The son of an embattled agriculture official has asked the Court of Appeals to order his father’s immediate release from Senate custody.
Owen Vincent Bolante, son of former agriculture undersecretary Jocelyn “Joc-Joc” Bolante said in a 15-page petition for habeas corpus, which he filed Monday that his father’s detention was unlawful and called for his immediate release.

The petition for the issuance of a writ of habeas corpus, which was filed today on behalf of Mr. Jocelyn “Joc-Joc Bolante” by a son of his, is obvious proof that he does not plan on answering any of the public’s questions about the rotten multi-million peso fertilizer scam at the Department of Agriculture where he was once a well-placed official fixture.
It is clear that Bolante is engaging in unabashed forum-shopping, considering that he has previously filed an action before the Supreme Court asking for essentially the same remedy. His continued evasion of arrest, skillfully planned by feigning illness, is an integral part of his malicious machination, with the objective of staying away from any investigation for as long as it takes.
In fact, he has a lot to answer for in the fertilizer scam. Mr. Bolante still has to explain to the public why the original whistleblower in the fertilizer scam, Ms. Marlene Esperat, a journalist, was murdered in front of her children in Tacurong, Sultan Kudarat on March 24, 2005.
What does he know of this most vicious crime? This is a key aspect of the fertilizer scam whose sordid details have yet to be fully exposed to public scrutiny. If anything, it may yet reveal the impunity with which some public officials have trumped the Rule of Law and the principle that a public office is a public trust by their participation in the fertilizer scam.
Mr. Bolante’s continued stay at the St. Luke’s Medical Center is an abuse of the humanitarian gesture extended to him by the Senate. St. Lukes’ Medical Center has already that Mr. Bolante does not have any serious illness, which means that his health will not impede his ability to appear in any investigation by the Senate or other office. Now we are being told that he needs more medical tests to ensure that his life is not in any immediate danger.
Indeed, Mr. Bolante – and in this, he may be aided by willing doctors – is taking the public for the gullible and the naïve lot that they are not.
His prolonged stay in the hospital in what – it is clear to many – are nothing but a contumacious display of pretended illness obstructs the cause of justice he has evaded for so long. We expect the Senate leadership to know better than playing Mr. Bolante’s own game. We expect the Senators of the realm to cut Mr. Bolante’s crap and forthwith subject him to a legislative scrutiny they owe to the public.
Any potential witness who would say, “I’ll talk…” once they arrive in the airport, is actually saying otherwise.
Any potential witness who would say nothing when ask, is actually avoiding being kidnap because they’re going to talk.
The only way to “encourage” Bolante to talk is to detain him until he is willing to talk. If the U.S. was able to put him under custody, until his case was resolved, why not the Philippines Authorities?
Just read the Medical bulletin and all of his illnesses are not life threatening as to prevent him from being summoned either by the Ombudsman, the Police Authorities, or the Senate. hyper acidity, high cholesterol, hypertension (just about everyone with his legal problem will suffer hyper, beta, blood thinner and maybe diuretic will make him like brand new)For h-pylori infection (ulcer) i recommend, triple theraphy, combinations of two anti-biotics and anti-acid, Nexium preferable, two weeks, he’ll be ready. But if it’s Peke, no amount of Medications will do.
The trick of the trade is to keep one’s mouth shut and leave everything to the counsel. Use money as the mouthpiece. Let the other side scream away every strategy if thats the only psywar left to fight with.
Habeas corpus – literally, have you the body?
It is a suit asking the Court to order the detaining authority to produce the person in Court, and explain why the person is being detained.
How can they sue the Senate Sergeant-at-arms when he does not have the body. The Senate sergeant-at-arms cannot even see Bolante, dahil pinagbabawal ng nangdodoctor na doctor.

Joc Bolate asked for political asylum in USA and was rejected and deported. The USA judge didn’t believe his excuses fearing for his life, that it’ll be in jeopardy when he return. It was a total lie, and now bolate once again is lying and trying so hard not to testify. That a*s hole doesn’t care about the country and the truth to come out, but himself and protecting the most corrupt couple of the Philippines, the Arroyo duo. There are no justice in the Philippines. Hence, what will satisfy the people is not what the crooked judges decision (habeas corpus) but vigilantes that will prosecute and humiliate him in public. The question, in case JDV indeed signed the impeach raps against the evil bitch (not you of course, hehehehe…)… Is to what lenght, how far is JDV willing to go. The last time I heard, one powerful congressman from the north told JDV not to talk anymore, tampuhan lang yan (like a lover’s quarrel), this happened during the weeks after he was removed as speaker and head of LAKAS-CMD. I ask the friend of the congressman from the north, what was JDV’s reaction, he said he was listening, and before you know, he did nothing until he departed for the US recently.
Whether he signs the impeach raps or not, everythhin remians to be seen. Knowing JDV, he will do everything in his way to to protect himsel, its his personal interest that matters most not the country’s and people’s interest.
