‘Wah’ happened! Miriam Santiago goes ballistic

An irate Sen. Miriam Defensor-Santiago covers her ears during a tumultuous moment in the impeachment trial of Chief Justice Renato Corona on Wednesday after private prosecutor Vitaliano Aguirre III was caught on camera covering his ears as Santiago was berating the prosecution panel. Aguirre, who said his ears “were hurting,” was later cited in contempt for disrespect of a senator-judge.

Private prosecutor Vitaliano Aguirre had had enough of Senator Miriam Defensor-Santiago and had the guts to stand up to her.


In a hearing marked by high drama, Aguirre covered his ears with his hands while the prosecution panel was receiving yet another a tongue-lashing from Santiago, this time for its sudden decision on Tuesday to rest its case against Chief Justice Renato Corona.

For that “contemptuous” behavior, Aguirre earned the ire of not just Santiago but the entire Senate impeachment court, which cited him in contempt on Day 26 of the impeachment trial, ironically a day after the prosecution had rested its case.

“I charge this private prosecutor with contempt of this impeachment court! I have evidence right here taken by Senator Alan Peter Cayetano, and to say that nasaktan ang tenga ko (my ears hurt) should have been (a cause) for you to walk out of this impeachment court. But you cannot make those contemptuous gestures in front of a judge, and get away with it,” Santiago declared.

Cayetano himself took the picture using his cellular phone camera.

Santiago made the motion to cite Aguirre in contempt soon after the volunteer lawyer candidly admitted to the impeachment court that he did cover his ears.

“That’s true because my ears already hurt,” Aguirre said, while being questioned by Senate President Pro Tempore Jose “Jinggoy” Estrada.

Estrada had inquired into Aguirre’s motive for publicly displaying his disdain for Santiago.

“It seemed that you don’t want to listen to her,” Estrada said. “That’s disrespect for a member of this court.”

Aguirre argued that he had to cover his ears because he did not agree with Santiago’s position that it was not usual for lawyers to withdraw, or amend their complaints.

“This happens every day. The fact is that this is the first time that I experienced in my 40 years of practice that a judge would lecture his lawyers. That’s not proper,” Aguirre said.

All about respect

Told by Estrada that he should have objected to Santiago’s manifestation, Aguirre retorted that he had “no right to object.”

Under the Senate rules, private prosecutors are under the supervision of the prosecution panel and can not debate with the senators.

Aguirre said: “May I say something? If my actuation has hurt somebody, I really did it purposely because my ears were hurting from her shrill voice. My point here is that even if we’re mere lawyers, we also deserve respect. If you demand respect, respect also these lawyers because human dignity has no equal.”

After the hearing, Santiago, whose blood pressure shot up to 190/90, said it was Aguirre’s problem how to deal with the citation. Citing her colleagues, she said Aguirre had been calling attention to himself during the hearing.

“I’m too old to take this thing personally. I think he has just a mental disorder. A lawyer will never, never aggravate the judge,” she said. “Maybe he just wanted the prosecution to lose, or to publicize himself.”

She said she was “happy” that the senator-judges were unanimous in citing Aguirre for contempt.

Part of ‘dirty tricks’

In a statement later, Santiago said it appeared that Aguirre might have been “planted” to provoke her and raise her hypertension to a higher level, “precipitating either a stroke or a heart attack.”

Quoting her staff, she said that Aguirre had always been seated in the gallery until Wednesday, and “would always sneer at me very loudly.”

“All of a sudden, he sat smack dab in the middle of the front row of the prosecution panel,” she said.

“With these tactics, the usual suspects are up to their dirty tricks,” she said.

At the trial, Santiago twice took the rostrum to blast the prosecution over the withdrawal of five of eight articles of impeachment and their manifestation to make their formal offer of evidence within three days. In both instances, Aguirre, who was seated in the row of the prosecution table, was seen covering his ears with both hands.

“I should be recognized first by this honorable impeachment court to state what I feel. But since I’m already here, I will say what I feel.”

At this point, an angry Santiago reiterated her motion for contempt.

“Imagine if all the lawyers did that in front of the impeachment court, if all of the senator-judges took the (floor) to express his opinions … (if) you don’t agree with (us) then don’t listen to us, get out of the courtroom!” said Santiago, a former trial judge known for berating lawyers who did not measure up to her courtroom expectations.

Aguirre swiftly replied: “I was about to leave but …”

“Granted!” Santiago roared. “If that is in the form of a motion, go ahead! You’re challenging me!”

Penalty: Miriam’s speeches

Senate President Juan Ponce Enrile pleaded for the parties to remain “calm in this proceeding and deal with one another in a fashion that will not a create an impression before the people that we are not following the rules.”

Before things got out of hand, Enrile banged the gavel to suspend the session.

But seething with anger, Santiago strode toward Aguirre and confronted him.

“What?” Santiago taunted him, her eyes fixed on Aguirre for a few minutes.

At this point, prosecutors and senators restrained the two.

Aguirre was ushered out of the courtroom by House staff members, while Santiago stayed in her seat during the long suspension in the trial, alternately talking with Senators Alan Peter and Pia Cayetano, Loren Legarda, Vicente Sotto III and Estrada.

Sotto said he was not kidding because “it’s being suggested, with a request that Aguirre would not be allowed to cover his ears.”

Frivolous and sham

Before the face-off with Aguirre, Santiago slammed the prosecutors for airing charges that they now refuse to prove, saying that they had compromised Corona’s “moral position.”

“I am terribly concerned that this might constitute unethical behavior in this trial court,” she said.

“We have a term of art—‘frivolous and sham’—that can be taken in its technical meaning. A frivolous claim refers to a motion or lawsuit motivated by intent merely to harass, delay or embarrass the opposition. The claim must have no arguable basis in law or in fact,” she explained.

Santiago wondered whether prosecutors “acted in good faith” when they told the impeachment court in a legal compliance submitted in January that they would present evidence and witnesses for eight articles.

“Because now you turn around and say you don’t want to do that,” she noted.

Santiago said some colleagues had read and studied all eight articles in fulfillment of their functions as senator-judges.

“That’s what the law calls frivolous when you say ‘I don’t want to present evidence on eight, I only want to present evidence on five.’ Let me remind you gentlemen, the lawyer’s oath: I will do no falsehood, not promote or sue any groundless, false or unlawful suit or aid or consent to the same,” she said.

Continuing habit

Santiago said that her suspicion was bolstered by the prosecution panel’s continuing habit of announcing to media that its evidence can already prove Corona’s guilt.

“I am very concerned that the prosecution has been acting in bad faith all along because you tell so many things to media when you can file an official manifestation in this court. You insist you are already winning the court battle because you have proof beyond reasonable doubt. Good grief, that is contempt of court,” she said.

Santiago reiterated an earlier charge that the prosecution’s discussion in press conferences of charges they planned to prove was a case of trial by publicity and was a clear prejudgment of Corona’s case.

‘Gago’

Wednesday’s action-packed hearing was heralded by Santiago’s manifestation virulently attacking the prosecution for dropping five of the eight articles of impeachment against Corona.

She spewed out highly unpleasant remarks, but the House lead prosecutor, Iloilo Representative Niel Tupas Jr., meekly held his peace throughout the tense trial.

“I felt like creeping back into bed and adopting a fetal position, which is the normal reaction of any sane person when he’s faced with a world that is crumbling around him. I no longer know what universe I’m in … because I’ve never seen this done to a judge before,” Santiago said.

She blasted the prosecution, calling it names such as the offensive word, “gago.”

How do you spell ‘wah?’

Upon a motion from the House deputy lead prosecutor, Ilocos Norte Representative Rodolfo Fariñas, this unparliamentary remark was later stricken from the record, with no objection from Santiago herself.

Scolding the prosecution, the senator said the prosecution was “playing games” with senator-judges in dropping the five articles after promising earlier to present about 100 witnesses.

“I was not born yesterday. We will be studied generations from now. This is a travesty. I request the secretariat to record in the journal that I said, ‘Wah!’” she said.

Santiago repeated this expression three times.

After the blast, Sotto said that Senator Serge Osmeña had asked, “What’s the spelling of ‘Wah?’”

No one asked Santiago what that term of endearment was all about.

    Hahaha! E ano nga naman magagawa ni Aguirre kung nabibingi sya sa noise pollution emanating from Miriam’s mouth? Sa totoo lang ay meron talagang mga tao na madaling maapektuhan ang pandinig lalo sigurado sa patuloy na walang pakundangan pagmumura ni Miriam. (Isa ako sa mga tao na madaling mabingi sa masyadong malakas at maingay na kapaligiran).

    Way to go, Atty. Aguirre for having balls and guts to stand up against the brenda of the Senate!

    I have P300.00 in my shallow pocket reserved for someone’s confinement in the Mental Hospital but now have shifted my sympathy to the beleaguered defense attorney Vitaliano Aguirre for his courage in defending against affront to personal dignity.

    Ma’am Ellen, where can I send my P300 that I want to contribute to the fine to be imposed by the Impeachment Court on Atty. Aguirre for contempt?

    OMG pakikinggan ni Aguirre and boses ni Brenda for a while as punishment? Magpakulong na lang sa bilibid si Aguirre baka mas mainam pa. Kung nandun ako sa senado, papalakpak pa ako after Aguirre’s remarks. It is a little bit too much for Brenda to abuse her “senator-judge” position to demean anyone. Wala na siyang respeto kahit kanino! Akala ko ba ang sabi niya eh quasi judicial lang ang impeachment court na ito. Why is she treating it as a Sandigan Bayan court? That everything has to be by the book!

    Besides, she keeps reiterating that the impeachment court is the HIGHEST COURT and no one can dictate on them. Yun pala, isang memo lang ng Supreme Court tameme na silang lahat. Kung baga, Brenda is trying all she can to sway the senators to her acquittal of Corona. Di ba tayo nakakahalata? Kung ang defense ang may diperensiya, bale wala lang. But if it is the prosecutors, konting kibot, lampasong lampaso sila!!!!! Well, she has to return the favor for all those oversees trips with pandak. Halos lahat yata ng trip ni pandak, kasama siya. And why is she so BIG on the dollar account concealment, baka naman iting mga senators na ito ay nangunguna sa pagtago ng kanilang mga “pork” sa dollar accounts. Kawawang bansa talaga! The only language the non-lawyers senators understand is, they will have to pay come election time if they do not vote in line with the people’s sentiments. Never mind Brenda, isang boto lang yan. Besides, she will go to the international court na. Good riddance! Pia has to be careful. Oo nga, she just got voted in recently eh yung isang Cayetano, he will have to run again.

    I doubt na magtatakip ng tenga yang si Aguirre sa husgado, lalo kung kay Judge Cesar Peralejo siya nag-appear; or even the late Salvador Valdez (RTC) of Baguio City (later CA).

    Addendum… it was the trio of Jinggoy (the Reporter), Pia (the Seconder) and Alan (the Photographer) who started it all. Miriam went gaga only after these three did their “coverage” work.

    There was another terror. Her sala was closed at exactly 8 am. Kung late ka, sorry. You did not get to have your case heard. Wala pa yung boundary mo (appearance fee), at kahiya-hiya sa cliente.

    She was Judge Nye, the mother of some newscaster in the 90s, David Nye.

    Ang magaling galit sa tanga; lalo yung tangang pasikat. Note, even Enrile lectures the prosecutors. Par for the course yan, if you do not come prepared.

    On the other hand, kung mapagkumbaba ka, you get sympathetic help from a judge. A judge in the province was practically prompting me in one case.

    I was rifling through my files, and the Judge asked, Is this your first time? I replied, my first land titling case Your Honor. Hayun, nagdicta na. I was just repeating what he said for the record. Instant law seminar.

    I noticed that even the gentle Tupas yesterday was getting flustered and was quick to stand up to Cuevas’ incessant snide remarks.

    The prosecution team should have done that long ago. But anyway… they’re starting to show balls. Kaya lang very respectful pa nga eh. Too respectful. Just covering the ears lang nga eh.

    Unlike the defense lawyers who practically called the senators “P100 million bribe-takers”. And what was their penalty? A soft guarded admonition lang.

    Get fairness from this court? I can get better fairness on a basketball court.

    The prosec team, mostly members of the House, are just cooling their heels. Siyempre, they don’t want to antagonize the senator-jurors dahil sa boto ng mga ito. Once this trial is over, u can bet your house. Mag-uunahan ang mga yan to deliver privilege speeches denouncing Lady Gaga! Oh, she will hear a lot! And hopefully, she will ‘drop dead’ this time. 🙂

    i think the point of miriam is —– you should read and brush up and make sure you know the law. True naman na frustrating ang makipag talo sa bobo, this is not classroom, its the real court, worst bobo ka na, ayaw mo pa aminin na mali ka, kahit ako, will be ballistic. Rememeber- there is only one interpretation of the law, besides bakit sasakit ang tenga nya, di ba lawyer sya ng alabang boys na napalaya???? so innocent sila ???

    Magkano kaya ang ipinakimkim na kwalta dito kay Lady Gaga para laitin at murahin ang grupo ng mga prosecutor? Ilang araw niyang ini-insulto ang mga ito. Talagang ginulo niya ang mga prosecutor para hindi maka-porma. Yon na nga …. buti na lang at may umalma.
    Dapat dito sa taong sira ulo na ito ay busalan ng kuwalta sa bibig para di makapagsalita at para hindi mairita si Atty. Aguirre.

    Respect goes both ways! The prosecutors knows what they have and how to depend it! All that the senators-judges have to do is go along with their process and let it be whether the prosecutors are good or not. The isyu here is finding the truth pero nangingibabaw ang pangungutya maybe to divert the attention to other things instead of focusing on the cheap justice.
    This exercise becomes a joke compared to the way the US handle their impeachment proceedings. Di man lang natanong si CJ na galing sa kanyang bibig ang sagot..Hustisya? hahaha…Also, the defense accused the senators judges as “100 million bribe takers” and let it pass and contempt for Aguirre! Hah..this is really a good show para masabing may hustisya. How can one respect such an institution dahil sa iilan puro kayabangan lamang ang pinakikita…mga attention seekers ika nga 🙁

    I thought it was only Enrile and Miriam whom I had to closely observe during this trial mostly because of their volatile tempers and arrogant manners.

    But it turned out there were other interesting creatures to watch in the zoo.

    – Joker the Grouch.
    His specialty is to scare the daylights out of the senator-judges. He will stop, block, delay any evidence against Corona. He has done nothing but spread gloom, doom and cowardice in the court room. In his mind, anything that looks and smells Cory-yellow is bad. Bad ka, lagot ka.

    – Jinggoy, the Sneer.
    Ok sana pero he thinks he is still in the movies starring as a hoodlum hero, quick to sneer and smirk and hurl his Erap look. He will confront anything that remotely appears to challenge his honorable peers and his beloved exclusive enclave, the Senate.

    – The Katzenjammer Kids.
    At first, okay.. but young and still insecure, have a tendency to pasikat..trying way too hard to appear fair.. but have been overdoing their morning and afternoon beso-beso routine to their beloved Tita Miriam. Lady Gaga is a communicable disease.. the Cayetano kids are getting infected.

    – Bongbong, the Cocky.
    He has shown great capacity for immaturity, cockiness and arrogance. He sounds too much like his father..has his father’s mind. His visions of his former childhood abode by the Pasig still looms clear in his mind. Clearer still is the vision of a hero’s burial for his father. Like Joker, he barks at anything yellow.

Lalabas at lalabas ang mga katutuhanan, na mayroong magdadala ng pangalan ni “Lady Gaga” sa Senate Court.Yong eyes niya kitang-kita ang Hypertension y ” High Blood “, kasi na insulto sa ginagawa ng “prosecutor lawyer, atty Aguirre. Nabangit ko din, ang mga “aura” ng kanilang mga pangalan na syang, “salamin” ng kanilang katauhan “…Grabe talaga ang Pinoy ( may-pinag-aralan at wala, kung minsan, pare-pariho lang..SA pananamit, at mga sasakyan lang nag-kakaiba, at lugar ng mga tirahan,e.g.. ngunit sa pag-gawa ng tele-Novela- show- grandstanding, walang pagkakaiba ).. Itong mga nasa Senate Court, tamimi-tikom-dila, kapag may ethical issues ang mga kasamahan ( lalo si babae ! )ngunit, kapag ang prosecutors, di pa nagsasalita, Tayo lang nila o galaw, katakot-takot na Pang-iinsulto agad ang napapala. Sino naman ang hindi mapipika sa sa kanila, at mabuti mayroong nag-paka-bayaning ISA, atty Aguirre. Makikita na halatang-halata ang “cover up ” sa mga “maraming nagtatago ng ” Dollar accounts ” ( mga Pork Barrels converted sa $$$ ???), kasi, halos wala namang, napupuntahan ang ” “Development Funds ” kundi sa development din ng kanilang mga bulsa at ari-arian ?, 10%-25% lang yata ang ki pobreng Juan de la Cruz ( kita ang ibedinsya kapag may mga kalamidad, exposed by nature’s justice, e.g. ).

    Kaya malayo na makamtan ang pagbabago sa Pilipinas, base na din sa “tinatako-tumbok ” ng mga expected leaders sa 3-sangay ng gobyerno ( matimbang ang samahang, KKKK:—kaibigan-kaklase-ka-kumpare-ka-sangga-ka-ututang dila, etc..)…Lagi kung naba-bangit, saan patutungo ang Pilipinas ?…kung ang mga pamunuan, ay mga walang deriksyon, maliban sa pag-papayaman ng mga bulsa nila, galing o gamit ang pangalan ni ginoong JUAN !.Kawawang Juan, GOD BLESS him!..Kung wala sya, wala ang lahat??.

    The events which transpired yesterday and the days prior were obviously a coordinated plan to threaten the Senator-Judges (INC Rally) and to paint the prosecution panel as a bunch of incompetents (Lady Gaga).

    asus, nagsalita ang dati meron mental problem (Mirriam). I hope the majority will vote for Corona’s conviction, except Mirriam and Joker. Maybe there are still a few more. Hope it doesnot reach 5 pro-Corona.

Miriam was voted immediately in the first round topping the field with 79 votes with the Judge from Trinidad and Tobago also making the cut with 72 votes from a field of 13 candidates.

    Then one (Czech Rep) followed the next round, then one each at the 12th(Dominican Republic), 13th(UK), and 15th(Nigeria).

    If she is called by the ICC on March 11 then we have no way of knowing if she will treat the defense with the same “cold impartiality” and a relaxed blood pressure of 120/70.

    If I am not wrong and i could be wrong, before the ICC was created by the statute of Rome it was the International Criminal Tribunal under the UN that prosecutes War Criminals but is not permanent and that the ICC was created as a permanent court…Some of the Individual who were brought before the ICT were those involved in the Yugoslavia Civil war and in some countries in Africa and were prosecuted by Louis Arbour, also a former UN commissioner of Human rights, and currently the CEO of International Crisis Management Group for which one Individual named Sheila Coronel is among the noted members of the Group…Louise Arbour successfully indicted among others Milosevic of Yugoslavia…and she did not have to shout to world that she is as smart as Miriam Santiago…and by the way she too was former Justice of Canada Supreme Court and during her University years was even much as irreverent or more than the show off Miriam…

    In the case of Esguerra et al, hindi naman Senado ang ininsulto, but the President and his cohorts, when they alleged that pork barrel was being dangled. They did not allege that the Senators accepted. Ang tangkang pag-suhol ay puna sa manunuhol, hindi sa sinusuhulan.

    Even if it be assumed that Esguerra et al “insulted” the Senate, they did it outside, not during a session. Dahil hindi harap-harapan, or in facie curiae, puwedeng palagpasin.

    Read in some commentary that the presiding Judge will no be casting his vote since he was presiding the case , but he belongs to the Juriors that any non vote is a vote for Acquittal since the Rule is ..16 votes are needed for conviction. So if this is the case one Judge already has his taken from the start. Maybe that is the reason why that the IC has to be Presided by a non voting Judge???one vote could mean win or lose.

    Defense strategy is becoming evident with the pronouncements of Cuevas, Enrile and the defense lawyers and spokespersons. The defense panel will, with all its bag of tricks, drag the trial to the point of public and senator-judges fatigue. Defense panel will first harp on their ‘affirmative defense’ that the whole process is unconstitutional from the start. Then, they will present volumes of documentary and testimonial evidence on the abandoned articles 1, 4, 5, 6 & 8. Enrile has already told the defense panel, in open court during the Feb29 hearing, that they CAN present evidences on the abandoned articles. It is very likely that the defense will let this process go on until the end of the year or beyond without even touching on articles 2, 3 and 7. Enrile, Santiago, Escodero and Cayetano (Pia) will make sure of this by invoking Corona’s right to due process . But what about the people’s right to a speedy trial?     Serious note, he should be facing some sort of punishment whether his action was right or not. Respect nga naman.

    He had options of excusing himself or simply not joining this circus.

    I don’t mind if the punishment is listening to Miriam’s voice for a few hours. Its childish though.

    Now since its also about respect, Miriam should suffer some sort of punishment as well. She should be asked to shut up for a few hours, the same few hours Aguirre had to endure her voice. Or maybe listen at the same time to those relaxing music (baka kasi rock music tinutugtog nya sa bahay).

    On a personal note to Miriam: you do know that having those medical condition is your body telling you to cool it down, right? Your own body is reminding you not to go overboard.     supreme court – particularly the SALN records of justices are prohibited to public access and its internal rulings/records off limits to scrutiny of outsiders.
