Merci impeachment moves forward in House, Senate iffy

Update: Senate Blue Ribbon Committee recommends the resignation and impeachment of Gutierrez over plea bargain agreement with former military comptroller Carlos Garcia.

The approval by the House Justice Committee of the impeachment complaint against Ombudsman Merceditas Gutierrez shows momentum in the fight to make government officials accountable of their actions.

Thirty-nine of the 55 members of the Justice committee found there are “reasonable grounds that an impeachable offense has been committed “by Gutierrez and that she is “probably guilty” and that she should face trial.”

The committee voted on two complaints against Gutierrez. The first one was filed by Akbayan led by former Rep. Risa Hontiveros-Baraquel alleged that Gutierrez betrayed public trust as shown by the low conviction rates of the Office of the Ombudsman under her leadership; inaction on the $329.5 million controversial National Broadband Network-ZTE telecommunications deal; inaction on the 1995 death of Navy Ensign Phillip Pestaño.

The second complaint filed by the Bagong Alyansang Makabayan (BAYAN) also found her to have betrayed public trust for her inordinate delay or inaction on the fertilizer fund scam, the Mega-Pacific poll automation contract, and the “Euro Generals” cases.
Section 12 of the Constitutions Art XI on Accountability of Public Officers provides that “The Ombudsman and his Deputies, as protectors of the people, shall act promptly on complaints filed in any form or manner against public officials or employees of the government…”

Gutierrez had dismissed all complaints against Gloria Arroyo.

In both complaints, 39 voted that there was probable cause for her impeachment. Nine voted against the impeachment in the first complaint. In the second complaint only six voted in favor of Gutierrez. In both complaints, Albay Rep. Edcel Lagman , who tried all sorts of tricks to delay the voting, abstained.

Davao Del Sur’s Douglas Marc Cagas even quoted the Bible, (“Let he who is without sin, cast the first stone”) in trying to block the inevitable. Someone should give him a copy of the Ten Commandments underlining “Thou shalt not take the name of the Lord in vain” and “Thou shalt not steal” which is what this impeachment exercise is all about.

The next battleground will be in the plenary where at least 94 signatures or one third of the 283 members are needed to transmit the complaint to the Senate where the trial would be conducted. ABS-CBN reported that some 150 congressmen are expected to support the impeachment of Gutierrez which is the desire of President Benigno Aquino III for him to be able to institute reforms in the anti-graft body in order that he can fulfill his campaign promise to the people make his predecessor accountable for her use of public funds to sustain her hold on her unelected presidency.

It’s in the Senate where the numbers for the conviction of Gutierrez is unsure. The vote of two- thirds of the members of the Senate are needed to convict and oust Gutierrez. There are currently 23 senators (the seat vacated by Aquino has not been filled). That means if Gutierrez gets the support of eight senators, she is free.

Sen. Miriam Santiago has criticized the impeachment complaint. So she is expected not to support it. Gutierrez will possible get the support of Sen. Joker Arroyo who has defended anybody that is an ally of Gloria Arroyo.

Sen. Edgardo Angara is seen as pro-Arroyo. Sen. Loren Legarda often votes with Angara. Those are already four votes.

There are three administration senators: Bong Revilla, Juan Miguel Zubiri and Lito Lapid. Are they going to break party ranks and vote for the impeachment of Gutierrez?

It would be interesting to see how the Nacionalista Party senators (Manuel Villar, Alan Peter Cayetano, Pia Cayetano, Tito Sotto) who now compose the minority, would vote. Same thing with Sen. Ferdinand Marcos.

In the Senate hearings on the plea bargain of retired military comptroller Carlos Garcia, Senate President Juan Ponce-Enrile has shown some understanding of the fix the Ombudsman is in. The vote of Sen. Gringo Honasan usually follows that of Enrile.

Those who are expected to vote to oust Gutierrez are Franklin Drilon, Serge Osmeña, Francis Pangilinan, Francis Escudero, Antonio Trillanes IV, Teofisto Guingona III, and Ralph Recto. They are only seven. If Sen. Panfilo Ping Lacson returns to Senate, eight.

It would be interesting also to see how Sen. Jinggoy Estrada would vote because Gutierrez’ nemesis –former Ombudsman Simeon Marcelo and Special Prosecutor Dennis Villa-Ignacio –were the ones who put him and his father in jail.

    The evidence against Merci are not of the Clinton variety that easily won the U.S. Senate Acquittal…they are of more serious variety and the Senators better act as the Jury of their peer and examine the evidence and throw away their personal biases and prejudices for this instance in their political career…The nation is watching…

    How the senators will vote, in alphabetical order:

    1. Angara will vote according to his best interest.

    2. Joker Arroyo will vote to screw Noynoy. He has not forgiven Cory Aquino for firing him.

    3 and 4. The Cayetano siblings are Villar’s adopted children. They will do what foster papa tells them to do.

    5. Frank Drilon will vote to convict.

    6. Enrile will vote according to his best interest.

    7. Escudero will vote according to his best interest.

    8. Jinggoy Estrada will vote to please his father. Nothing is more important to him than beating JV for the title of favored son.

    9. TG Guingona will vote to convict.

    10. Gringo Honasan will follow his mentor Enrile.

    11. Ping Lacson will vote to convict if he is allowed to vote.

    12. Lito Lapid is clueless. He will do as GMA wishes.

    13. Loren Legarda will follow her mentor Angara.

    14. Bongbong Marcos will vote to convict.

    15, 16, and 17. Serge Osmena, Kiko Pangilinan, and Ralph Recto will vote to convict unless any one of them feels he is being taken for granted.

    18. Bong Revilla is also clueless and will do what GMA wishes, unless it will endanger his position as Chairman for Life of the Committee on Public Works.

    19. Miriam Santiago will vote according to the phases of the moon.

    20. Tito Sotto, like Lapid, is clueless. However, unlike Lapid, he does not know it.

    21. Trillanes will vote to convict.

    22. Manny Villar is not Villarroyo for nothing.

    23. Migs Zubiri will say he will vote according to his conscience. Unfortunately he has none. As a matter of fact, he is not even a senator, if by senator you mean one who was elected by voters and not by Abalos and the Ampatuans.

    Before I forget, are senators allowed to abstain from voting in an impeachment trial?

    I still remembered a tapped conversation between Joker and Cory years back. Joker was talking about presidential speech writer of Cory Teddy Boy Locsin. If I remembered correctly, he was bad mouthing Locsin. Can’t remember the exact details. The taped conversation was aired on pro Marcos radio stations.

    I think the senators identified with Gloria will try to get into the good graces of the voting public. They will make all the excuses that this is not about Gloria, this is about Merci. They will up their bargaining chips with the Lilliput.

    But this is Gloria’s last battle. She loses her Ombudsman, she goes into the slammer.

    So she will dig deep into her treasure chests. What’s a few billions to her to spread around in the Senate?

Eto yoong pinag-usapan in an earlier thread above na “kung sino ang hindi nagnakaw ng milliones sa kaban ng bayan, eh siya ang unang pumukol ng bato”……….or something to that effect. Nakita mo na, Mitos !!! Due to Merci’s inaction in order to protect whom she thought were her “ka-kosas” in corrption, na-unahan siya ngayon ng mga tarantado. Why would they inhibit themselves when they, too, profess they had done nothing wrong ? Why don’t you, yourself, find probable cause for these asshole-congressmen so they might inhibit themselves for decency’s sake (kung meron sila noon) ? Una-una lang iyan, MItos. Naunahan si Merci kaya manigas siya ngayon. That’s what she gets for sitting on cases of corrupt politicians whom she never thought would not “do her in” for their own self-preservation.

    Ombudsman files rap vs Aquino ally

    ROXAS, Isabela, Philippines—The Office of the Ombudsman has recommended the filing of malversation charges against former Isabela Gov. Maria Gracia Cielo Padaca, an official of President Benigno Aquino’s Liberal Party, and three other officials.

    But in her counteraffidavit, Padaca denied any irregularity.

    She said everything was done above board as the loan was approved by Isabela board members in December 2005 and January 2006.

    She said the provincial board also ratified the memorandum of agreement (MOA) between the Isabela government and EDWINLFI on Jan. 31, 2007.

    In their joint counteraffidavit, Soriano and Pine denied any irregularity, too. They said they appeared before the provincial board to explain the program while board members deliberated on the MOA.

Majority of Senators in the upcoming impeachment court are the SAME ONES who investigated and voted on the reports of scandals that were dissected, mostly in the Blue Ribbon Committee under Magsaysay, Cayetano, and Gordon.

    For example, I remember Miriam Santiago abstained from approving the Fertilizer Fund Scam report, which appeared to me, as one-upmanship as she may have forecast that those who showed bias during the investigation will be pressured into abstaining in an earlier Gutierrez impeachment should Mercy fail to be protected by Gloria’s lapdogs in Batasan. She will have the impeachment court all to herself. But Gutierrez mustered the number of Congress supporters she needed then, so Miriam’s Plan B was useless. It looks like she is Plan B’ing this one, too.

    I tried to get the details of the signatories to the resolutions/reports on NBN-ZTE, Fertilizer Scam, and others that might be included in the articles of impeachment but the website of the Senate’s Archives is structured such that getting the older docs seems to be an impossibility. These reports explicitly prodded the Ombudsman to investigate and it will show which side each senator was leaning on (or which scandal they might have dipped their fingers into).

    Ibig sabihin sa 2-years na pagkolekta ng 25US$/24mos. e around 1.1B pesos ang cash on hand ng OWWA ngayon sasabihin nila na mauubos na ang pondo nila…saan nila dinala ang collection nila sa mga OFWs?     Senators are more perceptive and sensitive to public opinion than their House counterparts. Each one is considered to have a mind of its own and their political senses are sharper in interpreting the barometric mood of the people at any given time on issues that will determine their political survival, the propagation of their name, and their continuous endearment to people including that of their children and kins who may already be on the assembly line of politics. They read well the people’s sentiment that this is a battle between good and evil, the right and the wrong. Gutierrez therefore becomes a liability at this point to each one of them when taken in the context of losing the hard- earned trust and confidence the Filipinos have reposed on them if they vote to acquit, a stark reality anyone including the most avid Gloria fanatic cannot begin to imagine. Everyone in that august chamber will not let this golden opportunity slip past their hands in affirming their election platforms of good government by their action thus further engraving in people’s mind that they are the true defenders of the Filipino and not anyone else. They will not be left out as third class winners in this popularity contest of ingratiating themselves to the nation after the House and the SC have said their respective pieces. Things will be easy in the conscience of the early proclaimed impeachers but the task will be dauntingly difficult for the avid defenders of Merci and Gloria who will have to weigh between the ire of their master versus the abomination of the entire country, the doom it will confer on their political careers and the hatred that will haunt and follow them wherever they go even in their graves. They will relent. The walk is a long arduous road to cleanse this government of its dirt but at last we can begin with this one single step for the future of our children. Let the euthanasia in the Senate begins.

    Mercy’s magical numbers vs crooks

    Ombudsman a failure,

    The Ombudsman’s budget has tripled from P392.08 million in 2003 to P1.33 billion in 2009 during the administration of President Gloria Macapagal Arroyo, the wife of Gutierrez’s law school batch mate, then First Gentleman Jose Miguel Arroyo. In five years under Gutierrez, the Office’s budget grew by an annual average of 21.35 percent, or twice more than the usually allowed increase in the budgets of most other government agencies.

    On top of this, the Office has also received not less than $7.2 million or P316 million in four different foreign grants and assistance, including funds committed to her predecessor, Simeon V. Marcelo, between 2005 and 2009.

    Among the Office’s fund infusions from abroad was a $6.5-million grant that was its share from the $21-million Philippine Threshold Program under the U.S. Government’s Millennium Challenge Corporation (MCC).

    Before this, the European Union extended a $716,600 grant managed by the World Bank to help the Office set up its Case Management System software. Until the close of the project in March 2007, the Ombudsman never got to use the software, prompting the donors to cancel a third or $194,838.96 of the grant funds.

    Under AusAid’s Philippines-Australia Human Resources Development Facility (PAHRDF) from August 2004 to June 2009, the Ombudsman also received funds to build its internal capacity and competence for administrative and service delivery functions.

    Then in December 2009, the US Agency for International Development (USAID) funded two more projects for the Office: an “Integrity Project” to focus on corruption cases in the regular courts, and the second, in cooperation with the American Bar Association, to provide technical assistance in identifying, formulating and lobbying for its priority legislative agenda.

    That the Ombudsman has failed to produce more and better results in its campaign against corruption despite such windfalls could be traced to issues that money alone cannot resolve.

    Fudging numbers?

    And yet a senior finance department official points out that the Ombudsman did not qualify for further funding under the $484-million Philippine Compact Program, the subsequent grant that the MCC and President Benigno Simeon Aquino III signed in New York last September.

    “If they’re (Ombudsman) such a success story, why did it not get any money again?” asks the official familiar with negotiations for donor funds. “Nagkalokohan, kaya ‘di sila binigyan ng pondo (They were fudging, that’s why they weren’t given funds)…They’re just beating the system, that’s why they did not get anything.”

    In truth, it was largely in compliance with the project’s indicator targets that the Ombudsman “performed” in the last five years. The skewed formula for computing its “conviction rate” that the project adopted has also been the basis for the Ombudsman’s claim that it has achieved higher and higher rates of conviction from 2006.

    The project set the Ombudsman’s target at 40-percent “conviction rate” from a baseline of 30 percent. By the project’s formula, the “conviction rate” is derived thus: number of cases that went to trial resulting in convictions, including guilty pleas, divided by the number of “decided cases” in the Sandiganbayan for the year. In other words, the formula looks only at the cases decided by the Sandiganbayan (including guilty pleas) that resulted in convictions.

    The formula uses this “very small denominator” because the project wanted only to focus on “a subset” of data, according to Leandro Trinidad of the Department of Finance who joined the Project team as monitoring and evaluation officer.

    But the formula is an apparent statistical anomaly. It nets out other bigger numbers that should have been included to reflect the quality, diligence, and actual performance of the Ombudsman, such as the number of cases withdrawn by the Ombudsman for lack of evidence or poor investigation, cases that resulted in the acquittal of the accused, and cases dismissed or pending over long periods of time before the Sandiganbayan.

    The “conviction rate” indicator for the Philippine Threshold project was originally prescribed as an annual target, or which the Ombudsman must achieve in the year. On motion of the Ombudsman, it was later amended into a “cumulative” target for the 30-month life of the project, allowing the agency to catch up with compliance.

    Pirming sinasabi ni Merci na ang impeachment na ito laban sa kaniya ay political in nature. Hindi raw tama ang mga procedures of impeachment na ginagawa ng mga tongresman sa lower house. Bakit niya ito sinasabi ? Nakalimutan na ba niya na noong mag-file si ex-Senator Jovito Salonga ng impeachment laban sa kaniya eh pareho ang proseso ng impeachment na sinunod (para mabasura lang) ? Bakit wala siyang sinasabi noon ? Simple lang. Panahon pa noon ng tarantadong si Gloria and they had all the numbers then to junk any and all impeachment moves. Now that the numbers are against her, hindi na tama sa paningin niya kasi hindi panig sa kaniya ang takbo ng mga numero.

    Pero sa akin lang, if and when talagang ma-i-impeach itong mahaderang mukhang bakla na ito, it is my wish na it will be so not because the ruling coalition has the numbers to do it but on the legalities and true merits of the case on hand. For once, I hope these elected officials will set aside personal alliances and give Juan de la Cruz a winning hand for a change.
