Bolante asks for bail

Former Agriculture Secretary Jocelyn “Joc-Joc” Bolante, who has been in detention in the United States since July 7, has filed for bail, reported lawyer Harry Roque who has filed an opposition to granting bail and asylum to Bolante with the U.S. court.

Roque said his US-based colleague, Maria Carmen Madrid-Crost informed him that Bolante’s motion for bail will be heard on September 13, 2006 at 2PM at the Basement of 500 Jackson, Chicago, Il.

To support their opposition for Bolante’s provisional liberty, Roque said they sent today by courier to Karen Lundgren, Chief Counsel of the Immigration and Customs Enforcement of the Department of Homeland Security, through Mary Carmen Madrid-Crost, an authenticated copy of the Senate report on the fertilizer scam, a copy of the COA report on the scam, a copy of the Senate warrant of arrest issued against him which is still outstanding, and copies of the criminal complaints filed against him by former Solicitor General Francisco Chavez and by Sinag, headed by Dr. Minggita Padilla.

“Ms. Lundgren’s office represents the US Government and acts as oppositor to whatever relief Joc-Joc may ask. Even if Joc-joc’s motion for bail is granted, Ms. Lundgren’s office could still appeal such an Order and consequently, Mr. Bolante would still be detained pending such an appeal,” Roque said.

Bolante has been detained since July 7, 2006 when he attempted to enter the US without a valid tourist/business visa. He is currently in detention together with common criminals at the Kenosha Rehabilitation Center in Wisconsin, about an hour and half from Chicago.

Bolante’s application for bail comes at the same time when his family had just requested “humanitarian” assistance from the Philippine Government to procure what they alleged was “specialized” medical treatment even as he continued to invoke his ‘right to privacy” when it comes to details of of his case.

Roque, who is director of the Institute of International legal Studies at the University of the Philippines Law Center, said they interpret Bolante’s request for humanitarian assistance as a transfer to a better detention facility, a hospital, rather than in the jail where he currently is.

“We reiterate our previous observation that consular assistance in this regard is unnecessary since all he has to do is to consult the physician at the facility, or ask his expensive lawyers to file the appropriate motion with the immigration court,” Roque said.

The Department of Foreign Affairs said they are obliged to assist Bolante because they are required by law to help distressed Filipinos overseas.

Roque said DFA’s collusion with Bolante to keep details behind his apprehension a secret from the Filipino people, “should now end since not only is Mr. Bolante’s continued evasion of the wheels of justice a matter of public interest; the provision of consular services to him now means that public funds are now being spent on him.”

Roque further said, “To date, Joc-joc has insisting on closed door proceedings for his ‘master calendar hearing’ because this is where he will publicly ask for his relief, which could only be for asylum or adjustment of status by reason of an approved immigrant/investors visa.”

He was in charge of hundreds of millions of pesos destined for the common tao who are horribly in greater distressed situation than he would ever find himself to be (except of course, when he’s finally jailed in Muntinlupa!)? Are you being so friggin, effin gullible that this joke-joke of the lowest category is bereft of means, financial and all?

    I don’t believe that baloney for the moment.

    And even if, for the sake of argument, he is distressed, SO EFFING WHAT?

    Use your efforts and the limited means you have at your disposal to go to the aid of those Filipinos around the world who are in much worse distressing situation than this stupid financial hijacker finds himself in.

    Leave him to rot. He should be in hell and not just in a civilized detention center somewhere in California.

  2. Talaga, Anna. The ones who are distressed are the Filipino people, particularly the Filipino farmers, who were robbed by Bolante of P728 million that was supposed to be spent for their farms to improve their lives.

    That P728 million plus more that amounts to more that P3 billion that Bolante controlled were used to thwart the will of the people in the 2004 elections.

    It’s so infuriating that taxpayers money is being used to make life good for Bolante.

    DFA’s Romulo, who by putting this joke’s “distressed” situation on their list of priorities, is frankly being complicit to this joke’s crime.

  4. Wow ha. I don’t know if the Americans would be stupid to accept that, for in other more progressive countries like Japan, for instance, anyone breaking the Immigration rule cannot ask for a bail for the simple reason that the suspect may try to escape and overstay.

    Simpleng logic lang naman. I bet that with all these attempts to get the JocJoc out, magdududa na ang mga kano lalo na iyong walang kinalaman sa mga secret deals supposedly between the bogus president and the US embassy officials in exchange for some concessions!

    Americans adhering to the rule of law should not be carried away and allow themselves to be hoodwinked by the crooks by all means.

  6. Sorry to post this here but this is relevant to the case of the Fatso versus those who have criticized him. People who have been getting libel suits from this abusive Fat Guy, who does not want to be called such, may cite this example of a ruling of a US court against the suppression of freedom of expression by a 13-year-old versus the mad man at the White House:

    Well, unfortunately, in the Philippines, the courts apparently are now being controlled even by the Fatso, who has no official title but as FG (Fat Guy?), and therefore by law has no right to be putting his overweight on everybody, including the policemen and judges of the court being obligated to issue warrants of arrest directly from Malacanang!!!

    In more progressive countries, it is actually called “abuse of power” that is not tolerated.

  7. Sulat lang kayo ng comments at alam ninyo, dear bloggers. Apparently, the crooks are monitoring this blog at nagugulo na sila ng kaiisip kung ano ang gagawin kay Bolate. First, kunyari walang notification sa embassy kasi akala kayang-kaya na ng abogado niya ang INS. Walang nagawa!

    Next political asylum daw, pero mukhang hindi umubra kasi alam naman ng lahat na malakas siya kay Pandak at kay Fatso! Mahina ang katwiran na dahil sa NPA. E nagkamali si Palparan, Ermita, Esperon, et al na sinabing nalipol na nila ang NPA, kaya tuloy hindi pumasa ang sinabi ng lawyer ni Bolate. Turned down tuloy ang appeal niya for political asylum!     BTW, Ellen, I am told by an American lawyer in our church that CA lawyers cannot practice outside of CA unless he has a license to practice likewise in other states like this lawyer of Bolate acting as his counsel even when he is transfered to Wisconsin.

    Kaya walang nagawa kundi kunyari asking for legal assistance siya ngayon at kailangang i-notify ang embassy na sa kabobohan naman noong pinagsabihan nakalimutan na may Vienna Convention na nagsasaad na dapat na ipaalam ang mga kaso ng dayuhan sa kanilang mga embahada at consulado maliban na lamang kung ayaw nila at hindi dahil sa proviso ng Migrant Act na para lamang sa mga OFW. Gago nabisto tuloy ang kabulastugan! Ngayon naman kunyari kailangang magpiyansa na paluluwatan ng gobyerno through DFA! Ang sabihin nila siguro nagdedemand ng pera si Bolate at idinadaan kuno ngayon sa piyansa.

    Calling, calling Senator Magsaysay, Senator Villar, Senator Pimental, et al, sumulat na kayo sa mga counterparts ninyo sa Tate para i-facilitate ang pagpapauwi kay Bolante that is easier said than done that this guy is still in the custody of the INS, and his case not submitted as a federal criminal case on the ground that he has actually not committed a crime in the US except that he was not allowed to enter because of a cancelled visa that the airline that put him on the plane to the USA should have been informed beforehand so they will not allow him to board for I understand that any airline who allows anyone without a proper permit to enter any foreign country can be penalized for such.

    Otherwise, the airline can file litigation to regain the cost of penalty from the erring passenger who has concealed such information deliberately and otherwise. I have heard of this kind of cases in fact in Japan but none involving a kleptocrat from another country that is why Japan is not a favorite destination for wannabe political asylum seekers. They know that the Japanese are not open to breaking the rules but will insist on abiding by the rule even for humanitarian reason.

    I know these rules as a matter of fact because I have worked in a travel agency, and now owns one myself.

    Won’t be commenting for the next 4 or 5 days or so coz am driving to the City of Lights (3 hours and a half by car) on a blitzkrieg sojourn to sort out my son’s schooling and habitat prior to the opening of school which is on 18th of Sept, if I remember rightly.

    My son is moving flats and will help organize the transfer, and I probably would have to do lots of menial jobs like his laundry, clean up the mess in the old studio, sort out his last year’s “thrash”, paint the walls of the new flat, buy his books, clothes, shoes, etc, etc and won’t have the material time to even read the blogs.

    Naknampuchang buhay talaga ng mga nanay! Kung hindi taxi driver ng mga bata, kusinera o tagalinis ng bahay nila ang labas!

    Hantayin natin magsalita ang isa pang loose cannon ng DFA na si Conejos kung ano na naman ang kanyang sasabihin.

    I think Atty. Roque may have made a wrong assumption about the bail procedure in the U.S. Court system when he said that Mr. Bolante for bail is granted and is appealed by the oppositor he will remain in custody until the appeal is resolved. My understanding is he’ll be out of custody until the bail is denied on appeal. I’m not so sure about this, but I believe this is so, because the U.S. and Canada bail procedures are about the same and comparing both I assume the above scenario. This needs to be clarified.

    There are no set of regulations and policies that can’t be changed, it has being done ever since Gloria stole Malacanang. The real problem is that many of us still can’t get use to not accepting Super Maid Gloria’s ways of doing things. The sooner that we accept the reality of Gloria at power, it will be less painful. Surrender the country to Gloria and throw away the constitution? Get rid of Congress? They’re just causing the tax payers money and for what. It’s a no brainer, and we can all agree that Gloria is winning all the battles.     Super Maid Gloria will stop at nothing, she got the momemtum at her side, since she got all the resources at her own very disposal. Bogus Gloria has been manipulating the institution at every chances arises and as we all know Gloria has been succesful for over five years now. Obviously, DFA is another corrupted tool being used by Gloria like other department under her payroll. DFA set of standard guidelines are only just pieces of papers that meant nothing. Of course, only what is most convenience to the need of the Arroyos what’s most important and others are just incidental, they’re just in the way of bogus Gloria. Afterall, look at Bolate’s case, here’s an obvious thief that stole/squanderd billion of tax payers pesos and the Phil. govt couldn’t get their fingers on him. How about Hello Garci, Chavit Singson, et al. Ain’t laughable!

    Philippines as a whole has no credibility and the US govt is laughing at us. Case in point, Bolate a Pilipino citizen of a sovereign country the Philippines being held in some foreign land, the USA and yet we can’t even get the truths out of the USA or we can’t even get a cooperation to turn over Bolate to Philippines authority. What a country Philippines????

    I guess Bolate still good for a just talking point to relieve many of us the frustration.

I mean the Philippines can make demand to the USA, but we are not doing it. Simple reason, it’s not to the best interest of Super Maid Gloria.     By the way, I just finished watching a french movie on http://www.TV5 . It had English subtitles. But the title didn;t have. It’s “Le frangin de Americaine”. I looked up in my French-English dictionary the meaning of “frangin.” I can’t find it. What does it mean?

    I just found out that the US government will be contradicting its own rule when this Bolate is granted his wishes to escape prosecution in the Philippines, for the truth is there has been a new rule regarding inadmissible persons and removable (deportable) persons since 1997 and the asylum thing in fact does not apply since in the case of Bolate he can simply be deported since in the first place he has not been admitted into the USA when he was detained, and the detention is more likely because of some petition done by his lawyer, and what the lawyer must be doing now is simply to appeal with no guarantee that Bolate will be free and allowed to stay in America since he was not in principle on US soil but on international transitional ground.

    I’ll email you the ruling. I will leave it to you to post the information.

    in the real world of democracies, life can be so frustrating at times. the same is true with the principle of due process enshrined in almost every constitution of democratic states as its hallmark of a civilized society. it cut both ways and can be so outrageously frustrating. the due process is an adequate protection to the innocent and yet it can be abused by the crook or the guilty. that is so far the best formula of constitutional guarantee of our personal right adopted in any democratic justice system. sometimes it could give us the impression that the “due process clause” of the constitution makes the wheels of justice grinds so exceedingly slow. in the meantime, there is no other substitute for that “due process” as we know it then and now. remove that in our constitutional book and all of us will be damned forever.

    just as we often say, “ang pikon talo”. in our justice system, just like in the US where we copy almost everything, court battle is principally a battle of wits, or a battle of brains if you will. the US, for all its pretensions of being a superior country inhabited by superior white race, cannot craft a near-perfect law. and unfortunately or fortunately, which side of the controversy you find yourself standing, its immigration law may also be peppered with so much imperfections many practicing immigration lawyers find it very handy and convenient to advance the cause of their high-paying clients.

    I am no US fan especially when it comes to US foreign policy that is only for the benefit of America no matter how much they say it is for sake of mankind.

    I used to have no prejudice against the blacks in the US, but after my sad experience with my black tenants in SFO, I practice some reservation especially when it comes to articles on the inequality against the blacks.

    What many do not know or forget is that they are in fact a well-privileged class in the USA since the 60s and especially now with US politicians being wiser to use them to get their votes because their number in fact is more than the number of white people now in the USA. They actually dominate the number of those on welfare made available for their use even for evil or good.

    All my black tenants for example are subsidized by the SF Housing Authority that pays the bulk of their rent, pero ang mga walanghiya ayaw magbayad ng share nila! And let’s face it, they would not even try to change the impression that where they live, prices of real estates get depressingly low because of the negative impressions that they themselves are to blame.

    I have this property in downtown SFO in fact near the Japan Town. It’s at the corner of Sutter St. with one facing the housing for blacks and the other side along the Pacific Heights. It was a pretty good neighborhood until the blacks from Oakland started occupying places that used to be dominated by other nationals, particularly the Chinese and the Japanese, who have opted to transfer to places near the Silicone Valley. Nasira ang plano ko. Lugi ako doon sa side na harap ng mga itim! Something is wrong with these people, too, you know! Maybe, it was an after-effect of centuries of slavery just like the kind of mentality of Filipinos because of long years of being under foreign rule.

    Now, as to the justice system in America, let’s say that at least it is better than that of the Philippines!

    As a travel agent (I own a travel agency as a matter of fact), I know these simple rules. We are told of these rules or the airline is penalized when they let anyone without proper permits to get on board. On the other hand, the US has the discretion to cancel any visas given to non-Americans and non-residents of the USA, but in the case of green-card holders, they are allowed to appeal within the USA as provided by the law. This I know because I was a green-card holder myself.

    When I was one, I never go through the line for tourist and non-resident visitors. There was the special line that makes it easier to enter the US as a returnee considering the fact that as a green-card holder, you get all the rights and privileges of a US citizen except the right to vote for national and state leaders. I remember that in some areas green card holders are allowed to choose local officials and the right to participate in court proceedings as a juror or jury especially when you pay your taxes. Even now, I get invitation to join as a jury which I decline because I don’t live in the US. As a Japanese passport holder, I can enter the US without a visa because of a visa waiver. Reciprocally, both Japan and the USA give permits to citizens of each country to stay for at least 6 months without a visa. The same is true with most countries in Europe, and this is one reason in fact why many Filipino women married to Japanese opt to get Japanese citizenship that has become rather difficult to get lately.

    With this Joc-Joc kabastusan, you can bet your bottom dollar that entry procedures for Filipinos or Philippine-passport holders will be more difficult.

    I would recommend writing to the State Department, representatives of California and Wisconsin, and the Homeland Security Department that is now in charge of the INS, denounce this attempt by the bogus government to ignore the rule of law, and demand for the immediate return of this crook back to the Philippines.

    Senator Magsaysay, et al should do this as a matter of fact. He may not be known to officials there, but his father was a famous man, and he could ride on his name!

    We are planning in fact to ask Filipinos in Japan to sign a petition regarding this. If you have a ready one there, we might as well use it. Otherwise, we will use the one prepared by a group of Filipinos in New York. Ours is a true people’s initiative. No one dictates on us. We dictate on the officials here and there as a matter of fact.

    Hindi lahat ng mga nakakatanggap ng jury invitation sa US mga US citizens o green card holders. Pati mga non-immigrants. Pinagbasehan lang iyan sa census at random ang pagpili. May isang card kang matatanggap at doon ay isusulat mo kung authorized ka maging juror. Kung hindi ibabalik mo sa kanila na nakalagay na “non-citizen”.     taktika ni Ping Lacson yan na “makapasok” ng Maynila, dahil sa napipintong paglilipat ng tipo o porma ng gobyerno sa parliyamento. Hindi kasi sya makakaporma sa Cavite dahil alam nyang malakas makinarya duon.
    Ganyan din ang ginawa ni JPE noong 1992, sa pag-aakala kasi na magiging parliament tayo ng 1990’s. At isapa, nahuhuli sya sa survey ng mga Senatoriables.

    Kaya nga ang isa sa mga nasabi ko noon sa mga supporter ni Ping Lacson noong 2004 Presidential election ay hwag syang iboto. Nasabi ko ito noon sa isang egroup na nasalihan ko.
    Isa kasi sa pangako noon ni Ping Lacson ay magbibitiw sya sa kanyang pwesto kung sya ay hindi makakaabot ng 3 milyong boto.

    Hindi maikakaila na isa si Ping Lacson sa mga naimpluwensyahan ni Erap sa panawagan ng pag-a-abolish ng pork barrel sa SONA ng huli noong 1998.

Maliban sa kaunting tsismis na human rights violation, maganda naman ang nilitary records ni Lacson. Humanga ang buong Tsinoy Community nang nailigtas niya ang anak ni Gokongwei. Buo at walang kulang ang ransom money na ibinalik ni Lacson kay Gokongwei. Tumanggi din si Lacson sa reward money ni Gokongwei. Ganyan din ang ginawa niya sa Cebu nang na-assign siya doon. Kaya mahal siya ng mga Tsinoy at negosyante. Hindi ko na babanggitin ang performance niya noong PNP Chief siya ni Erap. Takot lahat ang Kapulisan. Kung susundin ang salitang “choosing between two or among the evils’, kay Lacson na ako. Tutoo hindi niya sinunod ang kanyang pangako na hindi papasok sa pulitika. Nasabi pa nga niyang galit siya sa mga pulitiko. Talagang ganyan…siguro naisip niya sa huli na kailangan siya sa opposition at ng bayan. Ang maling ginawa niya ay nag hindi pagpayag na maging bise ni FPJ. Kung pumayag siya noon, di siya na ang Pangulo natin ngayon.

    tataka ng ako y hindi si Lacson ang mataas nung election samantalang halos ng makaencounter ko Lacson ang bukam-bibig…jeepney driver, taxi driver, mga nasa palengke, most middle-class yuppies i heard were saying LAcson…ang ayaw ka kanya ay mga taga customs hehehe…eto pa ang ang kwneto ng kumare ko over the wkend..talagang hakot to the max si fatso ngayon sa customs…10% commission ea container ang mandatory quota ng bawat inspector ngayon…imagine kung hundi by % ay 160k per container, smaantalang 2000 containers per day ang transaction sa pier…kayo na ang mag-compute. pagka may tumawad at humirit, hi-jack ang labas or kaya ay papainan ng kung ano-ano contraband kahit legal ang laman ng container tapos tatawag ng media, photo-ops ang labas…someone even told me yung minsang mga oplan na ni-re-raid na drug den daw ay mga galamay din ng mga hoodlums na yan. traydorin nila pagka alam nilang malaki na ang kita at hindi sila napapartehan ng proper ratio..e pare-pareho silang gahaman kasi…

    hahaha…sabi nga ng mga kausap ko noon, hindi natin kailangan ng pandak, kailangan natin mamamatay tao at marunong ma-nalvage…u see, in a way, i told this b4 that ang kailangan sa pinoy ay yung may kamay na bakal na marunong mag-lead..with Lacson, whether he can do that remains to be seen…the KBB..payag pa nga ako na bayaran yan para lang…hmmmm..i will keep the rest to myself..i thnk ms Ellen prefers we dont mention the ultimate!!!

    the KBB has a renegade group as wat i was told..tru or not i have no idea..the renegade group of course cant be controlled…i jst saw in the MB last week re this stupid Puno of DILG(?) na thinking of legalizing ang pagkakaroon ng kanya-kanyang small “protection group” to private individuals..naku e parang sinabi na ok na ok ang private army…talagang ginagawa nilang engot ang mga simpleng pinoy…

  78. Ystakei, I find it hard to believe that you are getting requests to perform jury-duty (US-A) when you have never been an American citizen AND do not have an American address. Kind of far-fetched, if you tell me.
