the rule of law or adhere to it? especially those in government who wants to take advantage? Somehow, those in power and those who wants to be in power makes simple things difficult. Kung talagang ang gobyerno at ang hustisya sa ating bayan ay makatao, they will find ways to stop this unhealthy speculations and provide a timely resolution to issues at hand. There are many ways to handle this without making everybody feel uneasy. They just need to be real and professional. If not for the country, at least for themselves.

    I’ve thought long ago that Chiz could be a good Senate president after Enrile. But if Chiz would want to get the majority votes of his colleagues, he should not endorse anyone for president. PAra walang bahid at kakampi niya ang lahat.

    Let’s see how Enrile will react to this new clamor for him to give way asap.

Going for automated elections, considering the nature of this admistration, the current situation with our supreme court, Ombudsman, and the best comelec we ever had, combined with the obvious time constraints (we Filipinos take a long time to learn, if we ever learn) – was a stupid move in the first place. We allowed ourselves to be place in a situation where we can’t win…then again, it was popular, so everybody jumped on the bandwagon…

    Chiz endorsement of Noynoy exposed him for what he really is – a real man…someone who takes a stand no matter how tempting it is to just sit on the sidelines, pretend not to root for anyone because its easy and more rewarding to join the winner afterwards…

  15. Actually, there’s a bill authored by Rep. Edno Joson seeking a resolution to a possible power vacuum due to failure of the 2010 elections which is apparently becoming a great possibility judging from the unfolding events starting from the Comelec’s bungling one after another, the not so smart Smartmatic computers to the latest folders fiasco. The bill proposes that the number 1 senator elected in 2007 be designated as interim president. Since the number 1 senator is Loren Legarda but is running as vice president, the post should go to the second placer, Chiz Escudero. Oragon!

Joson, following the Constitution’s provision on succession, let’s jon Raissa Robles and ET to bat for Chiz Escudero as Acting Senate President and eventually, Acting President, to avoid dangerous power vacuum. Dito natin mate-testing kung sino ang tunay na makabayan sa hanay mga senador kung paguukulan nila ng sapat na attention at panahon ang bagay na ito. Magbigay daan sana, una, si Senate President Enrile na bitiwan na ang kanyang pwesto, at ikalawa, for the rest of the senators to vote for Chiz Escudero as Senate President.

    Actually, Enrile did say that he is willing to give up his post as Senate President before his term as senator ends in June 30. But he also said that it is not for him to decide alone because it is the majority in the senate who should or will decide who will replace him. I think he said this about a month ago in an interview.

    Mukhang OK na ngayon si Chiz dito kay Ellen. Hindi katulad noong akala ay kandidato pa siya for president, na panay -panay ang banat sa kaniya, na kesyo puro daldal lang siya, na walang improvement ang teritoryo niyang sorsogon, na ibinulsa niya yong pork barrel, niya, etc.
    May balimbingan din pala dito at walang consistency, kasi kakampi na siya ni Noynoy.

    Perl: I meant the current crop. Hindi pa naman tapos ang term nila after May 10, dahil nakaupo sila hanggang June. Pero kulang sa majority si JPE, dahil wala si Ping, at hindi makaboto si Trillanes. Mag-convene sila ngayon, tiyak talo si Manong Johnny.

    Under the Constitution, the Senate is composed of 24 senators from whom the Senate President is elected by its majority.

    Come June 30, 2010 where a failure to proclaim winners in the national positions, including Senators, occur, there will only be 12 senators left. This is one less than majority. Because of this, the presumed continuing mandate of the Senate President may be assailed, and his succession to the Presidency be put to serious question. Now would enter into the fray the Supreme Court to resolve this.

    Hence there is really an acute need for GMA to force through an Arroyo Supreme Court. She will thus appoint a Chief Justice vice CJ Puno when he retires, and another one to fill the vacancy to be left by whoever SC Justice she will promote as Chief Justice, very likely Justice Corona.

    Malalim ang dahilan kung bakit hindi natuloy ang pagtakbo ni Chiz. Without the support of his NPC party and boss Danding, mahihirapan siya. Sa pagtakbo ni Noynoy, tatlong tao ang nasagasaan niya. Unang-una na si Kabayan Noli. Noli was hoping for the Lopezes’ support just like he got last election. But the Lopezes frankly told Noli that they would be supporting Noynoy. Maaaring sa laki ng utang na loob nila kay Cory who returned ABS-CBN and Meralco to them like giving candies to kids. Kung si Noynoy ang manalo, tuloy ang ligaya ng mga Lopezes. Nasagasaan din si Mar Roxas. Take note that Mar’s rating in the survey is not only the highest among the vice presidentiables, daig din niya si Noynoy. Deep inside Mar and his loyal supporters, siya ang dapat tumakbo sa pagka-Presidente. Masama pa rin ang loob ni Korina. Pansinin niyo na hindi siya sumasama sa mga gatherings at campaign sorties ni Noynoy at LP. Nasagasaan din ni Noynoy si Chiz. Chiz backed out partly or mainly because of Noynoy. So, does Noynoy deserve to be elected? Let’s leave it to the people. My humble advice to him: Try to close his mouth hindi iyon laging nakanganga. Ayusin naman niya ang buhok niya kahit nakakalbo na. Kaunting porma naman sa pananamit. Lumakad ng maayos at hindi parang lasing. Aminin din niya kung tutoong nagpatingin siya sa psychiatrist. What’s wrong seeking professional help? In the West, it’s not even being talked about.

    Totoo kaya na ang dahilan kung bakit di tinuloy ni Chiz ang pagtakbo ay dahil sinabihan siya ng isang mataas na opisyales ng NPC na susuportahan siya ng partido sa isang kondisyon na di niya pwedeng batikusin si Gloria sa kanyang pangangampanya? May bumulong sa akin. 😛
