Esperon assails Melo, Alston credibility

Armed Forces chief Gen. Hermogenes Esperon Jr. yesterday assailed the credibility of separate investigations conducted by a United Nations special rapporteur and the Melo Commission that blamed the military for the rash of extrajudicial killings.

Esperon sought to turn the tables on UN special rapporteur Philip Alston who said Wednesday the military “remains in a state of almost total denial” over the killings which have been “convincingly attributed to them.”

“I believe that Mr. Alston might be in a state of denial himself. He probably refuses to believe that the Communist Party of the Philippines and the New People’s Army could perpetrate such killings,” said Esperon.

On the Melo Commission, whose report was kept by the Palace from the public for weeks until yesterday, Esperon said there were loopholes in the panel’s investigation.

The panel, headed by retired Supreme Court justice Melo, said “elements in the military” were behind the killing of some of the hundreds of left-wing activists murdered in unsolved shootings.

“To maintain otherwise would be closing one’s eyes to reality,” the Melo report said.

The report also said the military has not produced evidence to prove its claim that the killings were part of the Left’s ongoing purge.

The military presented to both the Melo Commission and Alton’s team a seized rebel document titled “Paglilinis sa Bushfire sa mga nakapasok na ahente ng kaaway.”

Justice Secretary Raul Gonzalez said the people should stop making a big deal out of the report of Alston, whom he likened to a glorified helper of the UN or “muchacho.”

“What I’m complaining (about) is the headline of our newspapers. Why do you say that Alston is the UN? Headline ninyo yan. Alston is not the UN nor one bishop is the CBCP. Why would you attribute the UN here? We are magnifying something coming from somebody who is nothing. He is just a rapporteur sent here but he is not the UN. His report may not even reach the UN General Assembly. He’s just a muchacho there,” he said.

“He’s just a small fry, but we’re making him so big. We’re making a mountain out of a molehill. Maybe he has not seen such kind of reception in his life, not even in Australia, except here,” he added.

Alston and his group left Wednesday after a 10-day investigation.

‘WHAT HAPPENED TO DOCUMENTS?’

Esperon asked why the Melo Commission concluded right from the start that the victims were mostly activists.

“My question now is what happened to our submission of a list of 1,227 liquidations perpetrated by the New People’s Army?” he asked.

“Were these victims categorized as members of activist organizations? The Melo Commission also concluded that the New People’s Army is not into purging its own ranks,” he said.

“May we ask what happened to the documents that we submitted which mentioned Oplan Bushfire, a document that was captured on May 22, 2006 in Tagkawayan, Quezon, which detailed the plans of the New People’s Army as directed by their central committee to eliminate their enemies within the ranks so that these will be blamed on government, on the military and on the government?” Esperon said.

Esperon said during Alston’s visit to Camp Aguinaldo last week, the military also gave the UN special rapporteur a list of 1,227 civilians, military and policemen killed communist rebels from 2000 to 2006.

“He said we were on denial, denial stage. I deny that. I think he was also denying things himself like when you present 1,227 liquidations, he said those are not credible because the NPA did not own up to them, or the human rights organizations did not document them so they are not credible,” he said.

NPA MORE CREDIBLE?

The human rights right group Karapatan said it has recorded over 800 victims of the summary executions involving members of left-leaning organizations and mediamen since President Arroyo assumed the presidency in 2001 but the PNP’s Task Force Usig has recorded only 116 deaths.

“What is he telling us? That if it is owned up by the NPA, it’s credible? Is he saying that the NPA is more credible than we or the Armed Forces,” Esperon said.

Esperon said he already had the feeling that Alston was “not so enthusiastic” when furnished the list of NPA liquidations.

“He said in his report that the 1,227 liquidations cannot be given credence because the New People’s Army did not claim responsibility for them,” he said.

He said the communist party has owned responsibility for two of the high-profile killings in the list – that of former communist party leaders Romulo Kintanar and Arturo Tabara who were slain in January 2003 and September 2004, respectively.

“Mr. Alston also said that the 1,227 liquidations could not be acceptable or credible because human rights organizations have not documented such cases. Do we expect or should we expect them to document this but we know that they have documented 783 of them, but none of which included these liquidations,” said Esperon.

EXPERTISE ON INSURGENCY

Alston suggested that the military review its strategy in the fight against the communists which pulled out from peace negotiations with government in 2004.

“Mr. Alston also questioned our counter-insurgency strategies. I do not know how familiar he is with other insurgencies but as he admits he has been here for the first time and he has stayed here for the last 10 days,” Esperon said.

Esperon said the military has been fighting the communist rebels for 39 years “and I have been fighting it for the last 33 years.”

He said, “I will not even claim expertise on the matter.”

Asked if he feels the investigation conducted by the group of Alston was biased, Esperon said: “It’s up to you to conclude but then I like the dynamics that is going on because all the more we are getting more conscious of human rights and the strengthening of the observance of human rights.”

On whether the military was insulted by the findings of Alston, Esperon said: “You said that. Is that a question? I will not answer that. Is that true? Maybe yes. You stayed here for 10 days and then you will talk about review of the (military’s counter-insurgency) strategy.”

Esperon reminded Alston that the military has been periodically reviewing its anti-insurgency campaign.

“I don’t know how extensive is the experience of Mr. Alston in insurgency but if we will have a quiz, I will fight him when it’s insurgency,” he said.

Esperon asked the Melo Commission why it did not take the statements of Karapatan.

“If indeed they were the complainant, then why did they not appear before the Melo Commission?” he asked.

KARAPATAN RAPPED

Esperon said Karapatan, which snubbed invitations by the commission, also prevented families of victims from appearing before the Melo Commission to shed light on the killings.

Esperon presented during the press briefing Renato Bugtong and Edwin Mascariñas who were among those included by Karapatan in its list of victims of political killings.

Esperon thanked the two for coming out in the open to disprove allegations that they were killed by the military.

    I mean, really, between Assperon, Prof. Alston & the Melo Report, who has the credibility ? Does Assperon actually even think that his voice will be heard by the international community ? If a mere pygmy like Gloria is not really taken seriously, much less an Assperon (& those associated w/ Gloria).

    Sooner than later, they will feel the reactions of other countries & feel the isolation.

    Assperon’s voice was heard, however, there was no cheering or clapping from the audience. Assperon was talking in an empty theater. That was what his presscon was all about.

    Something must have activated the Pigtails of both Asperon and Gonzales, because even before U.N. Rapporteur Alston submitted his report to the U.N. body, they are both already hitting the Messenger and were both very defensive.

    And both think that they are better men than what Gonzales term a “muchacho” and just show how these guys look down at their fellow men. Secretary Gonzales already called the Rapporteur as nobody as if he himself is somebody, but as I said before and I will say again a “certified Cuckoo” and also a bigot.

    As for Asperon assertion that Alston is not the U.N., oh boy that was perhaps the most stupid statement a General could utter. Of course you yourself is not the AFP and Gloria Arroyo is not the Philippines. You are just like anybody, made up water and organs, but the difference perhaps is somewhere between your two ears, there was a mistake, it’s empty. Same goes with Gonzales, only his is past due Expiry….

    Esperon is always in the state of denial. Why didn’t he initiate internal investigation against Palparan et al? Well, he will just say: ”it’s my prerogative.”

    He mentioned about Operation Bushfire (NPA’s internal purging). It’s heavily ‘doctored’ like the one they did on the alleged ‘Final Talk’ between the MKP(Magdalo faction) and the CPP. Esperon is very good in manipulation and lying (and will never admit even when caught with his pants down!)

    Esperon, knows full well that Alston is credible, but trying to shift blame and the spotlight is the only recourse Esperon has at this point.

    Actually there is no much exaggeration with this Melo Commission’s report. The investigation was being done awkwardly with a lukewarm results.

    Mr. Alston is here to collect evidence and statement from both sides, if there is a probable cause about the killings to pursue the case. He is not the final arbiter and he could not come up with a verdict So, there is nothing to exaggerate. Now, assuming that the Military are responsible for the killings, the victim’s next kin will wait a year or even a decade to resolve the case due to a prolong process, just like a turtle race. By the time we have a verdict, maybe, Gloria and her loyal General are all dead. They know how to play dirty, Their bag are full of tricks. They already planned this ahead long time ago, where to exit. Just come to think, Why Gloria rushed Davide to seat him on the U.N. office? That statements exchanges are carefully scripted. If we assume–It is an ass between u and me.–ASS—U—ME. ==assume.

    I don’t give much importances what Esperon,Gonzales or Alston has to say.It is only a zarsuela play.

    Heard many other tales in many shades similar to that Jabidah limbones trunk, diggings at that school near murphy, caves at antipolo. Mind you, even high mil ranks and LGU officials, politicians and those ‘federal reserve agents’ would meet at the usual hangouts normally at fastfoods negotiating cached marcos (yamashita)treasures and old Federal Reserve Notes, ABLs, Wells Fargo, American Dream, and even the lost uranium fuel from the Bataan reactor all termed commodities. Sad to say, most finds were fakes. One reads those fakes regularly on the papers. Europeans, Koreans and other forigners are the normal victims. Unwittingly, families of OFWs were used to finance deals and particularly transport of the commodities from Mindanao (or from any point of the archipelago) to Manila. Anything goes to a story just to give credence to it. I nearly got sold to a story about dormant marcos accounts abroad. I laughed at it and returned the docs. After a couple of months, Irene transferred $13Bn to safety after being trailed by an australian. Her party used my same source.

    The Mayuga report is an all military report and I have no doubt that if ever it’s released, it will have been doctored to put Gloria in a good light.

    Of course, it would be good to have the report come out now, doctored or not because media access to it will certainly help the Opposition’s chances in the elections.

    Shucks! There’s a caveat though on “it will certainly help the Opposition’s chances in the elections”: PROVIDED Esperon, Tolentino, Allaga and the rest of the whole military election cheating machine stay away from the polling places.

    I just read the Inquirer news item stating that Gloria might be held accountable for the non-resolution of the extra-judicial killings according to the Melo Report.

    It is possible that when the EU Rapporteur gets convinced that there’s been an absence of will on the part of Gloria to solve the killings, i.e., number of deaths vs number of convictions or something, the EU Human Rights Courts might examine any charges that will be leveled against Gloria with more diligence.

    Gloria is being astute when she declared on arrival here in the EU that she had constituted a Commission (Melo) to look into the killings – it buys her PR time but she should not underestimate the EU. The EU accepted to come but she must take the consequences.

    The EU is capable of being totally blind to her “alembong”. It’s proven it in the past by “punishing” other national leaders (who had invited the EU thinking perhaps they could fool around with the EU reps) found by the EU to have violated human rights, i.e, freezing of assets, blacklisted – cannot travel to EU, boycott, etc.

    Gloria MUST NOT UNDERSTIMATE THE EU. She has little credibility here. With the UN report from Alston passes to the Council of Europe (the grouping of 46 heads of state and government in Europe), Gloria will have a tough time explaining why she chose to praise Palparan instead of to berate him for the deaths in his areas of command. The Council of Europe deals with HUMAN RIGHTS…

    The report said that in the course of his testimony before the commission, Palparan confirmed having made the following statements:

    “My order to my soldiers is that, if they are certain that there are armed rebels in the house or yard, shoot them. It will just be too bad if civilians are killed in the process. We are sorry if you are killed in the crossfire.”

    “There would be some collateral damage, but it will be short and tolerable. The enemy would blow it up as a massive violation of human rights. But to me, it would just be necessary incidents.”

    “Sorry na lang kung may madamay na civilian. The deaths of civilians and local officials were ‘small sacrifices’ brought about by the military’s anti-insurgency campaign.”

    “They cannot be stopped completely. The killings, I would say are necessary incidents in a conflict because they (the rebels) are violent. It’s not necessary that the military alone should be blamed.”

    I do accept that the military cannot be totally blamed for collateral damage resulting in a fire fight but at the same time, with that kind of declaration and on record to boot (Melo Commission) Palparan has opened the door for further scrutiny on his personal responsibility that resulted in unresolved deaths.

    The EU could take it from there and Palparan doesn’t seem to realize it but before he knows it, he might be transported to The Hague to stand accused of crimes against humanity.
