Pangalawang kaso ng graft laban kay dating Comelec Chairman Benjamin Abalos kaugnay sa ma-anomalyang NBN/ZTE ang isinampa sa kanyan ng Ombudsman kasama si Gloria Arroyo.

Una ay yung isinampa ng Akbayan noong 2007. Paglabag din ng Republic Act 3019, ang Anti-Graft and Corrupt Practices Act. Hindi isinama ng Ombudsman na si Merceditas Gutierrez noon si Arroyo.

Sa kasong isinampa ng bagong Ombudsman, Conchita Carpio-Morales kaugnay ng anomalya tungkol sa NBN/ZTE bago matapos ang 2011 laban kay Arroyo, kasama din si Abalos.

Sabi ni Ombudsman Spokesman Asryman Rafanan ibang bahagi daw R.A. 3019 ang tinumbok ng bagong kaso laban kay Abalos.

Nakakulong si Abalos ngayon kaugnay sa kasong electoral sabotage noong 2007 na eleksyun na isinampa ng Comelec.

Bakit hindi pa nasampahan ng kaso si Abalos?

Bakit ba hanggang ngayon ay hindi pa na-isampa ang kasong electoral sabotage laban kay dating Commission on Election chairman Benjamin Abalos na inirekomenda ng joint panel ng Department of Justice at Comelec?

Ito rin ang tanong ni Sen.Senator Aquilino “Koko” Pimentel III noong Biyernes.

Comelec Chair Sixto Brillantes Jr. said the case against Abalos and other co-respondents of Arroyo would be filed next week, after Comelec lawyers are able to untangle some “procedural problems.”

“There is some sort of complication, but it is just procedural. But we are definitely filing against Abalos,” he said.
Noong Nob. 18, yung araw ng Biyernes na minadali ng pamahalaang Aquino ang kaso na electoral sabotage kay Gloria Arroyo, sinabi ni Comelec Spokesman James Jimenez, na kasama si Abalos at si Capt. Peter Reyes , isang intelleigence agent sa Armed Forces of the Philippines,ngunit sa Lunes na isasampa ang kaso laban sa kanya.

Orders immediate suspension of Neri

The Office of the Ombudsman on Wednesday affirmed the involvement of former National Economic and Development Authority (NEDA) director-general Romulo Neri and former Commission on Elections (Comelec) chairman Benjamin Abalos in the botched multi-million NBN-ZTE deal.

In a 16-page joint order, the Ombudsman upheld its April 21, 2009 resolution recommending the filing of graft charges against Neri and Abalos in connection with the $329-million national broadband network deal (NBN) the Arroyo government entered with China’s Zhong Xing Telecommunications Equipment (ZTE) Corp. in April 2007.

President Gloria Macapagal-Arroyo terminated the contract, which was supposed to improve the communication capabilities of government offices, in September 2007 after news of bribery surrounding the deal came out.

Hindi daw maintindihan ni dating Comelec Chairman Benjamin Abalos kung bakit siya isinama sa pinakakasuhan ng Senado kaugnay sa ma-anomalyang kontrata para sa pagpatayo ng telecommunication network sa Pilipinas (national Broadband Network) na gagawin sana ng ZTE, isang kumpanya sa China.

“Bakit? Nakasuhan na kami. Ano pa ang gusto nila?,” tanong daw ni Abalos. Ini-imagine ko lang na kuntodo paawa effect pa itong si Abalos.

Ano ang gusto ng mga tao? Makulong ka kasama ang iyong mga amo na si Gloria at Mike Arroyo.
Mabuti naman at isinama si Gloria Arroyo sa rekomendasyun ng Blue Ribbon Committee na pinamumunuan ni Sen. Richard Gordon ngayon sa kanilang mga rekomendasyun na kakasuhan at i-impeach.

Kailan ba naman na ang pangungurakot sa kaban ng bayan ay “acts of the state” o gawain para sa bayan?

Tama ang punto ng Concerned Citizens Movement sa pag-kwestyun sa desisyon ng Ombudsman na hindi kasama si Gloria Arroyo sa kakasuhan sa ma-anomalya na $329 milyon na NBN-ZTE deal.

Ang pinuprotektahan ng Saligang Batas ay ang mga gawain ng isang pangulo para sa taumbayan. Hindi ang katiwalian na dapat nga ang pangulo mismo ang magsusulong ng pagparusa dahil yan ay obligasyon niya sa taumbayan.

Malacañang is coming out with a masterpiece to divert attention from the unholy alliance between Gloria and Mike Arroyo and Merceditas Gutierrez, the Ombudsman.

A highly reliable source said anytime soon the Ombudsman will be filing a graft case with the Sandigan against Benjamin Abalos, the former chairman of the Commission on Election who was exposed to be brokering a $329.5 million national broadband network project for a Chinese firm, ZTE Corp.

Abalos is the subject of two complaints (filed separately by lawyers Ernesto Francisco and Harry Roque) before the Ombudsman in connection with ZTE deal for violation of Anti-Graft and Corrupt Practices Act and Code of Conduct for Government officials. It will be recalled that Abalos offered then NEDA chief Romulo Neri P200 million to endorse the ZTE contract which was allegedly overpriced by P9 billion. The peso equivalent of the Abalos-packaged ZTE deal was P14.8 billion.
