The Supreme Court has voted 8-5 to release a temporary restraining order on the watchlist order against former President Gloria Macapagal Arroyo, a source told abs-cbnNEWS.com.
Only 13 magistrates voted.
The 8 are: Chief Justice Renato Corona, Presbitero Velasco Jr., Arturo Brion, Diosdado Peralta, Lucas Bersamin, Roberto Abad, Martin Villarama, and Jose Perez.
The 5 who did not vote in favor of the decision are: Senior Justice Antonio Carpio, Associate Justices Maria Lourdes Sereno, Bienvenido Reyes, Estela Perlas-Bernabe and Jose Mendoza.
Those who did not vote are: Associate Justices Teresita Leonardo de Castro and Mariano del Castillo.
Another source said Arroyo is required to post a bond. She also has to report to Philippine consulates in the countries she will visit. Her legal counsels also have to coordinate her travels.
Arroyo and her husband, Mike, earlier filed separate petitions asking the Supreme Court to issue a TRO on the Department of Justice watchlist order. The WLO prevents the Arroyos from leaving the country without government permission.
The Arroyo couple also urged the Court to declare as unconstitutional Department of Justice Circular 41 which gives the Justice secretary powers to issue travel restrictions.
Justice Secretary Leila de Lima earlier turned down the former President’s petition for allow departure order, saying she found no compelling reason to allow Arroyo to leave the country.

At the first sight of light you have to grab it and go for it.
That’s what happened today, the leprechaun and the fatso are already at the airport, para bang alam na nila ang mangyayari sa korte suprema at nakahanda na agad ang tiket nila paupunta ng Singapore daw.
Although, a TRO was issued by the SC, I’m not a lawyer, perhaps, they should have waited for the clearance from the SC first. But as I said, it seems they already know that outcome of the SC decision, that’s why they already have the ticket to Singapore.
@ #6 & 7….. tama ka sa sinabi mo, that’s the reason why the leprechaun appointed these SC justices and corona. Perhaps de lima really did the leprechaun a favor. In the first place why it took too long for them to file a case against the leprechaun and the fatso, dapat noon pa. The dilly-dallying tactics back fired against team Noy-Ab.
I just hope that they are true to their words that they will return, and if not, perhaps those justices who voted for the TRO should be asked to resign.

Is it normal for the SC to announce the TRO before a written decision is supplied?
the reason i ask is this: the timing is suspicious to me.
– ABS-CBN got the leak at around 1pm.
– A presscon by Marquez finished at around 3pm. He did note the legal documents are to be made available later on the day (which apparently would be around 5pm).
– GMA and her family was able to pay up 2M before close of business (keep in mind bank closes at 3pm so may pera nakaabang or nakatabi si Arroyo. wow very convenient) and then book flights and also may certified true copy pa ng TRO and wanted to fly out right there and then.
(PS – i don’t buy Horn’s reasoning they want GMA to rest a full day for the thursday checkup – Singapore is but a two hour flight away). There was also no booking for tomorrow, so they really expected to be out today.
So my bottom line question to Arroyo? I would have ask why not fly tomorrow? If i was in her shoe, i would do so tomorrow knowing full well i will leave with my head high that i will be back.
The suspicious part is this: could it be that Arroyo wanted to be out before Tuesday morning business so the DOJ nor the SOLGEN can not have the opportunity to file an MR, making the issue moot? And since the government “cheated” GMA by not allowing her out, they then have to face the MR process, which may make the TRO lifted (fat chance since with 8 Justices enough to ignore the MR).
So to me, GMA looks too eager to leave, when she could have done it tomorrow.
And the Government can’t make this stick. To me, later on, the SC will just ignore the MR (their numbers work). So the only thing the Government can do is really to file a case to make it stick.
I think obvious si GMA. But then again losing sa public opinion (remember us Pinoy ay maawain a defect and a plus) si Aquino not until a case is filed. And i understand why they won’t file just yet (we’ve been filing cases just for the heck of it but it gets demolished by technicality) but the government has to have more than this.
The tactic is about to hit the end of its usefulness. They need to have a better strategy. (As Saxnviolin said, nasan na si Ombudswoman?)
it is very obvious that the current suprement court is stil a GMA SUPREME COURT but not for long d batanguenong hambog CJ must realise that it is only a matter of time that charges will be filed and the TRO becomes moot.
the TRO is the only reason why the Chief Pretender has to cut back his trip abroad. the GMA cabal in the SC is moving high heavens to have her leave at the soonest before the charges are filed.
Lagi talagang pabor ang korte suprema kay GMA. Nagtataka ako bakit ang tulad ni GMA na sinungaling at kurakot masyado ay pinapaboran nila. Siguro sila rin na mga mahistrado ay mga kurakot din. Nagtataka lang ako sa mga hitman kung bakit ang mga pinapatay ay mga negosyante. Bakit hindi nila patayin ang mga mahistrado o di man kaya balakin na patayin si GMA. Sa pelikula minsan may eksena na ang tao na maraming atraso kung nakakulong ay napapatay sa loob ng hospital dahil ang papatay ay nagpapanggap na doktor. Sa case ni GMA bakit kaya walang magpanggap na dokotor para siya mabaril.
Puwede naman siyang pagalingin dito ng doktor sa ibang bansa pero bakit doon talaga nila gusto. Kasi hindi na sila babalik. Kapag nakaalis ng bansa si GMA malabong bumalik. Napakasinungaling ng tao na iyon. Pagmumukha pa lang plastik na.
What do you expect sa Supreme Court, eh sa tagal sa poder ni Gloria, ang karamihan sa mga justices ay mga appointee pa ni GMA! Pag nagkagipitan siguradong kakampi sa kanya ang mga yan!
