Arroyo’s electoral sabotage case and Maguindanao massacre intertwined

Today, we will be at the historic Mendiola Bridge (now renamed Don Chino Roces Bridge) to remind President Aquino that the families of the victims of the Maguindanao massacre are still waiting for “justice” that he promised last July.

A tweet by Federico Pascual is shared by many who lament the slow pace of the trial: “If only PNoy could show the same speed & single-mindedness in prosecuting the plotters & killers in 2-year-old Ampatuan masssacre.”

In a statement the National Union of Journalists of the Philippines said “Two years after the gruesome crime, 103 of the 196 suspects remain at large and only two of the principal suspects have been arraigned. The case remains snagged on hearings on petitions for bail of the accused.”

Justice Secretary Leila de Lima, looking satisfied in her evening press briefing in Malacanang last Friday after the warrant of arrest was served on Gloria Arroyo at the St. Luke’s Hospital, said the reason she put Arroyo in the Watch List Order was because they were still finalizing the electoral sabotage case, which became the basis for the warrant of arrest issued by Pasay RTC Judge Jesus Mupas.

The arrest warrant was in connection with the electoral sabotage suit filed by the Commission on Election which alleged that Arroyo ordered former Maguindanao Governor Andal Ampatuan Sr to make all the senatorial candidates of the administration’s Team Unity win in the 2007 elections.

Her inclusion of Arroyo in the WLO, as we all know by now, became a Hold Departure Order because based on it, airport authorities stopped Arroyo from leaving the country.

I need to re-learn the Constitution’s Bill of rights again. What De Lima was saying was it was okay for her to restrict anyone, using WLO, even if there’s no case pending in court, while she is preparing a case against that person.

Sabi ng Malacañang, simula lang daw yun ng pagpapanagot kay Gloria Arroyo sa maraming kasalanan na ginawa niya sa sambayanang Pilipino.

Sana lang, sa pagbibigay ng hustisya sa sambayanang Pilipino, hindi rin babastusin ng pamahalaang Aquino ang batas katulad ng ginawa ni Arroyo nang siya ang nasa kapangyarihan.

Sa ngayon lang, iba ang sinasabi ni Pangulong Aquino, iba ang ginagawa ng mga tauhan niya na kinakampihan naman niya.

Bakit ba galit ang mga tao kay Gloria Arroyo na siyang naging dahilan na nanalo si Aquino noong 2011 kahit wala naman siyang naipakitang kakayahan para mamuno? Dahil binastos niya ang batas para lang manatili sa kapangyarihan.

Nangako si Aquino na kapag siya ang mananalo, magkakaroon ng reporma. Hindi na maging katulad ng panahon ni Arroyo na binabaluktot ang batas para lang manatili siya sa kapangyarihan. Protektahan daw ang karapatan ng bawat Pilipino. Yan ang intindi ko sa isang pamahalaan na demokratiko at makatao.

Kahapon bago magtanghalian, isinampa ng Commission on Elections ang kasong electoral sabotage laban kina Gloria Arroyo, dating gubernador ng Maguindanao na si Andal Ampatuan Sr. at datingformer Comelec election supervisor Lintang Bedol before the Pasay City RTC.

Ni-raffle at napunta ang kaso kay Judge Jesus Mupas na dati raw napagsabihan ng Supreme Court dahil may mga kasong hindi umuusad. Aba, noong Biyernes, ang bilis. Bago mag-alas singko na hapon, nagpalabas na ng warrant of arrest si Judge Mupas.

BREAKING NEWS: Pasay RTC Judge issues warrant of arrest vs Arroyo

Contrary to the announcement of Supreme Court Spokesman Midas Marquez that the High Court voted 8-5 reiterating the temporary restraining order on the Watch List Order of Justice Secretary Leila de Lima issued on former President Gloria Arroyo and her husband, a highly reliable source said the tribunal, voting 7-6, actually declared its Nov. 15 TRO inoperative following the failure of the Arroyo camp to comply with all the conditions set by the court.

The seven who voted that the TRO is inoperative were Senior Justice Antonio Carpio, Associate Justices Maria Lourdes Sereno, Bienvenido Reyes, Estela Perlas-Bernabe, Jose Mendoza, Martin Villarama and Roberto Abad.

The six who stood firm on the TRO were Chief Justice Renato Corona, Presbitero Velasco Jr., Arturo Brion, Diosdado Peralta, Lucas Bersamin and Jose Perez.

The lawyer of the Commission on Elections on Friday filed electoral sabotage charges against former President Gloria Macapagal Arroyo, former Maguindanao governor Andal Ampatuan Sr. and former Comelec election supervisor Lintang Bedol before the Pasay City Regional Trial Court.

Sen. Francis Escudero said once the judge issues a warrant of arrest all watchlist order and hold departure order in a separate on DOJ Memo circular 41 become moot and academic. Arroyo can be arrested. Electoral sabotage is non-bailable.

Defying the High Court’s temporary restraining order against her Watch Order List against the Arroyos, she ordered all agencies concerned not to allow the couple to exit the country because as far as she is concerned, the SC’s order cannot yet be implemented because she has not received it yet and she still has to file a motion for reconsideration.

The Supreme Court has voted 8-5 to release a temporary restraining order on the watchlist order against former President Gloria Macapagal Arroyo, a source told abs-cbnNEWS.com.

Only 13 magistrates voted.

The 8 are: Chief Justice Renato Corona, Presbitero Velasco Jr., Arturo Brion, Diosdado Peralta, Lucas Bersamin, Roberto Abad, Martin Villarama, and Jose Perez.

Sa gitna ng ingay ng diskusyon kung papayagan si Gloria Arroyo at ang kanyang asawang si Mike na umalis ng bansa para magpagamot day (siyempre marami at mas maingay ang ayaw), hindi na marinig ang tanong na bakit ba hanggang ngayon wala pang kaso sa korte na nakasampa laban sa mag-asawang kinaiinisan ng maraming Pilipino?

Halos magdadalawang taon na ang administrasyong Aquino ngunit hanggang ngayon ay wala pang nakasampang kaso laban kay Arroyo. Lahat nasa preliminary investigation pa lang.Pinapag-aralan pa kung may “probable cause” ang akusasyun sa kaniya.

Palagi nga kinukumpara ng marami sa ginagawa ni Arroyo kay dating Pangulong Joseph Estrada na ilang buwan lang siya napaalis sa Malacañang nasampahan na kaagad ng kasong plunder at nakulong.

Hindi sana problema ang pagbawal ni Aquino kay Arroyo umalis ng bansa kung may kaso na hindi pwedeng piyansahan dahil kung sa ganun ang korte ang mag-isyu ng hold order sa kanya . Kaso wala.

Ang pinaghahawakan nina De Lima ay ang kwestyunable na memorandum circular na inisyu noon ng justice secretary ni Arroyo na si Alberto Agra na kahit nasa preliminary investigation pa lang ang kaso, pwedeng ilagay sa Watch List Order ang isang tao.
