Malacañang must be feeling beleaguered.

Press Secretary Edwin Lacierda went all the way from Malacañang to ABS-CBN to appear personally in Anthony Taberna and Gerry Baja’s radio program “Dos por Dos” to insist that DAP (Disbursement Acceleration Pogram) is not violative of the Constitution according to the opinion of former Senator Joker Arroyo.

Arroyo said it’s the first time that he heard such an animal called DAP.

Former National Treasurer Leonor Briones questioned the legality of this DAP, which was created in October 2011, two months before the start of the impeachment against Corona. “Is there an executive order? Is there a provision in the Constitution which legitimizes its creation?”

Sen. Miriam Defensor-Santiago has also questioned the constitutionaity of DAP and has asked the Commission on Audit to look into the DAP.

DAP surfaced as the new buzzword in political patronage DAP after Sen. Jinggoy Estrada exposed that Malacanang gave each of the 20 senators who voted to convict Supreme Court Chief Justice Renato Corona on May 29, 2012, for culpable violation of the Constitution and betrayal of public trust P50 million each.

Estrada said it was not a bribe. He called it “incentive.” The public saw it as political patronage, the common practice in political systems to award a special favor to persons whose cooperation the giver needs.

The evolution of Malacañang’s reactions (I will refrain from saying “lies”) on Estrada’s P50 million expose would have been amusing if it were not our hard- earned money.

In the beginning they outrightly denied it. But some senators confirmed the distribution of the post-Corona largesse. Sen. TG Guingona admitted he got lump sum. Former Sen. Panfilo Lacson, they discussed it in a caucus but he did not get his share.

Senate President Franklin Drilon, who initially denied it, later said it was the much-maligned PDAF (Priority Development Assistance Fund) which were withheld during the four –month Senate impeachment.

The Department of Budget later admitted they released lump sums after the Corona impeachment . They gave out the list which showed that Drilon, who was the chairman of the Senate Finance committee got P100 million, Sen. Chiz Escudero P99 million, and then Senate President Juan Ponce Enrile, P92 million.

DBM changed tune and said it was not PDAF. It’s DAP, Malacañang said. Lacierda said they money (P72 billion in 2011) came from the savings?

“Is savings illegal,” he challenged critics insisting that the e question should be, “Was the money under DAP used properly?’

Mr. Secretary, that’s not issue. The question is the legality of the re-alignment of savings, without Congress approval.

As Briones said, “If the source is from different savings then we have to clarify constitutional provision. Who has power to realign? Isn’t it the legislature? After the budget is passed and the President realigns again, how do you call that? It is pork. Clearly, the source has to be clarified as to legitimacy and constitutional basis.”

    What’s in a name? Whatever name one uses the purpose of the funds disbursement or allocations is obviously the same; that is, to influence legislators/lawmakers to agree with the one using the same.

    Bribery can be in many forms…money, kinds, favors. The problem is how to prove it. There must be the giver and receiver. The burden of proof is on the accuser which is us, the Filipino people. Legal loopholes are so many that the ones in power could easily use to defend themselves. Unless, some Senators come out in the open to admit that the funds they received were intended for the conviction of Corona per Malacanang’s request, then this matter is a dead case. Who senator in his right mind would admit? Maybe only those like Jinggoy who are pushed to the wall desperately trying to counter the charges. In the meantime, the Palace through Lacierda is applying damage control. The media is one venue that has now become very valuable to the Palace as well as the ones being accused.

    DAP is illegal, it did not have the approval of the Legislature. It’s simple for the Palace not to get it. Ganyan talaga kung may pinagtatakpan, higit na nagiging bobo ang mga dati ay bobo na.

    Imagine, pinakialamang i-realign ni Abad ang savings ng pamahalaan na kinolekta ng Palasyo. Kundi pa nabisto, bilyun-bilyong sekreto ito na sa guni-guni ni Juan at Juana ay hindi mauungkat.

    Well, salamat na rin kay Jinggoy at nahalungkat ang DAP.

    The public had no hint DAP existed, kung di binisto ni Jinggoy it will be the secret forever of only a few in the Palace. How could it be proper?

    Ikalawa, kahit tama pang layunin ang pinaglagyan ng pera, kung ito ay sa illegal nakuha ay hindi proper ito. The end does not justify the means.

    Why Jinggoy only revealed it now is of course obvious. Had he reveal it earlier, then Corona could have been saved or the decision reversed by court like the Highest Tribunal. But I for one honestly believed Corona deserved to be impeached.

    When Corona dared the prosecutors to open their SALN, most promised but so far until this day, no one did as promised.

    Kung tutuusin pala ay di nag hihirap ang bansa natin at mayaman pala tayo. Kaso nakukurakot lang pala ang mga Bilyon Bilyon pera. Simula ng mawala si Macoy ay lumalala ang pamumuhay ng Bansa natin. kabila kabila ang nakawan.

    Ang mga politikong mandurugas ay naka upo pa rin at hindi kontento sa Milyon na kita lang.

    May matutuklasan na anomalya pero may kapalit agad na bagong anomalya para pag kakitaan ng pera agad.

    I’m not defending Marcos, but he did a lot of good things for the people even if his enemies claimed he was corrupt; in fact the most corrupt President. Marcos built bridges, school houses, rice was abundant and called “Miracle Rice”. We were exporting rice then. Environment was treated as priority through the so called “Green Revolution”. Marcos had a vision for energy. He put up the Bataan Nuclear Plant that even resulted in controversy, but if it succeeded, would have solved the power crisis today. The Yellow Brigade knew it was beneficial to the people, but chose to scratch it so we’re paying for the interest until this day. During Cory’s administration, anything identified with Marcos was evil so was canceled or stopped even if some projects were beneficial to the people. At that time, our military was compatible and even better than our Asian neighbors. We had better jets. Our AFP was better equipped. Politically, the two party system, then Liberal and Nacionalista, worked well unlike today’s multi-party system.

    Grabe talaga ang appetite ng mga politiko sa perang hindi kanila. Sige, maglabasan na ng mga pagnanakaw. It looks like lahat sila ay mandurugas! Iba iba lang ang pamamaraan. How can you expect these in power to have these thieves prosecuted when they themselves are violating the laws on disbursing the funds. Dapat lang talagang i-audit din ang mga “mambubutas” na kaalyado ni Pnoy.

  8. may savings naman pala tayo eh, bakit kamakailan ay naghahanap sila ng paraan na pataasin ang tax collection dahil sa mga “utang” natin? nakakadismaya naman na ito na ang “tuwid na daan” na ipinagmamalaki ng gobyernong ito.

    cguro kung yung perang nilaan sa DAP e ginamit na lang sa totoong barangay development, gaya ng pagtulong/pagaalalay sa mga barangay sa isang makabuluhang livelihood project, gamit ang mga indigenous resources (kasama na ang training kung paano ang tamang paggamit at pagproceso ng mga ito at ang tamang capacity building para sa mga taong-barangay). maliit na lang cguro ang problema ng unemployment. mababawasan na rin ang pag-migrate sa kalunsuran, mababawasan ang informal sectoro iskwater pati ang dami ng mahihirap.

    wala pang 44 thousand ang barangay. kung bawat isa ay mabibiyayaan ng isang milyon kada barangay, wala pang 44bilyon yan, maliit na bahagi lang ng ginamit sa DAP. PDAF, discretionary fund, CCT at kung ano ano pang porma ng pork. sayang mayaman pala ang pinas pero nilalaan lang sa kaganiran at kahayukan ng mga kapal muks na politiko.

    Ang buwis natin na dapat tayo ang nakikinabang. Di pa ba sila natitinag? Naglabasan na sila ng baho, silang nagdumi sa senado at kongreso na maituturing nilang bahay. Napakabantot na! Dapat na silang umalis sa pwesto at ipalit ang mga bago at matitino para walisin ang kanilang dumi.

    Nakakalungkot dahil tayo naman ang nagluklok sa kanila sa pwesto. Sa mga nasilaw sa pera tuwing eleksyon, sana matauhan na. Iboto ang tamang opisyal na mamuno satin, di dahil sa suhol ng mga tulad nilang mananangal.

    As a former member of the military (not AFP), I can attest to the statement “AFP was better equipped”. I might also add that the officers and enlisted member of the AFP then were all well respected and admired by members of the ASEAN (SEATO during my time.)

    Sa lahat ng nag Ra rally ay wala akong naririnig na nag sasabi sa kanila na tayo (mga tao) ay kailangan maging matapat sa bayan at iboto ang tamang tao sa gobyerno.

    Kalahati sa mga nag ra rally ay binoto sigurado ang mga mandurugas na politiko.

    Puro sigaw sa Rally ay ang mga kurakot nila pero dapat nila sabihin na may pag kukulang rin tayo.

    #15 Thank you sir. Yes, I remember SEATO. The Philippines then was not only respected militarily but economically. Our economy was better than most of our neighbors.

    The only criticism about the AFP at that time was the Ilocanos at AFP and even PC were given preferential treatment. That’s because Marcos was Ilocano as well as Gen. Ver. The gratitude Ilocanos have for the Marcoses remain until this day. Ilocanos are always solid behind the Marcoses.

  20. Ang isang kilo ng bigay ngayon halos 50 pesos na. Sampung taon pa baka isang daan na ang kilo. Lalong dadami ang magugutom. Lalog dadami ang masasama ang loob. Gagawa ng pagnanakaw para may makain. Ang kahirapan na tinatamasa ngayon ng mga mahihirap sa Pilipinas ay hindi na mababago pa dahil iyon ang sumpa. Isinumpa ang mga Pilipino dahil sa ginawang pagpapatalsik kay Marcos. Ang mga mayayaman sa ngayon lalo na pag nasa politika ay lalo lang yayaman. Pinagkakakitaan ang mga tao na mahirap para sila magkapera. Hindi mangyayari na maaabolish ang pork barrel kahit ano pang gawing pag rally dahil ang mga politiko na dikit kay Pnoy ay hindi magnanais na iyon ay mawala. Gagamitin na batayan ang kahirapan sa liblib na lugar, sa mga probinsya. Paano na sila pag wala ang pork barrel. Pero hindi naman nila ilalaan ang pork barrel sa mga mahihirap o kailangan na proyekto dahil hangad nila ay pera. Nang mapatalsik si Marcos lalong dumami ang mga korap dahil nagkaroon na ng kalayaan. Lahat ay mayroon ng kalayaan. Kalayaan na magnakaw, pumatay, magbenta ng shabu o ano pa. Samantala noong panahon ni Marcos ang mga ganun ay hindi puwede. Dahil kapag masama ka ay may kalalagyan ka para hindi na pamarisan. Ang pesteng shabu sa ngayon ang sumisira sa mga tao na mga adik. Gumagawa ng paraan makagamit lang ng shabu. Kahit mahal ay marami ang tumatangkilik. Kung panahon pa ngayon ni Marcos ang shabu ay hindi uubra dahil bitay ang kalalagyan ng magbebenta ng ganun. Pero sa ngayon dahil walang bitay ay malaya ang mga drug lord na makapagbenta. Kung mahuli man sila ay makakalaya din dahil sa pera. Kayang suhulan ang humuli at huhusga para hindi masentensyahan.

Si Marcos ang makakadisiplina sa mga tao sa Pilipinas sa panahon na iyon dahil kung masama ka ay may kalalagyan ka para hindi na tularan pa ng ibang tao. Nang mapatalsik na si Marcos nawalan ng disiplina ang mga tao. Nawala ang mga pagrespesto. Higit sa lahat madami ang nagutom dahil lahat ay unti unti ng nagtaasan ang presyo. Nawalan ng price control. Ang bigas ay unti unti tumaas ang presyo dahil ang mga abono o anu pa na kailangan sa pagsasaka ay binibili na. Samantala sa panahon niya ay libre lang. Kung ipagbili man ng iba pagtagal ay buy one take two.

Ang mga politiko sa ngayon na matataas ang posisyon o nasa gobyerno nagtrabaho an korap kapag sila ay huminto na sa politika o pagtrabaho ay ang papalit sa kanila ay baka korap din. Madaming bagong sibol na tao sa ngayon na ang nananalaytay na dugo ay dugong korap. Pagtagal at malagay sa mataas na posisyon ay gagamitin na ang pagka korap. Iyon ay dahil wala na talagang disiplina ang mga tao lalo na ang nasa gobyerno. Hindi naman lahat pero marami. Kung bakit nasabi ko ito ay malaman niyo dito sa sinulat ko.

    Mr. Tension, I think many would still run for public office. The power and benefits of an elected politician are beyond the Pork Barrel. The Pork Barrel is just an addition to their already many perks. Those who head the Committees including the members receive additional allowance. Senators and Congressmen aside from their monthly salaries and expenses for their staff have yearly allocations and bonuses. These are not Pork Barrels.

    Elected officials also carry some clouts over businessmen, small or big. They can give referrals and provide influence. Many politicians themselves own businesses. And they could protect their businesses. Add to all these are the glamor and celebrity status they possess wherever they go. Not only in the country but abroad.

    Sir, America has two party system: Republican and Democrat similar to what we once had: Liberal and Nacionalista. Canada is a parliamentary form of government with the Conservative as the majority rule. I think Canada’s Conservative is similar to America’s Republican wherein these parties are the less liked by the people. But the businessman and big corporation love Conservative and Republican. Canada has other minority parties like NDP.

    If the question is which type of political system is better. It’s hard to say. But for the Phil, I prefer that we go back to the two party system. Too many political parties is confusing and complicated. More jobs for the Comelec.

    #29, If I’m not mistaken, multi-party system began during Cory’s administration. When Marcos declared Martial Law, the political system was that of semi-parliamentary. We had a President in Marcos and a Prime Minister in Cesar Virata who at that time was also the Minister of Finance. In fairness to Virata, he did a very good job as Finance Minister. After the Congress was abolished, it was the Assembly composed of Assemblymen.
