Pairalin ang batas kahit kay Gloria Arroyo

Nakasuhan at naaresto na si Gloria Arroyo.

Sabi ng Malacañang, simula lang daw yun ng pagpapanagot kay Gloria Arroyo sa maraming kasalanan na ginawa niya sa sambayanang Pilipino.

Sana lang, sa pagbibigay ng hustisya sa sambayanang Pilipino, hindi rin babastusin ng pamahalaang Aquino ang batas katulad ng ginawa ni Arroyo nang siya ang nasa kapangyarihan.

Sa ngayon lang, iba ang sinasabi ni Pangulong Aquino, iba ang ginagawa ng mga tauhan niya na kinakampihan naman niya.

Bakit ba galit ang mga tao kay Gloria Arroyo na siyang naging dahilan na nanalo si Aquino noong 2011 kahit wala naman siyang naipakitang kakayahan para mamuno? Dahil binastos niya ang batas para lang manatili sa kapangyarihan.

Nangako si Aquino na kapag siya ang mananalo, magkakaroon ng reporma. Hindi na maging katulad ng panahon ni Arroyo na binabaluktot ang batas para lang manatili siya sa kapangyarihan. Protektahan daw ang karapatan ng bawat Pilipino. Yan ang intindi ko sa isang pamahalaan na demokratiko at makatao.

Ngunit sa maraming nangyari noong isang linggo bago naaresto si Arroyo, nalungkot ako sa pambabastos ng batas na ginawa ng pamahalaang Aquino. Nababahala ako kasi kung nagawa nilang baluktutin din ang batas para lang matupad ni Arroyo ang pangako niya sa taumbayan nang siya ay nagkakampanya, pwede rin yan gawin kahit kanino.

Ang aking tinutukoy ay ang Watch List Order na ginamit ni Justice Secretary Leila de Lima para pigilan umalis si Arroyo noong Nobyembre 8. Sa ating Constitution kasi, karapatan ng bawat Pilipino ang pumunta siya kung saan niya gusto at hindi siya pwedeng pigilan ng pamamahalaan maliban lang sa mga kundisyunes na nakasaan sa batas.

Ang pwedeng makapigil sa pagbiyahe ng isang tao ay ang korte kung nililitis ang isang tao.

Isang linggo lang bago niya pinalabas ang WLO kay Arroyo, ang rason ni De Lima kung bakit hindi nila napagilan si Ramona Revilla sa pag-alis ng Pilipinas ay wala raw kasong nakasampa laban sa kanya.

Bakit biglang nag-iba ang interpretasyun ng batas ni de Lima sa loob lang ng isang linggo. Noong Nob. 8 at Nob 15, nang naglabas ang Supreme Court ng temporary restraining order, walang kasong nakasampa laban kay Arroyo. Noong Biyernes lang nagsampa ng kaso ang Comelec na mabilis naman nag-isyu ng warrant of arrest ang korte.

Partikular ako sa isyu ng karapatan ng isang tao dahil noong may kaguluhan sa Manila Peninsula noong Nob. 28, 2007 ( malapit na lang pala anibersaryo nito) dahil noong ina-aresto kaming taga-media at tinangka nila kaming pusasan, ang tanong ko sa mga pulis, “Bakit napalitan na ba ang Constitution habang nasa taas kami? Nakalagay sa Constitution na hindi nyo kaming arestuhin kung wala kayong naisampa na kaso sa amin.Bakit nagsampa ba kayo ng kaso sa amin?”

Alam naman ang nangyari noon dahil yun ang utos ni Arroyo. Napusasan talaga ang ibang kasama namin. Dahil lang sa katarayan namin nina Charmaine Deogracias at Ces drilon kaya hindi na kami pinusasan ng mga pulis.
Ngunit dahil ayaw kung gawin sa akin ang pagbaluktot ng batas, ayaw ko rin gawin yan kahit kanino. Kahit kay Gloria Arroyo.

    I don’t disagree with the ‘big picture’ as Ding would suggest, although I would disagree that that would be the only ‘big picture.’

    It would be tragic if we were to throw the baby out with the bathwater, so to speak, that in the sudden “rush” to charge Gloria (the spadework for which should have been done the second after the president was proclaimed and the filing of charges done the second after he finished the last word of his oath, if I had my way), we would forget the ‘bigger picture’–the bill of rights applies in all situations, in every controversy, regardless of leaders, rulers, tyrants, kings or kingmakers of every stripe or hue.

    The dilution of the rights we are guaranteed will be irreparable and irremediable for so long as we keep tolerating short cuts created in order to fit political expediencies or worse justify incompetence or shortsightedness.

    As I said, I am all for jailing Gloria and certainly have no sympathy for her but I do remember how shortcuts and strong arm tactics twisted the constitution almost out of shape just so that Gloria could arrest Ka Bel, and the AFP and the DOJ could throw the likes of Ming Saladero in jail; how long ago was that? Not very long.

    And here we are, doing the very same things this president promised he wouldn’t do; being the very same things he promised he wouldn’t be.” Amen

  2. You have to admit arroyo was clever to pack the supreme court with her appointees during her 10 year reign and appointing her chief of staff to chief justice before she left office.

    now, we are having all sorts of problems because of a partisan supreme court tilted in arroyo’s favor. it will take a while to undo the damage.

    People love champions and so long as the playing hardball is seen as for a noble cause, subscribing to the ends justfies the means, they will support it. It will be a far worst picture if the current government is walloped by Arroyo and lapdogs, as the message will be ” crime does pay.”

    There is no substitute for victory, and those who are used to competiing will understand.

    Yong 7 justices na bumoto na pabor sa TRO ay arroyo appointed lahat.

    Yong 5 justices na hindi pabor sa TRO ay tatlo ang appointed ni noynoy at dalawang appointed ni arroyo ang hindi pabor sa TRO.

    Kung partisan ang pag uusapan e mas partisan yong mga appointed judges ni noynoy dahil kahit isa ay walang pumabor sa TRO.

Unfortunately the videos of Arroyo (neckbrace and all) probably succeeded in influencing international sympathy, just this morning I got comments from my colleagues in Singapore and Indonesia telling me to call Aquino (obviously as a joke) and tell him to be merciful on Arroyo. They really played their appeal to pity, I’m cruelly persecuted card to the hilt.
    If Aquino drops the ball on this one the pendulum will swing to his disadvantage big time.
    The government has to win and win big time, or lose the same way. Problem is, even if they win, not all people will like it as it will come to a point if the president has the cojones to unmercifully deal the final strike to the jugular and its not a popular thing to do.

  6. Arroyo and cohorts must be made to pay. When Gloria did this to Erap and tried to shame him, made him an example, etc, there was a bitter aftertaste, ther was a nagging doubt that something went wrong somewhere, this time around its different.

    Ellen, di rin ako sang ayon sa ginawa ni De Singko kaso sa ganitong sitwasyon ay nanaig ang inis ng karamihan dahil na rin sa pinag gagawa ni Pandak na baliktarin ang batas noon at ang walang sawang pag nanakaw sa bansa natin. Pinapalasap lng sa kanila ang kanilang katarantaduhan noon. Sa aking ulo sa kabila ay naiinis ako at parang ginagaya nila ang pang babastos ni Pandak noon sa ating batas. Pero sa kabila ng ulo ko ay natutuwa dahil nalalasap ni Pandak ang mga ginagawa niya noon na parang boomerang na bumabalik sa kanya. In short “KARMA”.

    Tungkol naman sa ating pinuno ngayon ay wala naman talagang kakayahan humawak ng mataas na puwesto. Nanalo dahil sa Sympathy Vote na namatay si Cory.

    Why did we have EDSA 1 at all? That was going against government and it’s existing institutions. It was a revolution, a peaceful one. But still a revolution. Were we justified in going against the government?

    Because we were abused. The institutions which were supposed to protect us were abusing us. All three branches of government failed us.
    Thus we had to resist.

    Gloria had destroyed the SC. It was clearly preventing the present administration from bringing Gloria to trial and in fact obviously aiding her to flee. The SC had to be checked. It was morphing into a judicial dictatorship.

    All this talk about illegality of moves is the same as EDSA 1. All our moves were also illegal, but it had to be done. And we should do it again if need be.

    We should be thankful we did not have to go out into the streets again because the executive branch fought the battle for us. It is a continuing battle. It is not yet over. That branch may need our help in the near future in this epic battle just starting.

    I am of the opinion, however, that De Lima’s moves were at the edge of the legal boundaries only. In a war like this, you fight smart. You push the envelope to the edge.

    I know. I know. I am one with the so many who say “napabagal nila kasi”.

    I admire you Phil for admitting that what Aquino and De Lima did were illegal. I wish they were as honest as you in justifying their moves.

    syempre naman.. bakit? simple lang, alam ntin kung sino mga nakaupo sa supreme court… mapupunta lang sa busurahan ang pinaghirapan ng mga humahabol kay gloria kung gagawa sila ng ilegal… maliban na lang kung sinadya… pra mabasura ang kaso dahil sa tinatawag nilang teknikalidad…

    Al, re your #11:

    I would just like to clarify my stand.

    In the case of De Lima’s and the Noynoy’s moves, I am not sure if it is legal or illegal because I am not a lawyer.

    But from my layman’s understanding, they are there at the edge of legality and illegality. The details of the law are too cumbersome for my non-legal mind to decipher. It is only the lawyers who can more easily judge their actions. But then again, lawyers have different opinions all the time.

    Anyway, my point is this. Should the SC fail to do its bounden duty to the people and continues to work for one person or a group of persons and against the public good, and the two other branches fail to check the SC, the people are justified to take mass action against them just like in EDSA 1.

    Let’s be thankful that the Executive Branch is now fighting judicial impunity in our behalf.

    I hope that should it ever come to the point that there is a need to file impeachment complaints against some justices, the Legislative Branch will also do their duty and stand up for the people.

    Actually, 8-5 in favor of Arroyo.

    and you don’t need every arroyo appointee to vote in her favor, just a majority. all who voted in her favor were GMA picks. it will take awhile to clean house in the SC before the partisan nature of the SC gets undone.

    dapat lang. tao din naman ‘yan, eh. maitim nga lamang ang budhi at halang ang kaluluwa.

    pabilisin na lang ang paglilitis sa kanya at sundin ang tamang proseso subalit kaiingat sapagkat limpak pa ang salaping magagamit nilang ipambili sa mga hukom.

    para maging patas at makamit ng taong bayan ang tunay na hustisya ay barilin na lamang sa ulo ang walanghiyang goyang na ‘yan.

    nakakaawang patayin subalit nakakakot hayaang mabuhay!

    Dapat lang! Gawin ung sinasabi nya noong una na “follow the rule of law.”

    Nandaya sya at nagnakaw ng milyong boto, dapat lang na kasuhan sya at ikulong. Isama na dun sila Abalos-los, Garci, at iba pang kakutsaba.

    Hindi na niya kelangan bilhin ang mga hukom sa SC. Hawak na nga nya sila sa leeg, maliban dun sa appointed ni Noynoy at ung 2 na hindi bomoto sa TRO.

    kailangan pa rin niyang bilhin ‘yung mga hukom na in-appoint niya para laging pabor sa kanya ang desisyon.
