Romulo pre-empted Malacañang on retention of envoys?

The July 5 statement of Malacañang says Romulo and Ochoa have recommended Arroyo envoys’ extension of service and the memo is still at the President’s desk.

Yet, last July 1, Romulo sent out a memo individually to the 26 political ambassadors that they can stay up to September 30, 2010. Click here for the news report on this by Philippine Star.

Did Romulo pre-empt Aquino?

Ochoa also said, “Everybody stays until they are replaced or until the agreed period, whichever comes first.”

What’s the basis of this order? Were the ambassadors appointed by Aquino? There’s nothing that says they were appointed? Nothing in the powers of the president grants him the power to extend a non-existent appointment.

Meanwhile that Aquino has not yet (supposedly) approved the recommendation of Romulo and Ochoa, what’s the legal basis of those political ambassadors in using government facilities and spending government money?

If the Union of Foreign Service Officers pushes through with their plan to goto court to once and for all settle the issue, Aquino might find himself on shaky ground. Will write more about this later.

Palace eyes envoys’ 3-month term extension

Executive Secretary Paquito Ochoa Jr., and Foreign Secretary Alberto Romulo have jointly recommended to President Benigno “P-Noy” S. Aquino III a three-month extension of the term of all ambassadors whose appointments are co-terminous with that of former President Gloria Macapagal Arroyo, and therefore deemed to have expired last June 30.

The move, announced by Ochoa in radio interview, sought to maintain the status quo in the country’s foreign service which had started recalling the so-called “political appointees” in the diplomatic posts abroad, and to finally resolved the question on whether or not their ambassadorial posting are considered automatically terminated, and that they should immediately return home following the June 30 change of government.

The recommendations are now at the President’s desk.

“Secretary Romulo and I have been conferring and we agreed to recommend that they be extended for a few more months because we don’t want to disrupt diplomatic relations with other countries,” Ochoa said.

“There are many pending transactions, pending concerns that are needed to be addressed and should not be disrupted by simply recalling them,” he stressed.

The three-month extension expires on September 30 by which time the affected diplomatic officials are expected to have wound up their tasks.

Sec. Ochoa also said all ambassadors, either career or political appointees, should stay put in their foreign postings until Sept. 30, unless recalled earlier.

“Everybody stays until they are replaced or until the agreed period, whichever comes first,” Ochoa added.

He said there are 21 political ambassadors who are still in active service. According to the Department of Foreign Affairs, a handful of these diplomatic officials have already come home. Among them were Ambassador to Iran retired Gen. Generoso Senga, Alejandro del Rosario (Warsaw), Acmad Omar (Oman), Masaranga Umpa (Nigeria), Alexander Yano (Brunei), Rigoberto Tiglao (Athens), Antonio Villamor (Riyadh), and Domingo Siazon (Tokyo).

One school of thought that will probably be cleared out of the Ochoa-Romulo reommendation is the issue of whether diplomats should not vacate their posts without replacements because it is considered a violation of the rules in diplomatic relations.

Also expected to be cleared is the issue of whether the “political” ambassadors should have come home voluntarily because their respective charge d’affairs can tentatively take over their functions until their replacements have been appointed.

    Shouldn’t they be re-appointed and confirmed by CA? I agree, P-NOY has no authority to extend them. No Black & White on this issue. It’s either Re-appoint them and pass through CA or Recall and head back to The Philippines. They should have returned, and left the operations sa Charge’ D’ Affairs. Sa kapal ng mukha ng mga ito, hanggang Manila (from their respective host countries) abot na ang balat nila…ang gaspang na nga eh.

    Romulo is one presumptuous secretary. Pre-empting even the orders of P-NOY, similar to what he did after meeting P-NOY sa Times Square.

    Romulo’s extension on this could be in line with GMA’s negotiated deals with this individuals. I really feel for the DFA folks, Union of Foreign Service Officers,the ones who should have been doing their jobs. They held hostage by Padrino system. Like political mendicants. Where’s the merit system here? Grrrr.

    This holdovers do not even have the courtesy to meet P-NOY, how can we entrust them with representing the Filipino’s welfare whilst abroad? Darnnnn I forgot, they neither have courtesy not delicadeza in their vocabulary…

    I have been following Yuko in FB, and so far her tirades against this supposedly new government is solid.

    Malamang marami din diyan sa Unfors ang nagmamadali na pumalit doon sa amabassadors kaya pinamamadali nilang pinapapalitan ang mga ito. There is more than meets the eye dito. Note how some quarters are raising a ruckus about the termination of other co-terminus positions in government. They are quick to cry vendetta but in the foreign postings, it’s the other way around. Masyadong atat knowing na the vetting process for the new appointees will take some time. Para bang ‘kami naman, weder na namin ito’. Bakit di na lang nila lasonin si Tatang Romulo? 😛

  4. Henry, I don’t agree with you about Unifors because I know many of them. But if that’s what you think of them, you are entitled to your opinion.

    But the point here is legality. Aquino promised that his government, in contrast to Arroyo’s would respect and follow the laws. Yun lang.

  5. This will probably reach the courts. I’m writing about it now for tomorrow. If Aquino wants to stake his presidency in defense of Arroyo’s ambassadors, so be it.

    Why take it against foreign service officers for wanting to serve the country professionally?

    Aquino has many problems and instead of helping him, Romulo is “putting him on the spot” as Malaya’s editorial states.

    Ballsy Cruz, who was reported to have sponsored Romulo’s retention to the Aquino cabient, should realize now her mistake. She should advise her “Tito Bert” to volunteer to resign because he is really incompetent.

    If not, I’m sure this will not be the last. Parang kumuha si Noynoy ng bato pamukpuk sa ulo niya.

While those political envoys are personal emissaries of the republic, by the very nature of their appointment as political envoys, they also specifically represent their political appointing authority who is none other than, in the case at hand, Gloria. If these overstaying political envoys are retained in their posts, it is only logical to believe that it is also Aquino’s desire to be represented by the same Gloria envoys. Question is why?

    In fact, by way of foreign representation, particularly in major postings, it is traditional that a president’s first and immediate action upon assuming power is to publicly release the names of the envoys who will personify the new national leader’s aspirations with regard to future relations with the foreign nation in question, and this even as said envoys are awaiting confirmation from Congress. For example, the appointment of a certain person of substance, as envoy who’s been personally handpicked by the president to a major posting, signals the importance the incoming leader places on future relations vis-a-vis said nation.

    Aquino’s non-action today, i.e., preferring to let things stand as they are, might be construed abroad as absence of real interest in forging good, personalised relations with a country. Either that or said foreign nation could easily perceive RP leadership as do lally.

    Actually, the “confusion” in Manila may just be projecting exactly that image.

    Ms. Ellen, Madam Chi hindi ba naman may pagka drastic na yung bring this matter to the courts?

    I am supporting Aquino at ang palagay ko lang kung dadalhin sa korte ang usapin na ito, may pagka combative o adversarial agad sa kauupong pangulo na wala pang 2 linggong nakakaupo sa pwesto.

    Hindi ko maarok kung anong kaso ang maifile sa ngayon dahil:

    1. Political question ang pag aappoint ng cabinet secretary kaya hindi pakikialaman ng Court ang pag appoint kay Romulo.

    2. Wala pang official order si Aquino extending the terms of ambassadors. Hindi pwedeng aksyunan ng court ang press release pa lang ni Ochoa at Romulo.

    3. Kapag nagfile ng kaso, unless my TRO o injunction, status quo ang mangyayari. habang walang decision ang kaso, stay muna si Romulo sa DFA at ang mga ambassadors sa pwesto nila abroad.

    Absolutely, and it leaves a very bad taste in the mouth, a brazen show of disrespect to the president. And in that case, Aquino should assert his authority. He must rescind the order and if only to prove his critics wrong in their assumption that he lacks leadership skills, maybe this is the best time to act decisively.

    Put an end to all speculations, fire and gift-wrap Romulo and send him back to Gloria where he belongs.

As I recall matagal bago siya napalitan ng incoming ambassador na matagal na ring naannounce ang appointment pero di agad naka assume dahil nga sa vetting process at confirmation hearings sa US Senate. Take note na di charge de affairs ang namahala sa US Embassy.

    Magkakagiyera ba tayo sa ibang bansa kung madelay ang pagtalaga ng bagong ambassador due to the vetting process? Mapuputol ba ang diplomatic relations natin sa ibang bansa habang inaayos pa ang mga gusot? Sa mga bansa naman na mas importante yung postings natin I believe na walang problema at career diplomats yata ang mga nakaupo. I understand yung invocation ng legality pero may iba-ibang opinion.
    again, tama lang na dalhin sa korte. Napansin mo ba Tedanz na malapit na maubos buhok ni PNOY? 😛

    Wala pang 1 linggo si Aquino na presidente. Hindi ba pwedeng bigyan sya ng konting panahon para magawa yung dapat gawin. I know tumakbo sya at alam nya ang kahaharapin nya. Bigyan din naman sya ng pagkakataon malaman kung ano ang mga sanhi ng problema para malaman kung ano ang magandang gawin.

    Yung sa MC1, nagpadalos dalos na nga, nung pumalpak, ayun maraming pumuna na sinabing maging metikuloso at pag aralan mabuti ang ginagawa. Ngayon naman, hindi mabilis ang pagtugon sa ibat ibang problema tulad sa DFA, gusto ng madaling remedyo. Huwag naman masyadong mainipin.

    Ulitin ko lang, wala pang isang linggo si Aquino sa pwesto, pwedeng bigyan ng pagkakataon at huwag madaliin.

    1. Huwag mong pirmahan ang extension ng mga ambassadors na co-terminus kay GMA. Bakit kamo? Kung mayroon silang delicadeza, dapat binitiwan na agad nila ang kanilang pwesto sapagkat kahit hindi ka pa nanunumpa, alam na nilang ikaw ang nanalo. Simula noong May 11 hanggang June 30, dapat ginawa na nila ang dapat gawin. Malalaki na sila.

    2. May hanay namang pwedeng pumalit agad bilang Charge d’affaires o most senior embassy official, sila ang i-appoint muna para tuloy-tuloy ang serbisyo. Malaki pa ang matitipid na salapi ng bayan.

    3. Sibakin mo si Romulo. Parang wangwang na tutunog ito sa buong bansa kapag pinalitan mo agad si Romulo dahil ikaw pa lamang ata ang sisibak sa isang cabinet member sa loob ng isang linggo.

    Kung hindi mo kami susundin, nasa iyo na yan, ikaw naman ang president. Ibig sabihin lang nun, hindi totoong kami ang iyong boss, istir lang yun. Aminin natin na patuloy pa rin kaming busabos.

    Most fellow members of ASEAN nations are considered major postings for RP in the same manner that most Western countries consider Washington DC, Court of St James, Paris, Berlin, Brussels (for EU and NATO), Tokyo, etc. as major or number 1 postings. Washington, Canberra and some other European capitals are considered major or number 1 envoy postings for RP.

    It will be easy to know who the envoys are in Bangkok, Jakarta, Singapore, Tokyo, KL, Canberra, Beijing, and a couple of other nations on the Pacific side of the globe (all considered major or “prime” postings) and to determine whether they belong to the now infamous “Gloria 26 co terminus.”

    Ambassador Kristey Kinney ba pinalitan agad ng mga unang araw pa lang ni Obama as President?

    I believe Obama released the name of Kinney’s replacement — which is what the whole presidential appointment exercise of appointing political envoys is all about, thereby signalling to his Philippine counterpart that he had handpicked his own man to “parlay” with RP on his behalf even before he stepped in the White House. And if you remember, Kinney didn’t have to wait for her successor. She left for Washington early and left the US embassy to a chargé d’affaires while awaiting the definitive confirmation of Thomas as ambassador to Manila.

  20. Oblak, re # 11.the political ambassadors would be guilty of usurpation of authority and malversation bevause they would be spending government money when they are no longer government officials.

    As of June 30, 2010, they ceased to be ambassadors. They have no legal personality to sign official papers and use government resources.

Personally, I’d opt to watch and learn how things unfold…as some things can’t be rushed, this disruptive behaviour of these unifors people must not be tolerated though, if anyone is to be sacked, they should be included…good intentions or not, they have shown that they do not deserve to be there also…

    Thanks Ms. Ellen for clarifying that the case will be against the over-staying ambassadors.

    Tinatamad lang akong magpunta sa mga archives ng mga dyaryo pero may nabasa ako nang June or bago bumababa si Arroyo na may inissue si Romulo na order sa mga political ambassadors na pwedeng hindi muna sila umuwi kahit tapos na term ni Arroyo.

    Playing Arroyo’s advocate lang ako, ang basis kung bakit hindi umuuwi ang mga political ambassadors ay yung order na yun na hindi naman iniinvalidate ni Aquino through Romulo.

    I still agree na dapat umuwi ang mga lahat ng political ambassadors na inaappoint ni Arroyo at dapat may mag point out kay Aquino na nababatikos ng husto ang bagong administration dahil kay Romulo.

Gloria Arroyo, may no longer be the focus of the so-called Truth Commission which is being created by President Noynoy Aquino, and which body will be headed by former Supreme Court Chief Justice and former permanent Philippine ambassador to the United Nations, Hilario Davide Jr.

Ang pagkakaalam ko si Cardinal Rosales ang nagmungkahi nyang isama ang mga ibang dating pangulo. Wala na si Cory, naconvict na si Erap kaya si Ramos na lang natitira. Most of these ambassadors are political appointees karamihan ay mga bagito at hindi nila alam ang capital city ng bansa ng mga assignment nila.all too often innocents abroad – as opposed to career people who have worked their way up the ranks of the all too hierarchical foreign service and have had extensive exposure to the country, language and culture to which they are being assigned –

    Ito ang advice ko sa kanya para maging epektibo siyang ambassador.
    Rule no.1– Manahimik na lang–He probably don’t know the issues and won’t be able to explain them properly to experienced career diplomats at the foreign ministry or in the President or Prime Minister’s office. Its embarrassing kung mabuko at wala pa siyang alam kung ilang ang bilang ng Camel at mga traffic rules ng sinusunod ng mga Camel Jockeys sa desierto.; That’s why you have career staff – including a deputy chief of mission and political and economic officers who have spent their lives learning the intricacies of this arcana and can read and understand bureaucratize. Let them take care of it. Besides, do you really want to spend your time writing your opinions at Ellenvile.

    Rule no.2—2.Kantahan o tulaan mo na lang sila. Entertain and expect to spend a considerable amount of your own money para pakainin sila kaya nga may malaking budget ka,don’t forget to send your reimbursement first before you spent. One of the best things you can do is provide a comfortable setting in your lovely-residence-behind-bars with security guards for the substantive people on your staff to meet with the movers-and-shakers in whatever foreign country you happen to be in. Playing gracious host or hostess like the looks of luningning,Milagring and mariposa can go a long way to establishing cordial personal relationships. That’s what the residence and its staff is for. And they make it incredibly easy for you to do just that. All you need to pay is for some of the food and drink because Tongress and Senate never provides adequate representation funds to cover the entertaining required of your position. Besides, you’re drawing a huge government salary plus numerous perks for living abroad that include free housing, a paid staff, a car and uniformed barong driver, and international air travel. If you could afford to buy the title and what comes with it, you can certainly expend some of your own fortune on entertaining.

    Rule no.3–Take a lot of travel and sight seeing-the in the country where you are assign,if you don’t know their language if the ask you, tell them you don’t speak English. Philippine government provides you a limousine libre ka ng magwangwang diyan. Show the flag at the front and back bumper. Take advantage of those invitations to whatever occasions you have a VIP reserved seat, but make sure the trip is coordinated well in advance by an Embassy staffer, or staffers who can make your trip proceed seamlessly. And take that most beautiful staffer along – you never know when you’ll need her to handle an unexpected detail or cope with a logistical glitch. An accompanying spouse can be an asset;but,make sure your spouse is really nice looking if not just tell them that you are a widow. but find out from your hosts how welcome yours is to tag along or you have a hotel reservation.

So nasa Presidente na yung bola kung papalitan nya agad itong mga ambassadors. I think between forcing these ambassadors to go home or allowing them to stay, i will opt for the former since kung mayroong emergency mangyari sa ating mga kababayan dun sa abroad, the ambassador, unlike any other lower diplomatic post, can easily and directly communicate with the head of government of that country.

    Take for instance si Ambassador Kristey Kenney of the US Embasssy who was replaced only recently by Ambassador Harry Thomas. Ambassador Kenney was the US ambassador since panahon pa ni George Bush and until nanalo na si Obama. So ano solution, dapat mag-appoint na agad si Noynoy ng mga successor ng mga ambasssadors na to as soon as possible. tapos ang problema.

    They are co-terminus with the never elected president with some if not most still have to be confirmed by the CA which is also an issue yet to be resolved (I understand there were those posted only as a gesture of utang-na-loob).

    For Romulo to cite what transpired in the past (panahon daw ni Cory at Ramos, nag-extend naman din daw) is lame. Hindi nga ba ang buong kahulugan ng pagboto sa bagong administrasyon ay pagbabago, ang pagsunod sa mga batas at pagsunod sa wasto? It might have been a practice before (was it before the foreign service act and its IRR?), but it does not mean it was right. The administration then were just plain lazy.

    The list of things that are illegal and yet allowed by the Philippine government is too long for a country supposedly based on a system of laws. We operate by what is expedient to certain powerful people. Through his long years in government, Romulo has become an expert on this. I won’t be suprised if Aquino hews to Romulo’s “recommendation” especially now that it’s been publicly supported by Aquino’s little president. So much for true change. We’ll be getting more of the same in the next six years.

    top secret information is very rare in the first place. what top secret information would the government of papua new guinea possibly need to convey to the political ambassador there? and if there is a necessity to convey a top secret information, the country can use its own ambassador in the philippines to convey the information directly to the DFA.

    the situation described by the senator assumes that the charge d’affaires is incompetent. most of them are not. all of them are career diplomats, with ranks of minister. in actuality, they are the ones running the embassy; the ambassador, especially a political ambassador, is actually a worthless frontliner whose value is derived from his/her close connection to the president who appointed him/her.

    finally, a charge is not an officer in charge (OIC); the charge has legal standing in international law.

    no, the political ambassadors had their own sweet time to prepare and say their goodbyes to colleagues way back in april. it was just that they were hoping someone close to them would get elected. turns out wrong, but hey, romulo stayed on, so they feel safe.

    if the president makes the wrong moves on this issue, it would aptly describe what his administration would be.
