Garci cleared:another stab on the people’s back

While the nation was busy observing Christmas, the Department of Justice released its Nov. 14, 2006 decision clearing former Comelec Virgilio Garcillano of charges of perjury and falsification of passport.

Cavite Rep. Gilbert Remulla, who spearheaded the investigation of Garcillano at the House of Representatives, said the the media release of the decision was timed for “minimal impact on the public.It must be the administration’s Christmas gift for Garci,”

Sen. Panfilo Lacson, who filed the case along with a number of opposition congressmes, is not at all suprised. “Malacañang and the DOJ have no choice but to drop the case. If the case were filed in court, Garci will go all over town pointing his fingers at them. They can’t afford Garci telling on them.”

Garcillano hopes DOJ ruling will end scandal

THE man at the center of suspicions that President Macapagal-Arroyo stole the vote in the 2004 polls hopes that the dismissal by the Department of Justice of the perjury and falsification charges lodged against him by opposition lawmakers will finally bury the ghost of the controversial 2004 presidential election.

“Sana matapos na (I hope this will end),” former Election Commissioner Virgilio Garcillano told the Inquirer when reached by phone yesterday at his farm in Baungon, Bukidnon.

Garcillano is widely believed to be the man with whom Ms Arroyo was speaking in tapped phone conversations during the 2004 election period.

The conversations triggered accusations of poll fraud that almost brought down Ms Arroyo’s administration and that continue to hound her.

Garcillano refused to comment further beyond saying that the DOJ order was long overdue.

But the dismissal of charges against Garcillano did not surprise Sen. Panfilo Lacson and Senate Minority Leader Aquilino Pimentel Jr.

Both senators said they had expected the DOJ, on the purported prodding of Malacañang, to clear the brains of the alleged fraud that came to be known as the “Hello Garci” scandal.

“We expected this. Malacañang and the DOJ have no choice but to drop the case. If the case were filed in court, Garci will go all over town pointing his fingers at them. They can’t afford Garci telling on them,” said Lacson, who had filed the charges along with a number of opposition congressmen.

If at all, the senator said, he and the other lawmakers had proved one thing: “[Those who benefited] remain hostages of Garci and whatever information he has on them. They remain hostages now and until God knows when.”

Pimentel agreed.

“Why should you be surprised [at the DOJ decision]? A life that is full of lies must necessarily be supported by other lies,” he said.

As early as November

The 12-page DOJ resolution was issued as early as Nov. 14 by State Prosecutor George Yarte and approved by Chief State Prosecutor Jovencito Zuño upon the recommendation of Assistant Chief Prosecutor Richard Fadullon.

But a copy of the decision was obtained by the media only the other day, faxed by Garcillano’s lawyer Eddie Tamondong.

In throwing out the charges against Garcillano, the DOJ discredited a note verbale from Singapore and a Bangko Sentral ng Pilipinas report.

It also said the opposition lawmakers failed to prove that Garcillano’s statements at a House hearing were made under oath.

The DOJ found no probable cause to prosecute Garcillano for the 21 counts of perjury and falsification of passport charges filed against him by Lacson and 19 other members of Congress in March and April 2006.

The cases were initially investigated by Prosecutor Laurence Chua Cheng of the Quezon City Prosecutor’s Office.

They were endorsed by the Quezon City Prosecutor to the DOJ for continuation of preliminary investigation and resolution, after the complaining legislators moved to inhibit the entire Quezon City Prosecutor’s Office for alleged bias.

On the phone yesterday, Garcillano’s wife Grace could not hide her elation.

“Mabuti naman. Magandang Christmas ‘to (This is good. This will be a good Christmas),” she said, adding that she and her husband would share a simple Noche Buena (Christmas Eve dinner) at the farm.

Unresolved issues

The other lawmakers who brought the charges against Garcillano warned that the Arroyo administration’s efforts to bury the truth would continue to haunt the incumbent in Malacañang and the country as a whole.

“Christmas is about reconciliation based on forgiveness and truth. But this Christmas, instead of giving the gift of truth to the Filipino people, the deception continues and it’s Garci who continues to receive gifts from this administration,” said House Deputy Minority Leader Alan Peter Cayetano.

“Although we really want reconciliation, peace, etc., the unresolved issues and continued whitewash do not augur well for the kind of reconciliation this country needs,” he added.

Another minority deputy leader, Cavite Rep. Gilbert Remulla, also said in a text message that the ruling was not surprising.

“From the get-go we knew that our case would be dismissed by the prosecutors and the DOJ they answer to. We expected no less when the prosecutors refused to even look at our solid evidence,” he said.

Remulla said even the media release of the decision was timed for “minimal impact on the public.”

“It must be the administration’s Christmas gift for Garci,” he said, but added that the fight was “far from over.”

He didn’t lie

Grace Garcillano said her husband was delighted when he heard of the dismissal in the weekend.

“Of course, he’s happy with the decision,” she said, adding that the DOJ ruling clearly proved that her husband did not lie when he told the Inquirer in a Nov. 27, 2005, interview that he did not leave the country following the surfacing of the “Garci tapes.”

“I was here all this time,” Garcillano said then.

Declared Grace yesterday: “My husband did not lie.”

Grace refused to comment on the specifics of the allegations against her husband, insisting that “details are more accurate in the proceedings.”

But she said that for some reason, the complainants bungled their own cases, and therefore had only themselves to blame for their legal defeat.

“They did not submit their own memorandum (reply to Garcillano’s counteraffidavit) for a long time. It’s not fair to prolong the case just because the other side will not submit their own memo,” she said.

She also defended her husband from allegations that his passport, which bears no immigration stamp indicating he had left the country, had been tampered with.

“They question his passport. But not all passports are the same. It’s possible that there may have been deviations during the production process. They say the passport size does not conform to standards, but I don’t know their standards,” she said.

No closure

Lacson and Pimentel expressed the belief that the dismissal of the charges would not put a closure to the scandal.

“Just like the impeachment [cases against Ms Arroyo] filed in the House, there’s no closure to this,” Lacson said.

Said Pimentel: “The Garci controversy will not end until the truth is out. Lies divide; only the truth unites.”

Lacson said it would not be prudent to appeal the DOJ resolution.

“It’s useless to file an appeal. With [Justice Secretary Raul] Gonzalez and Malacañang at the helm, it will only be dismissed. Everyone is the hostage of Garci now. At the proper time, this case will be revived,” he said.

Lacson expressed disagreement with the prosecutor’s finding that there was no probable cause to file a case against the former Comelec official.

He said he and the congressmen had presented strong evidence, including an authentication from Singapore’s foreign ministry that Garcillano had stopped in the city-state on July 14 on his way to London.

    And the timing of the release is perfect as the public was just dead tired of The Holiday celebration and may not even notice much of another “conspiracy”, between the law enforcer (aka the Justice Department) and the lawbreaker where Mr. Garci will be forever in history remembered..

    No wonder Garci needed this “clearance” from the DOJ. According to ABS-CBN News, FILTHY GARCI “is eyeing the congressional seat of the 1st District of Bukidnon next year, his spokeman said Monday…” To what gall or audacity does this FILTH OF A PERSON called, “GARCI” have ? Those of us who know of voters from Bukidnon should campaign hard to give this FILTH OF A PERSON what he deserves: To be thrown and remain in the BASURA OF PHILIPPINE SOCIETY !

    NEVER in Philippine history have we seen power so much abused and corruption so brazenly committed by people in power as they are today by Gloria Macapagal-Arroyo and Jose Miguel “Mike” Arroyo (except probably by the conjugal dictatorship during martial law).

    The two are wielding state power to satisfy their whims and caprices, as if they are above the law. Consider all these multimillion-peso irregularities committed under this regime of plunder:

    1. The $14-million kickback in the Impsa deal, which also involved a high-ranking Cabinet official. The deal was uncovered during the early days of the Arroyo administration.

    2. The highly irregular construction of the Diosdado Macapagal Boulevard, which has turned out to be the most expensive highway in the country.

    3. The P1.3-billion Commission on Elections-Mega Pacific scam.

    4. The P2.3-billion fertilizer scam involving former Agriculture Secretary Jocelyn “Joc-joc” Bolante, a known crony of the First Gentleman.

    5. The irregular use of PhilHealth and Owwa funds in the 2004 elections.

    6. The unexplained, hidden, overseas bank accounts of the Arroyos.

    7. And the biggest irregularity of them all, the “Hello, Garci” scandal that bastardized the 2004 elections and robbed the people of their vote.

    Add to this the more than 700 political killings since 2001; the blatant disregard of due process just to push Charter change that would ensure the political survival of the Arroyo regime; and the use of underhanded tactics to harass critics, including the use of the libel and rebellion laws as personal weapons against critics of the Arroyos.

    It’s about time we put an end to this regime of conjugal plunder if we want to end the current political impasse in our country.

    Mr. Guerrero, why do you think Gonzalez was placed as DOJ Secretary that despite all the blunders he committed he still stays? Why do you think Puno was appointed as DILG Secretary? To initiate the Cha-Cha through People’s Initiative which failed; and now in preparation for election. DILG is such a powerful department with the PNP and local government under it. At bakit kahit na sangkot sa dayaan ang mga Heneral ay na-promote pa? We can go on and on and the more we talk about it the more we get upset.     And as it is now, expect the unexpected when it comes to Garcillano as long as GMA is at the helm.

    1. He could be back at the Comelec and replace Abalos as Commissioner.
    2. Being a lawyer, he could go to DOJ and replace Raul Gonzales as Secretary.
    3. Better (bitter) still, be appointed as the 15th Supreme Court Justice. Sayang, okupado na ang Chief Justice.
    4. Being a civilian as called for in the Davide & Feliciano commissions’ recommendation, he could be appointed as Defense Secretary which is still vacant. It’s time for Esperon to salute him.
    5. Being a shrewd operator, he could operate jueteng, loteng, STL, ending, sakla, etc., with impunity.
    6. Pag natuloy ang con-ass at chacha, pwede siyang gawing Prime Minister if JDV is on the way out.
    7. If the election is pushed through, he could run as Senator, Congressman, Governor, Mayor or Barangay Chairman.

    Daming benefits, sabi nga sa commercial ng Lucky Me sotanghon. At totoo naman. So many benefits and possibilities is lined-up for Garcillano under the sun, I mean under this administration.

    The truth of the matter is, people don’t object to Cha-Cha or amendment of constitution. They just don’t trust Arroyo. Marami ang sang-ayon na palitan ang saligang batas kaya lang wala silang tinawala kay Arroyo at sa mga alipores niyang tumutulak dito. That means if ever there is to be an amendment, it should be during the post-Arroyo regime.

This provision of the Civil Code is true even during the US occupation of the Philippines circa the 30’s.

    Fernando Poe, Sr. was not registered in fact as a Spanish national but a Filipino, and he was known to be a great Philippine actor. We all know how his record was tampered in an attempt to disqualify FPJ from running as president.

    Lamentably, Filipinos do not seem to have any idea of the importance of keeping records intact. I have in fact interpreted in cases of Filipinos tampering with their records for example in some insurance exam. There was a girl I interpreted for who wanted to claim an insurance she made with a member of a gangster in Japan by proclaiming herself legally dead, for which she had to fake her death certificate and register a new birth under a fictitious names. This is one reason why I cannot believe any statistics coming from the Philippines unless done by an international body.

    Integrity is one virtue that is lacking in the Philippines, and made worst by the Great Switik who lives on lies and not being bothered by it.

    It is one of the things that should be looked into when the time comes that the Great Switik is removed and the Filipinos start anew!

    The constitutional rights to bear arms was instituted in the U.S. constitution, as the framers at that time contended that a well-organized Militia was the Best Check for a government that may forget their duties toward the citizens and turn tyranical, and it proves its wisdom, though at the cost of social pains at later days. Whereas, in a Parliamentary form, where the power is all vested in the Parliament and the Judiciary has a limited role in Check and Balance, it is still within the right of the Citizenry to overthrow a tyranical government. Our constitution does not give us the right to Bear Arms, but at the same time it doesn’t prohibit us the privilege to Bear Arms. In fact, per Ratio, Canadian possess more arms of any kind than American.     All of these reports exonerating Garci are crap. I already said my piece on the Garci anomaly before, and I believe Garci, the Secretary of Injustice, and Gloria are all liars and distorters of truth to the highest degree. They all cheated, conspired with one another, and would do everything to suppress the truth.

    The central problem in Philippine politics since 2004 is legitimacy. That is, Gloria is not a legitimate ruler elected by the people, she cheated her way to the presidency with the help of Garci, the comelec operator, and made possible by those who were obsessed with power and money. All efforts of Gloria have been devoted to shielding her sins just so she can stay in power. Nothing will ever change that pattern, and those who work with her — including her apologists in the media, congress, bloggers and in all walks of life — will not succeed in preventing the truth.

    Gloria’s “success” in trying to hold on to power is but temporary. She will finally meet her fate soon, and history will be unkind to her forever.

    Lets not give too much of our thoughts to former Comelec Virgilio Garcillano because its my opinion that Garcillano, the Dof J Sec with the congress allies of GMA have misjudged the people of Mindanao, because they are not so stupid. These people on Mindanao have been watching quietly waiting for the May elections to vote them out of office. They would never place their trust in Garcillano and will remember all those who assisted in his disappearance and cover up, even officials residing on Mindanao. In a clean election it will be the end of this administration. If it is a tampered election the people will know it is tampered and will take to the streets, have no doubt about that. It’s a good reason why Prospero Nograles Jr, who resides in Davao City, Mindanao goes on and on that the people of Mindanao want cha cha, he knows it’s a lie to say this, just read his local newspapers at what ordinary people are saying.. Every ordinary electorate says they don’t want it, they are too busy trying to make a simple living to feed their families. But Nograles also knows that if the choice is a clean election, he and the administration will be the losers. Their dirty deeds have been too many against the ordinary citizen.
    So, this leaves one thing to watch, People’s Initiative, because this is their best way to try to tamper with the results. Yet again with tampering with the PI they are taking a chance of people going to the streets. Bishop Oscar Cruz has not discounted this move, has he?

    Stronger pesos doesn’t mean anything if the poor Filipinos cannot eat three meals a day. Siyempre lumalakas ang piso tuwing Pasko dahil sa dollar remittances ng mga OFWs at pag-uwi nila. Such artificial rise in the value of peso is often being projected by Malacanang to show an improvement in economy. Isa pang dahilan ng pagtaas ng Piso ay dahil mahina talaga ang US dollar.     Garci case being considered for proceedings in people’s court–CPP
    December 28, 2006

    The Communist Party of the Philippines (CPP) today denounced the Justice Department’s absolution of all 21 counts in the perjury and falsification charges against former election commissioner Virgiliano “Garci” Garcillano and said that parties frustrated at the Arroyo government’s obvious whitewashing of the criminal cases the notorious “Garci” have already filed before the revolutionary people’s courts information about his crimes.

    Over the weekend, the Department of Justice (DOJ) dismissed all charges of perjury and falsification of legal documents filed against Garcillano by several legislators. These charges were based on passports he submitted to a congressional inquiry on the “Hello! Garci” tapes “as proof” that he did not travel anywhere outside the country since the time he disappeared from the public after the controversy about the “Garci tapes” broke into the open in June last year.

    The DoJ prosecution team headed by Chief Prosecutor Jovencito Zuño said that they dismissed charges that the passports were falsified, forged and fake, even as they admitted that laboratory examination reports submitted by Bangko Sentral ng Pilipinas attested that the passports “did not conform to standards” and a note verballe from the Singapore government attested that Garcillano in fact travelled to that country last July 2005.

    CPP spokesperson Gregorio “Ka Roger” Rosal said they had actually anticipated the DOJ’s dismissal of the charges against Garcillano, considering that Malacañang has been making sure that Gloria Arroyo’s principal henchman in rigging the 2004 elections will always be let out of the hook. Rosal also said that that Malacañang even intends to go all out in rewarding Garcillano for his “loyal and invaluable” services to Arroyo by making sure that he gets the Bukidnon congressional seat come the Mayo elections. “The Arroyo government will do everything to protect and satisfy Garci not only as a form of reward, but as a bribe to keep his mouth shut.”

    What else could we expect from the DOJ?” Rosal asked. “With the DOJ having acted true to form, several interested parties have approached the revolutionary movement to file information and seek justice for the grand fraud that Garcillano committed to ensure Arroyo’s ‘victory’ in the 2004 presidential elections,” added Rosal.

    Rosal said revolutionary justice authorities are considering proceedings against Garcillano, knowing fully well the outstanding nature of the case and the people’s widespread demand to punish the masterminds of the Arroyo regime’s biggest crimes against the Filipino people, including the rigging of the 2004 elections.

    “If proceedings on the Garcillano case are to be carried out, a special people’s court will have to be constituted. Garcillano himself would be compelled to appear before such proceedings. Otherwise he would have to be tried in absentia,” added Rosal.
