Jinggoy’s general and Erap’s DVD

Update: In today’s hearing, Atty. Bagares challenged Gen. Martir because he was the one who approved (even ordered according to militarynsources) of Lt. Raymundo’s detention and filing of charges against him.

Martir said he had inhibited, three days earlier. (Then why was he there presiding?) Then he left. Another member, Lt. Col. Emmanuel Salamat, also inhibited himself from the panel because he was the one who prepared the report on Lt. Raymundo’s case.

With only four members of the panel left, the court lacked quorum. Hearing was adjourned. Next hearing is set July 1.

Media was not allowed to cover. We were told to get permission from the Flag -Officer- in -Command , Gen. Calungsad.

Without the respondent knowing about it, a political twist has been added to the case of Marine 1Lt Artemio Raymundo Jr. who will have his first hearing tomorrow since his detention one year and nine months ago.

Raymundo, formerly logistics officer and officer-in-charge of the 16th Marine Company, Field Artillery Battalion, is charged with six counts of Conduct unbecoming of an officer and a gentleman (Articles of War 96); five counts of Acts prejudicial to Good Order and Military Discipline (AW 97) and one count of Disrespect toward a superior officer (AW 64).

What did Raymundo do to have been charged with such multiple offenses?

He shared with fellow marines DVDs which were being distributed at the LRT station.

What were those DVDs that cost him his career?

“Ang Mabuhay Para sa Masa”, a biopic of former President Estrada, and “At All Costs” a documentary of the 2004 elections.

The officer who charged him and ordered his confinement was Lt. Col. Danilo F. Luna, commanding officer, Field Artillery Battalion, Combat Service and Support Brigade. At that time Luna was still a major.

The CSSB brigade commander at that time was Col. John Martir. Last week, Martir’s promotion to brigadier general was confirmed by the Commission on Appointments.

One of those who voted for Martir’s confirmation was Sen. Jinggoy Estrada.

Martir’s confirmation was opposed by Maria Flor Querubin, wife of Col. Ariel Querubin, for his (Martir) having gone on AWOL (absent without leave) for more than a year. Instead of joining Senator Alan Cayetano and Rep. Joel Villanueva who opposed Martir’s confirmation (Senators Panfilo Lacson and Jamby Madrigal abstained) Estrada joined Sen. Juan Ponce-Enrile and other administration senators in confirming Martir’s promotion to brigadier general.

Martir will preside tomorrow’s hearing of Raymundo.

Raymundo’s lawyer, Romel Bagares of Roque & Butuyan law offices, has averred that his client’s detention is illegal and asked for his immediate release.

Raymundo’s charge sheet is ludicrous. Sen. Estrada should see it. It said: “Without any authority and despite its banning for its evident purpose of ousting President Macapagal Arroyo from her seat, did then and there willfully, unlawfully and deliberately, gave a CD entitled ‘At All Costs’ and ‘Ang Mabuhay Para sa Masa’….. for the personnel of 16 MC to watch it.”

For the information of Luna, the paranoid Movie and Television Rating and Classification Board prohibited public showing, repeat Public, of “Ang Mabuhay Para sa Masa”. It was never banned for private showing. There was never any ban on “At All Costs”.

In his counter affidavit filed last March, Raymundo said his confinement violated several provisions in the Articles of War, the law that governs military personnel.

He said: “ I was confined under the orders of someone who only holds the rank of Major. Under the manual for Courts-Martial of the Armed Forces of the Philippines, a commanding officer who holds the rank of Major and below can only impose as punishment on an officer a maxium of 15 days of arrest in quarters, or deprivation of liberty for 30 days….

“Under Article 105 of the Articles of War with respect to minor offenses,t he commanding officer, may, for minor offenses, impose disciplinary punishments upon persons of his command without the intervention of a court martial, but such cannot include confinement under guard.

“If the acts charged are not minor offenses, then any punishment meted out to me may be imposed only by a judgment through a Court Martial. Despite my demands for the convening and trial by court martial, such never materialized.

“Charges brought by Maj. Luna against me under AW 97 and AW 54 both have a maximum punishment of six months of confinement at hard labor, yet I have been confined for more than one year already. Moreover, in this case, since I am an officer above the rank of private, I cannot be sentenced to hard labor under AW 105.”

Since Martir was the superior of Luna, the ridiculous charges against Raymundo and his illegal confinement would not have been possible without his knowledge. In fact in the petition for habeas corpus by Raymundo’s wife before the Court of Appeals, Martir was one of the respondents.

Jinggoy should see how his general presides over the trial of an officer who just wanted to watch the story of his father’s life on the TV screen.

    Jinggoy must be out of his mind still suffering from the loss of his best friend actor Rudy Fernandez. He was mentally incapable of casting that vote to confirm the above officer. Otherwise, some kind of political accommodation was the reason.

    I have always had reservations about Jinggoy. Napaka-trapo. Look at what he did in the Senate presidency. Villar just dangled the vice presidential slot to him, he abandoned the opposition bloc.

    I was strolling at the memory lane of ellenville and I found this post from Ambassador H.C. Cruz that should had been implemented. If this recommendation by Amb. H.C. Cruz was implemented probably we will not have a kurakot military like Asspweron and the traitor Angelo Reyes.

    We seem to have a penchant for transforming systems that worked in other societies into failures in our country. The World Bank noted that the countries which became “Tiger Economies” in the decade of the seventies and eighties were all under authoritarian rule. Korea, Taiwan, Singapore, Hongkong and Chile achieved this status under authoritarian rule. ( This is the best argument against those who claim it is parliamentary rule which will hasten our national development). Marcos, his technocrats and the military had the Philippines under authoritarian rule during the same
    period and converted our country into a basket case.

    Likewise what Chile did in cleansing their military is
    a lesson to us. After the Pinochet dictatorship, they
    formed the Rettig Commission which uncovered all the
    human rights violations during the dictatorship. That action was the first step in purging the military of
    undesireable elements. They went up the hierarchy in their
    cleansing process. Finally they have reached Pinochet and are trying him in court for enrichment in office and human rights violations.

    Cory Aquino failed to do the same thing. While serving in
    Chile and upon release of the Rettig Commission Report, I immediately noted the significance of it. I made a series of reports some of which I sent directly to CCA by passing the DFA, to set up such a Commission. No action was taken by CCA. Had such a Commission been set up, most of the
    flag officers now in the military would have been purged
    from the ranks while they were still junior or field grade officers for enrichment in office and human rights
    violations. We would probably not have the corrupt military that we have today. I am sure some of the flag
    officers now would not have reached their present ranks.

    When CCA endorsed FVR in 1992 that was it, that means we will never have a complete break with the past, with the Martial Law years. FVR as head of the PC during the regime has also a lot of skeletons to hide. In short the Chilenos
    had the foresight to see that they must have a complete
    break with the Pinochet regime, we never took the same step. It must be noted that Pinochet and the Chilean military, at least converted the Chilean economy into a tiger or jaguar economy. So they at least achieved something. Our military which was the partner of Marcos in establishing Martial Law failed to do the same for our country.

    Sadly we cannot help but note that things that work in other countries are corrupted when used in our country.
    There must be something wrong with us.

    Was it a mass confirmation? In which Se. Jamby walked out? If so, Jinggoy should have been awaken by Jamby’s walkout, and got his senses back. What gives Sen. Jinggoy? Previously you questioned Security Detail of Jun Lozada, and concurred with JPE on this matter. Are you jumping ship? Does ERAP know about this? I am aware you are your own man, however, if you plan to jump ship and cross over the Pasig River, you should also be man enough to give headsup to your colleagues in the party and to your family, your Dad, especially, since he is the acknowledged leader of the opposition. Is there disharmony in te family, and Mayor JV is outshining you?
    Gloria is going to DC alright. State visit, yeah right. Rumor has it that The Dabya has instructed her to come over for some good tongue lashing on what is happening to teh country. Especially the Chinese influence on her domestic and international policy.

    Sometimes that’s the problem with our politicians like Jinggoy who seems to think that all Filipinos are within his level of thinking. He did’nt realize that by symphatizing too much with his dear friend, Rudy Fernandez, he was exposing his weaknesses to the people. Have you seen him how he cried like a child in front of the camera and how he would tell the world how scare he is to seeing ghost? Leadership in a democracy is not reserved for weaklings like Jinggoy. He should act like an honorable senator. This is the problem in the Philippines, electing an unqualified fellow merely because of his name. Poor Juan dela Cruz. Poor Philippines.

    Jinggoy is a remnant of the Trapos and warlords! He thinks that he is in the position to be served. By being in power, he has to take advantage all for his own gain. He does nothing but gamble and have a good time every night from what I heard. Look at what happened to San Juan when he was Mayor, it was left behind by all the neighboring cities. Now it has flourished ever since he left.

    I guess people are just scared to tell Erap the kind of person his son Jinggoy is. Erap should realize that his son is destroying his name.

    What a lucky guy because of the name he made it to the Senate though I personally believe he is so unworthy.

    Just wondering who placed that into your inbox. He didnt say we pass it to 11 friends including the sender. But kidding aside, I like the dissertation. But its not enough. Praying through the wrong church might not be heard upstairs. No amount of prayers na palepaleho lin could change his outlook or ours. I can only suggest a beginning of a concrete change for the better by getting rid of a wrong church that we have now. It has influenced everything in the dissertation of a friend above. What we are now is the sad result of that 500 years of erratic guidance. If we blame the government or Jinggoy now, we are only barking at the wrong tree. Thats only a drop in the sea of the untruth. Have a peak at the end of the tunnel. It says, Down with the church!

One example was the visit she made in Japan when she was merely acting president, and when the Japanese did not give her the big welcome, Philippine media even put the blame on the Japanese who did not know what the stupid woman was trying to do to build an aura of regality for herself.

    I would rather people in the media in the Philippines check with the US State Department, not the US Embassy in the Philippines with another loca as ambassadress there to see if it is indeed a state visit that US media do not even bother to report for some obvious reason unlike when personalities from countries recognized by Americans as really big and powerful visit the US of A.

    The only reason why the fight among the Estrada family members and siblings is controlled is because Erap is still alive. Maybe the children do this out of respect or fear. Once Erap is gone, expect the fight between Jinggoy and JV Ejercito to get worse. JV is often at the losing end of the conflict due to being the son of the other woman. The guy has made so much sacrifices and remain to be obedient to his father. During last election, he backed out from running as Senator heeding the advice of his father. When he ran for San Juan Mayor, instead of supporting his half-brother, Jinggoy put up his own candidates against JV. All of Jinggoy’s candidates lost except one. Deep in Erap’s heart, he sympathizes with JV and may love him more. But Jinggoy is his wife Loi’s son…

    Jinggoy is so insecure, that is why he hates his brother JV. I heard that in the last two elections, Jinggoy even put up candidates against JV’s group. The good thing is that the people of San Juan rejected Jinggoy’s group. They know too well who served them truthfully and who did not. I couldn’t Jinggoy for being insecure specially that JV although very low-key has proven to be a good public servant. JV has been known as a hardline oppositionist, but his being a good mayor is often overlooked.

    Comparing the two brothers is like comparing night and day. The good side and the bad side!

    It is a common knowledge that JV is a much better person than Jinggoy! It must be very difficult for Erap to balance himself between the two. I like JV much much better than Jinggoy.     I recently came across the “honor code” by which a cadet lives by as future officers at the PHILIPPINE MILITARY ACADEMY (PMA). If I am not mistaken, the same/similar code is likewise paramount in a cadet’s life at the WEST POINT, ANNAPOLIS, THE AIR FORCE ACADEMY, and all reputable military schools elsewhere where such codes are observed with a fanatical zeal. Simply put, the academy builds and
    improves one’s basic character and molds their future roles as guardians of a nation’s defense. They are taught strength of character in the face of stresses and challenges and not to buckle down to the temptation of comforts.

    Further beyond the walls of the academy, these graduates are expected to live by the same honor code as professional soldiers, and later on in life as possible appointed government heads, cabinet members, and if one is lucky, as the president of the republic himself if they, in fact, are qualified to hold such posts. In short, it would be a way of life until they retire if they are not killed in battle.The idealism really blows my mind as I read it.

    But as we are all witnesses to the hooliganisms and treasonous acts by some of its graduates, this honor code, it seems, is all but rhetoric.

    Read below the CADET’s HONOR CODE.

    The life of PMA cadets revolves around strict adherence to the honor code. It is a must for all cadets not only to know the code but to practice and make it a way of life. The Cadet Honor Code is what distinguishes a PMA cadet from students of other institutions.

    THE HONOR CODE
    DO NOT LIE, CHEAT, STEAL “WE, THE CADETS NOR TOLERATE AMONG US THOSE WHO DO.”

    1. A cadet does not lie. In his dealing with others, a cadet tells the truth, regardless of the consequences. He does not quibble. He does not make evasive statements.

    2. A cadet does not cheat. A cadet does not defraud others nor does he take undue advantage of them.

    3. A cadet does not steal. A cadet does not take any personal property of another without the latter’s consent. He does not keep for himself anything that he finds which does not belong to him.

    4. A cadet does not tolerate any violation of the Code. A cadet is bound to report any breach of the Code that comes to his attention. He does not countenance by inaction honor violations; if he does, he becomes party to such a violation and he himself is as guilty as the violator.

    Training to become an officer in the regular force of the Armed Forces of the Philippines in the Academy is challenging. It is good for the tough, well motivated, and gifted individual. The bottom line is that the training regimen will bring out the best in individuals who successfully hurdle it.

    As one who was not destined to be one of the guys in that “long gray line”, I shudder at the thought of my seeming “inferiority” in character in terms of my personal sense of integrity, honesty, and loyalty. But as I look back at those alumni who have trampled on the honor code and have become the oppressors instead of the protector of the people they have sworn to serve, I really wonder if the PMA of today is training the present crop of cadets to be steadfast in its own dogma or is it just another dying institution with nothing to teach but blind obedience to a commander-in-chief in exchange for personal greed and an un-heralded and un-deserved promotion. An insult to the truly deserving lot who risked life and limb in defense of the constitution but are only good for a medal (and the Philippine flag if one dies in battle).

    As we are all witnesses, the truly “honor-bound” and still idealistic few are the ones who are presently being hunted like fugitives, are incarcerated, stripped of rank, deprived of human dignity and respect simply because they were maliciously charged of “fabricated crimes” they allegedly committed for their desire to remain honorable against incredible odds while exposing a prostituted institution and a vindictive, mandate-less commander-in-chief and her pathetic and extremely corrupt dog-eats-dog regime.

    The late Gen.Douglas MacArthur and five others like him earned their fifth stars (as generals of the army and air force) deserving of their impeccable accomplishments both militarily and as administrators. On the other hand, “favored generals” of the AFP, borne out of “UTANG-NA-LOOB” retired as four-star generals with no accomplishments to their credit aside from being lackeys to the powers that are.

    I need not name names. They and the whole nation know who they are. They are those who command a spurious strict adherence and obedience to the “chain of command” to consolidate their hold on the soldiery and to camouflage their real intentions of abetting a criminal to defraud a nation and in anticipation of a personal reward politically-transacted by an equally greedy and presumptuous president-wannabe they call their commander-in-chief . They are even recycled and are occupying sensitive government posts for which they are totally ignorant and un-qualified while displaying that air of idiotic arrogance as if they deserved their appointments. Without batting an eye, these same lackeys are all willing pawns in the game of corruption to satisfy their respective personal greed and lust for power in the present pathetic regime of a despicable “iota” of a despot who indulges in contractual politics for personal survival. They truly deserve each other. It is just too bad that the Filipinos who subsidize their whims and caprices, while feeding their young with cups of cheap noodles, are the ones who suffer the most and are even accused as de-stabilizers when they opine their 2-cent’s worth for reforms.

    I used to marvel and regale at the graduates of this (once) great academy. I guess I do not anymore. With the string of the present lofty-perched PMA notables doing away with the honor code completely and prostituted by no less than the present regime of the damned, I really wonder where the rest of the more honorable majority of these graduates/officers stand as to realize where the chain of command should end and the defense of the constitution begins.

    It is a daunting gauntlet to pick up, but a gauntlet to be picked up nevertheless.
