After years of being protected by Gloria Arroyo’s Malacañang, House of Representatives,and Supreme Court, Ombudsman Merceditas Gutierrez is getting it from all directions.

Last Monday, the House Justice committee voted that there’s probable cause to impeach Gutierrez for betrayal of public trust on five cases at the same time that the Supreme Court denied with finality her motion for reconsideration to stop the House from proceeding with her impeachment.

The Senate Blue Ribbon committee came out Thursday with a partial report saying that their investigation on the plea bargain agreement entered into by the office of Gutierrez with former military comptroller Carlos Garcia was a breach of official duty and a betrayal of public trust.

The Committee called for the impeachment of Ombudsman Merceditas Gutierrez and the dismissal of the special prosecutors who handled the plea bargaining agreement saying they were “grossly negligent” and may have deliberately weakened the case against the former AFP comptroller.

Senate Blue Ribbon Committee Chair Senator TG Guingona III pointed out the instances that showed gross negligence on the part of the Ombudsman and the prosecutorial team: First, the consent of the offended party, the Filipino people – represented by the Armed Forces of the Philippines, the Department of Justice and the Solicitor General – was not obtained for the plea bargaining agreement; Second, the prosecution did not insist on the return of the P128 Million earlier withdrawn by Gen. Garcia; Third, the plea bargaining agreement was disadvantageous to the government since the cases against the family of Gen. Garcia were dropped and Gen. Garcia was only required to return P135 Million out of the P300 Million under litigation.

“These acts constitute grave inexcusable negligence,” Guingona said.

To spare the nation of stress of an impeachment trial, Guingona asked Gutierrez to “please resign.”

Gutierrez, a classmate and close friend of Gloria Arroyo’s husband, Mike, remained defiant declaring, “I’m ready, anytime, anywhere.” She accused administration legislators of “bullying” her.

The Garcia plea bargain agreement is not included in the impeachment complaint in the House which is expected to reach the Senate for trial. But it surely would be in the minds of the senators who would be sitting as judge in the impeachment trial. Definitely, that would be in the minds of the people as they watch the Senate how they would handle Gutierrez.

In her press conference, Gutierrez asked media to look at the signatories to the Blue Ribbon committee report. I get from the tone of her statement that she was taking it in her favor those who signed “with reservation”.

But as Sen. Francis Escudero explained, he had to write the “reservation” when he signed it so as not to “tarnish” his impartiality as a judge in the Gutierrez impeachment trial. In fact, Gutierrez’s lawyer, Salvador Panelo, has said they will be asking senators who have made public statements against Gutierrez to inhibit in the impeachment trial.

It has to be pointed out that the report is still being passed around the committee members and some may still sign it in the coming days.

Let’s take a look at it signatories to the Blue Ribbon committee report:

Those who signed the report without any reservation: Guingona, Serge Osmeña, Antonio Trillanes IV,Francis Pangilinan.

Those who signed with reservation so as not to affect their impartiality as judge in an impeachment trial: Franklin Drilon, Francis Escudero, Ralph Recto, Manuel Villar, Alan Cayetano, Pia Cayetano,Ramon “Bong” Revilla,and Juan Miguel Zubiri.

Joker Arroyo signed with a note: “I did not participate in the proceedings as to enable me to make any kind of judgment.”

Those who did not or have not yet signed are Senate Protempore Jinggoy Estrada, who is an ex-officio member, Edgardo Angara, Miriam Santiago, and Gregorio Honasan. The Senate president traditionally does not sign committee reports.

    Sige Maldita umasa ka pa. Personally, I like her to go through trial so that all her inefficiencies will be uncovered. As it is now, the people only know that she was protecting the purot, her family and her cronies.

    What puzzles me is why Jinggoy did not sign the findings yet. Ano ang inaantay niya? Mmmm. Puro dada naman ang isang ito. Baka inaantay pa niya ang sasabihin ni papa Erap.

    Jug is right. That’s to avoid the accusation of being biased, a ground for inhibition.

    As to Jinggoy, I think he has not yet seen the report. I guess he will be signing it.

    But to Maldita, “with reservation” means, “may pagasa ka Maldita”. From the very beginning when this Garcia plea bargain started, I watched the hearings. Maldita was defending her “plea bargain” and the senators were so frustrated with her. The Blue ribbon wanted her to withdraw the “plea bargain” and she promised that she will look into the case again but it has been more than a month now and still she has not done anything on the possible withdrawal. Sabi nga ni Enrile, kung naibigay na ito kay Garcia, mahirap na ring bawiin. Kaya the senate is left with no other option than to put this blame of entering into the plea on Maldita.

    Tama ka. Ang mga senador ay uupong parang mga jurors iyan sa US ng America.Kailangan huwag kang magpakita na bias ka at dingin muna ang ilalatag na ebidins sa magkabilang panig.Tapos maykakaroon sila ng deliberation sa chambers at pag-usapan at ireview ang kaso to convict or to acquit.

    Ang impeachment ay galing the kongresso at ang mga senador ang magbigay ng hatol.

    Palagay ko laglag na si Merci. Halimbawa na lang iyung kaso ni Bolante, there was a recommendation to the ombudsman to file criminal charges against him and mayroon pang other issues that recommendations for her office to file cases against other personalities involved in questionable transactions and none of these cases were filed.Ano ang hinihintay ni Merci sa bata pa si Sabel nun, ngayon dalaga na.Mabuti sana kung walang statute of limitation ang pag file ng kaso at What do you think? ang iisipin ng mga Senador.Baka mauba-uba na si Mirriam at joker awan pay te kaso ni lakay Bolante, sila ang nag recommenda, alangan naman na they will contradict there own investigation. .Ang kalalabasan kung kontrahin nila ang imbistigation nila ay mga payaso sila sa palabas ng moro-moro komedya.Buti sana kung si Lito Lapid lang ang maging Payaso at understood na iyan ng madlang pipol.

    Mas maganda nga na dumaan sa impeachment proceedings yang si Maldita Gutierrez para lumabas pa ang mga milagro niyang pinag-gagagawa, at baka sakali na makanti din si Putot…… as for Jinggoy, i think hindi pa nga niya nabasa yung report dahil busy pa siya sa repatriation ng mga OFW na naiipit sa gulo sa Middle East dahil nasa Committee siya ng Labor.

    Bilang Ombudsman ay hindi dapat pumapasok sa mga Plea agreements. Kaya nga may Ombudsman eh para habulin ang mga nagsasamantala sa kaban ng bayan. Para parusahan at hindi na pamarisan ng iba. Eh kung may plea bargain agreement din lang pala eh MAGNANAKAW na sila ng MALAKI at makipag-negotiate na lang sa mas maliit na halaga! Hahahaha! Bugok talaga yang si Maldita Gutierrez.     Aquino assures Heidi Mendoza of COA seat

    SINGAPORE (via PLDT) — President Benigno Aquino III on Thursday night said whistleblower Heidi Mendoza was assured of a ranking position at the Commission on Audit (COA).

    In an interview with reporters, Aquino said he would have to talk to Mendoza first because she had told him that she would have to consult her family before making any decision to return to government service.

    “I think as a minimum, she will be a COA commissioner. If she becomes a commissioner, then the COA chair has to be a lawyer as mandated by law,” Aquino said in a talk.

    Corona admits splits amid impeach threats

    The perception of factionalism heightened on Wednesday after questions were raised on whether in the en banc session last Sept. 14, justices were given copies of the petition of Ombudsman Merceditas Gutierrez asking the court to stop the impeachment proceedings against her in the House of Representatives.

    The high tribunal issued a status quo ante order that day, which gave Gutierrez temporary relief until February 15, or six months later, when it dismissed her petition paving the way for impeachment proceedings.

    Court spokesperson Jose Midas Marquez claimed all justices received a copy of the Gutierrez petition. But Senior Associate Justice Antonio Carpio and Associate Justice Ma. Lourdes Sereno said they did not.

    Carpio asked Marquez to rectify his statement, while Sereno issued a press statement—a rarity for the justices—in which she slammed the spokesperson.

    Brenda I think is up to her old tricks. Not as Brenda as most people think. She has her lucid moments.

    She already made statements earlier that the House Justice Committee charges and evidence against Merceditas is weak.

    As a lawyer, she knows that when it reaches the Senate, somebody is going to question her bias/prejudgment of the case and ask her to inhibit herself. So she may simply say “Okay, I will not sit as a Senator judge on the impeachment of Gutierrez.”

    She gets away from that difficult situation of judging Merci and thus sparing herself the ire of the Lillliput. She owed Gloria quite a few favors. And Gloria knows quite a lot about her and her secrets.

    A commitment to fight corruption (symbolized by the scandalous excesses of the NBN-ZTE deal, the fertilizer scam, the Mega Pacific perfect crime and so on, all cases in which Gutierrez betrayed the public trust) is perfectly compatible with a commitment to fairness. Only Gutierrez or other officials pining for the return of the Arroyo era would even think that the two are opposed.

    In other words, the conviction of Gutierrez is in truth a conscience vote: it will reveal how the senators, and the parties they represent, really stand in the war on corruption.

    Hindi ko nga ma trace eh. But in my experience not many bisayans are experts in lying, cheating, stealing (stealing a kiss marami 🙂 ) and tolerating/protecting others who do so.

    Jug, I think Joker’s animosity towards the Aquinos stems from his having been fired as Executive Secretary by then President Cory. Instead of being part of the solution to Cory’s problems then, Joker’s intellectual and legal arrogance riled a lot of sectors..not only the military, the Catholic Church but also the business community. So Cory fired him.

    Joker and Noynoy also had this debate in the Senate a year or two ago. Joker was for a redistricting law that would allow Gloria’s son, Dato, to run for Congress again but in a new district. Noynoy was opposing it.

    Anyway, Joker’s arrogance I think did him in. And his cantankerous attitude in his old age is getting worse. And his vision is now clouded. He can no longer distinguish between black and white(good and evil)as shown by his support of the Arroyo’s.

    What a waste of intellect and brilliance. Destroyed by pride and arrogance.

    It does look like the biggest obstacle to the anti-corruption efforts now is not Merci but the Senate. The way Merceditas is confidently talking, she already has enough Senate votes in her bag.

    If so, all these high hopes and expectations and sweat and tears to return honesty and integrity into the government service will have been in vain. Or at least will be delayed until Mrs. Nunal is finally changed?

    Can’t take that lying down or sitting on our breeches, can we?

    I know “Sabit” Singson filed a case against her with the Ombudsman (was dismissed last Feb2011)for: unexplained wealth, obstruction of justice (not allowing investigation of her son’s ‘suicide’), nepotism (appointing relatives to government posts), and abuse of parliamentary immunity. Any hints on her other ‘secrets’?

    You would think that with the big earthquake in Japan and all, Maldita would have a change of heart. But NO, she had another press conference a few minutes earlier mouthing the same things over and over again. Now she has a new allegation, that her predecessor took the documents from the file before he left his office so she said some cases are still hanging. WHAT A LAME EXCUSE!

    I understand that the PCIJ tried to get the SALN of Merceditas and her Ombadmen subordinates but could hardly get copies of it. Is this true?

    The agency which is supposed to run after the corrupt are themselves trying to hide their wealth? Why? The House prosecutors should dig into this and present ther findings to the Senate during the impeachment trial.
