Lorredo claims Palace wants him out of Lozada case

lorredo Controversial Manila court judge Jorge Emmanuel Lorredo revealed Wednesday that someone from Malacañang is trying to persuade him to inhibit himself from the perjury case of NBN-ZTE star witness Rodolfo “Jun” Lozada.

“Kahit anong pressure ng Malacañang sa akin, hindi ako mag-inhibit (Malacañang cannot pressure me to inhibit),” Lorredo, presiding judge of the Manila Metropolitan Trial Court (MTC) Branch 26, said in an exclusive interview with ABS-CBN News.

Lorredo said that his refusal to inhibit from the case is also meant to protect his fellow magistrates at the Manila MTC.

The judge declined to name the alleged emissary from Malacañang who talked to him, saying that he knows, as a trial lawyer, that that person would only deny his claim. “Sinong gagawin kong witness (Who will I use as witness)?” the judge said.

He said he heard reports that Justice Secretary Raul Gonzalez, a friend of his late father, allegedly wants him to inhibit from the case. He said Gonzalez had made verbal accusations against him, but he will not react because “I have breeding.”

Lorredo also suspects that a demolition job against him is already in the works. He mentioned a newspaper article where he was accused of “ignorance of the law” for citing in an earlier order that he can subpoena or issue a warrant of arrest against President Arroyo and her husband, Jose Miguel “Mike” Arroyo, to make them stand as hostile witness in Lozada’s perjury case.

In the same order, Lorredo tried to persuade Lozada’s complainant, former presidential chief of staff Michael Defensor, to dismiss the perjury case.

Pacquiao’s help sought

During the interview, Lorredo announced that he is inviting Filipino boxing icon Manny Pacquiao, who has been given a title of “Ambassador of Peace” by Malacañang, to the perjury case’s pre-trial hearing on May 28.

“Nanawagan ako kay Pacquiao na pumunta siya sa May 28 sa courtroom ko (I’m calling on Pacquiao to go to may courtroom on May 28), I will allow him to talk to Mike Defensor and Jun Lozada,” he said, adding that the boxing icon, being an Ambassador of Peace, may be able to help him broker peace between the two.

The judge said he is having a hard time persuade Defensor to make peace with Lozada. One of the reasons, he said, was Malacañang’s conflicting position on the case.

Lorredo added that according to his friends, Malacañang is planning to ask Pacquiao to humiliate him in public as part of the demolition job to force him to inhibit from the case.

Meanwhile, the judge said that he will explain during the May 28 hearing his decision to allow media to cover the proceedings live.

He said that after reading reactions of his decision about the media coverage, he extensively read a Supreme Court circular used in the trial of a case filed by former president Corazon Aquino against the late broadcast journalist Luis Beltran Sr..

Lorredo clarified that the circular was meant to protect an accused from public prejudice. He said the circular would be of no use if Lozada himself would allow the media coverage.

“So ang tatanungin ko sa May 28, kung payag si Jun Lozada na nandoon [ang media]. Kung payag siya, hindi na magiging applicable ang ruling ng Supreme Court (I will ask Jun Lozada if he will allow media’s presence on May 28. If he agrees, the Supreme Court ruling won’t be applicable anymore),” the judge said.

    I just watched the Judge being interviewed and later heard GOONzalez’ interview too. Mukhang nagkakainitan itong dalawang ito. Sabi ni GOON, bakit daw idinadawit ni Judge si putot at si taba eh hindi naman daw sila kasali sa kasong ito. ANO? Di ba sila ang mga MASTERMIND?

    DOJ Chief Gonzales is avoiding accusing Judge Lorredo of “ignorance of the law” since he was once accused of such and it might just backfire on him. Goonzales said he does not have a case against Lorredo.

    Live coverage? Diyan nasira si Judge Ito of OJ Simpson fame. I hope the good judge will reconsider, and not offer the option to Jun Lozada; and I hope Lozada declines.

    It is difficult to resist the seduction of the camera. People tend to preen and pose before it, and reach for the quotable quote instead of logic. Just watch the circus called Congress. Ganyan din ang nangyari sa mga abogado, both prosecution and defense, of the OJ case. Di ba’t nagpa-makeover pa ng hairdo si Marcia Clark?

    Kapag naging media conscious ang mga abogado, mababawasan ang kanilang effectivity.

    In reading Supreme Court decisions, while in law school, my gang abhorred the decisions of CJ Fernando, because he was obviously reaching for the quotable quote instead of merely deciding the case. Those who just decided the case, like JBL Reyes and CJ Teehankee, frequently, and without forcing it, produced gems by the sheer force of their logic.

    Also, live media detracts from the formality of the proceedings, which is what distinguishes the Courts from that perya called Congress. Sa US District Courts nga, ni camera wala. Mayroon lang sketchers, that is why you only see sketches of Michael Ray Aquino, or the lawyers. Sabi nga ni Justice David Souter about live coverage, “Over my dead body.”

    Please reconsider Your Honor. Three things intoxicateth a man; wine, women and popularity. Of the three, popularity is the most potent. Mas maganda ang bakbakan kung walang grandstanding. So I recommend no live coverage.

Should the Con Ass / Cha Cha not push through, expect ‘Organized Chaos” as prelude to declaration of such emergency. Glorietta was a sample, to test if those people spoiled by gloria could carry out and deliver a sinister program_yes including deaths to innocent civilians and crushed dreams and hopes of the young ones. Not to mention and never to be forgotten, the suffering of those families who have lost their loved ones, at a shallow reason / findings of Methane Gas Explosion.     Judge Lorredo gives Jun Lozada a choice which is fair enough for the accused. If he is reading ET, I suggest Lozada should think wisely to exclude live media coverage.

    The rule does not give the judge the unfettered discretion to decide whether he should desist from hearing a case. The inhibition must be for just and valid causes.30 The mere imputation of bias, partiality and prejudgment will not suffice in the absence of clear and convincing evidence to overcome the presumption that the judge will undertake his noble role to dispense justice according to law and evidence and without fear or favor.31 The disqualification of a judge cannot be based on mere speculations and surmises or be predicated on the adverse nature of the judge’s rulings towards the movant for inhibition.

    In People v. Kho (G.R. No. 139381 April 20, 2001)

    Judge Bersamin issued an Order, dated January 8, 1998, inhibiting himself from further hearing the case. In said order, the judge, while noting that the motion for inhibition is based on flimsy and imaginary insinuations, resolved to disqualify himself in order to dispel any suspicion about his objectivity.

    But the Court of Appeals, and later Supreme Court ordered him to continue hearing the case, because:

    We see no reason for Judge Bersamin to disqualify himself from the case simply because of baseless accusations from the prosecution of bias and impartiality. Hence, it is a matter of official duty for him to proceed with the trial and decision of the case. He cannot shirk the responsibility without the risk of being called upon to account for his dereliction. To allow Judge Bersamin to recuse himself from this case will amount to a condonation of the actuations of the prosecution and set a mischievous precedent and open the floodgates to forum-shopping for a friendly judge.

    Yan talaga ang pakay, forum-shopping para mapunta sa friendly judge. Isa lang ang friendly judge na patas – si Judge Henry Friendly of the US Court of Appeals for the Second Circuit. The current CJ John Roberts clerked under Judge Friendly.

    Lozada is definitely lucky to have Judge Larredo as the judge for his case. Imagine if the case ended in a pandak friendly court. Lagot na si Lozada! Kaya malakas talagang magdasal ang mga sisters.

    I absolutely agree with the Judge that pandak is always looking for reasons to possibly provoke the people so she can declare Martial Law in case the charter change fails. Pandak is perfectly timing everything so if one of her plans fail, another one will be in place to prolong her stay in power.

    Note na wala pang sinasabi si Judge ukol sa karne at sahog (merits) ng kaso. Kung iyon ang naging paksa ng kanyang mga kataga, maaaring sabihing my bias at paghatol antemano (prejudgment). Nakita niyo, maingat siya diyan. Ang sinasabi niya, mga nauukol na hakbang (procedural matters) – aresto ng witness na ayaw humarap, pagpili ng naatasang mang-aaresto (deputize Fred Lim) atbp.

    Yes, why tell them to run for president, etc.? Judge Lorredo will be better off cleaning the Justice Department if he wants to prove his worth by standing up against the criminal trying hard to control all the branches of the Philippine government presently.

    It is becoming a fad—this recommending of this and that popular figure to run for office even when they are not really qualified as in the case of Pacquiao. Akala ko ba ayaw nila ng mga walang college degree to run for public office? Di ba si Pacquiao, ni hindi nag-graduate ng elementary school?

    Puede ba maging consistent naman sila?
