CHR to probe violent Iloilo capitol takeover;‘Cops acted like they were in war zone’

The Commission on Human Rights (CHR) yesterday ordered an investigation into the police takeover of the Iloilo provincial capitol Wednesday for possible human rights violations.

CHR chair Purificacion Quisumbing said she issued the order after seeing on TV a “very shocking view” of the incident.

Some 200 members of Western Visayas police command, in full battle gear and carrying high-powered firearms, forcibly entered the capitol Wednesday afternoon to serve a dismissal order on Tupas.

They were seen manhandling some of Tupas’ supporters, including his children, and pointing their firearms at them. TV footage also showed a policeman smashing with a sledge hammer the rear glass panels of the building.

Local reporters said they were also harassed by the policemen who shoved them out of the premises.

The operation took place before the 48-hour deadline set by the interior department for Tupas to vacate his post lapsed. The deadline would have lapsed Thursday.

Tupas on Wednesday obtained a temporary restraining order against the Ombudsman order dismissing him from office for alleged involvement in graft.

Tupas’ son, provincial board member Niel “Jun-Jun” Tupas Jr., said they were kicked, shoved aside and threatened with M16 rifles by the policemen in full battle gear.

Tupas said his lawyers are preparing criminal and civil cases against the PNP and the Department of Interior and Local Government for the assault which hurt dozens of people, including his four children.

“They should pay for it,” he said.

Senators denounced what they called the “brutal” dispersal of Tupas’ supporters.

Sen. Franklin Drilon said the Senate committee on public order and illegal drugs which he chairs, would investigate the “unnecessary raid and excessive use of force” by the PNP.

Quisumbing said there was “unnecessary use of long firearms” by the police that posed threats to the life and security of the persons gathered at the capitol.

Quisumbing said she was “concerned about the behavior of authorities.”

She said government officials must act in accordance with their legal obligation to protect citizens and to make sure that due process is followed and that security of persons is respected.

Conflict area

The CHR investigation can start even without a formal complaint filed by Tupas’ camp. “The CHR has authority to conduct investigations on cases of violations of civil and political rights,” she said.

Quisumbing also said she has instructed CHR regional director Dave Bermudo to conduct an “independent investigation.”

Quisumbing said the police during the incident were “acting like soldiers in a conflict area.”

Tupas, in a radio interview, accused Gonzalez of being behind the order to assault the capitol.

He said Chief Supt. Wilfredo Dulay, Western Visayas regional police head, refused to grant his request for the maintenance of the status while a copy of the TRO, issued by the Court Appeals, was being secured.

“I think he (Dulay) was following the instruction of the acting secretary of justice. It’s the department of injustice … Probably they had a hint a TRO would be issued so they wanted to install an impostor governor So they wanted to push me out of office. Sabi ko, no, it could not be,” he said.

Political persecution

He said his political rivals, including Augusto Syjuco, head of the Technical Education and Skills Development Authority, might also have something to do with it.

“So it is a political persecution, political harassment … Acting Secretary Gonzalez, he wants to be king of this city, not only king of the city but of this province. As long as I am governor of Iloilo he cannot say he is the king of the province,” he said.

Tupas said the policemen not only destroyed glass windows and panels to enter the capitol, but also aimed high-powered firearms at his children and supporters.

Drilon, president of the Liberal Party which to which Tupas belongs, said TV footage showing policemen in full battle gear, armed with high-powered rifles, manhandling unarmed civilians inside the Iloilo capitol building were shown in international TV “giving the impression that the Philippines is under an undeclared state of martial law.”

“The use of excessive force against unarmed civilians, including women, is completely unjustified. This fiasco at the Iloilo capital has given the Arroyo government another black-eye before the international community,” said Drilon, who is in Geneva presiding over a regular meeting of the Inter-Parliamentary Union Human Rights Committee.

Minority leader Aquilino Pimentel Jr. said: “The brutal dispersal by heavily armed police officers of unarmed Ilonggos who were merely protesting the high-handed ouster of Governor Tupas is highly deplorable.”

Abusive use of force

Pimentel said Wednesday’s scenario was reminiscent of “tactics used at Beijing Tiananmen Square and Myanmar against peaceful demonstrators.”

Sen. Ralph Recto said: “The firepower of 200 hundred cops to serve an order of dismissal is an abusive use of force.”

“A man who submitted himself to the public’s verdict in an election involving millions of voters seems more than just a reasonable man. It did not do any good that his family was subjected to such intimidation,” Recto said.

“The action-packed service of the order of dismissal is now a melodrama with the governor gaining public sympathy,” he added.

Recto said “it may be a very thin line that divides reasonable force from excessive force, but cops, and certainly their chiefs, ought to know it.”

Sen. Edgardo Angara said Tupas’ dismissal was a grave abuse of the judicial process for partisan political interests.

He said the siege at the Iloilo capitol and the breaking down of glasses were “lawless (acts) on the part of the law enforcement officers.”

“The process of decimating, liquidating practically the whole elected official of a city like Pasay right in the middle of Metropolitan Manila is to me a barbaric process. It’s a grave abuse of the judicial process,” he said.

Desperate Move

“What’s happening is that they’re trying to eliminate through judicial process, through the abuse of legal process, potential political opponents,” Angara added.

LP leaders condemned the Ombudsman’s order against Tupas, saying it was a desperate move on the part of the Arroyo administration particularly with the coming elections.

Former LP president Florencio “Butch” Abad said Malacañang was trying to eliminate some of its strongest opponents like Tupas, who has the support of his province with no serious contenders for the governorship.

Drilon said several Malacañang “political operators” have been trying to convince Tupas in the past months to abandon him and the LP and join the Arroyo administration. However, the Iloilo governor has remained steadfast with his political convictions, he said.

Drilon said Malacañang was applying “unlawful and shameless political bullying” tactics against Tupas after realizing that the administration-backed Lakas and Kampi political parties could not find a legitimate candidate who can defeat Tupas as Iloilo governor in the coming elections.

Rights Violation

Makati City Mayor Jejomar Binay, who flew to Iloilo to show support to his “kumpadre,” said there was clear violation of human rights when police assaulted the provincial capitol.

“I also ask the PNP to review the rules on engagement to prevent a similar incident here in Iloilo…Yung ibang tao dito ay kinulata pa nila,” Binay said.

Binay said that the assault team should have instead waited for the temporary restraining order before they barged in the capitol.

Iloilo Rep. Rolex Suplico, Tupas’ nephew, called for the immediate relief and transfer of the raiding policemen and a subsequent investigation.

“I condemn in the strongest possible terms the manner by which the PNP forcibly overran the Iloilo provincial capitol,” he said.

“I have never seen a blitzkrieg takeover of a government facility as what happened in Iloilo yesterday (Wednesday), not even in the Cory era when officers-in-charge were installed nationwide. It was simply an overkill,” he added.

House minority leader Francis Escudero, secretary general of the United Opposition, said the Ombudsman should explain why “the wheels of justice grind faster for the opposition members than the allies of the administration.”

“I condemn any and all forms of violence inflicted by the state and government on pour people,” he said.

Party-list Rep. Joel Villanueva of the Citizens Battle Against corruption (Cibac) said the administration’s move is a “show of panic.”

“It’s payback time for the administration. It’s a show of panic and an admission that it lacks confidence that their men will make any good showing in the May polls so they want to ensure all posts are covered for them,” he said.

I’m sorry, but…

Interior Secretary Ronaldo V. Puno apologized for what happened during the entry of the policemen into the capitol building.

“We’re sorry if people were hurt… There were some disturbing footages during the operation but it’s normal in clearing operations and that there will always be pushing and shoving,” Puno said.

Puno said there were specific guidelines issued by Dulay to the Regional Mobile Group and other PNP units tasked to carry out the clearing operations at the capitol.

“The PNP will take the necessary action against those who may have violated police operational procedures in carrying out their orders,” he added.

He said the move by Tupas’ men to padlock and barricade the provincial capitol building, along with reports of the presence of firearms inside the capitol and of armed provincial jail guards who were taking orders from the governor, were taken into account when the PNP made the decision to clear the building.

Puno has advised local chief executives to fully comply with the orders issued by competent authorities, such as the Ombudsman, on their suspensions or dismissals instead of defying these directives and resorting to disruptive acts bordering on sedition.

“If you look at the definition of sedition, these are seditious acts. Whenever we see a takeover of local facilities the refusal to heed orders is a clear textbook definition of sedition,” Puno said. – With JP Lopez, Raymond Africa, Wendell Vigilia, Regina Bengco, and Gilbert Bayoran

This is one government where members lose their heads so easily, they panic, they say one thing and do another, they have absolutely no notion of government as in TO GOVERN; they don’t have an iota of notion of what right governance is all about. They resort to legalities because they have no notion of what is right from wrong.

    From one at the top who believes God has put her as ruler of the Enchanted Kingdom down to the pencil pusher in the AFP…they are pathetic and despicable!

    When I said that the AFP leadership are a bunch of apes, I now want to modify that: guys in government, Puno included as well as the PNP and the AFP are a bunch of apes. Good at mimicking, immitating but not really at thinking.

    Not only the violation of Human Rights, but also the violation of Constitutional Rights. Everyone is presumed innocent and can not be denied the rights of an innocent person, until convicted by a competent court of charges against him or her. That is a Right. And no law, not even the make-believe power vested on the office of an Obbudsman, whose duties is that of the prosecutor and investigator of complaints, can violate the Spirit and Provision of the Constituttion. This another perversion of the Constitution.

    Regardless of the guilt or innocence of these political leaders, the governor of Iloilo (my province) or any other jurisdiction, they are entitled to Due Process, before they can be suspended or dismissed from their elected office, just like the President Herself, who is so scared to face her Impeachment Proceedings and Trial. Chicken…

    To my mind, the passion & devotion the people in the provinces have towards their leaders are stronger than those in Metro Manila. If it means that they will die for their leader, they will. And should the worse happen-God forbid-what would the, if I may borrow the words of Anna de Brux, “Damn Idiot” say ? As of late, the “Damn Idiot” Puno says what they did was correct in Iloilo.

    GLORIA is now being boxed in because it is pay-back time. For all the times that the IDIOTS stood by her during the “Hello..Garci” scandal, to the Fertilizer Scam, to the ditching of the 2 Impeachments-to name a few-now, GLORIA HAS to pay back. Look at what is happening in Pampangga-its the Lapids versus the Pinedas. What I hear is that GLORIA would prefer to support the Lapids.

    Remember Graciano Lopez-Jaena of Jaro, Iloilo? About time that someone of his calibre should lead the revolution against the Great Switik there. People of Iloilo, arise!

    Mayors of cities and towns not willing to be under the dictate of the Great Switik should now bond together and demand for the removal of this creep and her lackeys before she succeeds in replacing those who oppose her with all her puppies especially in the military that has now control of the police that should not have been the case.

    I wonder why the lawmakers who framed the Constitution of 1987 and revised the laws of the land after 1986 failed to see this happening. It’s disgusting!

Gloria Arroyo and Acting DILG chief Ronaldo Puno are held responsible for Gestapo-like assault. Iloilo Governor Tupas has a true mandate of the people while usurper Gloria Arroyo has a fake mandate.

    You might be surprised to know that Manila Mayor Lito Atienza has condemned the way Malacanang’s men enforced the suspension order on certain officials like Gov. Tupas. Sa tinagal-tagal, ngayon lang naging critical si Atienza sa Malacanang. Of course if you critize Malacanang, you also criticize Arroyo. Why is Atienza doing this now? Political fever is brewing. Baka may ibang manok ang Malacanang sa Manila na hindi nagustuhan ni Atienza. O baka naman naaamoy na niya ang pagbagsak ni Arroyo. In fairness to Atienza, he stayed with President Erap until his last day in Malacanang. Medyo may kaunting loyalty din ang taong ito.

Ang palusot naman ng PNP sa Iloilo, they said they were forced to use force because of reported presence of NPAs inside the Capitol building. Panginoon ko po, NPA na naman ang ginamit na dahilan.

    What unfolded in Iloilo on our television screens was a copy-cat of a ‘B’ rated Action Movie. They’re training consist of watching too many Action Movies. No other civilized country over reacts in this way, who are they really, can anybody name these men.
    Maybe they are the same hooded men on motorcycles shooting and killing innocent people tagged as destibilisers by this administration. Someone must be able to name the men in this team of thugs. Its important we know who they are.
    This evil woman has lost the will from the people, the respect from the people & International leaders of any standing. She is doomed and knows it, but is prepared to fight dirty, using the peoples money, because she belongs in the gutter. What a legacy this evel woman has to leave her country. God help us all.

  34. The result of this raiding team is similar to the party game, pass the parcel. When Puno DILG is asked who’s responsible he says they’re acting under instructions of the Ombudsman. Hello! its a police function therefore the buck stops with DILG and that you Mr Puno.
    But the question I ask, where they PNP? they were acting like a second rate military from what I saw on television. Who was at the scene directing this event, do we know who that was his name& rank, if not why not.

    Whoa! If this was the only “sin” committed by Tupaz et al, it should not warrant 200 force to bodily take them out of the municipal hall.

    The woman Pidal in Malacanang wasn’t even elected, so she’s not entitled to any appropriation. Acting Ombudsman Maldita G should run fast after her, not those local officials voted by the people whose sins are negligible compare to the excesses of the bansot!

    Tupaz et al deserve a punishment if they committed any wrongdoing, but this action of the powers that be was overkill. Overtrained by the US, heheh!

    Last time I saw Sir Raul O. Gonzales on TV, he was mumbling something about Tupas not getting his lollipop. I heard him say, though, that he DID NOT ORDER THE COPS to point their guns at people. Does that mean that he DID ORDER the cops to raid the capitol?

    He added that Tupas has armed supporters from the NPA and that they are taken to the capitol at night by truckloads! He said he also instructed Dulay to conduct checkpoints en route to Iloilo. This old fart has again used red-scare tactics against his opponents in Iloilo and those of his queen in all islands of the country. Did I get it right he is now ordering policemen around?

    It was also his stupid opinion that is now used by the ombudsbitch and DILG’s Puno for this mad rush to dismiss or suspend admin-unfriendly candidates for the elections. Trinidad is hands-down sure winner in Pasay, ditto for his councilors. The ombudsbitch, like Vic said, is wielding its make-believe power to thwart any possibility of total wipeout in any LGU as may happen in Pasay or Iloilo polls. They wiped out the whole opposition slate in Pasay, even disqualifying them from future elections. What is there that is more brazen?

    Never mind the law that prevents suspension during the election period. Gonzales says it doesn’t apply to graft cases, that is the law. He is the law.

    Never mind that the ombudsbitch has judged the cases without filing them in court, she has even passed the sentence of disqualification. Gonzales says the law is silent on this. That is the law. He is the law.

    Namfootah, paanong hindi masisira ang ulo nitong si Tanda, e ang laging hinahanap yung loopholes, yung hindi specified, yung inexistent. Sa madaling salita, naghahanap ng wala.

    Kundi ba naman imbisil!

    TT, talagang nakakagigil yang si siRaulo gonzales, kita mo naman ang katusuhan, he’s quick to twist what happened saying it was a “moro-moro” lang on the part of the Iloilo governor and the regional/provincial director of the PNP. Kita mo ang kawalanghiyaan ng hayop na matandang iyan, kasalanan pa ngayon ng mga biktima ang pangyayari dahil palabas lang pala nila iyon? Ang sarap palakulin ang ulo nitong si siRaulo gonzales at ng makita kung anong klase ang utak na meron siya, masyadong demonyo ang pag-iisip.

    The Senate will investigate whether police commandos used excessive force when they stormed the Iloilo provincial capitol on Wednesday to drive out Gov. Niel Tupas, who had been dismissed on orders of the Office of the Ombudsman.
    In a statement, Sen. Franklin Drilon said television footage showed heavily armed police commandos in combat gear manhandling unarmed civilians inside the capitol.
    Ellen: I wouldn’t be surprised that this team of 200 men have been trained for the purpose of showing force simply because the AFP cannot be completely relied upon by this administration, but it would take more than a team of 200 to control a very large hostile crowd.
    This is the reason this evil woman sets up road blocks to stop crowds coming into Manila. She is sooo.. afraid of large numbers of people because she knows its hard to control them, certainly not with only 200 men. Why not rely on her AFP, simply put she can’t be sure how many are loyal to her. But sooner than later, it will happen as sure as night follows day, they will turn against her.

The force used was not only Excessive, but not supposed to happen in a country who pride herself to be Democratic under the Constitution.     The Commission on Human Rights (CHR) on Friday rejected the proposal of the Department of the Interior and Local Government (DILG) to conduct a joint probe into the police assault on the Iloilo provincial capitol earlier this week.

    CHR Chairwoman Purificacion Quisumbing told ANC’s Dateline Phils. that the commission would be in a better position to determine if there had been human rights violations during the assault if it conducted its own independent investigation.

    “We define our independent investigation as one where we ourselves have to examine the facts and the circumstances,” she said.
