De Lima courts constitutional crisis to cover up incompetence

Why has she not filed a case vs the Arroyos after more than a year in office?
Leila de Lima looked and sounded desperate in her early evening presscon trying to salvage the situation where the government was in danger of losing face in the struggle to make Gloria Arroyo accountable for her crimes against the Filipino people.

Defying the High Court’s temporary restraining order against her Watch Order List against the Arroyos, she ordered all agencies concerned not to allow the couple to exit the country because as far as she is concerned, the SC’s order cannot yet be implemented because she has not received it yet and she still has to file a motion for reconsideration.

Asked if the Arroyos, who were booked for a late afternoon flight to Singapore, would be arrested if they insisted on leaving after they have posted the P2 million each bond, De Lima admitted she cannot order the arrest of the Arroyos because no warrant of arrest has been issued by the court.

No warrants of arrest have been issued because her office has not yet filed a case against the Arroyos.

Supreme Court spokesman Midas Marquez, in explaining the 8-5 decision of the SC granting the Arroyos a TRO against the implementation of the WLO barring them from leaving the country, took note that “the Arroyo couple had not yet been charged with any crime.”

Marquez said the High Court’s decision was “consistent with the constitutional presumption of innocence.”
Why has there been no case filed against the Gloria and Mike Arroyo after one year and five months in office?

All these desperate attempts, to the point of bending the law, would not have been necessary if the DOJ had filed unbailable cases against Gloria and Mike Arroyo.

In yesterday’s briefing, she said that they may be able to file the electoral sabotage case against the Arroyos in connection with the 2007 election before Christmas because they are making sure that “the charges will stick.”

To make the electoral sabotage charge stick, we expect that they have more than just the testimony of Norie Unas, the senior aide of former Maguindanao Governor Andal Ampatuan Sr, who said he heard Arroyo tell his boss to make sure of a 12-0 win for senatorial candidates of Team Unity.

The greatest crime of Gloria Arroyo is the stealing of the presidency in the 2004 elections. The problem is, the crime of electoral sabotage was enacted in 2007.

But the 2004 elections grand theft led to more thieveries like the fertilizer scam, the Road Users tax anomaly, the NBN/ZTE which can be subjects of plunder cases against the Arroyos. Some individuals like Frank Chavez and organizations like Bayan have filed plunder cases against Arroyo and they are still also in the preliminary investigation stage with the DOJ and the Ombudsman.

Had plunder and electoral sabotage charges been filed against the Arroyos, the court, after ascertaining that the finding of probable cause was in order, would have been the one to order the warrant of arrest and Hold Departure Order against the Arroyos.

This distressing battle with the Supreme Court would have been avoided.

  1. Bernas sounded amused when asked whether Justice Secretary De Lima is correct in ordering immigration and airport authorities to stop the Arroyos’ departure for the simple reason that the government had not received a copy of the TRO issued by the Supreme Court.

    A laughing Bernas told Jumilla, “It’s really easy to get it if they really want to. If they are serious about it, they should just believe the announcement of the Supreme Court. There is that decision already. What is obvious is they don’t want to do it. They’ll do everything not to do it.”

    Bernas maintained that the government has no power to put the Arroyos under a watchlist order.

    The weakness in the De Lima position is her own making. Unlike Arroyo who put President Joseph Estrada behind bars months after she, to quote Susan Roces, “stole” the presidency, De Lima and President Noynoy Aquino have waited all this time to even charge Arroyo with something.

    Mahirap talaga ang lagay ni de Lima dahil ang binabangga niya ay may “power” at pera. Let us face it, halos lahat ng mga SC justices eh appointee ni pandak. When Corona was in hurry to go back to PI instead, nakakaduda na talaga.

    It is not so easy to file cases that are not thoroughly put together. It is easy for all of us to say, “file a case” kung ang mga witnesses ay walang credibility at nababayaran.

    Anyway, snv and lawyers here, can the DOJ file any dummy cases to the Arroyos just to buy time while they are building their case (for 18+ months now, which btw is the wrong case, as Ellen points out, as the major evidence is hearsay. They should go all the way to the 2004 elections.)

    The Executive branch has practically “defied” the Judicial branch. Good. About time. This SC is a rubber stamp anyway of a most corrupt and law-breaking Couple.

    They have been defied. So what is the SC going to do next?

    Are they willing to go against the powers of the Executive branch? Exactly what can they do? Arrest De Lima? Arrest the BI people? Impeach the President?

    Are they really willing to pit their strength against the might of a sitting President who has control of the military and the police and the legislature.. plus the support of a big majority of the public?

    The Executive branch is willing to go toe to toe with this SC on this issue. Good for them.

    But they have to work fast on filing those charges against the Arroyos..for heaven’s sake.

    It is quite obvious that there is collusion between the Arroyos and the SC. Just look at the split second timing of their moves. As synchronized as a Swiss clock.

    Everything timed to converge after office hours so that the Arroyos can zip off to the airport and grab their already reserved or bought alternative flights out of the country and not giving the DOJ much time to file its counter petitions.

    The Arroyos and the SC didn’t think the DOJ and Noynoy would dare shut the airport gates on their faces.

    You gotta hand it to De Lima and Noynoy. But..guys, please file those charges already… for God’s sakes.

    Marquez is the supreme court jester. (pun intended).

    He thinks he is also a Supreme Court Justice. Although in my book, that title of SC Justice doesn’t carry much weight or value or honor anymore.

    Gone are the days when people almost bowed their heads in reverence before a Supreme Court Justice. No more. No more. These days the title, the office stature is gone.

    Who can restore that respect to the once-revered body? And how to do it? How long will it take to clean it and polish it back to its original luster?

    A new law has to be passed withholding the right to travel to those who are facing charges which carry with it capital punishment.

    We cannot allow the same Ramona Bautista scenario where she left the country in the midst of controversy.

    GMA cannot be allowed to leave. Sure as day follows night, she will not return to face the charges leveled against her. The safeguards meted by the Supreme Court are insufficient to say the least. The Government, the party in interest in the TRO case, a co-equal branch of government, must be accorded the right to submit its arguments via an oral argument.

    I am personally disturbed by Midas Marquez’s statement that, in the event GMA fail to return to face the charges against her, the government has all the resources to ensure that she is returned to the country.

    That is an admission that the “safeguards” set by the SC are not weak at best.

    Also, why would the SC pass the responsibility to the government in ensuring GMA’s return if in the first place the SC can abort precisely such a scenario.

  58. Just finished reading the TRO of the majority and Sereno’s dissenting opinion.

    Sereno stripped the court naked of its own position and interpretation on the constitutional right to travel.

    It has been held in one case that it is not only through court order that the right to travel may be impaired. In fact, the Supreme Court itself has issued stringent regulations on the right to travel, including the denial of the travel authority request of employees who may be undergoing preliminary investigation. An important question thus must be asked: why is the majority not even willing to hear the government before issuing the TRO, when, in the supervision of judiciary employees, a mere administrative officer of the Supreme Court, and not a judicial officer, may deny the right to travel?

    It is possibly incongruent for the Court to hinder the exercise of the DOJ Secretary’s power to issue a Watchlist Order restricting the right to travel of a person subject of its preliminary investigation, when the Court itself strictly regulates the travels of its own personnel.

    The Pro-Arroyo block in the SC is left with but one argument – the right to life which Sereno likewise refutes by citing flaws in the petition itself. Which only proves that there is no extreme urgency for the Arroyos to travel. The documentary evidences submitted by Gloria and Mike Arroyo belie their own claim of the need to immediately seek medical attention abroad.

    Note that Sereno is not voting to deny the TRO, she is just extending the TRO deliberation to a week later and give the Executive the right to be heard and for oral arguments to be undertaken. Then they vote on the TRO. She also reminded the Majority the Rules of Court in issuing TROs.

    I concur with Sereno, the petitioners did not prove any extreme emergency for the need to travel abroad. The Arroyos in fact, even contradicted that need with their submitted Medical Certifications. The surgeon even explained why Gloria is on the way to recovery.

    They should hear the government’s side and decide the TRO prayer immediately thereafter.

    Two conclusions can be derived from this:

    1. The right to travel is not absolute, as proven by the SC’s own practice.

    2. The right to life – and the benefits emanating from it – when it is threatened as claimed, cannot be implored by inconsistent, contradicting, feigned, and falsified evidence and especially when coming from a pathological liar and her perjurious spouse.

    The difference between the Supreme Court’s denial of travel to its employees, and that of the DOJ on the Glue, is the fact that the Supreme Court employees are merely threatened with administrative cases. In other words, they may still travel at their own peril; there is no physical restraint, by way of the Bureau of Immigration blocking them.

    That is not the same situation when the BI blocks Gloria, or offloads OFWs.

    I am wary of the recognition of the executive’s power to restrict travel, because it impliedly validates offloading of OFWs on mere suspicion of being a victim of trafficking.

    I think we should not allow the Supreme Court to run roughshod over us this time.

    There is no perfect Supreme Court. Those seats in that chamber are not occupied 100% by saints. Those individuals are human and thus fall prey to temptations, pressure and fear.

    No different from the churches whose spiritual leaders have fallen by the wayside at times.

    And so it is with our Supreme Court. It is not infallible. This SC has shown itself to be very fallible. It should therefore be put aright, be corrected. By Whom? By us, by the other branches of government.

    We cannot just lie idle and let them do whatever they want to do. The SC must feelour sentiments.

    We fight battles with the NPA,the MILF, the rebels, terrorists, etc. Everybody accepts this as normal for a government and a nation.

    And yet when time comes for us to do battle with a biased and corrupted Supreme Court, all the howls about respect for the courts and the Constitution can be heard.

    I say we should distinguish between a respectable and honorable Supreme Court from one which is not. I say this Supreme Court today has proven itself to be of the latter kind. Not all members of it, but majority of it. And the majority of it is what carries the results of their collective decision.

    I say again, when the Supreme Court or any court has lost its neutrality and respectability, it is time to expose it for what it is. It is a battle to be fought not with arms but with minds and public pressure.

    Let us not be blinded by such statements as “We should follow the Supreme Court. It has spoken.”

    No, again I say the Supreme Court or any other court is not infallible. What is legal and constitutional may not be morally right.

    Sometimes it is better to use common sense to fight gangsters in robes who use the constitution to defeat blinded constitutionalists.

    gloria had pinched nerve in the neck threatening paralysis below the neck. She had operations and titanium implants were used to stabilize the neck.

    Then came the hypoparathydoidism which causes calcium imbalance and the possibility of a RARE metabolic bone disorder (the reason for the metabolic bone biopsy only available abroad according to her Horn) that may lead to further bone destruction. Both threaten the success of the operation. Failed neck stability will eventually lead to lifelong disability.

    Nowhere can I see a threatened life other than having a COMFORTABLE life. This means there is no life-and-death situation that requires a race for time.

    The Minerva brace is doing its work at present, i.e., to stabilize her neck while healing takes effect in 3-months time (last operation was in September; brace may be removed in December…possibly in jail?).

    The insult to gloria’s bone because of the late diagnosis of hypoparathyroidism and/or possible, and I repeat, possible RARE metabolic bone disorder already overtook her lifetime (including the stolen time of her “presidency”). Why were they racing for time?

    gloria’s condition is in jeopardy right now because of fluctuating blood pressure. Hypertension is proven to be a life-threatening condition and it’s a race for time to really control the condition.

    Yet, gloria herself didn’t consent for a buzzer-beating clinic appointment today with a Singaporean specialist. Well, travel definitely is ill-advised considering the life-threatening diagnosis at the moment. Besides, local medical specialists can easily control gloria’s BP to normal.

    The point here is this:

    Life not threatened by a SUSPECTED diagnosis, go abroad. A race for time.

    Life threatened by an ACTUAL diagnosis, stay here. Suddenly, gloria can wait.

    This is further irony, or aptly, titaniumly to Congresswoman gloria’s colorful saga!

    The SC decision is inevitable. Blame it to the team Noynoy/Leila who were so naïve and well aware that their case has no legs to stand on, yet believed that they will be able to sail through counting on the pressure of public opinion. They lost and defied the order which only means that their latest drama is just to save face.

    Interfering and blundering into areas best left to the courts is a no-no in a democratic society. And defiance of a court order is plain arrogance.

    Rule of law should be observed at all times. There’s no question that in the court of public opinion, majority of the people wanted to see Gloria be meted out the maximum penalty for her crimes, but this does not mean that government should defy and bend it just to satisfy the majority.

    The rule should be always: the will of the majority does not override the rule of law or the constitution, otherwise mob rule prevails.

    ‘But if the court decides to jail De Lima, who will enforce their order?’

    SENATE-BOUND Justice Secretary Leila de Lima is expected to be raked over the coals in the Supreme Court today by a majority of Arroyo appointees led by Chief Justice Renato Corona for defying the temporary restraining order (TRO) they issued earlier this week.

    Lawyers expect De Lima and others to be cited for contempt with penalty ranging from a fine to imprisonment of up to 6 months. But if the court decides to jail De Lima, who will enforce their order against the alter ego of the commander-in-chief on whose orders she seems to be acting? Jesse Robredo’s police? Volt Gazmin’s military?

    Unless the order of Corona’s majority can be enforced, it is worth no more than the paper it is made of. To avoid embarrassment due to impotence, all that they can do is to slap her with a fine with possibly a threat of disbarment.

    De Lima’s defiance stems from the seeming orchestration that attended the hasty issuance of the TRO.

    Corona, who was appointed by Arroyo to his post in defiance of a clear constitutional ban, flew into town on call of duty shortly after the petitions were filed by the Arroyos.

    I suppose that was the least he could do. He then immediately scheduled deliberations on the newly filed case much like he did on a similar urgent TRO application of former Ombudsman Merceditas Gutierrez, another Arroyo ally.

    After the hastily called deliberations, Midas Marquez came out to announce the issuance of the TRO even before the actual order could be written. Marquez now says his announcement was sufficient notice to all, including De Lima.

    Promulgation of court decisions can now be done through a press conference, it seems. Never mind the actual ruling. It can just follow after office hours. Insiders say that the cash bond of P2 million as a condition of the TRO was actually posted at around 7 p.m. Court staff had to work overtime to receive it. I wish they can be as accommodating to a poor litigant like me.

    As if on cue, the Arroyos were at the airport barely an hour later, ready to depart on any available flight. They had with them several plane tickets for other flights scheduled that day. They seemed to have expected that the TRO would be issued that day. Ironically, the high and mighty former president and her doting husband were denied departure by a lowly immigration bureaucrat. But they played the moment to the hilt in a bid to gain public sympathy.

    When former President Estrada was arrested in a similar embarrassing fashion, EDSA 3 followed in a matter of days, I do not see that coming this time. No sympathies here.

    The morning after, Marquez was on television sitting next to Arroyo’s lawyer explaining the ruling of Corona’s majority. They both telegraphed possible contempt charges against De Lima. How convenient.

    The haste attending the ruling of Corona’s majority defies all logic and smacks of nothing more than a payback by a loyal rearguard. All the government was asking for was a chance to he heard before the Court ruled on the issue of the TRO. But Corona’s majority would hear none of it.

    They have the numbers and they decided to issue the ruling. In doing so, they virtually decided the merits of the case, according to De Lima.

    Next Tuesday, the Supreme Court will finally hear the government argue its case on a matter that has already become moot with the issuance of the disputed TRO. This is clearly a case of shoot them first, ask questions later.

    But not too fast. By then, the fight will most likely shift to the House of Representatives. Impeachment cases from both sides seem to loom in the horizon. This remains the only logical conclusion, if the rule of law is to be followed.

So if the SC insists on aiding this woman to escape, it will end up an impotent force. And if this trend prevails, no order of the SC will be obeyed, when say, they issue a TRO on the BIR, or Customs, etc.

    Kailangang bigyan nila ang Executive, at ang sarili nila ng graceful exit. Kapag nagpormahan, talo sila.

    This is the same dilemma that Chief Justice Marshall faced in the case of Marbury v Madison.

    The US Congress, in the lameduck session (session of those whose terms were ending, before the new ones are sworn in), amended the Judiciary Act of 1789, by the Judiciary Act of 1801, which created new judiciary posts, and expanded the jurisdiction of the Supreme Court, beyond the grant of the Constitution. John Adams made midnight appointments (yes, nauna sila), and the lameduck Senate confirmed them. The judges included William Marbury.

    When Jefferson took office, he did not want to give Marbury his commission (appointment papers, hindi pera); so Marbury went to the Supreme Court to petition for a writ of mandamus (order from SC compelling the executive to hand over the appointment papers).

    Problema. If the Supreme Court orders Jefferson, he may refuse. What will the SC do? If, on the other hand, the Supreme Court upheld the Judiciary Act of 1801, there will be the supremacy of the legislature, a la England, where the parliament enjoys parliamentary sovereignty, and is not bound by precedent.

    Anong ginawa ni CJ Marshall, he declared the appointment valid, and that Marbury had the right to the office. But, can the SC issue a writ of mandamus compelling Jefferson to deliver the appointment papers? Marshall said no. The writ of mandamus by the Supreme Court may be issued only in its appellate capacity. Because Marbury filed an original petition, the writ could not be issued.

    Bottom line, the Supreme Court kept its authority to declare whether a law (Judiciary Act of 1801) is valid or not, and it invalidated the portion that expanded its (Supreme Court’s) jurisdiction as violative of the Constitution. It also said Marbury was right, Jefferson was wrong. But it did not force Jefferson. Pinitik si Jefferson, pero walang confrontation with the boss of the military and the police.

    Can the Supreme Court do that?

    MANILA, Philippines – The Commission on Elections has voted 5-2 to file electoral sabotage raps against former President Gloria Macapagal Arroyo, Comelec Commissioner Gus Lagman confirmed Friday.

    The Comelec legal department is expected to file the electoral sabotage raps against Arroyo before a regional trial court anytime now.

    I wanted to point out one thing, that even with all the legality siding with GMA, the noisy or general crowd have voiced their support for the “illegal” action of De Lima.

    Are we Filipinos who are known to be hospitable to strangers really monsters who do not care for a sickly old lady? Ganun ba talaga tayo kasama?

    ABS host Anthony Taberna said it best in one of his interviews: GMA has no one else to blame why people treat her the way we treat her.

    I agree, for nine years she did not want to face the issues Filipinos clamored to be resolved. She ignored it all. She even insisted that her people do not reveal anything and just keep the issue under the carpet. No accountability. No resolution. No need for the madla to know.

    I have personally seen GMA treat media (yes yes our PH media is known to be less courteous and ruthless at times) poorly. Media, the very instrument to spread word to the people. She treated reporters as if they were fourth class citizens. GMA is also known for her temper. She barks worst than her PSG’s bomb sniffing dogs. Yung mga asong yun, matitino yun. May modo; si GMA?

    And now she ask for our pity?

    We the Filipino people are not mean nor demonic. We do not have hearts made of stone. Malambot nga puso natin. Our hearts simply failed to take these sh1t5 any more. Naging bato na ang ating puso dahil sa pinaggagawa nya. She did this on her own.

    Unless the order of Corona’s majority can be enforced, it is worth no more than the paper it is made of. To avoid embarrassment due to impotence, all that they can do is to slap her with a fine with possibly a threat of disbarment.

    It seems that the gov’t finds it convenient to find refuge on SENSATIONALISM for their INCOMPETENCE or worse for their ACCOMODATION of the Arroyos.

    I do hope it’s more of the INCOMPETENCE rather than the OTHER. Heaven forbid !

    Arbitrary application of law is as bad as NON-Application of the law. We are in a “democratic” society in NAME only.

    Sometimes I wonder… titino kaya ang Pilipinas kung ipatupad ang DEATH PENALTY especially if we start executing corrupt public officials… followed by economic saboteurs…

    Kung may aangal sa batas na yan… pwede syang tanungin, “E, bakit? May balak ka bang lumabag sa batas? ano ang kinatatakutan mo?” His answer should be quite interesting.

    Call it sensationalism if you please but its reality.

    Its not like living in a Communist state where the state dictates and no amount of emotion from the people will government like that of China will ever bow to the wishes of the people.
