Detained ex-Marine chief joins probe call

Superiors sent men to their deaths in Basilan?

by Victor Reyes

The 28 military officers implicated in the failed power grab last February said they have an “idea” on who led the Marine contingent to their deaths in Basilan last July 10 but said they have to validate it.

Fourteen Marines died, 10 of them later beheaded, in clashes with forces from the Moro Islamic Liberation Front, Abu Sayyaf and lawless elements.

In a statement to media during the continuation of court martial proceedings, Maj. Gen. Renato Miranda, a former Marine commandant, said “all of these will come to light if there is an honest to goodness investigation so that the deaths of those Marines will not be in vain…and for the sake of the living who are still willing to offer their lives,” he said.

He said Sen. Antonio Trillanes “may be correct” on his pronouncement Tuesday that high government officials were directly responsible for the deaths of the Marines.

“He has his own basis for the claim because of his broad contacts, assets and informants. We are sure that the senator is doing his homework,” Miranda said.

Armed Forces chief Gen. Hermogenes Esperon reserved comment. “They (Miranda’s group) have to name names.”

He questioned Trillanes’ claims.

Marine spokesman Lt. Col. Ariel Caculitan downplayed the allegations.

“That’s impossible that our officials would do that, feed them (to the enemy), especially that they are Marines,” he said.

“What we can say is the operation was initiated by the (1st Marine) brigade. It was acting on information to verify the presence of (then kidnapped) Fr. Giancarlo Bossi and his kidnappers, nothing more than that,” he said.

On Miranda’s remarks his group has an idea on who led the Marines to their death, Caculitan said: “I don’t think a brigade commander would feed his own men to enemies.”

Col. Ramiro Alivio was the brigade commander.

Trillanes warned of further restiveness in the ranks of the 8,000-strong Marine Corps if the government sidesteps calls for a thorough probe into the July 10 clashes.

“If a thorough investigation is denied, we wouldn’t know how to control the Marines. More will be disgruntled and we wouldn’t know what they would do to re-channel their feelings,” Trillanes said.

Trillanes was in a Makati court for a hearing on his motion to reverse its ruling which junked his petition to attend Senate sessions.

Trillanes on Tuesday filed Senate resolution 72 calling for an inquiry to pinpoint culpability for the Basilan ambush.

He said witnesses were willing to attend the probe even if it means sacrificing their careers and putting their lives on the line.

Trillanes said he will ask Sen. Rodolfo Biazon, who chairs the Senate committee on national defense, to initiate the probe.

Biazon was a former Marine commandant.

Biazon said Trillanes must provide solid evidence before his committee can start with a hearing.

Biazon said he will have to ask Trillanes to disclose the identities of the witnesses and officials allegedly involved.

Sen. Panfilo Lacson said he will join the call for a Senate probe when fighting against Muslim extremist groups in Sulu ends.

Lacson said senators should not dismiss Trillanes’ claim that top government officials were to blame for the deaths of the Marines.

“The reason for a senator in seeking an investigation is to unearth the truth. Those behind efforts to shoot down his resolution could be held equally liable along with the officials supposedly involved in the alleged sellout,” he said. – With Ashzel Hachero and Dennis Gadil

  1. One does not even have to be a professional investigator to know which is which especially with reliable witnesses to the crime committed against these brave men. It only takes a simple patching up of events to know the truth and right. Unfortunately, all the agencies responsible for arresting and locking up criminals in jails are now under the control of a criminal who put decent and gallant men to prison so they cannot do anything to stop her from making life miserable for all Filipinos and even for people of other countries being affected by her corrupt and evil ways as when she tries to manipulate the peso to make it look stronger even when the only industry she can boast of is trafficking of Filipinos, and soon, trafficking likewise of human organs.

Worse is when the Philippines is going to be blamed likewise for making the cheating machine that helped a mad man become president of the U. S. A. and God cursing the promised land of milk and honey no more.

    Kawawang Pilipinas!!!

Go! Go! Go! Senator Trillanes. I’m positive you will see this investigation to the finish for the sake of the courageous soldiers.

The “Men of Honor” know!

  3. goji goji

So what’s new? Whenever there is crime committed and Malacanang men are involved, all they can say is to dare accusers to name names. And that’s what hits Assperon said…name names. Even those involving high officials and politicians, the accused are so brave to challenge the accusers to name names. Unfortunately, most of the time the accusers refuse to name names. That’s the predicament we have. Either they don’t have enough evidences or are afraid to reveal the identities. To me, it’s useless to make accusation if you’re not ready to reveal the culprits. Even those whistle blowers…who exposed jueteng and other corruption…they sometimes even retracted their statements.

How do our leaders protect and care for our soldiers who put their lives on the line for the sake of our country and the government?

  5. goji goji

Sorry…I meant “that’s what this Assperon said…” I hope some brave souls can now tell the truth and name names if they have the names. Otherwise, it’s back to zero again until another scandal appears.

  6. luzviminda luzviminda

IT is about time that we give importance to our soldiers. Our soldiers should stand united and if need be, ‘forcefully’ press for the truth to come out! Our brave and galant soldiers should fight for their welfare. “The people are behind you”!!!

  7. luzviminda luzviminda

Tama sina Sen. Trillanes at retired Major General Renato Miranda sa puntong ‘honest to goodness investigation’.

  11. The article says, “Biazon said Trillanes must provide solid evidence before his committee can start with a hearing.

Biazon said he will have to ask Trillanes to disclose the identities of the witnesses and officials allegedly involved. ”

He should be more aggressive in pursuing the truth. Hindi iyong palagi siyang groping in the dark!

If he is not sure of Trillanes, he should not ask him for names. He should do the investigation himself through outside source, not one who is in incarceration. Pambihira naman! There should be no ifs, but sure determination to get to truth and justice!

  12. parasabayan parasabayan

Goji, the hesitance of Trillianes and the 28 incarcerated officers to name names is because of security reasons. We are dealing with hard core criminals whose main jobs are to liquidate and abduct people to silence them! We have over 800 extra judicial killings and rising. We have abductions left and right and no resolution. Even soldiers who have the ammunitions to fight the enemy end up mutilated. Even the best officers in the Armed Forces of the Philippines can not free themselves from unlawful incarceration. Not even a higher position in the military can guarantee ones protection. With a criminal running the country, everyone is licensed to commit whatever crime they wish to do. So, unless the whole AFP bundle up together and boot out these criminals running the country, all citizens are afraid to come out for fear of being liquidated!

  13. parasabayan parasabayan

The marines may just be a handful but they are potent! They are the fighting machines! Tiyanak used them in the election cheating in 2004 and that left them so demoralized. Then they became headless because all the officers they look up to are all incarcerated leaving them with a Garci general! Recently they lost more than a dozen men to an unjustified fight in Mindanao. They must be ready to explode!

It is only the few higher ranking officers in the AFP who lost all their integrity to money and power! But bulk of the AFP still consist of really good men! Let us just hope that they will find their way to a position of power to overhaul the rotten system. I am just afraid that the notorious generals in Mindanao will not metastasize to the other honorable officers in the AFP. What is Tolentino doing in Mindanao? I wonder if this is part two of his pre-retirement investments?

  14. Diego K. Guerrero Diego K. Guerrero

  16. goji goji

Parasabayan, if the reason or reasons for not naming names are the ones you cited above, then we better wait for the next administration hopefully from the opposition so that the above matters could be addressed. In the meantime, keeping the status quo is the most appropriate thing to do.

  17. parasabayan parasabayan

Kaya nga dapat hindi isulong ang “Amnesty ME”. In this regime, there is no justice and if one openly comes out to testify, they die or get abducted or jailed! You will see that after the tiyanak is out of her stolen office, all the cases against her will be filed. Kaya nga tiyanak, thru the tengang daga, wants the amnesty bill in place so all of her abusive officials and of course herself as the principal, will benefit. Kunyari lang it will absolve Erap and those who are politically fighting her now. But the absolute truth is hidden. Tiyanak’s plan is to be a perpetual leader of the Philippines! If she steps down all her troubles will start and she will suffer worse fate than Erap. At least Erap is in his own home. The Filipinos may not be that kind to the tiyanak and her minions.

Biazon seems to be softening up. He is not as determined as he used to be with the pursuit of truth for the AFP, particularly the Marines where he used to be. In the stand-off of February 2006, he was so involved.

Goji, status quo is not even an option at all! Something has to be done but exposing the sources of imnformation so early in the game is like exposing your cards in a poker game too early, giving a chance to the opponent to beat you! Document, document and keep as many original documents in different places so the chances of losing them all will be nil. Di ba si Bedol kinuha muna niya lahat ng COCs tapos sinabi niya na nawala and mga ito and they created new fraudulent COCs but because wala na yung totoong documents, it was easier for the “komisyon” on eleksyons to fabricate new ones? The documents should be kept by people who do not have any political nor military clout. If all these witnessses are not harnessed now, pagdating nila sa taas, iba na naman ang tono nila. There is something with money and power that change people! At this point, I can only trust Trillianes and the 28 incarcerated officers!

  18. goji goji

Biazon used to be with the administration until that Garci tape when he joined the rest of Drilon’s LP faction in withdrawing support from Arroyo. So, his being with the opposition is in question. He almost lost to the late Barbers in that “Dagdag bawas” scheme and threatened to expose what he knew; but he kept quiet after his victory. He’s a tough Marine, a disciplinarian but scared of one person at home. Try giving him the microphone and interview him and you might have to prepare your bed to sleep until the next morning. This is his last term. He might be playing sweet music with the administration hoping he would be appointed to a position after he retires from politics (or even before he retires).

Conflicting nga ang sinasabi e, name names daw and then he’ll ask Senator Sony for the names, ano ‘yan!

The only way to resolve this controversy and clear up everything, including “naming names” is for the Congress or the President herself to call an Independent Judicial Inquiry, with the power to Subpoena all parties of interest, granted all forensic expertise and legal counsels for all witnesses and the pain of contempt and perjuries for those who refuse to testify and found not truthful in their testimonies. It maybe expensive to conduct, but money well worth for it will uncover the roots of all evils and measures will be formulated to correct and avoid the same from ever happening and to find where we did go wrong and never to go the same path again…but then again we always chose the easy way out….

  21. goji goji

But Vic, how independent is the Independent Judicial Inquiry?

  22. You bet, Chi, naniniguro. Golly, Ilocano pa naman. Dapat give na give!

  23. vic vic

goji, you will never know unless you try. there are many honest to goodness Justices in the country who are capable of conducting such inquiries and their chance to stand above the rest for being “truly independent”.

so many were skeptical when an PM appoints a Judge or Justice to conduct such inquiries, because he or she might be biased toward the appointing official, but every time, it turn out that the same Justice even subpoena the PM himself and grind him before the inquiry just like any witness. and their reports will bear witness to their independence and then the public will judge…

Let him come forward so the real honest to goodness investigation could start. Tough talk from the police and the military on arresting some 130 Moro Islamic Liberation Front (MILF) and Abu Sayyaf rebels whom they claimed massacred 14 Marines, with 10 of them beheaded in Basilan, and for which thousands of troops were sent to back up the elements of the Philippine National Police (PNP) in serving these arrest warrants, turned out to be nothing but bluster, in the military brass’ bid to get the troops to cool down their anger over the brutal slaying of their Marine comrades.

The PNP yesterday returned to the court the warrants of arrests issued against 130 MILF and Abu Sayyaf Group (ASG) suspects after they failed to serve the warrant to any of the suspects.

This was confirmed by Senior Supt. Salik Macapantar, Basilan Police Provincial Office director who said the warrants of arrests were returned to Judge Leo Principe of the Basilan 9th division Regional Judicial Branch 1.

He explained this had to be done as they failed to implement the 10-day limit and as such these have already expired.

The police official said they would have to wait for the Armed Forces of the Philippines (AFP) to file a petition before the local court to reissue the warrants of arrest.

In a similar vein, to project an image of the AFP not losing the war against the rebels and other alleged terrorist, AFP chief of staff Gen. Hermogenes Esperon Jr., yesterday ordered military forces operating in Sulu to intensify pursuit operations against ASG elements after claiming that the military had succeeded in validating reports that an Indonesian terrorist group leader seeking refuge in the ASG lairs, was among those wounded during a recent firefight.

  38. vic vic

Goji, the Philippines is not different from any evolving democracy. Canada had experienced pains and aches, and before we also had the Senate and house of Commons committees doing the investigations, but found out that they didn’t yield impartial results because of political partisan which the members can not just jettison. so it was decided that important investigations that involve political wrongdoings must by done by outside judges and justices or coroners with the mandate clearly defined before proceeding so as to avoid any ad hoc process. I had witness numerous inquiries as they are held in Public (televised or complete media coverage, or you may attend in person) and they are very open and the results are always welcome.

As to the possibility of the foreign body, it is not possible, because the Philippines is a Sovereign, she is capable of conducting her own affairs, for now she lacks the desires, but it could change any day, months, but not for more. Give it a chance, you will see it coming. Most probably sans Gloria, assperon and the rest of them obstructionists…

  39. goji goji

Vic, our system in the government such as the judiciary is in place like Canada and other countries. It’s the application of law by these corrupt officials that differs. Since the judiciary is appointed by a corrupt and evil leader, what do you expect? Yes, there are few brave officials willing to stand up for their principle and conviction; but most end up resigning and being fired. When I asked how independent is the Philippine Independent Judiciary body, I asked it literally. Most if not all Philippine government agencies are not independent even if they create such independent bodies. These have been tried in the past and failed. Example, the Department of Audit is supposed to be an independent agency tasked to check/oversee the expenses and lifestyle of different agencies/government officials. The department is not only performing its function, it sometimes is in cahoot with the crooks. An independent body will never succeed under the Arroyo government.

  40. goji goji

I meant…the department not only fails to perform its function…Once again Vic, your idea and proposal are good but won’t work in the Philippines. if we ask foreigners to compose the body, many of our self-proclaimed nationalists in the government, the politicians will cry foul invoking our sovereignty.

  41. rose rose

goji: para sa akin kahit na they were appointed by a corrupt and evil gov’t they can still stand up and fight for what is right, just and good of the country. Most of them studied in good Christian schools..they studied law and should be able to interpret what the laws are..laws of the country and above all the laws of God.However the lure of greed, power and corruption is quite strong..but there is still a God who is just..soon all these corruption will be gone..kaya antus anay kay buwas magsinadya na kita..be patient and tomorrow we will all rejoice. Don’t give up our faith, love and hope.

  42. rose rose

Gokusen: I was very surprised when I read that the warrants of arrest were returned for a very stupid reason. The gov’t is simply playing games..at the expense of the people particularly in Mindanao. They are simply stupid but we are not..and we will win..ang sabi nga “more things are wrought by prayers than this world dreams of..” I strongly believe in prayers..I will keep you and your people in my prayers every day.

  43. Diego K. Guerrero Diego K. Guerrero

  44. vic vic

Imagine this, you encounter the ABU terrorists and before you do anything, you announced that you are arresting them for this and that crime committed and advise them of their rights to remain silent and to have council of their choice and if they can’t afford to have one, they will be provided with a competent one by the Public Defenders office. Then have then sign the warrant and commence firing.

That is a good way to conduct a warfare against the band of terrorists who don’t recognize any law much less from the Government who can not obey its own law..funny scenario, but that is a possibility or what’s the use of executing those warrants if they are not served properly?

  45. goji goji

Rose, the question is not if we have principled and decent government officials, the question is how far they can stand the pressure and intimidation from Arroyo’s goons. Who would in his right mind sacrifice his family? We have had such people but they belong to the rare breed. Many have resigned or forced to resign. The few moderate ones are experiencing tremendous pressure and even threat. Again, how far and how long can they stand against this evil government? And having studied in Christian schools is not a guarantee of one’s moral quality. Don’t you see where all these prominent lawyers came from? Ateneo…bastion of Jesuit education. Yet, we see the likes of Nani Perez and even this Mike Arroyo, products of such reputable Christian (Catholic) school.

  46. rose rose

where did you read this report:

Tough talk from the police and the military on arresting some 130 Moro Islamic Liberation Front (MILF) and Abu Sayyaf rebels whom they claimed massacred 14 Marines, with 10 of them beheaded in Basilan, and for which thousands of troops were sent to back up the elements of the Philippine National Police (PNP) in serving these arrest warrants, turned out to be nothing but bluster, in the military brass’ bid to get the troops to cool down their anger over the brutal slaying of their Marine comrades.

I’m asking because I’m writing about it. Nagkaproblema kasi sila in the issuance of warrant of arrest. Their witnesses said they only saw four persons doing the beheading while 10 watched. The problem was only one of those alleged beheaders is in the 130 issued warrant of arrest.

I’ll explain it more in my column for Sunday.

  48. goji goji

I’m sure Lubao is included. Lubao sounds “Lubog”. But let’s not rejoice about the calamity. There are many good and nice people of Pampanga. Those that should drown are the Arroyos and gambling lords. Speaking of gambling, I’m told that jueteng is back in Pampanga especially in Angeles. What’s going on with Fr. Panlilio? I thought this priest turned Governor would make the difference. Well, maybe difference in
the amount of pay-off. That’s what they meant.

  49. TurningPoint TurningPoint

    Goji

Yes, it’s not only in Pampanga that jueteng is back in vengeance. Halos lahat yata ng probinsiya, umarangkada uli ang jueteng on top of STL which most jueteng operators are also the operators.

Proliferation of jueteng cannot be sustained without the local executives knowing it. In the case of Governor Panlilio, he’s barely two months into his governance and we should understand that he’s still feeling his way on how to effectively perform his mandate in Pampanga. The latest is, after Lilia Pineda brought some Pampanga mayors to Hongkong, her filed protest to nullify Panlilio’s victory has been given due course by the COMELEC. Could be that once again, the unseen hands of the top Malacanang dweller are orchestrating it.

  50. goji goji

Even before Gov. Fr. Panlilio became Governor, he already knew that jueteng existed and how the operations went. So true to his promise and people are expecting him to do is for him to treat this jueteng disease as priority. Being new in office is the common excuse of many politicians. Look at Isabela’s Gov. Padaca? She has also been eaten by the jueteng epidemic.
She was so brave to call on the fight against all forms of gambling in her province, but now reasons that she cannot turn down the wishes of his mayors and other local officials. Panlilio would say the same thing. He may even add that he’s a man of God and his priority is the spiritual needs and livelihood of his constituents.

“In Basilan (beheading incident), there was a reinforcement by the brigade commander but it was countermanded. (It’s Tribune’s banner story today)

He also said the issue was very serious it could destabilize the whole AFP. And with Enrile saying that there is no stopping the Senate from investigating right in the Marine Brig, they might do just that.

Judging from Biazon’s tenor, I assume this is where “top gov’t officials from Malacañang” had a hand in feeding the soldiers to the enemy.

Isn’t it that incident in Lamitan was about ransom for Reghis Romero being delivered midway into the hospital encounter between Sabaya and Janjalani on one side and troops led by now-incarcerated Capt. Guinolbay on the other?

Didn’t the senior officers then call the troops for a briefing at the height of the shooting giving the Abu Sayyaf an easy way out from their entrapment?

In the case of Tipo-tipo, didn’t we first read it here about ransom delivery, the countermanding of the airplanes?

It could probably be the NSC group, Ermita, the 2 Gonzaleses, Gloria herself and one other.

Tongue, do you know why Biazon flipped flop and changed his position/mind? That was after consulting his wife at home. At the Senate, he and Kiko are the most obedient husbands in the family.

It is about time that the men and womes of our Armed Forces of the Philippines act on probing their own men who died uselessly and are still out in Mindanao risking their lives.

In the 2007 elections, we thought the opposition senators would be cheated out but we were vigilant and we ended up with seven senators! It would have been 8 but Abalos, Garci and Bedol did their “magic” in Maguindanao and cheated Kiko.

We know that we can fight this super corrupt regime, if we only band together in all the issues, one at a time. It is true that the tiyanak and her dogs(they are all very quiet now on the Mindanao incidents)may have the power because they control the underworld operations but 80 million Filipinos should be stronger if we all are determined to change the course of our mismanaged country! We did it in the 2007 elections(except in Maguindanao), we sure can do it again and again!

  63. chi chi

    PSB

Talaga. We showed them that if united, Pinoys can do it. Let’s unite again this time and give our moral, spiritual and political support to AT4 cause of unmasking the evil EK official and Gloria’s political allies who are involved in the unfortunate pugutan at Tipo-Tipo.

If AT4 becomes successful, this might become the start of a new Pinoy military.

  65. gokusen gokusen

    Ms. Ellen,

Ang isa sa pinadala ni “maas” ay yung pamankin niya si “Hadji Abdul Jalil Hassiman”, chief of staff of the Office of the Chairman of the central committee,”Ustadz Shariff Zain Jali”, chairman of the Bangsa Moro Congress who is the head delegate,”Sultan Firdausi Abbas”, Ph.D., general legal counsel and chairman of the committee on legal affairs who is also delegation spokesman; “Dr. Mashur Bin Ghalib Jundam”- “prof. jundam is the dean of islamic studies in UP and who chairman of the secretariat and the committee on education” Maj. Gen. Abduljabbar ‘Narra’ Jialil”, vice chief of staff of the Bangsa Moro Armed Forces.
Congressman Jikiri’s claim that he speaks for the mnlf because he is the chief of staff is not true, di sila kinikilala ng mnlf, kaya kung may sinasabi siyang “misuari breakaway group” sila yun na bumubuo ng 15 council na siyang ka-alyado ng malakanyang.

  66. AK-47 AK-47

no matter how strong an evidence for a certain crime is, if there is no “honest to goodness” investgation and no fair & just judgement from the supreme court (which is supposed to be independent!), then it would only be a waste of time and effort (useless!). also, at least majority of the senate is sincere and determined to enter such probe, not only for them (senators) to join such an investigation on evidences presented to them but to lead themeselves even more in digging up the truth. they should remember & keep in mind, that AT4 is in jail and his moves is limited! so, sen. biazon as well as sen. ping lacson (consistent true GO’s) if they are really sincere and determined to bring the truth to justice, then these two senators would rather lead and start the investigation by now before we lost all our poor soldiers in a worthless and meaningless war.

If Senator Trillanes is successful in unmasking the true picture of what happened in Mindanao, then it could start perhaps a renewal inside the AFP that could affect the chain of command. I firmly believe that the marines will not take it sitting down.

Malacanang evil empire is the root cause of country’s destabilization. A possible gridlock with the Senate is brewing once more. Hiding the truth and skirting Senate inquiry by invoking unconstitutional gag order is worst than destabilization. Let’s see how Senate President Manny Villar handles possible gridlock with the evil empire. Here they go again!

Palace turns down cooperation on Senate’s Tipo-Tipo probe

Malacañang issued notice yesterday that the Senate cannot count on its cooperation in a planned inquiry on allegations top government and military officials have a hand in “feeding Filipino troops to the enemies” that led to death of 14 Marines in an encounter in Basilan, 10 of whom were beheaded and severely mutilated.
Instead, chief presidential legal counsel Sergio Apostol branded opposition Senators Rodolfo Biazon and Antonio Trillanes IV of fomenting destabilization in initiating the inquiry.
During a phone interview, Apostol said the Arroyo administration would surely invoke Executive Order (EO) 464 or Memorandum Circular (MC) 108 to prevent any government and military officials from attending the planned Senate investigation. Excerpts from Daily Tribune 08/19/2007

ano ba yan..democratic country pa ba tayo? gokusen,
