P-Noy orders De Lima to review Trillanes case; says coup charge unjust

Aquino says coup charge vs Trillanes ‘unjust’; Trillanes posted bail in connection with Manila Pen November 2007 incident

abs-cbnNEWS.com

President Benigno “Noynoy” Aquino III on Friday labeled as unjust a coup charge against former Navy Lt. Senior Grade and now Senator Antonio Trillanes IV for his involvement in the 2003 Oakwood Mutiny.

Update July 18 from Justice Secretary Leila de Lima:

” We abide by the directive of the President. I am reviewing the records of the case and have consulted our prosecutors, especially those handling it before the court.

“I understand that the case will soon be deemed submitted for the court’s decision, upon the filing of the required memoranda by both the prosecution and the defense. At this stage, the options for the prosecution may be limited. And the courts have absolute discretion in the disposal of a case once it has acquired jurisdiction over it.

“On the other hand, the President has the absolute prerogative to direct the Secretary of Justice, as an alter ego, to review the case against Senator Trillanes. It is in consonance with his oath to do justice to every man. That is also part of the thrust and mission of the new DOJ,” Secretary De Lima added.

“I will, however, exercise care and circumspection under the circumstances, given the independence of the judiciary,” Secretary De Lima further added.

Aquino said he has ordered Justice Secretary Leila de Lima to review the coup charge against Trillanes since the elements of a coup were not present during the short-lived mutiny.

“Trillanes was first incarcerated by virtue of the charge of participating in a coup. However, if you review the Revised Penal Code, there is a provision that says a coup is committed if there is a swift, violent attack. Then there’s an enumeration. The enumeration does not include a hotel,” he said at the inauguration of the Philippine National Police School of Values and Leadership (SVL) in Subic Freeport Zone, Zambales.

He added: “[Trillanes] was imprisoned because of Oakwood. My opinion is, and that is just my individual opinion, the fiscal should not have let that case prosper. There are several other cases but the coup d’etat case has specific requirements, which were not present. I think there was injustice there.”

Aquino said he will leave it to de Lima to review the case thoroughly. He added that the government will leave it to the court to decide on Trillanes’s petition asking that he be allowed to participate in the Senate sessions.

Trillanes, along with 300 junior officers and soldiers, took over the Oakwood Premier Ayala Center (now Ascott Makati) on July 27, 2003 and demanded that President Arroyo and other government leaders step down from office due to corruption. The group later surrendered to authorities less than 24 hours after taking over the apartment tower.

Trillanes has been in jail since 2003 but was still able to win a seat in the Senate during the 2007 election. He has not been allowed to participate in any of the Senate sessions because of security risks.

Trillanes’ lawyer, Rey Robles, earlier urged Aquino to follow the example set by his mother, former President Cory Aquino, and free all political prisoners at the start of his term.

He said his client is asking the President to allow him to participate in the Senate sessions either personally or through teleconferencing. He said there have been examples in other countries where a legislator is still allowed to continue his duties even while facing a court case.

Trillanes posts bail, just in case

by Ashzel Hachero, Malaya

DETAINED Sen. Antonio Trillanes IV yesterday posted bail before a Makati court hearing the rebellion case filed against him and several others in connection with the 2007 Manila Peninsula Hotel standoff.

His lawyer Reynaldo Robles said the P150,000 bail was posted at the sala of Makati RTC Branch 150 Judge Elmo Alameda.

“Senator Trillanes has posted bail in anticipation of the possibility na baka payagan siya ng korte na makalabas at maka-attend sa Senate session sa July 26, “Robles said referring to the petition earlier filed by Trillanes before another Makati court.

Robles said he does not see any reason for the other court to junk his request, though previous appeals of Trillanes failed to get the nod of the court.

Alameda’s court is hearing the coup d’etat case filed against Trillanes and the other junior officers belonging to the Magdalo group for the Oakwood mutiny in July 2003.

The coup case is being heard by Makati RTC Branch 148 Judge Oscar Pimentel.

“Wala kaming nakikitang rason dahil kung ang iba nga like former ARMM governor Nur Misuari was allowed bakit si Senator Trillanes pa at isa pa may rason naman at ito nga ay makaattend sa opening session ng Senado sa July 26,” he added.

Alameda earlier allowed Trillanes and the other Magdalo officers charged with rebellion to post bail while the case is being heard by the court.

Other officers such as former Marines Capt. Gary Alejano and former Navy Lt (s.g.) James Layug have posted bail.

Trillanes has asked Pimentel’s permission to attend the opening session of the 15th Congress, when senators will elect their president. – Ashzel Hachero

    Thanks, Ellen.

Oo nga, YB. Aquino will have many friends for life if he orders review and set right all cases of Gloria’s kapalpakan and kababuyan.

Secretary Leila de Lima can do what Attorney General Eric Holder did, in the case of Senator Ted Stevens. AG Holder filed a motion to dismiss on the basis of prosecutorial misconduct. In fact, in that case, there already was a conviction, but the USDOJ asked that it be set aside.

    The motion was granted.

    Read about it here:

    http://www.ktuu.com/Global/story.asp?S=10108778

In the news item, there is a link to the motion filed by the Prosecutor.

It is true, that the above is based on Rule 48a of the Federal Rules of Criminal Procedure, which provides that:

    (a) By the Government.

The government may, with leave of court, dismiss an indictment, information, or complaint. The government may not dismiss the prosecution during trial without the defendant’s consent.

But Federal Rules are usually based on jurisprudence. Hahanapin ko, and will post it here.

I hope the president is right on ordering the Justice Secretary to review the case of Sen Trillanes. But then again this might leave other people wondering why only trillanes? I am sure there are also people languishing in jail who might be hoping for the same treatment by no other than the President of the Republic. But why only Trillanes? If the reason is to allow the senator have the chance to serve his constituency well by having to personally attend senate session, why not also allow fathers who are in jail to post bail or request tempoarary freedom so that they may have the chance to earn a living to feed their families.

Methinks that this should be decided upon carefully. It must be remembered that Sen Trillanes, for whatever reasons he and his group had, put law in their own hand. Hasty decisions or maybe perception of questionable decisions on his case may bring different signal to other people who may have the tendency to be like him. Im not talking here of members of the Armed Forces alone. We should accept that our country is struggling and some people are suffering. How about if everytime the people want to raise issues against the government they’d rather do what trillanes did? Would not this create a vicious cycle? Would this not be a display of lack of faith on our justice system? Remember the “push ups” Ramos ordered the mutineers do after staging coups against the Cory Aquino admin? Did it send a clear signal to would-be mutineers?
I believe in reconciliatons but I also believe to let justice take its own course.

I have no link to the Order of the judge. Pero maigsi lang naman, so here it is quoted in toto.

At the direction of the Attorney General, on April 1, 2009, a newly-appointed team of prosecutors filed a Motion to Set Aside the Verdict and Dismiss the Inductment, citing the failures to produce notes taken by prosecutors in an April 15, 2008 interview of Bill Allen. At a hearing on April 7, 2009, the government conceded that these notes contained information that the government was constitutionally required to provide to the defense for use at trial. Despite repeated defense request and the Court’s repeated admonitions to provide exculpatory information, the notes were not produced to the defense until March 25-26, 2009, nearly five months after trial. The Court will grant the Motion.

There was never a judgment of conviction in this case. The jury’s verdict is being set aside and has no legal effect.

The government’s Motion is GRANTED. The verdict is hereby set aside and the indictment is hereby dismissed with prejudice. See Fed. R. Crim P. 48(a).

    IT IS SO ORDERED.

The above Federal Rule is based on the common law principle of nolle prosequi – Latin for unwillingness to prosecute.

Gamit din yan sa Pilipinas, since the colonial times. It was first applied in the case of US v. Valencia (1903),

and later US v. Barredo (1915).

    www(dot)lawphil(dot)net/judjuris/juri1915/dec1915/gr_l-9278_1915.html

The most recent case citing Valencia and Barredo is Stevens N. Fuentes v Sandiganbayan (2006)
    www(dot)lawphil(dot)net/judjuris/juri2006/jul2006/gr_139618_2006.html.

In both the Philippine and US jurisdictions, the dismissal is made with leave of court, meaning, the prosecutor must file the motion in court.

The President pointed out the absence of one element – the attack on an edifice enumerated by law (hotel is not enumerated).

There is another element that is missing. The law states:

The crime of coup d’etat is a swift attack accompanied by violence, intimidation, threat, strategy or stealth, directed against duly constituted authorities of the Republic of the Philippines, or any military camp or installation, communications network, public utilities or other facilities needed for the exercise and continued possession of power, singly or simultaneously carried out anywhere in the Philippines by any person or persons, belonging to the military or police or holding any public office of employment with or without civilian support or participation for the purpose of seizing or diminishing state power.

  13. saxnviolins saxnviolins

    The elements are emphasized above.

    1. Swift attack
    2. Use of violence, intimidation, threat, strategy or stealth.
    3. (a) Attack is on a military camp, etc.
    (b) The facility is needed for the exercise and continued possession of power.

4.The attack is made by person belonging to the military
    5. The purpose is the seizure of power, or to diminish state power.

Element 3, as pointed out by the President is missing.

Element 4 is also missing, because Trillanes’ stated purpose was to force the Glue to resign. There was no intent on the part of Trillanes to seize power for himself or for a Boss, unlike Gringo’s coup to install Enrile.

Neither was there a purpose to diminish state power. Had the Glue resigned, the VP would have assumed office. The government would still have functioned, so there would have been no diminution in state power.

Kulang ng dalawang elements. So like the President said, sa fiscal pa lamang dapat dismissed na ang charge ng coup.

  15. So perhaps, time to turn the gun around and point it at Gloria, i.e., the coup d’état against Erap.

All the ingredients are apparently complete if you follow by RP’s definition of a sustained coup d’état.

  16. 2. Use of violence, intimidation, threat, strategy or stealth.

Most of these elements were committed during the coup d’état against Erap.

Use of physical violence was not apparent unless the threat of violence is considered sufficient. Intimidation? Yes, particularly when Gen Rene de Villa went to Malacanang to issue his ultimatum. Threat? Yes! Pidal himself admitted that an army batallion led by Espinoza would be coming from Quezon to attack Malacanang if Erap didn’t give up. Strategy? Oh yesss! Just read the Philippine Graphic interview of Pidal — he spelled it out completely.

Stealth? By gum! Couldn’t be more stealth than what happened: 21 January at dawn, Gloria was waiting outside the room where Angie Reyes and major service commanders were shitting about as Angie Reyes was convincing the military chiefs to commit “mutiny” (even as he and CGPAF were arguing bitterly “Let’s call for a snap election now!” screams CGPAF; later on when the die was cast, Angie opened the door and let the midget in saying, “Gentlemen, your new commander in chief!” By 12 PM, Davide, chief of the supreme court had sworn in Gloria based on “constructive resignation” of the duly elected president of the republic!

  17. Anyway, to me, good thing that Trillanes is now likely to be freed — the president’s body language, i.e., saying coup charge unjust” is like a presidential marginal note, eg., “I want him out!!! And that’s that! The senator is as good as out!

If ever there’s something I can blame Trillanes is that they should have attacked Malacanang to kick out the squatters. Otherwise, everything sounds good to me. He’s been in prison for quite some time, paid his fine, time we all put these Magdalo coup d’état thinggy behind us so we could all concentrate on sending Gloria and her husband and junior to prison.

By no small measure, I must assume that SNV is an accomplished lawyer and knows exactly what he is talking about when it comes to law technicalities and legalese talk. As such, I must assume further that being so, his un-biased legal observations are shared by people of the same profession like he is. If that is so, how come Tony Trillanes has been languishing in military custody for the past seven years ? Did the lawyers for the government knew something that the lawyers for the defendant’s side didn’t know about ? I mean, they are not reading different books for such an offence, are they ?

If indeed two key elements were haplessly missing to have otherwise overturned the charges against Trillanes, then what the hell was he incarcerated for ? What was the “legal” charge that he should be accused of in the absence of the two elements ? I am very sure it is not coup de etat because two elements were missing to name it as such ! What was it then ?

Let me guess. It is all of malicious political persecution, intimidation, and that fear of Mr. Trillanes that led him to his “senatorial chambers” inside the military camp. Other than that he was jailed for seven years with no clear and substantiated “charge sheet” against him. Basta ang sabi ni bruha, “I want him jailed, PERIOD”!!! Then the more honorable legal community just went pffft.

Now that there is a new Malacanang tenant, how many more SNV’s are willing to come out and muster a consensus that Pareng Tony was never guilty of a coup de etat and that “sa fiscal pa lamang dapat dismissed na ang charge ng coup” (SNV) and that he should be released immediately without prejudice and allow him to freely fulfill his mandate as a senator of the republic ?

And what about the plight of the other political prisoners ? What were the real “charges” against them ?

I am, of course, not a lawyer so I stand corrected for any errors. This is merely my layman’s opinion.

Ok si Pnoy ah. Kahit na hindi siya ang pinili ni Trillanes na supportahan sa 2010 elections, he is trying his best to free him rhis time. This tells me a lot of his character.

Even if Trillanes was guilty in staging the protest at the Oakwood facility and at the Manila Pen, he has more than paid for it! There are generals who had done more harm to the country by destroying the AFP institution in cheating in the elections for the midget and in cahoots with the midget put in detention the upright officers. Palayain na ang lahat ng political prisoners ni midget so they can start cleaning up the mess left by the super typhoon MIDGET!

    jawo:

Kulang ng elements sa coup. Some other charge could have been instituted, because Trillanes et al had guns and explosives and menaced (in the perception of the hotel occupants) private individuals.

But threat of physical injuries, or some other charge would have been bailable. That was the reason why they forced the square peg of the coup charge into the round hole of the facts – to effect the illegal detention of Trillanes.

The above is the same reason why Lim and men, who obeyed their superior and went back to the barracks were charged with mutiny, also to be able to deny them bail.

    Persecution nga, like you said.

I would be minded to fire all prosecutors who went along with this injustice and did not stand up for what is right. Of course, they can feign good faith, and claim that if ever, they just had a different appreciation of the law and the facts. So mahihirapan si De Lima to fire them.

There is a way to punish them though.

I will give them what is called a lateral demotion. You keep your title, and you get to continue receiving your pay. But I will not assign you any cases. I will assign some dumb-ass research project to you, that is clearly inconsequential (like suggested amendments to the Rules of Court and the Revised Penal Code), the results of which I will not read anyway.

A lawyer loves the action of litigation. If you deny him that, it is like denying a singer the mike. But since De Lima is the Boss, sorry, tiis sila for six years. No court appearance for you dickheads.

  21. sax, the only popular case that comes to mind about withdrawing a court case (help me here) when a new Ombudsman that came with the new administration petitioned for it was in (excuse me po) Hacienda Luisita’s case.

I think it was Sedfrey Ordoñez who filed the motion against its own case versus the hacienda following an order by then Minister Condring Estrella to distribute the land to the farmers.

Sorry but I don’t want to add color to this topic but just to provide reference to a previous act of the state.

Napapag-usapan na rin lang ang mga wrongs on military men that must be redressed. Paano na yung mga bata ni General Miranda who were separated from the service, because they refused to testify against General Miranda? Di ba’t dalawang taon ding nakulong? Tila wala pang suweldo while in detention.

That order must be recalled and set aside by the Commander-in-Chief. Those men should be reinstated, with backpay, with interest. Barya lang yan, compared to the sums for junkets of the Glue generals.

Walang judicial review diyan, may blanket authority ang Commander-in-Chief in issuing dishonorable discharges, or setting them aside.

  27. Bankrupt na ang California.Schwarzenegger administration had asked the court to order that the employees’ pay immediately be reduced to the federal minimum wage of $7.25 an hour because there is no state budget in place.

Bakit walang budget? cheap illegal alien labor is bankrupting the state and posing enormous burdens on the state’s shrinking middle class tax base.Mga under the table at hindi sila nagbabayad ng income tax.Libre pa sila costs of education, health care and incarceration of illegal aliens, and concludes that the costs to Californians is $10.5 billion per year.

I wanted to share my observation on our Senators drumbeating on the Trillanes issue. I think that they are trying to tell the public now that maybe the previous admin did injustice to trillanes by not allowing the guy to personally participate in senate sessions. Why are they telling us this only now? By God, why didn’t they raise the issue when GMA was still in power? Are they trying to tell us their helplessness during GMA’s time as a president? Yes I think that the legal opinions regarding the chances of Trillanes going out of incarceration maybe right. But the disturbing thing is why are our beloved senators speaking just only now? WHY? I hope the senators concerned can explain this. Because my opinion is that they could have moved heaven and earth during the time of GMA just to give Trillanes the justice he so deserved like what they are trying to tell us now. But why did they not do it? Why are they talking only now?

Nearly 528,000 homes were foreclosed in the first six months of 2010. As lenders work through a huge backlog of borrowers behind on their mortgages, even more home repossessions could occur before the end of the year.

According to RealtyTrac, Inc., a foreclosure listing service, the number of households facing foreclosure in the first half of the year climbed 8 percent when compared to the same time frame last year. In June, 1 in every 411 households received a foreclosure filing.

The fastest growing group of foreclosures involved homeowners with good credit who took out conventional fixed-rate loans. Many of these borrowers have fallen behind in their mortgages due to unemployment or reduced income.

It takes about 15 months for a home loan to go from being 30 days late to the property being seized and sold. Between January and June of this year, about 1.7 million homeowners received a foreclosure-related warning. At the time of this writing, more than 7.3 million home loans are in some stage of delinquency. The states experiencing the highest foreclosure rates are California, Florida, Michigan, Illinois, Arizona and Nevada.

Footah, parang yung Emperor’s New Clothes!

That PNoy would order a review of Sen. Trillanes’ cases, was something we have all been anticipating since Aling Gloria left the Palace.

Sa akin, I’d like to see the EDSA Dos case revisited.

Mike Arroyo’s behind-the-scenes maneuvers, even Aling Gloria’s admission that she was already in talks with military leaders prior to the impeachment trial mus not go unpunished- kung hindi man sa hukuman, sa kasaysayan man lang.

Our historians must not refer to EDSA Dos as People Power II.

Sino kaya ito na nakalusot o pinalusot?!

  42. henry90 henry90

They were dismissed from the service dahil sa plea bargaining. Bakit nasa labas sila Alejano at Layug? Nakapagpiyansa? Ano ba yan. 😛

  43. Trillanes was already granted bail by Judge Elmo Alameda trying the Manila Pen case. He has posted bail and the court ordered the relese of Trillanes Thursday last week.

But there is still the Oakwood case.

Trillanes’ request is just to attend the opening of the 15th Congress. pagkatapos nun, balik na siya sa kulungan.

  44. henry90 henry90

    Mam Ellen:

I am sure that lahat tayo ay sumasangayon dito na Sonny’s case is a ‘political’ one. Sauce for the gander is sauce for the goose, ika nga. Following this argument, I don’t see how the court can still deny his motion to bail citing the case of the other ring leaders now that the legal argument ng prosecution oppsing his motion to bail was the subsequent Manila Pen incident has become,so to speak, moot and academic with the grant of bail as you said, last Thursday. Regardless of what is being bandied about by other quarters opposing this seemingly ‘presidential meddling’, the political nature with which the law was unjustly applied to Sonny is finally being settled politically also by the President himself after noting perhaps the turtle pace of the case in the judiciary. After being incarcerated in jail for 7 years na walang linaw ang kaso, sasabihin lang ng ibang tao na magtiis pa ulit siya kahit wala na sa pwesto ang pekeng Pangulo na ginawa ang lahat ng paraan to make sure na di siya makalabas sa kulungan kesehodang nanalo pa siya na Senador? So who’s perpetrating the injustice now?

  45. petite petite

Sonny Trillanes had been exactly seven years in incarceration, suffered much for calling the lying cheat and her court of supot cowards to stop corrupting the AFP, yet we do not want injustice to be corrected? He and other Magdalo officers and soldiers were denied fair trial, enlistedmen dishonorably discharged from the service by a CSAFP who should be the first to consider addressing their plight, but NO, this coward CSAFP only satisfied the whims of his commander-in-cheat who was very much afraid of her own shadows that she wanted those crossing her path rot behind bars and suffer the consequences of their standing up for truth.

  48. petite petite

  49. Statement of Sen. Trillanes:
